The Admissibility Of Cell Site Location Information In Washington Courts, Ryan W. Dumm
The Admissibility Of Cell Site Location Information In Washington Courts, Ryan W. Dumm
Seattle University Law Review
This Comment principally explores when and how a party can successfully admit cell cite location information into evidence. Beginning with the threshold inquiry of relevance, Part III examines when cell site location information is relevant and in what circumstances the information, though relevant, could be unfairly prejudicial, cumulative, or confusing. Part IV provides the bulk of the analysis, which centers on the substantive foundation necessary to establish the information’s credibility and authenticity. Part V looks at three ancillary issues: hearsay, a criminal defendant’s Sixth Amendment confrontation rights, and the introduction of a summary of voluminous records. Finally, Part VI offers …

“Lonesome Road”: Driving Without The Fourth Amendment, Lewis R. Katz
Seattle University Law Review
The protections of the Fourth Amendment on the streets and highways of America have been drastically curtailed. This Article traces the debasement of Fourth Amendment protections on the road and how the Fourth Amendment’s core value of preventing arbitrary police behavior has been marginalized. This Article contends that the existence of a traffic offense should not be the end of the inquiry but the first step, and that defendants should be able to challenge the reasonableness even when there is proof of a traffic offense.

Section 501(C)(4) Advocacy Organizations: Political Candidate-Related And Other Partisan Activities In Furtherance Of The Social Welfare, Terence Dougherty
Seattle University Law Review
In the wake of the 2012 presidential election, tax and political law lawyers are left with a number of unanswered questions concerning the political activities of tax-exempt organizations. Despite the importance of these questions, there are striking gaps in the authority of federal tax law governing the conduct of political candidate and other partisan-related activities by tax-exempt organizations. Assuming activities in furtherance of partisan interests are activities that support private interests, I consider what this authority may tell us about the permissibility of Section 501(c)(4) organizations engaging in partisan political activities and having as a constitutive purpose a partisan political …

Costs Of Capital Punishment In California: Will Voters Choose Reform This November?, Judge Arthur L. Alarcón, Paula M. Mitchell
Loyola of Los Angeles Law Review
In November 2012, California voters took to the polls to consider Proposition 34, a ballot initiative to replace the death penalty with a sentence of life in prison without the possibility of parole (“LWOP”) as the state’s most severe punishment. In advance of the election, Judge Arthur L. Alarcón and Paula M. Mitchell released this Article, which the Loyola of Los Angeles Law Review published on its website on September 10, 2012.
In this Article, the authors updated voters on the findings presented in their groundbreaking 2011 study, which revealed that from 1978 to 2011, California’s death-penalty system cost the …
Sexual Assault And Sane (Sexual Assault Nurse Examiners) In Our Community, Emily Barrow
Sexual Assault And Sane (Sexual Assault Nurse Examiners) In Our Community, Emily Barrow
Honors Theses
Sexual assault and sexual violence is a problem in our society, with one in four college women report surviving rape (15 percent) or attempted rape (12 percent) since their fourteenth birthday, and about 42% of survivors did not tell anyone about their rape. Research on the subject is being done and information in a special report, Extent, Nature, and Consequences of Rape Victimization: Findings from the National Violence Against Women Survey (NVAWS), conducted by American Prosecutors Research Institute and Boston College Connell School of Nursing, exposes some alarming statistics. The study reveals that over half of female victims and nearly …

The Power Of Perceptions: How Social Capital Is Being Impacted By Crime And Corruption In Mexico, Pablo G. Paras
The Power Of Perceptions: How Social Capital Is Being Impacted By Crime And Corruption In Mexico, Pablo G. Paras
Doctoral Dissertations
Coinciding with the transition to democracy in Mexico (and elsewhere in Latin America), violent crime increased substantially and joined with the citizenry’s concerns about corruption. The overarching question of the research can be summarized as: How and how much do perceptions and experiences with crime and corruption impact democracy? In its most general conception the thesis is that in Mexico, an increasingly adverse context (experience + perceptions) of crime and corruption has a negative and significant impact on social capital. This discussion can be viewed as a partial assessment of the quality of democracy in Mexico. The topic is of …

A Discussion Of Structural Analysis Techniques For Western Kentucky University's Concrete Canoe, "Courageous", Aaron J. Daley
A Discussion Of Structural Analysis Techniques For Western Kentucky University's Concrete Canoe, "Courageous", Aaron J. Daley
Mahurin Honors College Capstone Experience/Thesis Projects
One of the most famous aspects of the WKU Civil Engineering department is the annual student participation in the Concrete Canoe Competition. This year-long project requires seniors to design, manage construction for, and compete with a twenty-foot long boat made out of concrete and reinforcement. It is important to know the loads that the canoe will experience during its use in paddling races. The process for determining these internal forces is called structural analysis. For my project I will be discussing the analysis process employed for the 2013 concrete canoe, exploring accuracy, technical knowledge required, and the practical application of …
