Federal Jurisdiction In Sports Labor Disputes, Michael H. Leroy

The appropriate boundaries of federal jurisdiction are currently debated regarding hot-button issues such as military tribunals for enemy combatants, abortion, and conservative social goals. Compared to these controversies, the role of federal courts in sports labor disputes is unlikely to arouse congressional alarm. Indeed, one can hardly imagine a constituency beyond wealthy owners of professional sports teams who would seek legislation to strip federal jurisdiction in these antitrust actions. Nonetheless, this study makes a strong case that federal courts exceeded their jurisdiction in sports labor disputes. Judges who have crossed this line had understandable motivations. Animal-assisted therapy (AAT) is defined as "a goal directed intervention in which an animal, meeting specific criteria, is an integral part of the treatment process" (Nebbe, 1995, p. 40). Since its first introduction into the scientific community in the 1960s, AAT has grown in both recognition and application. This is primarily attributable to the characteristics of AAT that allow it to be appropriate for a wide range of populations. These qualities are shown to be especially effective in research with children (Menzies Inc., 2003). Recently, phages have been used as affinity reagents in quartz crystal microbalance (QCM)-based biodetection methods. The goal of this study was to isolate and characterize a Bacillus cereus group soil-phage assemblage, which was isolated from 5 grams of local topsoil, and compare its population structure to that of a similar phage assemblage that had been additionally selected by adhering to a QCM electrode. Viruses aren't well-defined in terms of 'species', therefore operational taxonomic units (OTUs) were defined by structural protein profiles from sodium dodecyl sulfate-polyacrylamide gel electrophoresis (SDS-PAGE). Cicero's famous observation-silent enim leges inter arma – from which I take my title, was not a novel insight when uttered in 52 B.C. and in any case was not said in the context of war, but of a prosecution for murder in the aftermath of the Roman riots of that era between the partisans of the populares and optimates. After reviewing data from over 600 case studies of mentoring, Stanley and Clinton (1993) concluded many people long for intensive mentoring relationships yet miss out on opportunities because they simply do not understand the true nature of mentoring. The stories of my intensive mentors and their mentors will bring greater clarity, depth, breadth, and an applied perspective to intensive mentors on Stanley and Clinton's mentorship continuum. The article explores the vibrant constitutional community that existed in St. Augustine and the province of East Florida in the final decade of Spanish control of the area. Based on relatively unexplored primary sources, it reveals a great deal of unknown information about the importance of the Constitution in Florida immediately before the territory was transferred to the United States. The article provides full description of the Constitution's promulgation in 1812 and a second promulgation of the Constitution in 1820 (something unknown in the general literature). The global Cold War is used frequently by historians to frame the context of political, economic, social, military, and geographic history of the 20th century. This is often the case in Africa as well. This thesis set out to explore U.S.- South African relations during the 1960s. After conducting research in Record Group 59 (State Department Records) of the National Archives from 1967-1973, three case studies emerged that suggested that reexamination of how historians traditionally view U.S.-South African relations during this time period is necessary. Short-finned pilot whales (Globicephala macrorhynchus) are the most frequently sighted odontocete in a long-term study in Hawaiʹi (representing 23.8% of all odontocete sightings from directed research efforts), yet little has been published on this species in Hawaiian waters. Studies elsewhere have suggested that short-finned pilot whales travel in stable mixed-sex groups composed of strongly associated individuals; however temporal analyses of social structure are lacking. To examine site fidelity, association patterns and temporal relationships, I analyzed data from 267 directed research and opportunistic encounters of short-finned pilot whales off the island of Hawai`i from 2003 through 2007. This paper analyzes the state of Middle East Track-II projects since the 1990s, the failure of the ACRS working group, and how a better understanding of security norms and public opinion can improve Track-II collaboration and produce long-term results. The purpose of this effort was to (1) provide a characterization of benthic habitats within the South Florida Ocean Measurement Facility (SFOMF) OP AREA cable corridor along deep fiber-optic cable C/S 96 from a depth of ~30 m to the reported eastern seaward terminus on the Miami Terrace (~500 m depth), and (2) identify and estimate impacts to deep benthic habitat resources from cable infrastructure in the same corridor preparatory to an Essential Fish Habitat (EFH) Assessment.

The rights of individuals to recover for dignitary torts has been withering for the past forty years, since the Supreme Court constitutionalized the state common law tort of defamation in New York Times v. Sullivan in 1964. The Court announced in that case that the First Amendment required it to impose high standards for individual defamation claims in order to protect robust speech. As that principle has taken hold, it has in effect squeezed the rights of individuals to recover for invasion of privacy and intentional infliction of emotional distress as well as defamation.
