Alive Not Dead: The Revival Of Redevelopment Post-Matosantos, Helen Luu Chou
Alive Not Dead: The Revival Of Redevelopment Post-Matosantos, Helen Luu Chou
UC Law Constitutional Quarterly
In December 2011, the California Supreme Court in California Redevelopment Association v. Matosantos upheld AB 1X 26-a bill eliminating redevelopment agencies in California. Even though redevelopment officially ended with Matosantos, discussion concerning the state of redevelopment has since been revived. The purpose behind the dissolution of redevelopment agencies was to fund special districts in a time of financial crisis, but what instead followed was dissension within California as cities and counties strongly opposed the dissolution of redevelopment and instead filed lawsuits challenging the constitutionality of AB 1X 26, and its subsequent "clean up" bill, AB 1484. Moreover, the redevelopment wind-up …

Determinants Of Crime In Chicago, Ross Olson
Determinants Of Crime In Chicago, Ross Olson
Undergraduate Honors Theses
This paper addresses occurrences of violent crime and their determinants in the city of Chicago using data collected at daily intervals for a period of two years. The economics of crime, in particular the price that crime imposes on society, is briefly explored along with a discussion of general policy techniques that aim to reduce the occurrence of violent crime. The empirical analysis addresses temperature, holidays (both official federal holidays and informal "party" holidays), weekends, unemployment rate, and seasonal trends. Relationships are examined between these variables and total crime, as well as with each component of violent crime: aggravated assault, …

Racial Profiling As Collective Definition, Trevor George Gardner
Racial Profiling As Collective Definition, Trevor George Gardner
Scholarship@WashULaw
Economists and other interested academics have committed significant time and effort to developing a set of circumstances under which an intelligent and circumspect form of racial profiling can serve as an effective tool in crime finding–the specific objective of finding criminal activity afoot. In turn, anti-profiling advocates tend to focus on the immediate efficacy of the practice, the morality of the practice, and/or the legality of the practice. However, the tenor of this opposition invites racial profiling proponents to develop more surgical profiling techniques to employ in crime finding. In the article, I review the literature on group distinction to …
Civil Commitment And Sex Offenders, Ashley Pederson
Civil Commitment And Sex Offenders, Ashley Pederson
All Graduate Theses, Dissertations, and Other Capstone Projects
Currently there is insufficient training for staff at the Minnesota Sex Offender Program (MSOP) about the civil commitment process of sex offenders. Thus, the purpose of this Capstone Project is to educate current MSOP staff about the history and important markers that have contributed to the current civil commitment law in Minnesota. Conducting trainings and educating staff are important for maintaining and enhancing the therapeutic environment for clients.15 Therefore, I hypothesize that educating staff about sex offender’s civil commitment will enhance staff knowledge, thus contributing to the quality of the therapeutic relationships and environment at MSOP.
Tort Claims And Canadian Prisoners, Adelina Iftene, Lynne Hanson, Allan Manson
Tort Claims And Canadian Prisoners, Adelina Iftene, Lynne Hanson, Allan Manson
Articles, Book Chapters, & Popular Press
Prisoners can be tragically wronged by the prison system, as highlighted by the recent Ashley Smith case. Tort actions have proven to be a problematic form of recourse for them. Negligence claims made by prisoners face many obstacles at every stage of the analysis: the duty of care, standard and breach, and causation. The authors offer an overview of tort litigation coming out of Canadian prison with a focus on health care based negligence claims, risks arising from other prisoners and the risk of self-harm. They find that these cases are unevenly resolved when the plaintiff is a prisoner. The …
Capacity To Consent To Sexual Risk, Elaine Craig
Capacity To Consent To Sexual Risk, Elaine Craig
Articles, Book Chapters, & Popular Press
In delineating the legal boundaries of capacity to consent to sexual touching, law makers and jurists must grapple with tensions between sexual liberty, morality, sexual minority equality interests, and public safety. Legal rules that stipulate that an individual cannot consent in advance to unconscious sexual activity or to sado-masochism, or that an individual under a certain age or with a particular intellectual capacity cannot consent to sexual touching have an impact on sexual liberty and should be justified. This paper argues that establishing these limits based on normative assessments about specific sexual acts poses too great a threat to the …

Institute for Tourism and Recreation Research Publications
This study assesses the image and perceptions of Gardiner by visitors as well as their reasons for visiting Gardiner and spending patterns within the town. Visitors to Gardiner were primarily in the town to eat and drink, shop, drive through and get fuel; average daily spending was $178. Visitors, both in open-ended and structured responses noted that Gardiner was a friendly and welcoming community, and a fun place. Respondents also believed, however, that there was room for improvement with services available such as food and shopping opportunities. Visitors have many opinions about Gardiner, some positive and some negative. Gardiner is …
The Judiciary And Fiscal Crises: An Institutional Critique, Peter Conti-Brown, Ronald J. Gilson
The Judiciary And Fiscal Crises: An Institutional Critique, Peter Conti-Brown, Ronald J. Gilson
Faculty Scholarship
Scholars have long debated the role for courts with respect to governmental action that responds to crisis. Most of the crises analyzed, however, are exogenous to the political process; the courts’ role in response to politically endogenous crises has received less attention. We evaluate the role of the judiciary in a subset of those endogenous crises: the judicial treatment of governmental efforts to resolve the crisis facing underfunded public pensions. Assessing institutional competence schematically with reference to an institution’s democratic accountability and fact-finding ability, we argue that, where institutions function properly, judicial intervention in politically endogenous economic crises should be …
Justice Policy Reform For High-Risk Juveniles: Using Science To Achieve Large-Scale Crime Reduction, Jennifer L. Skeem, Elizabeth S. Scott, Edward Mulvey
Justice Policy Reform For High-Risk Juveniles: Using Science To Achieve Large-Scale Crime Reduction, Jennifer L. Skeem, Elizabeth S. Scott, Edward Mulvey
Faculty Scholarship
After a distinctly punitive era, a period of remarkable reform in juvenile crime regulation has begun. Practical urgency has fueled interest in both crime reduction and research on the prediction and malleability of criminal behavior. In this rapidly changing context, high-risk youth – the small proportion of the population where crime is concentrated – present a conundrum. Research indicates that these are precisely the individuals to intensively treat to maximize crime reduction, but there are both real and imagined barriers to doing so. Institutional placement or criminal court processing can exclude these youths from interventions that would better protect public …

Aggressive Policing And The Mental Health Of Young Urban Men, Amanda Geller, Jeffrey Fagan, Tom Tyler, Bruce Link
Faculty Scholarship
Objectives: We provide the first population-based analysis of the health implications of contemporary policing. Many cities have adopted “proactive” policing models, which engage citizens – often aggressively – at low levels of suspicion. We survey young men on their experiences of police encounters and subsequent mental health. Methods: We conducted a population-based phone survey of 1,261 young men in New York City. Respondents reported how many times they were approached by New York Police Department (NYPD) officers, what these encounters entailed, any trauma they attributed to the stops, and their overall anxiety. Data were analyzed using cross-sectional regression. Results: Respondents …
Managing Effective Collaboration Among Law Enforcement, Intelligence Services, And Military Forces In Fight Against Terrorism And Organized Crime, Cihan Demirhan
Electronic Theses and Dissertations
The fight against terrorism and organized crime require strong collaboration between public security organizations. Public security networks include several agencies that are not bound to each other with strong hierarchical ties. Because of a lack of the strong hierarchical structure, managing public networks is not similar to managing a single government agency. This study aims to examine the factors influencing network effectiveness in the public security sector. The main research questions of the study are: Which factors are important for effectiveness in public security networks? What is the role of inter-organizational trust among partner agencies? Which kind of leadership style …

In another essay being published contemporaneously with this one, I have explained that as the concept "human right" is understood both in the Universal Declaration of Human Rights and in all the various international human rights treaties that have followed in the Universal Declaration's wake, a right is a human right if the rationale for establishing and protecting the right-for example, as a treaty-based right-is, in part, that conduct that violates the right violates the imperative, articulated in Article i of the Universal Declaration, to "act towards all human beings in a spirit of brotherhood." Each of the human rights …
Data Protection In The European Union: A Closer Look At The Current Patchwork Of Data Protection Laws And The Proposed Reform That Could Replace Them All, Christina Glon
Faculty Articles
Laws protecting a European's right to control the flow of their own personal data (also known as "data privacy") date back as early as 1950. In the 65 years since the Council of Europe declared that every person has the fundamental "right to respect for his private and family life, his home and his correspondence," a patchwork of conventions, directives, treaties and communications have been created to ensure the ongoing protection of this right. However, in recent years, this patchwork approach has been unable to keep up with the pace of technology and has created confusion and concern for the …

M-139 Corridor Improvement Plan: Enabling A Strong, Place-Based Vision For Berrien Springs & Oronoko Charter Township, Mi, The 2014 Urban Design Studio, Andrew C. Von Maur, Troy Homenchuk
Books
This corridor plan was jointly commissioned by the Village of Berrien Springs and Oronoko Charter Township in response to the 2013 findings of the M-139 Corridor Improvement Taskforce. The twelve appointed members of this taskforce included Village and Township officials as well as a range of private property owners and citizens.
In anticipation of expanded water and sewer service, a major indoor equestrian arena, and various private and university development prospects, the taskforce identified the following challenges and opportunities that deserve attention and planning:
• Existing zoning along the corridor creates unnecessary burdens due to non-conforming uses and structures.

Grounding Drones: Big Brother’S Tool Box Needs Regulation Not Elimination, Melanie Reid
Grounding Drones: Big Brother’S Tool Box Needs Regulation Not Elimination, Melanie Reid
Richmond Journal of Law & Technology
The Ford Model A was advertised as “the latest and best” in the world in 1903 and sparked global interest to design and create better, faster, and more complex machines than had ever traveled on land. Fast forward to the 21st century and creating machines that can travel around the world’s airspace appears to be the latest fascination. Until relatively recently, only airplanes and helicopters dominated the friendly skies. But now, the public is catching on to the idea that building an aircraft is easier that one might expect. In fact, a pilot is no longer necessary. Drones, also referred …
Health Law As Social Justice, Lindsay Wiley
Health Law As Social Justice, Lindsay Wiley
Scholarly Articles in Law Reviews & Journals
Health law is in the midst of a dramatic transformation. From a relatively narrow discipline focused on regulating relationships among individual patients, health care providers, and third-party payers, it is expanding into a far broader field with a burgeoning commitment to access to health care and assurance of healthy living conditions as matters of social justice. Through a series of incremental reform efforts stretching back decades before the Affordable Care Act and encompassing public health law as well as the law of health care financing and delivery, reducing health disparities has become a central focus of American health law and …
Ending Mass Incarceration: Some Observations And Responses To Professor Tonry, Gerard E. Lynch
Ending Mass Incarceration: Some Observations And Responses To Professor Tonry, Gerard E. Lynch
Faculty Scholarship
We should all be grateful for Michael Tonry’s (2014, this issue) characteristically thoughtful article proposing 10 concrete steps to reduce the excessive reliance on incarceration in the United States. It would behoove legislatures and judges to think carefully about each of his proposals. The following remarks constitute an attempt to expand on some of his observations and offer a few cautionary notes about some of his proposals.
At the outset, however, it is important to note that I fully agree with the general premise of Tonry’s (2014) article, which is by now conventional wisdom among criminal law scholars and practitioners …
Street Stops And Police Legitimacy: Teachable Moments In Young Urban Men's Legal Socialization, Tom Tyler, Jeffrey Fagan, Amanda Geller
Street Stops And Police Legitimacy: Teachable Moments In Young Urban Men's Legal Socialization, Tom Tyler, Jeffrey Fagan, Amanda Geller
Faculty Scholarship
An examination of the influence of street stops on the legal socialization of young men showed an association between the number of police stops they see or experience and a diminished sense of police legitimacy. This association was not primarily a consequence of the number of stops or of the degree of police intrusion during those stops. Rather, the impact of involuntary contact with the police was mediated by evaluations of the fairness of police actions and judgments about whether the police were acting lawfully. Whether the police were viewed as exercising their authority fairly and lawfully shaped the impact …

Use Of Funds In A Nonprofit Organization As Predictor Of Organizational Effectiveness And Efficiency, Throstur B. Thordarson
Dissertations
Purpose. The purpose of this study is to explore predictive relationships between how funds are used in a religious not-for-profit organization (NPO) and member recruitment. Financial data, from Seventh-day Adventist conferences at the organizational level, were correlated with data on membership recruitment from these same conferences.
Method. This study used a linear time-series analysis where relationships between variables and past values were explored over a 12-year period. Financial data were collected from year-end audited statements and financial activity statements. Published statistical records were used to collect data on membership and member donations.
Findings. This study concludes that Seventh-day Adventist …

“White Collar” Crimes, Samuel W. Buell
“White Collar” Crimes, Samuel W. Buell
Faculty Scholarship
In addition to serving as a précis of the subject of ‘white collar’ crime, this chapter does three things. First, it deals with white collar crime’s longstanding definitional problem, rejecting several standard approaches and arguing that the category is most usefully understood according to the conceptual legal problem these offenses generate. White collar crimes, much more than other offenses, are committed in social settings in which undesirable behaviors are embedded within socially welcome conduct. Thus they are difficult to set apart and extract through clearly specified ex ante rules of law. Second, the chapter illustrates this definitional claim, and discusses …
Redesigning Sentencing, W. David Ball
Redesigning Sentencing, W. David Ball

Design thinking purports to take the methods of industrial and product design and apply them to social and political problems. One particularly intractable problem in California is its bloated penal code, which has expanded almost continuously over the past forty years. Since 1983, more than a dozen bills have been introduced in the CaliforniaLegislature to establish a sentencing commission. All have failed. In this paper I explore how design thinking might help frame our discussion of mass incarceration in general and sentencing commissions in particular:what kinds of changes are possible within the foreseeable future, how wecan make any changes sustainable, …
