Engaging Outside Counsel In Transactional Law Clinics, Alicia E. Plerhoples, Amanda M. Spratley Mar 2014

Engaging Outside Counsel In Transactional Law Clinics, Alicia E. Plerhoples, Amanda M. Spratley

Georgetown Law Faculty Publications and Other Works

This article examines the plurality of objectives and methods by which transactional law clinics collaborate with outside attorneys to competently represent their organizational clients on a wide range of legal issues. Some transactional law clinics rely on outside counsel as informal legal advisors or consultants; others collaborate with outside counsel for the development of community projects or referral of legal work; many transactional law clinics engage outside counsel as “local counsel” when assisting a client in other jurisdictions or internationally; still others engage outside counsel more formally to assist in student supervision of client work. For some, the idea of …

Brief Of Law Professors As Amici Curiae In Support Of Petitioner, Scott R. Bauries, Sheldon H. Nahmod, Paul M. Secunda, Joshua D. Branson

Law Faculty Advocacy

Amici curiae respectfully submit this brief in support of Petitioner, Edward Lane, encouraging the reversal of the judgment of the Eleventh Circuit, because the judgment below is inconsistent with both the Court’s general historical approach to public employee speech and the specific approach to such speech that the Court adopted in Garcetti v. Ceballos, 547 U.S. 410 (2006).

Amici are law professors who teach and write about the constitutional rights of public employees and have published a number of scholarly articles on these topics. Amici have no financial stake in the outcome of this case, and in this brief …

Privatization Of Prisons: Costs And Consequences, Alex Friedmann, Kathryn Hamoudah, Alec Karakatsanis Mar 2014

Privatization Of Prisons: Costs And Consequences, Alex Friedmann, Kathryn Hamoudah, Alec Karakatsanis

Working in the Public Interest Conferences

The privatization of prisons is generally undertaken by states to lower the cost to the public of housing prisoners. Whether cost savings actually result is debatable. Importantly, the ways in which private prisons do cut costs are problematic from the perspective of public safety, human rights, and public policy. In some well-documented cases, prisoners have escaped due to lax security and poorly trained staff. More generally, staff turnover rates are often high and the compensation packages of private prison guards may be inadequate to attract the best candidates. The U.S. Department of Justice produced a report in June of 2013 …

Delivering Public Assistance: What Does It Mean To Follow The Law?, Patrick Cates, Keith Horton, Frances Fox Piven

Working in the Public Interest Conferences

Temporary Assistance for Needy Families (TANF) is the rare public program that provides direct assistance to families in need. Georgia, like other states, receives block grants to administer TANF. What is the current state of the TANF program in Georgia and is assistance getting to those who need it? Should the state be more proactive in reaching out to those who qualify for assistance? Are there times when qualifying families are unable to access benefits due to administrative hurdles and poor customer service? What recourse do families have if they are not treated fairly by TANF administrators? This panel will …

Law Enforcement, Community, And Military Tactics: What’S The Conflict?, Stacey Cotton, Peter Kraska, James A. Pikl

Working in the Public Interest Conferences

Local law enforcement is a critical community service, and the expense of maintaining a modern and effective police force can be substantial in relation to local resources. At the same time, military equipment, SWAT teams, and aggressive search and seizure tactics have been called into question by the recurring loss of innocent life and Fourth Amendment concerns attendant to the use of overwhelming force. This panel will consider the funding mechanisms available to police and sheriff departments for equipment and capital investments, the incentives these revenues create, and the conflicts between community trust and the atmosphere of counter-insurgency which military …

Poverty In Suburbia: Are The Poor Out Of Reach?, Ellen Dunham-Jones, Dolly Jenkins-Mullen, Dwight Mullen, Benjamin Roth Mar 2014

Poverty In Suburbia: Are The Poor Out Of Reach?, Ellen Dunham-Jones, Dolly Jenkins-Mullen, Dwight Mullen, Benjamin Roth

Working in the Public Interest Conferences

The story of suburbs in America sweeps in much of this country’s modern history of sprawling land use and the self-segregation of affluent and middle class commuter communities. This panel will explore the current state of the suburbs and ask whether the infrastructure that supports a commuter economy is compatible with changing demographics. Who lives in the suburbs, and who speaks for them in local government? Are the children of lower income communities further disadvantaged in terms of income mobility by virtue of living in the suburbs? What problems arise when affordable housing is located in areas with poor public …

Measuring The Justice Gap: Flaws In The Interstate Allocation Of Civil Legal Services Funding And A Proposed Remedy, Dion Chu, Matthew R. Greenfield, Peter Zuckerman Mar 2014

Measuring The Justice Gap: Flaws In The Interstate Allocation Of Civil Legal Services Funding And A Proposed Remedy, Dion Chu, Matthew R. Greenfield, Peter Zuckerman

Pace Law Review

With the supply of legal services not particularly responsive to demand, we conclude that the justice gap could be narrowed simply by reforming the way in which policymakers distribute legal services funds while holding constant the total amount of funds distributed.

In reaching this conclusion, we proceed in two parts. First, drawing largely from Access Across America and LSC data, we analyze the supply of legal services funding across states. Since eligibility for Legal Services Corporation (LSC) funds is principally determined by income (only individuals in households with income at or below 125% of the federal poverty level are LSC …

Caught In The Cross-Fire: The Psychological And Emotional Impact Of The Individuals With Disabilities Education Act (Idea) Upon Teachers Of Children With Disabilities, A Therapeutic Jurisprudence Analysis, Richard Peterson Mar 2014

Caught In The Cross-Fire: The Psychological And Emotional Impact Of The Individuals With Disabilities Education Act (Idea) Upon Teachers Of Children With Disabilities, A Therapeutic Jurisprudence Analysis, Richard Peterson

Pace Law Review

The shortage of special education teachers in the United States, and the adverse consequences flowing from factors related to this condition provide a unique opportunity for scholars to study these issues through interdisciplinary research. Educational scholars have typically focused their research on educational practice and institutional policy. Although this scholarship frequently acknowledges the statutory and regulatory foundations of the IDEA, the literature does not generally adopt a legal framework for research purposes. This is not a criticism of educational scholars. It is merely an observation that opportunities exist to study special education teacher issues in a broader context. This Article …

Voting Rights Act Panel, Kareem Crayton, Brian Kemp, Tomas Lopez Mar 2014

Voting Rights Act Panel, Kareem Crayton, Brian Kemp, Tomas Lopez

Working in the Public Interest Conferences

Section V of the Voting Rights Act (VRA) required covered jurisdictions to obtain “preclearance” before making changes to voting laws. In Shelby County v. Holder, the Supreme Court held that the formula determining which jurisdictions were covered by Section V was unconstitutional. Following Shelby County, states previously covered by Section V began proposing changes to election laws. If those laws are in fact discriminatory they must now be challenged under Section II of the VRA, which places the burden on plaintiffs to show racial discrimination. This panel will provide an update on proposed and enacted election law changes being made …

One Small Step For Legal Writing, One Giant Leap For Legal Education: Making The Case For More Writing Opportunities In The "Practice-Ready" Law School Curriculum, Sherri Lee Keene Mar 2014

One Small Step For Legal Writing, One Giant Leap For Legal Education: Making The Case For More Writing Opportunities In The "Practice-Ready" Law School Curriculum, Sherri Lee Keene

Mercer Law Review

While the practice of law is often equated with writing, many law courses involve little or no writing during the semester, and often only require writing in student assessment. While accredited law schools are required to offer both first-year legal writing instruction and a rigorous writing experience during the second or third year,2 few law schools infuse legal writing throughout a student's three years of law school matriculation. While significant attention is given to the breadth of law taught in law school, more attention must be given to the depth of this knowledge and the application of this knowledge to …

Machine Learning And Law, Harry Surden Mar 2014

Machine Learning And Law, Harry Surden

Washington Law Review

Part I of this Article explains the basic concepts underlying machine learning. Part II will convey a more general principle: non-intelligent computer algorithms can sometimes produce intelligent results in complex tasks through the use of suitable proxies detected in data. Part III will explore how certain legal tasks might be amenable to partial automation under this principle by employing machine learning techniques. This Part will also emphasize the significant limitations of these automated methods as compared to the capabilities of similarly situated attorneys.

Encouraging The Development Of Low Bono Law Practices, Luz E. Herrera Mar 2014

Encouraging The Development Of Low Bono Law Practices, Luz E. Herrera

Faculty Scholarship

For decades, the discussion about access to justice has primarily focused on the ability of low–income individuals to obtain free representation by lawyers. Lawyer representation is the “gold star” of the legal profession and advocates of legal services for the poor have fought difficult battles to ensure the most disadvantaged in our country have access to these professionals. As a result, legal aid programs and pro bono services that assist the most economically disadvantaged in our country are now common in our legal service delivery system.

Despite those important efforts, only 50% of those eligible for free legal services actually …
