Neoconstitutionalism, Rights, And Natural Law, Juan Cianciardo Dec 2013

Neoconstitutionalism, Rights, And Natural Law, Juan Cianciardo

Journal of Civil Law Studies

Rights are, without a doubt, the most outstanding feature of contemporary legal systems. It can be argued that since the middle of the past century we are immersed in a culture of rights. Neo-constitutionalism is one among other such concepts that has been used to designate and study this phenomenon. The hypothesis we will attempt to address in this paper is that some of the central characters of our culture of rights, here termed as “neo-constitutionalism,” cannot be explained consistently without an explicit reference to natural law.

We will specifically examine the connection between the assertion that there exist natural …

International Cooperation Among States In Globalized Era:The Decline Of State Sovereignty, Koesrianti Koesrianti Dec 2013

International Cooperation Among States In Globalized Era:The Decline Of State Sovereignty, Koesrianti Koesrianti

Indonesia Law Review

This article discusses the national sovereignty and regionalism in the context of the membership of a state into regional economic organisations. It concludes that in nowadays-shrinking world the traditional concept of sovereignty is less relevant since states have suffered a loss in their sovereignty. It found that member states of regional economic organisations have to cede a degree of sovereignty, such as in the EU. This phenomenon however is not the case for NAFTA and AFTA.

Scaling Social Ventures: An Exploratory Study Of Social Incubators And Accelerators, Guillermo Casasnovas, Albert V. Bruno

Journal of Management for Global Sustainability

This article addresses the specific role of programs that attempt to help social ventures scale. We utilize combined experience in the Momentum Project from ESADE Business School and the Global Social Benefit Incubator at Santa Clara University, as well as an exploratory study of 40 social incubator and accelerator programs around the world, to frame the issues. We make a comparison among different programs and classify them as social incubators and social accelerators according to targeted social ventures and portfolio of resources offered. We note opportunities for research on social entrepreneurship and discuss relevant issues for both academics and practitioners …

Seasonal Habitat Selection By Elk In North Central Utah, Jeffrey L. Beck, Kurt T. Smith, Jerran T. Flinders, Craig L. Clyde Dec 2013

Seasonal Habitat Selection By Elk In North Central Utah, Jeffrey L. Beck, Kurt T. Smith, Jerran T. Flinders, Craig L. Clyde

Western North American Naturalist

Understanding anthropogenic and environmental factors that influence seasonal habitat selection is critical in establishing conservation objectives for wildlife populations. However, many resource selection studies provide inferences only for single seasons, potentially masking factors essential to populations during other times of the year. Our objective was to model elk (Cervus elaphus) habitat selection for 4 seasons to identify factors influencing selection within and across seasons. Using aerial relocation data, we evaluated seasonal habitat selection for 46 radio-marked, migratory adult female elk in a 6123-km2 landscape in north central Utah, USA, from 1993 to 1997. We evaluated habitat use …

Positive Uncertainty And The Ethos Of Comparative Literature, Brigitte Le Juez Dec 2013

Positive Uncertainty And The Ethos Of Comparative Literature, Brigitte Le Juez

CLCWeb: Comparative Literature and Culture

In her article "Positive Uncertainty and the Ethos of Comparative Literature" Brigitte Le Juez examines the continuous difficulty comparatists have with the lack of definition of the discipline and explores possible new avenues for tackling the problem. Le Juez argues that "uncertainty" recognized as a tenet of comparative literature should not be unheeded, but embraced in order to shift the focus from the idea that comparative objects and methods are the defining elements of the discipline and envisage them as the aims and results of an ethos. Le Juez posits that when "indiscipline" and "serendipity" are added to the notion …

Multilingual Literature, Translation, And Crnjanski's Роман О Лондону (A Novel About London), Biljana Djorić Francuski

CLCWeb: Comparative Literature and Culture

In her article "Multilingual Literature, Translation, and Crnjanski's Роман о Лондону (A Novel about London)" Biljana Djorić Francuski discusses aspects of the translation of multilingual texts. Although xenisms (words in foreign languages) can often be translated and yet preserved as a part of code mixing, it is difficult to transpose what are known as nonce loans. A further obstacle arises when the author of the multilingual text is such an artist of subtle allusion that the dominant language is pervaded with words and phrases transferred from other languages so that they gain meanings which differ from the expected ones. Djorić …

The Persistence Of "Cathay" In World Literature, Eugene Eoyang Dec 2013

The Persistence Of "Cathay" In World Literature, Eugene Eoyang

CLCWeb: Comparative Literature and Culture

In his article "The Persistence of 'Cathay' in World Literature" Eugene Eoyang argues that China has only recently begun to occupy a place in world literatures as evidenced by the absence of Chinese literature from the early editions of the widely adopted Norton Anthology of World Masterpieces and its token representations in subsequent editions. "Orientalized" images of China still persist partly stemming from the continuing currency of stereotyped images of the Chinese promoted by publishers, by Western Sinologists, and even by expatriate Chinese. A cottage industry has developed which privileges the study of images of China (however distorted and oversimplified) …

Comparativist Imagology And The Phenomenon Of Strangeness, Małgorzata Świderska Dec 2013

Comparativist Imagology And The Phenomenon Of Strangeness, Małgorzata Świderska

CLCWeb: Comparative Literature and Culture

In her article "Comparativist Imagology and the Phenomenon of Strangeness" Małgorzata Świderska presents an imagological-hermeneutic conception of the interpretation of national, ethnic, and/or (inter)cultural strangeness in literary works. Świderska develops her concept of comparativist imagology from the work of Paul Ricoeur's concept of multiple étrangeté and from the work of Jean-Marc Moura. Świderska applies her conceptualization of comparativist imagology to Heimito von Doderer's "Divertimento No I" and Das letzte Abenteuer. Ein Ritter-Roman.

The Pan-Asian Empire And World Literatures, Sowon S. Park Dec 2013

The Pan-Asian Empire And World Literatures, Sowon S. Park

CLCWeb: Comparative Literature and Culture

In her article "The Pan-Asian Empire and World Literatures" Sowon S. Park argues that world literature studies have been limited to "Europe and its Others." That is to say, while there has been an increasing preoccupation with literary networks beyond the Western canon since the middle of the last century, the investigations have been restricted to the colonial world and the postcolonial states of the Western powers. The non-Western colonial field of the Pan-Asian empire (1894-1945) — Imperial Japan, colonial Korea, semi-colonial China, and Taiwan — has been not so much relegated to the margins as just passed over. Park …

World Literatures, Comparative Literature, And Glocal Cosmopolitanism, Paolo Bartoloni Dec 2013

World Literatures, Comparative Literature, And Glocal Cosmopolitanism, Paolo Bartoloni

CLCWeb: Comparative Literature and Culture

In his article "World Literatures, Comparative Literature, and Glocal Cosmopolitanism" Paolo Bartoloni reflects on the topos of the crisis of literature and the humanities. An urge to question the status and the relevance of literature; to investigate the relation between literature and literary studies; and the location of literature within the context of a transforming world has emerged in the last three decades. Assuming that a bond exists between literature and the world, what is its nature? Is it possible to take an interest in literature without knowing its potential relevance or its world? These questions are related to the …

Major Histories, Minor Literatures, And World Authors, Theo D'Haen Dec 2013

Major Histories, Minor Literatures, And World Authors, Theo D'Haen

CLCWeb: Comparative Literature and Culture

In his article "Major Histories, Minor Literatures, and World Authors" Theo D'haen discusses how the idea of world literature has made a remarkable comeback in literary studies. A major feature of this revival has been increased attention from a "world perspective" to literatures until recently little studied beyond disciplinary boundaries, particularly so some "major" literatures such as Chinese, Japanese, Arabic, and various Indian-language literatures. As such, these literatures have come to join what has usually been thought of as "European" world literature. What this move, however to be welcomed in itself, obscures is the even further peripheralization of a number …

Crater Detection Via Genetic Search Methods To Reduce Image Features, Joseph Paul Cohen Dec 2013

Crater Detection Via Genetic Search Methods To Reduce Image Features, Joseph Paul Cohen

Graduate Masters Theses

Recent approaches to crater detection have been inspired by face detection's use of gray-scale texture features. Using gray-scale texture features for supervised machine learning crater detection algorithms provides better classification of craters in planetary images than previous methods. When using Haar features it is typical to generate thousands of numerical values from each candidate crater image. This magnitude of image features to extract and consider can spell disaster when the application is an entire planetary surface. One solution is to reduce the number of features extracted and considered in order to increase accuracy as well as speed. Feature subset selection …

Racism And Anxiety In A Black American Sample: The Role Of Mediators And A Brief Mindfulness Manipulation, Jessica Rose Graham Dec 2013

Racism And Anxiety In A Black American Sample: The Role Of Mediators And A Brief Mindfulness Manipulation, Jessica Rose Graham

Graduate Doctoral Dissertations

It is important to determine factors that may exacerbate the negative effects of experiences of racism on anxiety, as well as factors that might buffer racism's negative impact on anxiety in Black American samples. To examine these factors, we conducted two related studies. In study 1, 119 Black American individuals completed the Schedule of Racist Events, the five factor mindfulness questionnaire, the anxiety control questionnaire (assessing perceptions of control), the self-hatred subscale of the cross racial identity scale, and the depression anxiety and stress Scale. As hypothesized, frequency of racist experiences over the past week was significantly positively associated with …
