Florida Law Review

Scholars and policymakers from multiple disciplines have long debated whether and when paternalistic intervention might be appropriate to guide ordinary decisionmakers choices and behaviors. Recently, the use of empirical data has begun to inform this debate. Some such research has demonstrated that individuals' susceptibility to cognitive and emotional biases leads to nonoptimal decisions in a variety of areas, including health, finance, and safety, among others. This has led some scholars to suggest a role for third-party intervention to help protect citizens from their own biased decisionmaking.

Critics of this approach suggest that such intervention prevents individuals from learning from their …

“Buying Time Or Doing Harm?”: Tracing Contestation And Consensus In Debates On Puberty Blockers For Trans Youth, Dana R. Lavergne

The use of hormone blockers and other forms of gender affirming medical care for trans youth has emerged as a site of medical and political contestation, with 26 states passing legislation outlawing their use (Movement Advancement Project, 2024). Drawing from a multiple-methods approach, this dissertation examines the ways in which this contestation emerged and has been framed both in political case law and digital spaces, which a specific attunement toward how medical discourse is used to support arguments calling for either the allowance or ban of hormone blockers. Fear Of Victimization, Trust, Security, And Public Spaces In Guatemala, Keyla Navarrete

This dissertation explores fear of victimization, personal encounters with crime, perceptions of institutional trust, support for informal justice practices, and avoidance of spaces in Guatemala. Institutional trust—understood as individuals’ confidence in the police, judiciary, and correctional systems, particularly their fairness and effectiveness—is vital for democratic governance and social stability. High levels of trust in legal institutions can foster civic engagement, reduce social fragmentation, and encourage public cooperation in crime prevention. In contrast, diminished trust may lead individuals to withdraw from formal systems of justice, limiting the state's capacity to function effectively. The Force Of Resilience: Exploration Of Correlations Between Generational Differences In Occupational Resilience And Turnover Intentions Among Active United States Law Enforcement Personnel, Kaylin Elizabeth Switzer

Law enforcement agencies across the United States are facing critical challenges with the recruitment and retention of officers. This study examined whether differences existed in occupational resilience and turnover intentions across generations of active law enforcement personnel, and whether resilience levels were correlated with turnover intentions. A quantitative, cross-sectional design was used to collect data via an online survey that included the Predictive 6-Factor Resilience Scale and the Expanded Multidimensional Turnover Intentions Scale. Operational demands and training of policing professionals may be a source of conflict leading to a potential increase in risk for both the officer and the general public. Training in a law enforcement academy does not adequately prepare officers for the impacts the career may have on mental health, changes to the biological system, or societal criticism of modern-day policing. The emergency nursing profession faces a critical challenge with a declining workforce and a high prevalence of workplace violence (WPV), which negatively impacts nurse job satisfaction. This quantitative study examined the relationships among nursing resilience, time elapsed since WPV exposure, and job satisfaction among emergency nurses (ENs) in the United States. Grounded in resilience and Herzberg’s two-factor theories, this study used a cross-sectional, correlational design. A national, anonymous online survey was distributed via social media, using a sharable QR code to recruit participants. The State of Illinois Model Programs of Study Guides were developed in collaboration with the Illinois State Board of Education (ISBE) and Illinois Community College Board (ICCB) through a process led and facilitated by Education Systems Center (EdSystems) at Northern Illinois University. The process included extensive research into labor market information and credential programs, as well as dialogue across secondary, postsecondary, and employer stakeholders. With the support of ICCB, EdSystems researched the utilization of the State of Illinois Model Programs of Study Guides: Culinary and Hospitality and Human and Public Service.

While warning fatigue is commonly described among emergency management practitioners as a problem due to over-alerting, which leads to opting out, there has been limited research to define these concepts in a systematic manner that can inform policymaking around public alerting strategies, especially as they relate to Wireless Emergency Alerts (WEA). In this study, we draw from semi-structured interviews with emergency managers and open-ended responses from surveys with emergency managers and members of the public, to develop definitions of “over-alerting” and “warning fatigue” and to identify the conditions that cause the public to “opt out” of WEA messages. The internet plays a crucial role in modern life, but equal access to it is not guaranteed. This inequality is only starker since the recent overruling of the Chevron doctrine that afforded agencies deference in their interpretation of statutes and the second Trump administration’s hostility toward net neutrality––a policy that prevents internet service providers from charging more money for access to faster internet while slowing other users’ access. For those living on tribal lands, rescission of net neutrality policies has unique implications due to the federal government’s trust responsibility to American Indians.

Under the federal Indian Gaming Regulatory Act (IGRA), a tribe may conduct Class III or casino-style gaming only in a state that “permits such gaming” and in accordance with an approved compact between the tribe and the state. But the appropriate interpretation of IGRA’s “permits such gaming” requirement and how it relates to the state’s duty to negotiate gaming compacts in good faith remain murky more than 35 years after IGRA was enacted, hindering both compact negotiations between individual states and tribes and the entire tribal gaming industry.
