Energy Transmission Across Wild And Scenic Rivers: Balancing Increased Access To Nontraditional Power Sources With Environmental Protection Policies, Robert L. Glicksman
Energy Transmission Across Wild And Scenic Rivers: Balancing Increased Access To Nontraditional Power Sources With Environmental Protection Policies, Robert L. Glicksman
Public Land & Resources Law Review
Increases in the level of renewable energy production, spurred by climate change mitigation goals and regulatory programs such as state renewable energy portfolio standards, and in the level of fossil fuels extraction spurred by technological developments allowing access to previously unavailable natural gas supplies, have created a need for new energy transmission facilities. The new supplies are often located far from centers of high energy demand, requiring transportation over long distances. Some of the routes chosen for the new electric transmission lines and natural gas pipelines have already come into conflict with the environmental protections provided by the Wild and …
Guns, Campus And The Courts, Joseph Cernik
Guns, Campus And The Courts, Joseph Cernik
Journal of Educational Leadership in Action
The Newtown shooting opened up (again) the issue of guns on school grounds, both at the K-12 level and university level, and whether teachers and administrators should be armed. The Newtown shooting also focused attention again on the shootings at the Virginia Polytechnic Institute and State University in Blacksburg. In that incident, 32 people were killed and 17 wounded on April 2007. The shooter, Seung-Hui Cho, a senior, ended his killing spree by committing suicide. Following Cho’s shooting spree, the National Rifle Association (NRA) created NRA-U, or National Rifle Association University, an organization that reaches out to college students interested …

Geographic Information Systems Analysis Of Crime In San Luis Obispo For 2012, Eric Delorme
Geographic Information Systems Analysis Of Crime In San Luis Obispo For 2012, Eric Delorme
Social Sciences
The research and final project that I plan to do will be composed of a few different parts. I will be taking crime report data from the city of San Luis Obispo and analyzing it with GIS software. The data will be from the most recent reported calendar year. I will be looking at the data spatially so that I can compare the areas of the city in which crime is most prevalent. I will be creating multiple maps which will be looking individually at different types of crime, such as violent crimes, burglary and theft, assault and battery, sex …

The Case For Conscientiousness: Evidence And Implications For A Personality Trait Marker Of Health And Longevity, Tim Bogg, Brent W. Roberts
The Case For Conscientiousness: Evidence And Implications For A Personality Trait Marker Of Health And Longevity, Tim Bogg, Brent W. Roberts
Psychology Faculty Research Publications
Purpose Recent initiatives by major funding agencies have emphasized translational and personalized approaches (e.g., genetic testing) to health research and health management. While such directives are appropriate, and will likely produce tangible health benefits, we seek to highlight a confluence of several lines of research showing relations between the personality dimension of conscientiousness and a variety of health-related outcomes.
Methods Using a modified health process model, we review the compelling evidence linking conscientiousness to health and disease processes, including longevity, diseases, morbidity-related risk factors, health-related psycho-physiological mechanisms, health-related behaviors, and social environmental factors related to health.
Conclusion We argue the …

Lost In The Fog Of Miranda, George C. Thomas Iii
Lost In The Fog Of Miranda, George C. Thomas Iii
UC Law Journal
For over two centuries, Anglo-American law used a test of “voluntariness” to determine the admissibility of confessions. The twentieth century saw increasing skepticism that law can determine which conscious utterances are “voluntary” and which are not. Suspects who speak to police do so because they choose to speak rather than the alternative. If the alternative is torture, that feels involuntary. But if it is merely a lengthy interrogation, who can “prove” that the choice to answer is involuntary? Miranda v. Arizona was, in part, the Court’s response to this skepticism. If judges cannot tell which utterances are voluntary, why not …

Exploring Factors Contributing To Injury Severity At Freeway Merging And Diverging Locations In Ohio, Worku Y. Mergia, Deogratias Eustace, Deo Chimba, Maher Butros Qumsiyeh
Civil and Environmental Engineering and Engineering Mechanics Faculty Publications
Identifying factors that affect crash injury severity and understanding how these factors affect injury severity is critical in planning and implementing highway safety improvement programs. Factors such as driver-related, traffic-related, environment-related and geometric design-related were considered when developing statistical models to predict the effects of these factors on the severity of injuries sustained from motor vehicle crashes at merging and diverging locations. Police-reported crash data at selected freeway merging and diverging areas in the state of Ohio were used for the development of the models. A generalized ordinal logit model also known as partial proportional odds model was applied to …

Terrorism, Tips, And The Touchstone Of Reasonableness: Seeking A Balance Between Threat Response And Privacy Dilution, Geoffrey S. Corn
Dickinson Law Review (1908-2003)
It is the morning of the Oklahoma City terrorist bombing. The phone rings in the Oklahoma City Police Department, and a duty officer answers. The caller says, "There's a Ryder rental truck parked in front of the Murrah Federal Building with a massive bomb inside set to go off within one hour." The caller then hangs up. The duty officer alerts all nearby patrol units, and within three minutes an officer confirms the presence of the Ryder truck. What should the police do next? What response would be reasonable? Does the law permit them to cordon the area, take control …
Substantial Connection: The Intersectionof Extraterritorial Jurisdiction And Constitutional Protections For Foreign National Contractors Serving With Or Accompanying U.S. Armed Forces, Joe D. Montenegro
Dickinson Law Review (1908-2003)
Every day, many foreign nationals place their lives in danger for the benefit of the United States while serving with U.S. Armed Forces in hostile environments. In United States v. Ali, the U.S. Court of Appeals for the Armed Forces held that a combat interpreter did not have a substantial connection, as envisioned under United States v. Verdugo- Urquidez, with the United States to entitle the interpreter to Fifth and Sixth Amendment protections. Although the result is likely correct given that U.S. service members prosecuted under the Uniform Code of Military Justice (UCMJ) are not entitled to the specific protections …
Before You Press Record: Unanswered Questions Surrounding The First Amendment Right To Film Public Police Activity, Jesse Harlan Alderman
Before You Press Record: Unanswered Questions Surrounding The First Amendment Right To Film Public Police Activity, Jesse Harlan Alderman
Northern Illinois University Law Review
In 2011 and 2012, two circuit courts of appeals held that there exists a positive First Amendment liberty to record police officers in the public performance of their official duties. The opinions represent a swift response to the hundreds of arrests of ordinary citizens for filming police that have received national and local publicity in recent years. After a recitation of the two opinions, Glik v. Cunniffe and ACLU of Illinois v. Alvarez, this Article discusses four unresolved questions that remain: (1) Will future courts that have not addressed the issue be persuaded by Judge Richard A. Posner's dissent in …

Executive Functions And Social Interactions: Developing Social Scenarios, Mackenzie Waite
Masters Theses
The aim of this study was to develop a series of vignettes to form the basis for an assessment of executive functions (EFs) for 9 – 12 year old children. Although EFs are necessary for effective social communication and positive social interactions, currently, most EF assessments focus on impersonal activities. Little research exists that incorporates real-time processing using ecologically valid social scenarios. The current study aims to develop realistic scenarios that children could encounter in daily life. Ethnographic interviews were conducted with six participants, who worked in a school with 9-12 year old children, to gain their perspective on social …
The Right To Challenge The Accuracy Of Breath Test Results Under Alaska Law, Paul A. Clark
The Right To Challenge The Accuracy Of Breath Test Results Under Alaska Law, Paul A. Clark
Alaska Law Review
Section 28.90.020 of the Alaska Statutes provides that in prosecutions for drunk driving, "if an offense described under this title requires that a chemical test of a person's breath produce a particular result, and the chemical test is administered by a properly calibrated instrument approved by the Department of Public Safety, the result described by statute is not affected by the instrument's working tolerance." This provision appears to prohibit the defense from calling into question the accuracy of a breath test by introducing evidence of uncertainty inherent in the testing procedure. The statute is problematic because due process requires that …

The Future Of Securities Class Actions Against Foreign Companies: China And Comity Concerns, Dana M. Muir, Junhai Liu, Haiyan Xu
University of Michigan Journal of Law Reform
In Morrison v. National Australia Bank Ltd., the U.S. Supreme Court limited the application of U.S. securities fraud law in transnational situations. The Supreme Court noted that its decision was influenced by international comity considerations. In this Article, we evaluate the availability of class actions in China in cases involving alleged securities fraud. Because we find that the availability of those actions is too limited to fully protect U.S. shareholders, we argue that U.S. investors should be permitted to bring securities fraud class actions against non-U.S. companies whose securities are traded on a U.S. exchange regardless of where those investors …
On The Demand To Incorporate Shari'a Law Into Uk Law, Mayada Serageldin
On The Demand To Incorporate Shari'a Law Into Uk Law, Mayada Serageldin
Theses and Dissertations
The origin of this thesis lay in the emergence of a minority group of ‘religious’ activists in London, England. The purpose of this group was to establish “Shari’a Zones” in pockets of Waltham Forest and Tower Hamlets, wherein certain acts would be prohibited and Shari’a law would be enforced. This led to an examination of the theological and religious beliefs of this small and much marginalized section of the British Muslim community. What became apparent is that this group prescribed to a view of Islam, and shariah law in particular, which is incongruent with the provisions of human rights law. …

Path Loss In An Urban Peer-To-Peer Channel For Six Public-Safety Frequency Bands, David W. Matolak, Qian Zhang, Qiong Wu
Faculty Publications
We provide path loss data and models for a peer-to-peer wireless channel for an urban environment in six public safety bands, for simultaneous transmission to five spatially separated receiving sites. Results are from measurements in Denver, Colorado. The six frequencies at which we measured are (in MHz) 430, 750, 905, 1834, 2400, and 4860. Both line-of-sight and non-line-of-sight conditions were covered, and we quantify path loss exponents and linear-fit standard deviations as functions of frequency and location. Line-of-sight results agree with prior work, but non-line-of-sight exponents, from 3.6-7.3, are generally larger than in most other references.

The Plea Bargain Crisis For Noncitizens In Misdemeanor Court, Jason A. Cade
The Plea Bargain Crisis For Noncitizens In Misdemeanor Court, Jason A. Cade
Scholarly Works
This Article considers three factors contributing to a plea-bargain crisis for noncitizens charged with misdemeanors: 1) the expansion of deportation laws to include very minor offenses with little opportunity for discretionary relief from removal; 2) the integration of federal immigration enforcement programs with the criminal justice system; and 3) the institutional norms in non-federal lower criminal courts, where little attention is paid to evidence or individual equities and where bail and other process costs generally outweigh perceived incentives to fight charges. The Article contends that these factors increase the likelihood that a noncitizen’s low-level conviction will not reliably indicate guilt …

Comparing Class A Compressed Air Foam Systems (Cafs) Against Plain Water Suppression In Live Fire Gas Cooling Experiments For Interior Structural Firefighting, Sean Carter Mitchell
Master's Theses
Wildland fire services have successfully integrated compressed air foam systems (CAFS) into their fire suppression arsenal over the last few decades to effectively increase the firefighting ability of water. Many urban fire departments have done the same, but far more still rely on plain water to extinguish Class A fires. Many claims have been made about the advantages and disadvantages of firefighting foams, but only limited research has been conducted on the subject to date. Fire departments need more information, beyond that provided by foam suppliers and CAFS equipment manufacturers, to make an independent decision on whether or not to …

Uav Formation Flight Utilizing A Low Cost, Open Source Configuration, Christian W. Lopez
Master's Theses
The control of multiple unmanned aerial vehicles (UAVs) in a swarm or cooperative team scenario has been a topic of great interest for well over a decade, growing steadily with the advancements in UAV technologies. In the academic community, a majority of the studies conducted rely on simulation to test developed control strategies, with only a few institutions known to have nurtured the infrastructure required to propel multiple UAV control studies beyond simulation and into experimental testing. With the Cal Poly UAV FLOC Project, such an infrastructure was created, paving the way for future experimentation with multiple UAV control systems. …
