The Plea-Bargain Crisis For Noncitizens In Misdemeanor Court, Jason A. Cade Jun 2013

The Plea-Bargain Crisis For Noncitizens In Misdemeanor Court, Jason A. Cade

Cardozo Law Review

This Article considers three factors contributing to a plea-bargain crisis for noncitizens charged with misdemeanors: 1) the expansion of deportation laws to include very minor offenses with little opportunity for discretionary relief from removal; 2) the integration of federal immigration enforcement programs with the criminal justice system; and 3) the institutional norms in non-federal lower criminal courts, where little attention is paid to evidence or individual equities and where bail and other process costs generally outweigh perceived incentives to fight charges. The Article contends that these factors increase the likelihood that a noncitizen's low-level conviction will not reliably indicate guilt …

Government Regulatory Policy Towards The Biopharmaceutical Sector: Regulatory Outlook On Biosimilars In Egypt., Mohamed Atef Abdelhakim Farag

Theses and Dissertations

The thesis examines the government regulatory policy towards the pharmaceutical biotechnology sector (Biopharmaceutical), with focus on Similar Biotherapeutic Products (biosimilars). Biosimilars are highly similar but not identical molecules that claim to have similar quality, safety and efficacy of original (innovator/ reference) products. They differ significantly from the chemical based medicines (conventional pharmaceuticals) that the main active substance is usually from a living organism (biological). Such critical products are high on the treatment guidelines recommended for complex diseases with high death and disability burdens. Biosimilars started accessing the Egyptian Market long time before the Government established a proper regulatory structure/pathway to …

Note – Fair Use As Free Speech Fundamental: How Copyright Law Creates A Conflict Between International Intellectual Property And Human Rights Treaties, Jacob Zweig Jun 2013

Note – Fair Use As Free Speech Fundamental: How Copyright Law Creates A Conflict Between International Intellectual Property And Human Rights Treaties, Jacob Zweig

UC Law Journal

Copyright law grants individuals monopoly over a particular kernel of expression, whereas the right to freedom of expression theoretically grants others the right to use that same kernel of expression. In this sense, the right to freedom of expression conflicts with copyright law. This Note argues that a flexible, open-norm copyright exception like the U.S. fair use doctrine provides a free speech safety valve that is essential in resolving the conflict and is thus a necessary component of the right to freedom of expression protected by treaties such as the International Covenant on Civil and Political Rights and the European …

The city of Kelso has a rich history based in a strong community ethic, hard-working people, and an economy deeply rooted in the bounty of the natural environment. This economy has changed over the last several decades, however, and the difficult transition has left its mark on the community. South Kelso in particular- one of the four neighborhood quadrants- is battling its fourth generation of disinvestment and widespread poverty. To help the City revitalize South Kelso, the aim of the South Kelso Revitalization Plan is to give voice, strength, and direction to the concerns and priorities of the South Kelso …

Searching For Solutions To The Indigent Defense Crisis In The Broader Criminal Justice Reform Agenda, Roger Fairfax Jun 2013

Searching For Solutions To The Indigent Defense Crisis In The Broader Criminal Justice Reform Agenda, Roger Fairfax

Scholarly Articles in Law Reviews & Journals

As we mark the fiftieth anniversary of the Gideon v. Wainwright decision, the nearly universal assessment is that our indigent defense system remains too under-resourced and overwhelmed to fulfill the promise of the landmark decision, and needs to be reformed. At the same time, fiscal necessity and moral outrage have prompted a historic reexamination of outdated policies that have led to an overreliance on incarceration and inefficiencies in the administration of criminal justice. This Essay argues that there are synergies between the indigent defense reform agenda and the broader criminal justice reform agenda, which places a premium on cost-effective, evidence-based, …

Community Composition, Demographic Change, And The Impact Of Spatial Proximity To Disadvantage On Violence And Gang Presence In New Jersey Municipalities, Brian Engelmann May 2013

Community Composition, Demographic Change, And The Impact Of Spatial Proximity To Disadvantage On Violence And Gang Presence In New Jersey Municipalities, Brian Engelmann

Dissertations

Neighborhood composition, change, and disadvantage have been shown to influence crime and gang presence in communities. There is a dearth of research, however, that explores whether spatial proximity to disadvantaged areas affects crime and gang presence in nearby locations. Through maps and spatial analysis, this study investigates how neighborhood demographics may vary and may have changed by community type in New Jersey municipalities. Through quantitative analysis and interviews with school and law enforcement officials, the study then analyzes how such community-based phenomena, coupled with proximity to disadvantaged areas, may affect crime, violence, and gang presence in towns and schools.

Findings …

Session 1-4-B: Gambling And Marijuana Use In The Netherlands: Is Legalization The Best Tool For Dealing With "Naughty Habits?", William N. Thompson, Laura K. Thompson May 2013

Session 1-4-B: Gambling And Marijuana Use In The Netherlands: Is Legalization The Best Tool For Dealing With "Naughty Habits?", William N. Thompson, Laura K. Thompson

International Conference on Gambling & Risk Taking

In 1976, the Netherlands embraced two policy initiatives which encompassed similar objectives. The policies sought to control “undesired substances” via the process of legalization. One legalization process involved casino gambling. The policies have sometimes led to desired results (the right road), while at other times they have led to undesirable results (the wrong road). Now in 2013, without an observable crossroad or even fork in the road, The Netherlands is poised to deviate from a right road to travel down a wrong road by placing rather severe restrictions upon the operations of “Coffee Houses” which have been “serving” customers measured …

Diasporas, Development And Governance In The Global South, Abel Chikanda, Gareth Haysom

International Migration Research Centre

Diasporas are increasingly recognized as key development resources for low- and middle-income countries. Thus, governments in the Global South are turning to their own extra-national diasporic populations in order to boost economic development, build global trading and investment networks and increase their political leverage overseas. The main goals of the conference on Diasporas, Development and Governance in the Global South were to enhance international understanding of the role of diasporas in development, identify best practices for policy engagement of diasporas and facilitate Canadian diaspora engagement in development. The conference focused on three main areas:

  • Critical examination of efforts by international …
