Protecting Intangible Cultural Resources: Alternatives To Intellectual Property Law, Gerald Carr
Protecting Intangible Cultural Resources: Alternatives To Intellectual Property Law, Gerald Carr
Michigan Journal of Race and Law
Cultural resources can be defined as "the tangible and intangible effects of an individual or group of people that define their existence, and place them temporally and geographically in relation to their belief systems and their familial and political groups, providing meaning to their lives." The field of cultural resources includes tangible items, such as land, sacred sites, and religious and finerary objects. The field also includes intangible knowledge and customs, such as tribal names, symbols, stories, and ecological, ethnopharmacological, religious, or other traditional knowledge. The tangible cultural resources of tribes can fall under the protection of statutes such as …

‘Kami Juga Punya Suara’: Dunia Blogging Buruh Migran Indonesia Di Hong Kong Sebagai Politik Budaya, Pratiwi Retnaningdyah
JURNAL KOMUNIKASI INDONESIA

Fibromyalgia Syndrome: A Pathoneurological Basis Of Disease, Alex D. Hamilton
Fibromyalgia Syndrome: A Pathoneurological Basis Of Disease, Alex D. Hamilton
Senior Honors Theses
Fibromyalgia (also known as fibromyalgia syndrome, or FMS) is a condition which causes its victims to suffer a wide range of symptoms, most notably chronic musculoskeletal pain. Although the causes of fibromyalgia remain unknown, recent advances help elucidate the underlying pathophysiologies of this condition, and show that it is likely not a musculoskeletal condition, but rather a pathoneurological condition.
The Software Life Cycle Applied To The Development Of The Avnul Rpg Character Creation Program, James C. Rogers Iii
The Software Life Cycle Applied To The Development Of The Avnul Rpg Character Creation Program, James C. Rogers Iii
Senior Honors Theses
This project will endeavor to replicate the "cradle-to-grave" software engineering life cycle development process. This process takes a software project through many stages of existence, from requirements gathering to software design, coding, testing, and maintenance. In this thesis we apply this process to a character creation program, which will be constructed for a client to facilitate the design of his tabletop roleplaying game.
Over the course of developing this software, contact was maintained with the client, but difficulties were encountered in the form of shifting requirements as he refined and modified his as-yet unfinished game rules. Without regular communication, these …
Future Foreign Language Teachers’ Intercultural Competence, Andrew Baalerud
Future Foreign Language Teachers’ Intercultural Competence, Andrew Baalerud
Masters Theses
There is a lack of research regarding the implications for foreign language study and intercultural competence. Scholars suggest that foreign language proficiency plays a role in cultivating intercultural competence, but agree that there is a lack of empirical evidence supporting this notion. Research also shows that foreign language teachers are ethnocentric. Many educators and foreign language programs use a framework developed by the American Council on the Teaching of Foreign Language (ACTFL) to promote language learning. This framework also possesses key elements in promoting intercultural competence. This study addressed whether a pre-service, ACTFL-guided teaching component of the curriculum had an …
Mobile Knowledge, Karma Points, And Digital Peers: The Tacit Epistemology And Linguistic Representation Of Moocs, Lisa Portmess
Mobile Knowledge, Karma Points, And Digital Peers: The Tacit Epistemology And Linguistic Representation Of Moocs, Lisa Portmess
Philosophy Faculty Publications
Media representations of massive open online courses (MOOCs) such as those offered by Coursera, edX and Udacity reflect tension and ambiguity in their bold promise of democratized education and global knowledge sharing. An approach to MOOCs that emphasizes the tacit epistemology of such representations suggests a richer account of the ambiguities of MOOCs, the unsettled linguistic and visual representations that reflect the strange lifeworld of global online courses and the pressing need for promising innovation that seeks to serve the restless global desire for knowledge. This perspective piece critically appraises the linguistic laboratory of thought such representation reveals and its …
Multiculturalism And Racialization In Latin America And The Caribbean, Bernd Reiter
Multiculturalism And Racialization In Latin America And The Caribbean, Bernd Reiter
Government and International Affairs Faculty Publications
This article, which is based on a keynote address, delivered for the 2nd International Congress of Caribbean Studies, held at the Universidad del Norte, Barranquilla, Colombia, in August of 2012, argues that Caribbean nations are in dire need to analyze and deconstruct the foundational myths upon which their national unities were constructed after achieving independence. This process is under way in such countries as Brazil, Mexico, and Colombia, but has not been carried out for most Caribbean nations, maybe with the exception of Cuba. Where such efforts have not been pursued vigorously, myths of racial harmony tend to prevail. These …

Evaluating The Grammars Of Children Who Speak Nonmainstream Dialects Of English, Janna B. Oetting, Ryan Lee, Karmen L. Porter
Evaluating The Grammars Of Children Who Speak Nonmainstream Dialects Of English, Janna B. Oetting, Ryan Lee, Karmen L. Porter
Faculty Publications
In this article, we review three responses to the study and evaluation of grammar in children who speak nonmainstream dialects of English. Then we introduce a fourth, system-based response that views nonmainstream dialects of English, such as African American English (AAE) and Southern White English (SWE) as made up of dialect-specific and dialect-universal features. To illustrate the usefulness of a system-based approach and to distinguish our two terms from others in the dialect literature, we present AAE and SWE relative clause data from two previously published studies. Following this, we present new findings from AAE- and SWE-speaking children's use of …
Infants’ Responses To Affect In Music And Speech, Daniel K. Feinberg
Infants’ Responses To Affect In Music And Speech, Daniel K. Feinberg
Pitzer Senior Theses
Existing literature demonstrates that infants can discriminate between categories of infant-directed (ID) speech based on the speaker’s intended message – that is, infants recognize the difference between comforting and approving ID speech, and treat different utterances from within these two categories similarly. Furthermore, the literature also demonstrates that infants understand many aspects of music and can discriminate between happy and sad music. Building on these findings, the present study investigated whether exposure to happy or sad piano music would systematically affect infants’ preferences for comforting or approving ID speech. Five- to nine-month-old infants’ preferences for comforting or approving ID speech …

“Under The Seams Runs The Pain”: Four Greek Sources And Analogues For The Modern Monster In Anne Carson’S Autobiography Of Red, Joshua M. Carmel
Student Publications
This work seeks to explore the monster figure in its evolution from the Classical to the contemporary literary canons. Using Geryon, a three-headed and red-hued monster, as the central figure and Carson’s 1998 verse novel Autobiography of Red, it evaluates the underpinnings of the alienated “other” and attempts to shed light on its role in modern society.
The Development Of Differential Object Marking In Spanish-English Bilingual Children, Mariluz Ortiz Vergara
The Development Of Differential Object Marking In Spanish-English Bilingual Children, Mariluz Ortiz Vergara
Open Access Theses
In monolingual development, the acquisition of differential object marking (DOM) is completed by three years of age (Rodríguez- Mondoñedo, 2008). However, among bilingual speakers, the development and use of the marker at a young age is less predictable. Spanish marks animate and specific direct objects with the preposition-a; English in contrast does not. Based on previous studies documenting transfer in areas where Spanish and English differ, it was predicted that bilingual children would experience difficulties with the use of the preposition both in matrix and left dislocated sentences (CLLD) (Montrul, 2004, Montrul & Bowles, 2009). This study tested 14 simultaneous …

Pierogies To Hamburgers: An Immigration Story, Madeline Cross '13
Outstanding Ethnographic Research Projects
This ethnographic study examines the experiences of an immigrant from Poland through visual media. The process of becoming a citizen, the transition to American culture, and current identity as a Polish American are addressed. The consultant for this ethnography is Agnieszka (Agnes) Kubas who is a Junior at Illinois Wesleyan University. Agnes moved from Poland to America 12 years ago.
Agnes’s immigration story is a culmination of historical and cultural factors that she experienced on a personal level. The three main themes of Agnes’s story were the language barrier, the transition to the American educational system, and the way her …
Why They Rise Up, Or Not: A Study Of Linguistic Minorities And Ethnic-National Mobilization, Yelei Kong
Why They Rise Up, Or Not: A Study Of Linguistic Minorities And Ethnic-National Mobilization, Yelei Kong
Honors Projects
Most theories of nationalism focus on majority nationalism and do not provide an adequate explanation of the inaction of most ethnic minorities. The first part of this paper adopts the political process model from social movement theory to study the factors that prompt linguistic minorities to mobilize on ethno-national grounds. Using a large-N statistical model with data drawn from the Minorities at Risk (MAR) database, the results indicate that group capacity, a favorable opportunity structure, and strong issue framing facilitate ethno-national mobilization. The second part of the paper employs a most similar system design to compare Uzbek language minorities in …
The New Originalist Manifesto, James E. Fleming
The New Originalist Manifesto, James E. Fleming
Faculty Scholarship
Lawrence B. Solum and Robert W. Bennett's excellent book, Constitutional Originalism: A Debate, calls to mind a famous book in political philosophy, J.J.C. Smart and Bernard Williams's Utilitarianism: For and Against.' Both works pair two spirited yet fair-minded scholars in a constructive debate between two competing views prevalent in their fields. Originalism has a reasonable, programmatic, and inclusive proponent in Solum, and living constitutionalism has a capable, pragmatic, and effective champion in Bennett.
Predictive Coding: Emerging Questions And Concerns, Charles M. Yablon, Nick Landsman-Roos
Predictive Coding: Emerging Questions And Concerns, Charles M. Yablon, Nick Landsman-Roos
Articles
Technology-assisted review-also referred to as "predictive coding," "computer-aided review," and "content-based advanced analytics"-is the most important development in e-discovery to have occurred in some time. While technical characterizations of the process vary largely because of differences across software platforms, basically predictive coding is a process whereby computers are programmed to search large quantities of documents using complex algorithms to mimic the document selection process of a knowledgeable, human document review. It is said to do such a review faster and without many of the dangers of human error. Because of its speed and accuracy, it has been described as a …
Through The Eyes Of Jurors: The Use Of Schemas In The Application Of “Plain Language” Jury Instructions, Sara Gordon
Through The Eyes Of Jurors: The Use Of Schemas In The Application Of “Plain Language” Jury Instructions, Sara Gordon
UC Law Journal
“Through the Eyes of Jurors” is the first law journal article to consider all of the major cognitive psychology studies that examine how “schemas,” or the preexisting notions jurors have about the law, shape jurors’ use of jury instructions, even when those jurors are given “plain-language” instructions. This Article examines the social science research on schema theory in order to advance our understanding of how schemas continue to influence jurors’ use of jury instructions, even when those jurors are given “plain language” instructions. A significant body of legal literature has examined jurors’ use and understanding of jury instructions, and many …
The Relation Between High School Teacher Sense Of Teaching Efficacy And Self-Reported Attitudes Toward The Inclusive Classroom Settings, Heather Wright
The Relation Between High School Teacher Sense Of Teaching Efficacy And Self-Reported Attitudes Toward The Inclusive Classroom Settings, Heather Wright
Doctoral Dissertations and Projects
The purpose of this study was to investigate if collective sense of teaching efficacy, general sense of teaching efficacy, or personal sense of teacher efficacy influenced teacher attitude toward inclusive classroom settings. Additionally, the study sought to determine if teacher attitude toward inclusive classroom settings differed when taking into account primary student disability type. Prior research indicates that there is a direct link between teacher sense of efficacy and student disability type when determining teacher attitude toward inclusive classroom settings. The sample population for the survey consisted of a convenience sample that represented only a select number of teachers, thus …

Effects Of Using A Neuroeducational Intervention To Enhance Perseverance For Online Edd And Eds Students, Charles Cadle
Doctoral Dissertations and Projects
Developing and maintaining a "completion mindset" is a necessary mental condition for online educational doctorate (EdD) and educational specialist (EdS) students to obtain their advanced degrees. The purpose of this research study was to examine the effect of a neuroeducational intervention on a volunteer convenience sample of EdD and EdS students enrolled in online research and analysis courses at a private central Virginia university to determine if the intervention would have a positive effect on the level of perseverance through the stages of practical inquiry when compared to a control group. The independent variable was a web-based instructional method consisting …
Predicting Product Review Helpfulness Using Machine Learning And Specialized Classification Models, Scott Bolter
Predicting Product Review Helpfulness Using Machine Learning And Specialized Classification Models, Scott Bolter
Master's Projects
In this paper we focus on automatically classifying product reviews as either helpful or unhelpful using machine learning techniques, namely, SVM classifiers. Using LIBSVM and a set of Amazon product reviews from 25 product categories, we train models for each category to determine if a review will be helpful or unhelpful. Previous work has focused on training one classifier for all reviews in the data set, but we hypothesize that a distinct model for each of the 25 product types available in the review dataset will improve the accuracy of classification. ! Furthermore, we develop a framework to inform authors …
The Case Of Three Karen Families: Literacy Practices In A Family Literacy Classroom, Sabrina D. M. Quadros
The Case Of Three Karen Families: Literacy Practices In A Family Literacy Classroom, Sabrina D. M. Quadros
Department of Teaching, Learning, and Teacher Education: Theses and Other Student Research
The lack of research in understanding the literacy practices of Karen families, influencing their schooling performance and language acquisition, leave professionals in the educational field limited in their knowledge about the forms of engagement of these families into American schooling. To better understand literacy practices in which Karen families engage, in this case study the author explores some of the literacy practices of Karen families when at school and in their homes. The author observed three Karen adult/parent learners during a period of three months, in an ESL family literacy program at Kennedy Elementary, in Lincoln, Nebraska. One interview with …

The Twin Aims Of Erie, Michael Steven Green
Notre Dame Law Review
The article presents justification of the twin aims in diversity cases and systematic analysis of its role in federal and state court. It informs that twin aim protects state interests with separation of powers in which state law is incorporated into federal procedural common law in order to serve federal interests. In the U.S. Supreme Court case Erie Railroad Co. v. Tompkins, the Court held that federal courts can not create federal common law under diversity jurisdiction.

Conversations In A Pub: Positioning The Critical Friend As “Peer Relief” In The Supervision Of A Teacher Educator Study Abroad Experience, Jenifer J. Schneider, Audra K. Parker
Teaching and Learning Faculty Publications
In this paper, we share the results of a self - study of our experience as university supervisors in a study abroad program for U.S. pre - service teachers. We share the shifts in our thinking that occurred as a result of our daily conversations about our work as teacher educators. Our reflections led us to new understandings of the nuances of field experiences, our constructions of pre - service teachers in the field, and the necessity of personal and professional renewal for faculty, not only as critical friends, but as peer relief.
