Female Hurricanes Are Deadlier Than Male Hurricanes, Madhu Viswanathan

Marketing & Business Law Faculty Works

Do people judge hurricane risks in the context of gender-based expectations? We use more than six decades of death rates from US hurricanes to show that feminine-named hurricanes cause significantly more deaths than do masculine-named hurricanes. Laboratory experiments indicate that this is because hurricane names lead to gender-based expectations about severity and this, in turn, guides respondents’ preparedness to take protective action. This finding indicates an unfortunate and unintended consequence of the gendered naming of hurricanes, with important implications for policymakers, media practitioners, and the general public concerning hurricane communication and preparedness.

A suspension of the writ of habeas corpus empowers the President to indefinitely detain those suspected of endangering the public safety. In other words, it works a temporary suspension of civil liberties. Given the gravity of this power, the Suspension Clause narrowly limits the circumstances in which it may be exercised: the writ may be suspended only in cases of "rebellion or invasion" and when "the public Safety may require it. Although marijuana is illegal under federal law, twenty-three states have legalized some marijuana use. The state-legal marijuana industry is flourishing, but marijuana-related businesses report diffi- culty accessing banking services. Because financial institutions will not allow marijuana-related businesses to open accounts, the mari- juana industry largely operates on a cash-only basis-a situation that attracts thieves and tax cheats. This Article explores the root of the marijuana banking problem as well as possible solutions. Michigan’s policy to distribute the Child Care Fund (CCF) to counties at a flat rate of 50% as stated in the Michigan Comprehensive Laws 400.117a provides no structured incentive to the counties to use evidence based practices that are cost-effective for locally based delinquent youth intervention programs. This policy analysis answers the following questions: (1) would retaining delinquent youth in the community produce a cost benefit and/or better outcomes than confinement and (2) is public safety at risk if delinquent youth are retained in the community? Remedies influence rights, and rights apply across remedies. Combined together, these two phenomena produce the problem of spillover across remedies. The spillover problem occurs when considerations specific to one remedy affect the definition of a substantive rule that governs in other remedial settings. For example, the severe remedial consequences of suppressing incriminating evidence might generate substantive Fourth Amendment precedents that make other Fourth Amendment remedies (such as damage awards, injunctions, or ex ante denials of search warrants) more difficult to obtain. This article presents a preliminary work domain theory and identifies autonomous vehicle, navigational, and mission capabilities and challenges for small unmanned aerial systems (SUASs) responding to a radiological disaster. Radiological events are representative of applications that involve flying at low altitudes and close proximities to structures. To more formally understand the guidance and control demands, the environment in which the SUAS has to function, and the expected missions, tasks, and strategies to respond to an incident, a discovery experiment was performed in 2013. Because of its simplicity, the shock response spectrum has become widely used as a means of describing the shock responses and fragilities of structures and equipment. This paper focuses on the drawbacks of using the shock response spectrum for defining equipment shock tolerance. A cantilever beam with a tip mass was used to model a hypothetical piece of equipment subjected to strong ground motion such as that caused by an explosion. The exact solution from a detailed modal analysis shows that multiple modes of response were excited. Contributions from higher modes can be more predominant than that from the fundamental …

Core design components of the Ecosystem Management Decision Support system were used to develop and implement the integrated restoration and protection strategy of the Northern Region of the U.S. Department of Agriculture Forest Service. Scenarios that spatially optimized hazardous fuel reduction, protected developed recreation values, and improved watershed conditions are presented to illustrate how the evaluation and decision modeling capabilities of the decision support system can be used sequentially in both strategic and tactical planning.

The US prison system has multiplied by four since 1980; each year about 730,000 people enter state and federal prisons and 700,000 people exit. As a result of this expansion, there is a massive increase of formerly incarcerated people reentering local communities every year. Budget cuts in prison programs and in local government’s social services are causing these individuals to be less educated and less prepared for reintegration; communities are also ill prepared to absorb them. As government and private companies rapidly expand the infrastructure of surveillance from cameras on every street corner to facial recognition for photographs on social media sites, privacy doctrines built on seclusion are at odds with technological advances. This essay addresses a key conceptual problem in US privacy law identified by Justice Sotomayor in U.S. v. Jones and by Justice Scalia in Kyllo v. U.S.; namely that technological capabilities undermine the meaning of the third-party doctrine and the 4th Amendment's ‘reasonable expectation of privacy’ standard. OBJECTIVES: The purpose of this study was to examine the lived experiences of frontline police personnel of a mid-sized police service in Southern Ontario. As the prevalence of mental illness increases, so do the calls for assistance to police services. Police officers often find themselves on the frontline and are often the first responders to mental health calls when an individual is in crisis (Wells & Schafer, 2006). Evidence-Based Sentencing And The Scientific Rationalization Of Discrimination, Sonja B. Starr

This Article critiques, on legal and empirical grounds, the growing trend of basing criminal sentences on actuarial recidivism risk prediction instruments that include demographic and socioeconomic variables. I argue that this practice violates the Equal Protection Clause and is bad policy: an explicit embrace of otherwise- condemned discrimination, sanitized by scientific language. To demonstrate that this practice raises serious constitutional concerns, I comprehensively review the relevant case law, much of which has been ignored by existing literature. To demonstrate that the policy is not justified by countervailing state interests, I review the empirical evidence underlying the instruments. I show that …

Back To Basics: Special Domestic Violence Jurisdiction In The Violence Against Women Reactivation Act Of 2013 And The Expansion Of Inherent Tribal Sovereignty, Laura C. Sayler

Part I of this Note outlines the VAWA Reactivation Act of 2013, as well as the case law that it seeks partially to abrogate. Part II.A examines the delegation and inherent sovereignty theories more closely, and argues that inherent tribal sovereignty is the superior mechanism for validating the Act. Parts II.B, II.C, and II.D review the basic textual authority that should form the foundation of the Court’s analysis, and conclude that this authority supports recognition of inherent tribal sovereignty. Part III addresses counter arguments to this approach, and argues that, in upholding sections 904 and 905, the Court need not …
