A Material World: Using Trademark Law To Override Copyright's First Sale Rule For Imported Copies, Mary Lafrance Jan 2014

A Material World: Using Trademark Law To Override Copyright's First Sale Rule For Imported Copies, Mary Lafrance

Michigan Telecommunications & Technology Law Review

When the Supreme Court held that the first sale rule of copyright law permits the unauthorized importation and domestic sale of lawfully made copies of copyrighted works, regardless of where those copies were made, copyright owners lost much of their ability to engage in territorial price discrimination. Publishers, film and record producers, and software and videogame makers could no longer use copyright law to prevent the importation and domestic resale of gray market copies, and therefore could no longer protect their domestic distributors against competition from cheaper imported copies. However, many of these copyright owners can take advantage of a …

A Decade Of Adaptive Governance Scholarship: Synthesis And Future Directions, Barbara Cosens

Articles

Adaptive governance is an emergent form of environmental governance that is increasingly called upon by scholars and practitioners to coordinate resource management regimes in the face of the complexity and uncertainty associated with rapid environmental change. Although the term “adaptive governance” is not exclusively applied to the governance of social-ecological systems, related research represents a significant outgrowth of literature on resilience, social-ecological systems, and environmental governance. We present a chronology of major scholarship on adaptive governance, synthesizing efforts to define the concept and identifying the array of governance concepts associated with transformation toward adaptive governance. Based on this synthesis, we …

Human Rights And The New Reality Of Climate Change: Adaptation's Limitations In Achieving Climate Justice , Zackary L. Stillings

Michigan Journal of International Law

In 2005, the Inuit of Canada and the United States filed a petition with the Inter American Commission on Human Rights, alleging that their respective governments had violated their human rights by failing to mitigate climate change harms. The Inuit alleged violations of several specific human rights, including the right to enjoy their culture; the right to enjoy and use the lands they have traditionally occupied; the right to use and enjoy their personal property; the right to health; the right to life, physical integrity, and security; the right to their own means of subsistence; and the right to residence …

Making Water Resource Decisions More "Informationally" Efficient: Development Of A Geospatial Water Rights Decision Support System For Kittitas County, Washington, Michael Pease Jan 2014

Making Water Resource Decisions More "Informationally" Efficient: Development Of A Geospatial Water Rights Decision Support System For Kittitas County, Washington, Michael Pease

Geography Faculty Scholarship

In semi-arid river basins like the Yakima River Basin in central Washington State, United States of America, water demand can exceed available supply on an annual basis. More informed decisions about water supply and current allocation have the potential to improve water management. This research created a geospatial water rights database for the Yakima River Basin. The creation of a publicly available decision support system mapping water rights can provide water managers another tool to help achieve this goal. This paper describes the creation of the Decision Support System. In addition it looks at the current utility of the system, …

Scholarship and Professional Work - LAS

Aim- Cities represent an ideal study system for assessing how intensive land-use change and biotic interchange have altered beta diversity at broad geographic extents. Here we test the hypothesis that floras in cities located in disparate regions of the globe are being homogenized by species classified as invasive (naturalized species that have spread over a large area) or as a European archaeophyte (species introduced into Europe before ad 1500 from the Mediterranean Basin). We also test the prediction that the global influences of European activities (colonization, agriculture, commerce) have supported this outcome.

Location- One hundred and ten cities …

History, External Influence And Political Volatility In The Central African Republic (Car), Henry Kam Kah Jan 2014

History, External Influence And Political Volatility In The Central African Republic (Car), Henry Kam Kah

Journal for the Advancement of Developing Economies

This paper examines the complex involvement of neighbours and other states in the leadership or political crisis in the CAR through a content analysis. It further discusses the repercussions of this on the unity and leadership of the country. The CAR has, for a long time, been embroiled in a crisis that has impeded the unity of the country. It is a failed state in Africa to say the least, and the involvement of neighbouring and other states in the crisis in one way or the other has compounded the multifarious problems of this country. Some of these states have …

Formative And Summative Assessment In Online Education, Dilani M. Perera-Diltz, Jeffry L. Moe Jan 2014

Formative And Summative Assessment In Online Education, Dilani M. Perera-Diltz, Jeffry L. Moe

Counseling & Human Services Faculty Publications

Assessment is an integral part of both traditional and online education, especially when determining student learning outcomes. In the online learning environment, both formative and summative assessment practices require an understanding of the features and tools inherent to the electronic medium. Creating assessments for online education, either formative or summative, also requires application of constructivist learning principles to our collective understanding of the educational process and related goals. In this paper, we offer an overview of formative and summative assessment approaches suited to the online education environment.

Using Iceland As A Model For Interdisciplinary Honors Study, Kim Andersen, Gary Thorgaard Jan 2014

Using Iceland As A Model For Interdisciplinary Honors Study, Kim Andersen, Gary Thorgaard

Journal of the National Collegiate Honors Council Online Archive

Interdisciplinarity is a well-established educational approach that speaks directly to our understanding of what knowledge is and, more specifically, what practical knowledge is. Despite its long history, the concept of interdisciplinarity continues to raise essential questions: whether knowledge is anchored in particular fields of investigation separate in nature or can be found in a breaching of disciplines, across fields of investigation; how we might attain such cross-reference; and whether it is even possible to achieve a synthetic, interdisciplinary understanding or if knowledge is invariably anchored in separate disciplines occasionally informing each other. The term has not just epistemological value but …

Insecta Mundi

We provide new state and county records of biting midges in the genus Culicoides Latreille (Diptera: Ceratopogonidae) from the southeastern United States collected with CDC miniature light traps during 2007–2012 in Florida, Georgia, Alabama, Mississippi, Louisiana, Arkansas, and Texas. The primary goals of the surveys were to identify the presence of exotic Culicoides, and determine the ranges of known and possible vectors of bluetongue virus (BTV) and epizootic hemorrhagic disease virus (EHDV). Included are the first records of: Culicoides (Amossovia) beckae Wirth and Blanton from Louisiana and Mississippi, C. (A.) oklahomensis Khalaf from Alabama and Arkansas, …

New Synonymy In The Genus Chelotrupes Jekel, 1866 (Coleoptera: Geotrupidae), Marc E. Miquel

Insecta Mundi

In 2012, two articles were published describing new species of the genus Chelotrupes Jekel, 1866 (Coleoptera: Geotrupidae); the first one included fi ve new species and the second a single species. However, the species described in the second article, Chelotrupes annamariae Byk 2012, is identical to Chelotrupes algarvicus Hillert, Král and Schneider 2012 and should be considered a junior synonym: Chelotrupes algarvicus Hillert, Král and Schneider 2012 = Chelotrupes annamariae Byk 2012, syn. nov.

Taxonomic And Nomenclatural Changes In The Anticheirine Scarabs (Coleoptera: Scarabaeidae: Rutelinae: Rutelini), Matthew Robert Moore, Mary Liz Jameson, Aura Paucar-Cabrera

Insecta Mundi

We clarify the taxonomy and nomenclature of several species-group names and the family-group name for the anticheirine scarabs (Scarabaeidae: Rutelinae: Rutelini), a group that includes nearly 550 species and subspecies in 44 genera and subgenera. These clarifications are necessary due to taxonomic and nomenclatural inaccuracies in recent revisionary works. We provide a list of genera included in the anticheirine scarabs sensu Soula. Numerous nomenclatural changes are necessary due to invalid type designations or misspellings: the valid type species of Aequatoria Arrow is Chlorota associata Waterhouse; the valid type species of Chlorota Burmeister is Rutela terminata Le Peletier de Saint-Fargeau and …

Hedini, N. Sp. (Callipodida: Schizopetalidea), Rowland M. Shelley, Casey H. Richart

Insecta Mundi

Tynommatidae, n. stat., elevated from Tynommatinae, is established as a schizopetalidean family encompassing the western North American callipodidans previously assigned to the Mediterranean Schizopetalidae. It is considered a valid taxon despite somewhat anatomically dissimilar subfamilies, and Colactidinae, Texophoninae, Diactidinae, and Aspidiophoninae constitute tribal elevations and additional new statuses. With a subbasal telopodal prefemoral process, Diactis hedini, n. sp., requires rediagnoses of all three diactidine genera, Diactis Loomis, 1937, and Florea and Caliactis, both by Shelley, 1996, and suggests that telopodal branches ‘B’ in congeners and Florea represent distal relocations of the process along the stem. Similarities in the …

From Climate Action To Coalition: Ypsilanti And Emu As Models For Sustainability, Erica Mooney Jan 2014

From Climate Action To Coalition: Ypsilanti And Emu As Models For Sustainability, Erica Mooney

Senior Honors Theses and Projects

Inspired by leading EMU's engagement with Ypsilanti's climate Action Plan in 2011, a journey began to discovering ways to cultivate healthy relationships through sustainability. How have other universities addressed climate change? How have other municipalities work with schools addressing sustainability? I explored national programs as well as a thorough review of Michigan's other public universitites. This thesis is a mix of best practices research and a proposal to both city and school administrators and stakeholders. Reviewing what other campuses and towns have done to address environmental and social justice, and the complex realms of economic and community development, a coalition …

Selling State Borders, Joseph Blocher Jan 2014

Selling State Borders, Joseph Blocher

Faculty Scholarship

Sovereign territory was bought and sold throughout much of American history, and there are good reasons to think that an interstate market for borders could help solve many contemporary economic and political problems. But no such market currently exists. Why not? And could an interstate market for sovereign territory help simplify border disputes, resolve state budget crises, respond to exogenous shocks like river accretion, and improve democratic responsiveness? Focusing on the sale of borders among American states, this Article offers constitutional, political, and ethical answers to the first question, and a qualified yes to the second.

The Right To Food And The Political Economy Of Third World States, Opeoluwa Adetoro Badaru Jan 2014

The Right To Food And The Political Economy Of Third World States, Opeoluwa Adetoro Badaru

The Transnational Human Rights Review

Current global events validate the fact that beyond a theoretical analysis of rights discourse and food justice, there is a need to understand and propose ways to address the very fragile global food situation, and especially so in Third World states. At the peak of the high food prices in mid-2008, the world observed how the issue of access to food and the means to acquire food (in the larger context of other socio-economic needs) spurred riots from Egypt to Bangladesh and Mexico. And one cannot definitely say that we are out of the woods yet concerning rising food prices. …

Geographic Analysis Of West Nile Virus In The Upper Minnesota River Valley: A Gis And Multi-Temporal Remote Sensing Approach, Matthew Moore

All Graduate Theses, Dissertations, and Other Capstone Projects

Throughout human evolution civilizations have been faced with implications from infectious diseases caused by various environmental factors. This connection was recognized as far back as the 5th century by Hippocrates and since several key advances have been realized and will be addressed in this an environmental and physical geography of disease. Arthropod or vector-borne viruses are among the most common pathogens introduced into the modern human population. West Nile Virus is considered endemic in most parts of the world and appeared in the United States in 1999 with 62 confirmed cases in an urban New York location. Since its first …

Institutional Stress And The Federal District Courts: Judicial Emergencies, Vertical Norms, And Pretrial Dismissals, Daniel J. Knudsen Jan 2014

Institutional Stress And The Federal District Courts: Judicial Emergencies, Vertical Norms, And Pretrial Dismissals, Daniel J. Knudsen

Utah Law Review

This Article examines the effects of judicial emergencies on the federal district courts. The Administrative Office of the U.S. Courts declares judicial emergencies when a weighted statistic of filings and vacancy days exceeds certain thresholds. This Article presents evidence on the relationship between emergency status in a judicial circuit and the frequency of pretrial disposition in federal district courts within that circuit: a federal district court is statistically more likely to dismiss a case before trial if its corresponding circuit court is in emergency. This evidence suggests that emergency status may affect normative expectations between the federal district courts and …

Understanding Insurance Antidiscrimination Laws, Ronen Avraham, Kyle D. Logue, Daniel Schwarcz Jan 2014

Understanding Insurance Antidiscrimination Laws, Ronen Avraham, Kyle D. Logue, Daniel Schwarcz

Articles

Insurance companies are in the business of discrimination. Insurers attempt to segregate insureds into separate risk pools based on their differences in risk profiles, first, so that they can charge different premiums to the different groups based on their risk and, second, to incentivize risk reduction by insureds. This is why we let insurers discriminate. There are, however, limits to the types of discrimination we will allow insurers to engage in. But what exactly are those limits and how are they justified? To answer these questions, this Article articulates the leading fairness and efficiency arguments for and against limiting insurers’ …

Institute On Metropolitan Opportunity Response To Professor Edward G. Goetz’S Comments On Imo’S Report: Reforming Subsidized Housing Policy In The Twin Cities, Myron Orfield, Will Stancil, Thomas Luce, Eric Myott

Studies

Professor Goetz’s comments reflect an obvious misunderstanding of our report and of the issues of urban racial segregation and fair housing. Yet we understand why he is upset––organizations and individuals, including Professor Goetz, have invested their time and energy toward the activities our report challenges. We regret that he has expressed his anger by attacking the scholarly reputations of his colleagues rather than by taking the time to outline real and substantive concerns with the work itself.
