The Second Amendment Implications Of Regulating 3d Printed Firearms, Michael L. Smith Jan 2014

The Second Amendment Implications Of Regulating 3d Printed Firearms, Michael L. Smith

Faculty Articles

3D printed firearms have arrived, and commentators are beginning to ask whether and how this new technology can be regulated. An inevitable question that governments and courts will need to confront when considering restrictions on 3D printed firearms is whether these restrictions violate the Second Amendment. In this paper, I argue that most restrictions on 3D printed firearms would survive Second Amendment challenges. In carrying out this argument, I consider a complete ban on the manufacturing and possession of 3D printed firearms and conclude that even this complete ban would be likely to survive Second Amendment challenges. Because these particularly …

First Amendment Values For The Internet, Dawn C. Nunziato

GW Law Faculty Publications & Other Works

In May 2014, the Federal Communications Commission (FCC), on the ropes from two adverse D.C. Circuit decisions, proposed the latest in a series of regulations of broadband providers--the entities that serve as the gatekeepers for all content, applications, and services on the Internet. While in recent years the FCC has sought to regulate broadband providers to impose on them the duty not to discriminate against any of the traffic flowing through their pipes, in these latest Proposed Rules--in response to the recent D.C. Circuit decision Verizon v. FCC--the FCC has sought to enable broadband providers to discriminate in favor …

Improvement Of Tobacco-Free Policy Enforcement At The University Of Kentucky, Muchen Bai

Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)

Smoking has been known as the leading preventable cause of death and premature disease in the United States (DHHS, 2014). Every year, cigarette smoking causes more than 480,000, approximately, one in five deaths (DHHS, 2014). According to the Centers for Disease Control and Prevention (CDC), "smoking causes more deaths each year than all of the listed combined: Human immunodeficiency virus (HIV), Illegal drug use, Alcohol use, Motor vehicle injuries, and Firearm-related incidents" (CDC, 2014). Since 1964, 31 Surgeon General's Reports have revealed the causal relationship between health outcomes and tobacco smoke exposure (DHHS, 2014). The report, The Health Consequences of …

The Post-Koontz Landscape: Koontz¿S Shortcomings And How To Move Forward, Kristin N. Ward Jan 2014

The Post-Koontz Landscape: Koontz¿S Shortcomings And How To Move Forward, Kristin N. Ward

Emory Law Journal

This Comment analyzes the Supreme Court¿s opinion in Koontz v. St. Johns River Water Management District, and critiques the Court¿s language regarding environmental protection and local government regulation. In sum, the Koontz opinion reveals that the Court is unsympathetic to environmental protection at the local level, and is suspicious of local government¿s ability to make reasoned land-use decisions without extorting unfair value from property owners. The Court¿s doubtful attitude regarding the validity of wetlands protection and local government regulation are unsupported by the relevant scholarship. Next, this Comment argues that applying the formulaic takings test prescribed in Koontz has the …

Tesla And The Car Dealers’ Lobby, Daniel A. Crane

Law & Economics Working Papers

Tesla Motors, the offspring of the South African-American entrepreneur Elon Musk who also brought us Pay-Pal and SpaceX, is the most exciting automotive development in many decades and a marquee story of American technological dynamism and innovation. The company’s luxury electric cars have caused a sensation in the auto industry, including a review by Consumer Reports calling Tesla’s Model S the best car it ever tested.

Tesla faces enormous challenges in penetrating an automotive market that has been dominated for a century by internal combustion engines. Not only must it build cars that customers want to drive (and, ultimately, produce …

Solving Charity Failures, Brian L. Frye Jan 2014

“Crowdfunding” is a way of using the Internet to raise money by asking the public to contribute to a project. In the past, asking a large number of people to contribute small amounts of money to a project was expensive and inefficient for most organizations and individuals. By greatly reducing transaction costs, crowdfunding enables anyone to inexpensively and efficiently seek small contributions to a project. While crowdfunding is a new model of fundraising, it has already transformed funding for the arts. For example, the crowdfunding platform Kickstarter distributed more than forty million dollars to the creators of almost seventy-five hundred …

Offender Reentry: A Mixed Model Study Of Interorganizational Commitment To Partnership, Gail Humiston Jan 2014

Offender Reentry: A Mixed Model Study Of Interorganizational Commitment To Partnership, Gail Humiston

Electronic Theses and Dissertations

This study explores the associations between the independent variables of organizational motivations and culture with the dependent variable of organizational commitment to local jail reentry partnerships. A cross-sectional, mixed methods design was used based primarily on a quantitative survey mailed to organizational informants involved in jail reentry activities within three central Florida counties. Qualitative data was also collected by observing conveniently sampled reentry meetings and analyzing the content of social artifacts, such as meeting handouts, minutes, e-mails, and other related documents. This study extends the literature by using the theoretical framework of Oliver (1990) to develop measures of organizations' motivations …

From The Watch Tower To The Acropolis: The Search For A Consistent Religious Freedom Standard In An Inconsistent World, Casey Jo Cooper Jan 2014

From The Watch Tower To The Acropolis: The Search For A Consistent Religious Freedom Standard In An Inconsistent World, Casey Jo Cooper

Emory International Law Review

In late 2011, Greek authorities convicted a Pentecostal Christian for proselytizing to another man. In Greece, proselytism is a crime punishable by hefty fines and imprisonment and is strictly prohibited by both the Constitution and statutes. Emmanuel Damavolitis, a Pentecostal Christian, now faces four months in prison and a fine of €840 for proselytism. His attorney, Vassilios Tsirbas, appealed his case to the European Court of Human Rights ('ECHR'), claiming the conviction violates Article 9 of the European Convention ofHuman Rights. This case illustrates how creating a framework for securing religious freedom is a paradox amidst the democratic revolution of …

The Incidental Regulation Of Policing, Seth W. Stoughton Jan 2014

The Incidental Regulation Of Policing, Seth W. Stoughton

Faculty Publications

What do the laws governing municipal annexation, collective bargaining, and race-conscious employment decisions have in common? Each plays a significant and under-appreciated role in shaping local law enforcement practices even though each, on its face, has nothing to do with policing.

This Article explores the incidental regulation of policing, illustrating the concept with examples from different areas of state and federal law. Many legal decisions happen to include police as constituents of a broader regulatory ambit, and thus are not intended to have any particular effect on the unique functions of policing. Nevertheless, these laws have profound ramifications for police …

Life On The Big Slab: Identity And Mobility In The United States Trucking Industry, Valerie J. Keathley Jan 2014

Life On The Big Slab: Identity And Mobility In The United States Trucking Industry, Valerie J. Keathley

Theses and Dissertations--Geography

Many changes have occurred in the United States trucking industry over the last thirty years. This study examines the effects of these changes by looking at three related themes: life on the road and life at home, body image and bodily health, and the experiences of women and sexual minorities in the industry. This research is based on a discourse analysis of interviews conducted with truck drivers and trucking industry leaders.

Most truck drivers say that they value the independent nature of their workplace. Yet the independence that is a part of the trucker mystique is challenged by increased surveillance …

Evaluation Of Overpressure Wave Transition By Airblast Overpressure And Shock Wave Attenuation Analysis Using A Small Black Powder Charge, William R. Weitzel Jan 2014

Evaluation Of Overpressure Wave Transition By Airblast Overpressure And Shock Wave Attenuation Analysis Using A Small Black Powder Charge, William R. Weitzel

Theses and Dissertations--Mining Engineering

Eight flush mount pressure sensors were used in a series of 3 test sequences to measure air overpressure produced by a firecracker. Overpressure was recorded at a range of 1 inch to 21 inches away from detonation, and charge weight was determined to be 0.1mg of black powder. Air overpressure prediction equations were developed from test series then compared to collected data for subsequent tests. Overpressure wave velocity was measured using wave arrival time and distance between sensors. This wave velocity was compared to calculated wave velocity using overpressure and ideal gas law. Overpressure and wave velocity are directly related …

A primary role of the Incident Command System is to learn from past incidents, as illustrated by its origins in the wildland firefighting community. Successful emergency response operations under the Incident Command System has prompted its nationwide spread, this promulgation critically relies on the system’s capability to stabilize and continuously improve various aspects of emergency response through effective organizational learning. The objective of this study is to evaluate the potential to apply fundamental principles of the Toyota Production System (Lean manufacturing) to improve learning effectiveness within the Incident Command System. An in-depth review of literature and training documents regarding both …

Primary And Secondary Prevention Of Hepatitis C Virus Among Rural Appalachian People Who Use Drugs, Dustin B. Stephens Jan 2014

Primary And Secondary Prevention Of Hepatitis C Virus Among Rural Appalachian People Who Use Drugs, Dustin B. Stephens

Theses and Dissertations--Clinical and Translational Science

Hepatitis C virus (HCV) remains a major cause of morbidity and mortality worldwide, with 3% of the global population chronically infected. Clinical impacts in the United States are projected to increase for two decades, and mortality attributed to HCV now exceeds HIV. Injection drug use (IDU) is the most common route of transmission in the developed world. Advances in treatment offer hope of mitigating HCV impacts, but substantial barriers obstruct people who inject drugs (PWID) from receiving care, particularly in medically underserved regions including Central Appalachia. This study assessed IDU paraphernalia sharing longitudinally over 24 months in a sample of …
