New Beginnings: Texas A&M University School Of Law Has The Noble Charge Of Being Texas's First Public Law School In The Dallas-Fort Worth Metroplex, Aric K. Short

Faculty Scholarship

On the evening of Aug. 12, 2013, the doors to Texas Wesleyan University School of Law in downtown Fort Worth closed for a final time. The following morning, those same doors opened, and Texas A&M University School of Law began operations. During the next week, the school welcomed 250 1Ls to orientation, and fall classes began for all 770 students.

For Aggies, this transition in ownership capped a decades-long effort to bring a law school to Texas A&M University. For those of us at the law school, Aug. 13 concluded a busy and challenging year laying the foundation for our …

The U.S. Supreme Court's Failure To Fix Plea Bargaining: The Impact Of Lafler And Frye, Cynthia Alkon Mar 2014

The U.S. Supreme Court's Failure To Fix Plea Bargaining: The Impact Of Lafler And Frye, Cynthia Alkon

Faculty Scholarship

In the 2012 companion cases of Lafler v. Cooper and Missouri v. Frye, the United States Supreme Court held that there is a right to effective assistance of counsel during plea bargaining, even when a defendant later loses at trial. Legal commentators suggested the cases were "the single greatest revolution in the criminal justice process since Gideon v. Wainwright," that the cases will have a "significant effect,"' and that they were "the term's decisions with the greatest everyday impact on the criminal justice system." But, will things really change for defendants in the wake of Lafler and Frye …

No At-Risk Law Student Left Behind: The Convergence Of Academic Support Pedagogy And Experiential Education, Starla J. Williams, Iva J. Ferrell Mar 2014

No At-Risk Law Student Left Behind: The Convergence Of Academic Support Pedagogy And Experiential Education, Starla J. Williams, Iva J. Ferrell

Southern Illinois University Law Journal

This Article addresses the urgent need to develop innovative experiential education that takes into account the unique learning needs of both at-risk and underperforming law students.  The authors discuss the anticipated surge of these academically vulnerable law students who are unable to benefit from clinics or externships that law schools offer to higher achieving students.  The authors observe that as the economic downturn in the United States continues to take its toll on law school applications, law schools will admit candidates with lower performance indicators who require more practice-based legal skills training to succeed.  This influx of academically and professionally …

Out Of Practice: The Twenty-First-Century Legal Profession, Dana A. Remus Mar 2014

Out Of Practice: The Twenty-First-Century Legal Profession, Dana A. Remus

Duke Law Journal

Lawyering has changed dramatically in the past century, but scholarly and regulatory models have failed to keep pace. Because these models focus exclusively on the "practice of law" as defined by the profession, they ignore many types of work that today's lawyers perform and many sources of ethical tension they encounter. To address these shortcomings, I examine significant twentieth- and twenty-first-century social dynamics that are fundamentally altering contemporary lawyers' work by broadening and blurring the boundary between law and business. Within the resulting boundary zone, a growing number of lawyers occupy roles for which legal training is valuable but licensure …

Litigation Investment And Legal Ethics: What Are The Real Issues?, Anthony J. Sebok Mar 2014

Litigation Investment And Legal Ethics: What Are The Real Issues?, Anthony J. Sebok

Articles

One of the foundational principles of legal ethics is that the lawyer owes an obligation of undivided loyalty to the client, and no other interests or relationships can be permitted to interfere with the lawyer's exercise of independent professional judgment on behalf of the client. The strongest objections to litigation investment by third parties is that it may compromise a lawyer's independence. This article examines this objection in the context of a recent report from the Ethics Committee of the Commercial and Federal Litigation Section of the New York State Bar Association and argues that it misses the real legal …

Enforcement Of The Duties Of Directors By The Securities And Futures Investors Protection Center In Taiwan, Christopher C. H. Chen Mar 2014

Enforcement Of The Duties Of Directors By The Securities And Futures Investors Protection Center In Taiwan, Christopher C. H. Chen

Research Collection Yong Pung How School Of Law

The purpose of this article is to examine the role of the Securities and Futures Investors Protection Center (SFIPC) in Taiwan in enforcing the duties of directors. To help shareholders or investors pursue a director for breach of company law or securities regulations, Taiwan created the SFIPC, a charity sanctioned by statutes, to bring class action or direct legal action on behalf of minority shareholders or individual investors. By conducting an empirical survey of judgments from lawsuits involving the SFIPC since its creation, we found that the SFIPC is generally very active in enforcing securities regulations but far less active …

The Responsibilities Of Lawyers For Their Clients Misstatements And Omissions To The Securities Market In Singapore, Wai Yee Wan Mar 2014

The Responsibilities Of Lawyers For Their Clients Misstatements And Omissions To The Securities Market In Singapore, Wai Yee Wan

Research Collection Yong Pung How School Of Law

This article examines the extent to which lawyers advising on the disclosure documents of their clients issued to the securities markets should be responsible for their clients’ disclosure failures. It identifies the following problems with the current framework. First, there is a lack of objective due diligence standards which lawyers are expected to meet when they are advising on public disclosure documents. Second, except for takeovers, lawyers are not subject to public enforcement actions even if they have not acted with due care and diligence in ensuring that their clients comply with their disclosure obligations. Third, private enforcement actions against …

Everyday Lives Of The Elderly: A Dimensional Analysis, David Kowalewski, Steven Peterson Feb 2014

Everyday Lives Of The Elderly: A Dimensional Analysis, David Kowalewski, Steven Peterson

Sociological Practice

Considerable dissension surrounds the number and composition of the domains comprising the daily lives of the elderly. The present study employs an array of biological, economic, political, social, and psychological data obtained from a house-to-house survey of elderly citizens to derive a mapping of dimensionality. Factor analysis of the data isolated eight domains: Poor Health, Disengagement, Self-Sufficiency, Female Aging, Meaningful Employment, Political Faith, Self-Starting, and Stoicism. External validation supported the factor solution and highlighted the impact of dietary and economic deficits on the problems of the aged.

The results described include 369 stewardship groups including non-governmental organizations, community groups, municipalities and others who voluntarily filled out the survey between November 2010 and November 2011.
