Free Riding On Benevolence: Collective Action Federalism And The Minimum Coverage Provision, Neil S. Siegel

Opponents of the minimum coverage provision in the Patient Protection and Affordable Care Act (ACA) argue that this “individual mandate” is beyond the scope of Congress’s commerce power because it regulates the “inactivity” of not purchasing health insurance. Defenders of the provision argue that it regulates the “activity” of participating in the interstate health care market, including by obtaining health care without paying for it. This Article argues that the distinction between inactivity and activity is irrelevant to the limits of the commerce power.

The purpose of this research is to explore the conceptual background of agility in knowledge management, re-conceptualize it and extend it to military applications with a special focus on Counterinsurgency (COIN).

An initial qualitative exploration of agility in knowledge management was performed. Three different concepts and their interrelationships were analyzed: (1) knowledge management, (2) agility in operations, and (3) military organizations in the COIN environment. October 7, 2011, marked a decade since the United States invaded Afghanistan and initiated the Global War on Terrorism (GWOT). While most ten-year anniversary gifts involve aluminum, tin, or diamonds, the greatest gift U.S. policymakers can present American citizens is a reconsideration of the logic that guides America's counterterrorism strategy. Although the United States has successfully averted large-scale domestic terrorist attacks, its inability to grasp the nature of the enemy has cost it dearly in wasted resources and, more importantly, lost lives. Despite the vast amount of literature on events of the Sandinista Revolution and Sandinista political aspirations, minimal research has been done on the perspectives of fighters in the counterrevolutionary forces. This study therefore examines the motivations of the Contra army, their respect for human rights considerations, and their perceptions of the United States’ involvement in the Contra War through qualitative interviews with former Contra soldiers and commanders. An analysis of the responses reveals a diversity of motivations among the Contra, ranging from a desire for indigenous autonomy to a struggle for political representation to a reaction to personal attacks. In Civil War historiography, consistent attention and public interest has illuminated the history of various Irish organizations, no regiment more so than New York's famed "Fighting Sixty-Ninth." During the conflict, the State of New York fielded three regiments designated the Sixty-Ninth, but the scholarship has tended to favor just one of them, the 69'" New York Volunteers of the Irish Brigade. The 69" New York National Guard Artillery, the first regiment in General Michael Corcoran's Irish Legion, has been virtually forgotten. Trace element detection of metals, for example, iron, Copper and zinc, are important in biological systems and in the environment. Many of us are aware that our cells contain metal ions that are “tied” up in proteins. However, chelatable or “free” trace elements can also be found in small quantities, and can have a negative impact on our bodies. This report examines 13 terrorist plots against public surface transportation that were uncovered and foiled by authorities between 1997 and 2010 and two failed attempts to carry out attacks. Certainly, this is not the total universe of foiled or failed terrorist plots in these years, but they were selected on the basis of what is known about them and the accessibility of information. The report focuses on terrorist plots in the West. Seven of the 15 plots took place in the United States, and four occurred in the United Kingdom. Media, Military, Militarism: Media Consumption, Awareness Of U.S. Military Foreign Policy, And Support For War, Daniel James Patten

This study examines the relationship between the media, attitudes towards supporting war, and military awareness. Online survey data were collected from a four-year university located in a heavily militarized area. This study found that having knowledge of Afghanistan and Iraq War facts negatively affected one's decision to support war and was the strongest predictor of this decision. The media was not found to be a significant predictor impacting this knowledge when controlling for other variables. Political ideology and other related variables were found to be more influential of this knowledge. These findings imply that the public may be imprudently supporting …

Since the inception of cinema, women have been portrayed with the typical identities of emotionally and physically weak characters; this portrayal led to their subsequent dependence on men. Men were usually the protagonists and/or the heroes, following their archetypal journey. Thus, women's position in early cinema was to exemplify what men were not, placing the former in the diminutive position of the Other. One may conclude that men were often defined by what women lacked, and the women were defined by their relationships with these heroic men. My study highlights a link of U.S. American hypermasculinity running through Cormac McCarthy's two novels Blood Meridian (1985) and All the Pretty Horses (1992), Toni Morrison's Song of Solomon (1977), and James Baldwin's Another Country (1960). My literary interpretations of these texts suggest that U.S. American hypermasculine man originated in the American frontier and transformed into a definition of hegemonic masculinity embraced by many southern rural American men. These southern rural American men then concocted the myth of the black rapist in order to justify the mass murder of African American men after Reconstruction, inadvertently creating a figure more hypermasculine …

This dissertation examines the patterns and motives of state-perpetrated wartime sexual violence in Peru and El Salvador. Using a new database on sexual and other forms of political violence, it documents the prevalence and the patterns of perpetration of violence. It seeks to determine whose interests motivate the commission of sexual violence in times of war and why state armed forces commit more sexual violence in some regions and at particular moments during civil war than in others. Models that account for the progression of nation-building and the impacts of the instruments of national power -- Diplomacy, Informational, Military, and Economic effects -- are rare. This research proposes the development of such a model. Through the derivation of state indices for the operational variables of Political, Military, Economic, Social, Infrastructure, and Information, a functional form of a system of differential equations is developed to account for the interactions between the state indices and instruments of national power. This methodology is a mean-field inverse problem which solves for the coefficients of the differential equations in a data-driven manner. Publicly …
