Inclusionary Eminent Domain, Gerald S. Dickinson Jan 2014

Inclusionary Eminent Domain, Gerald S. Dickinson

Loyola University Chicago Law Journal

This Article proposes a paradigm shift in takings law, namely “inclusionary eminent domain.” This new normative concept serves as a framework that molds eminent domain takings and economic redevelopment into an inclusionary land assembly model that is equipped with multiple tools to help guide municipalities, private developers and communities construct or preserve affordable housing developments. The tools to achieve this include Community Benefits Agreements (“CBAs”), Land Assembly Districts (“LADs”), Community Development Corporations (“CDCs”), Land Banks (“LABs”), Community Land Trusts (CLTs) and Neighborhood Improvement Districts (“NIDs”).

The origins of the concept derive from the zoning law context, where exclusionary zoning in …

Attempting To Close The Digital Frontier: A Mixed-Methods Approach To The Study Of The Cyber Intelligence Sharing And Protection Act, Renee Lorene Pieschke Jan 2014

Attempting To Close The Digital Frontier: A Mixed-Methods Approach To The Study Of The Cyber Intelligence Sharing And Protection Act, Renee Lorene Pieschke

All Graduate Theses, Dissertations, and Other Capstone Projects

A mixed-methods approach was taken to study the Cyber Intelligence Sharing and Protection Act (CISPA), recent legislation that would have considerable effects on the digital landscape. The combined methods help to define the problems underlying the legislation by defining stakeholders and isolating views from various media sources. The theoretical examinations of landscape studies, communications geography and Panopticism combined with methodology in political geography, and media analysis helps to develop a multi-angled view of the current perspective on the Cyber Intelligence Sharing and Protection Act. Landscape studies, with roots in Sauer's seminal work, "The Morphology of Landscape," contributed to the narrative …

New Evidence On Why Children's Food Security Varies Across Households With Similar Incomes, Diane Whitmore Schanzenbach, Patricia M. Anderson, Kristin F. Butcher, Hilary W. Hoynes Jan 2014

New Evidence On Why Children's Food Security Varies Across Households With Similar Incomes, Diane Whitmore Schanzenbach, Patricia M. Anderson, Kristin F. Butcher, Hilary W. Hoynes

University of Kentucky Center for Poverty Research Discussion Paper Series

This project examines why very low food security status among children is different across households with very similar measured resources. Controlling for measures of income-to-needs, we examine whether elements in the!environment, household characteristics, or behaviors are systematically correlated with VLFS among children. We use different measures of income-to-needs, including those averaged across years to capture “permanent” income (or to average out measurement error) and measures that include income after taxes and transfers. Our analysis uses the Current Population Survey (across many years, matched December to March), the American Time Use Survey (matched to the December CPS), the National Health and …

Arrangement Of Google Search Results And Imperial Ideology: Searching For Benghazi, Libya, Jacob Stewart Jan 2014

Arrangement Of Google Search Results And Imperial Ideology: Searching For Benghazi, Libya, Jacob Stewart

Electronic Theses and Dissertations

This project responds to an ongoing discussion in scholarship that identifies and analyzes the ideological functions of computer interfaces. In 1994, Cynthia Selfe and Richard Selfe claimed that interfaces are maps of cultural information and are therefore ideological (485). For Selfe and Selfe and other scholars, these interfaces carried a colonial ideology that resulted in Western dominance over other cultures. Since this early scholarship, our perspectives on interface have shifted with changing technology; interfaces can no longer be treated as having persistent and predictable characteristics like texts. I argue that interfaces are interactions among dynamic information that is constantly being …

Let Me Tell You About Homestuck: The Online Production Of Place, Jennifer Short Jan 2014

Let Me Tell You About Homestuck: The Online Production Of Place, Jennifer Short

Electronic Theses and Dissertations

This thesis investigates the potential for the online production of place, specifically as it applies to the host site for the Homestuck web comic, MS Paint Adventures, and its attendant fandom. The proliferation of digital environments such as video games, web sites, and chat rooms has led to numerous opportunities for the study of online spaces and the numerous practices that take place within them. The lack of physical location in online spaces can, however, make it difficult to conceptualize of a web site as real, a problem that has often led researchers to develop new theories of space that …

The Impact Of Impoundment And Urbanization On Shallow Groundwater Conditions In The Joe Pool Lake Catchment, Texas, Manoj K. Ghimire Jan 2014

The Impact Of Impoundment And Urbanization On Shallow Groundwater Conditions In The Joe Pool Lake Catchment, Texas, Manoj K. Ghimire

Earth & Environmental Sciences Dissertations - Archive

This dissertation is an assessment of the shallow groundwater (SGW) regime within the drainage area of Joe Pool Lake (JPL), an impoundment on Mountain Creek (MC) located in Grand Prairie, Texas. A thin zone of highly-weathered consolidated rock is normally found at the upper surface of the bedrock in north-central Texas; the SGW regime, or shallow aquifer, as defined for this study, extends vertically downward from the water table to the base of this highly-weathered layer, and extends laterally over the surface water drainage area of JPL and its tributaries. Geologically, the shallow aquifer thus consists largely of unconsolidated material, …

Densovirus Associated With Sea-Star Wasting Disease And Mass Mortality, Ian Hewson, Jason Button, Brent Gudenkauf, Benjamin Miner, Alisa Newton, Mya Breitbart, Elizabeth Fahsbender, Kevin Lafferty Jan 2014

Densovirus Associated With Sea-Star Wasting Disease And Mass Mortality, Ian Hewson, Jason Button, Brent Gudenkauf, Benjamin Miner, Alisa Newton, Mya Breitbart, Elizabeth Fahsbender, Kevin Lafferty

Marine Science Faculty Publications

Sea stars inhabiting the Northeast Pacific Coast have recently experienced an extensive outbreak of wasting disease, leading to their degradation and disappearance from many coastal areas. In this paper, we present evidence that the cause of the disease is transmissible from disease-affected animals to apparently healthy individuals, that the disease-causing agent is a virus-sized microorganism, and that the best candidate viral taxon, the sea star-associated densovirus (SSaDV), is in greater abundance in diseased than in healthy sea stars.

Spatiotemporal Chlorophyll-A Dynamics On The Louisiana Continental Shelf Derived From A Dual Satellite Imagery Algorithm, Chengfeng Le, John C. Lehrter, Chuanmin Hu, Michael C. Murrell, Lin Qi Jan 2014

Spatiotemporal Chlorophyll-A Dynamics On The Louisiana Continental Shelf Derived From A Dual Satellite Imagery Algorithm, Chengfeng Le, John C. Lehrter, Chuanmin Hu, Michael C. Murrell, Lin Qi

Marine Science Faculty Publications

A monthly time series of remotely sensed chlorophyll-a (Chlars) over the Louisiana continental shelf (LCS) was developed and examined for its relationship to river discharge, nitrate concentration, total phosphorus concentration, photosynthetically available radiation (PAR), wind speed, and interannual variation in hypoxic area size. A new algorithm for Chlars, tuned separately for clear and turbid waters, was developed using field-observed chlorophyll-a (Chlaobs) collected during 12 cruises from 2002 to 2007. The new algorithm reproduced Chlaobs, with ∼40% and ∼60% uncertainties at satellite pixel level for clear offshore waters and turbid nearshore …

Utah's Fine Particulate Air Pollution Problem, Arnold W. Reitze Jr. Jan 2014

Utah's Fine Particulate Air Pollution Problem, Arnold W. Reitze Jr.

Utah OnLaw: The Utah Law Review Online Supplement

For those living along Utah’s Wasatch Front, the air quality problem is visibly obvious. The air pollution, especially in the winter when inversions trap pollutants between the surrounding mountains, is hazardous to people’s health. Several counties along the Wasatch Front violate the Clean Air Act’s air quality standard for particulate matter and are currently designated as “nonattainment” areas. The Environmental Protection Agency requires that affected areas take action to reduce the levels of pollution. This Article will discuss the Clean Air Act and the state’s role in ensuring compliance. This Article then examines some of the reasons for the Wasatch …

Pride In Istanbul, Susan C. Pearce Jan 2014

Pride In Istanbul, Susan C. Pearce

Societies Without Borders

In June of 2013, Istanbul, Turkey held its annual Lesbian, Gay, and Bisexual Pride parade. This year’s parade was performed in a particular historical context: in the midst of an anti-government uprising that had begun in Istanbul and spread throughout Turkey. This context loaned a particular flavor to the Pride parade, and there was a reciprocity between the recent protest movement and LGBT activism. These field notes describe the June 2013 parade and its relationship to the socio-political context, drawing from these observations some preliminary conclusions regarding human rights and gender as Turkey interacts with transnational human rights regimes such …

Making Visible The Invisible: Nighttime Lights Data And The Closing Of The Human Rights Information Gap, Xi Chen Jan 2014

Making Visible The Invisible: Nighttime Lights Data And The Closing Of The Human Rights Information Gap, Xi Chen

Societies Without Borders

War, poverty, geographical remoteness and political isolation all contribute to unreliable or non-existent data for developing regions of the world. As a consequence, research within these areas has been hampered by an abject lack of data in underdeveloped regions. The satellite-based nighttime lights data introduced here may hold the potential to overcome this problem by providing a proxy measure for large numbers of variables dealing with second and third generation human rights issues. The images presented here represent some of the newest forms of data available to social science investigations and those interested in human rights studies, and are already …

Also, this study aimed to address the middle-school students' ability to learn 3-D …

Past On A Plate: An Exploration Of ‘Heirloom’ Cultivars As Politically Palatable, Cady Gonzalez Jan 2014

Past On A Plate: An Exploration Of ‘Heirloom’ Cultivars As Politically Palatable, Cady Gonzalez

Theses & ETDs

The anthropological study of food reveals the power of cumulative tradition to shape food behavior. Through processes of production and consumption, food refers to a larger set of themes and situations within the social environment, implying a system of communication and signification. Through participant observation and ethnographic interviews, I track the dynamic political and personal meanings of ‘heirloom’ through the supply chain. Following three ‘heirloom’ commodities through three ‘locally conscious’ restaurants in the Tampa Bay Area, this thesis analyzes the political economy of food communication in relation to agrobiodiversity conservation. By examining the founding ‘heirloom’ cultivar ideals and comparing these …

Movement As A Means Of Social (Re)Production: Using Gis To Measure Social Integration Across Urban Landscapes, Heather Richards-Rissetto, Kristin Landau Jan 2014

Movement As A Means Of Social (Re)Production: Using Gis To Measure Social Integration Across Urban Landscapes, Heather Richards-Rissetto, Kristin Landau

Department of Anthropology: Faculty Publications

This paper contributes to the archaeological study of movement in urban environments where built forms and natural features worked together to play a key role in structuring human mobility. We propose an analytical method using least cost analysis in a Geographic Information System (GIS) to empirically measure social integration. The method defines mobility as the potential for pedestrian movement, and identifies locations where people were most likely to walk to or through in a landscape. The calculated mobility data are then employed to identify with whom people were most likely to interact and the degree to which they were socially connected …

Quality Of Life, Perceptions Of Change, And Psychological Well-Being Of The Elderly Population In Small Rural Towns In The Midwest, Rodrigo Cantarero, James J. Potter Jan 2014

Quality Of Life, Perceptions Of Change, And Psychological Well-Being Of The Elderly Population In Small Rural Towns In The Midwest, Rodrigo Cantarero, James J. Potter

Architecture Program: Faculty Scholarly and Creative Activity

This study examines the quality of life of the elderly residents of two rural Nebraska towns, both having experienced a large increase in population. The study examines how the residents’ perception of changes in the community affect their view of quality of life, and identifies determinants of psy-chological well-being for these elderly residents. The results are compared to the non-elderly resi-dents of these two communities for purposes of contrast. A face-to-face survey of the residents addressed physical, social/cultural, economic, and service issues. Both correlation and regression were used to analyze the data. The quality of life of the elderly residents …

Clcweb: Comparative Literature And Culture, Gregory E. Rutledge Jan 2014

Clcweb: Comparative Literature And Culture, Gregory E. Rutledge

Department of English: Faculty Publications

In his article "Race, Slavery, and the Revaluation of the T'ang Canon" Gregory E. Rutledge re-evaluates—from the purview of African Diaspora literary studies—historiography that considers the place of East African slave lore in T'ang Dynasty fiction. Julie Wilensky's "The Magical Kunlun and 'Devil Slaves': Chinese Perceptions of Dark-skinned People and Africa before 1500" (2002), a revision of Chang Hsing-lang's "The Importation of Negro Slaves to China Under the T'ang Dynasty (A.D. 618- 907)" (1930), is pivotal since it occupies the nexus between European-American, East-Asian, and African-Diasporic canons and policies. Rutledge situates Wilensky's and Chang's works in the context of Edward …

International Advertising Education: Curriculum And Pedagogy, Frauke Hachtmann Jan 2014

International Advertising Education: Curriculum And Pedagogy, Frauke Hachtmann

College of Journalism and Mass Communications: Faculty Publications

Since the end of World War II and the subsequent emergence of new democracies and free market societies in Europe and parts of Asia, advertising practitioners and educators have recognized that advertising students needed to be prepared to work in international markets (Miracle, 2008; Dunn, 1994). The global advertising industry began to grow rapidly, and it was no longer enough to just compete within the United States. Despite the recent global economic recession, global advertising spending reached US$ 485.4 billion in 2011, with North America, Europe, and Asia-Pacific accounting for 33.1%, 30.0%, and 26.1%, respectively (WARC, 2012). The Asia- Pacific …
