Jefferson Sleep Disorders Center in the News
As with many other specialties, sleep medicine has been shifting toward helping clinicians obtain a better understanding of gender-specific issues in disorders and disturbances. It is easier today to appreciate the complex dynamics of biological, psychosocial, and cultural factors that define sleep patterns and problems in women. Sleep in women changes across their life spans, with three major shifts likely due to hormonal differences: at the onset of the menstrual cycle, during pregnancy, and during the perimenopausal period.

Usefulness Varies By Country: The Utility Requirement Of Patent Law In The United States, Europe And Canada, Jay Erstling, Amy M. Salmela, Justin N. Woo

The requirement that an invention have utility is one of the most fundamental of the patent laws. In the United States, for example, the concept of utility is rooted in the Constitution: Article 1, Section 8, gives Congress the power to grant exclusive rights to inventors in order “[t]o promote the progress of Science and useful Arts.” Other jurisdictions recognize utility in the form of inventions that have “industrial applicability” or are “capable of exploitation in industry,” with all of these terms and phrases generally viewed as being synonymous.
Historically, nearly every jurisdiction has excluded some type of invention from …

Down syndrome (DS) is caused by triplication of Human chromosome 21 (Hsa21) and associated with an array of deleterious phenotypes, including mental retardation, heart defects and immunodeficiency. Genome-wide expression patterns of uncultured peripheral blood cells are useful to understanding of DS-associated immune dysfunction. We used a Human Exon microarray to characterize gene expression in uncultured peripheral blood cells derived from DS individuals and age-matched controls from two age groups: neonate (N) and child (C). A total of 174 transcript clusters (gene-level) with eight located on Hsa21 in N group and 383 transcript clusters including 56 on Hsa21 in C group …

Shaken Baby Syndrome As Felony Murder In North Carolina, Derick R. Vollrath

This Article argues that the North Carolina criminal law’s treatment of Shaken Baby Syndrome should be reformed. Rather than leaving in place a legal regime that allows the state to prosecute all Shaken Baby Syndrome cases as first-degree murder, the law should distinguish between accidental and purposeful killings. If the state wishes to punish Shaken Baby Syndrome cases with special severity, the General Assembly should make this policy choice explicit. In making this argument, this Article proceeds in three parts. First, this Article examines how and why North Carolina subjects all Shaken Baby Syndrome deaths to prosecution as first-degree murder. …

The development of chemically functionalized materials, such that their physical properties can vary in response to external mechanical, chemical, or optical stimuli, offers potential applications in a wide range of fields, namely microfluidics, electronic memory devices, sensors and actuators. In particular, patterned structures built with stimuli-responsive polymer materials are attractive due to their inherent lower cost production and for building soft scaffolds that mimic closer natural bio-environments. “Dollars Versus [Equality] Rights”: Money And The Limits On Distributive Justice, Hester A. Lessard
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
The social benefit challenges under the Charter’s equality guarantee offer insight into the Supreme Court of Canada’s approach to claims for distributive justice. In most of these cases, the financial costs to government of rights recognition play a role in the analysis. A survey of the outcomes of these cases and the “dollars” at stake reveals a “follow the money” pattern. In all cases in which the claim that the government regime creates an inequality was successful, the cost to the public purse of finding in favour of the equality claimant was characterized by the Court as low or inexpensive. …

Countries after countries are adopting a controversial regulatory system of linking the market approval for pharmaceuticals to the status of potentially blocking patents as part of their bilateral and multilateral trade agreement package with the United States. Surprisingly, China took up pharmaceutical patent linkage in the absence of any treaty obligations and became the first country to adopt this regulatory regime outside of North America, despite the presence of a flourishing generics pharmaceutical industry and its developing country status. For Sale. Patents. Never Used: Gaps In The Tax Code For Patent Sales, 11 J. Marshall Rev. Intell. Prop. L. 859 (2012), Khurram Naik
UIC Review of Intellectual Property Law
Patent sales are an underappreciated means of monetizing patents. Recent blockbuster patent sales indicate heightened demand for patent acquisitions. There is evidence that such patent sales transfer patents to parties more skilled in patent enforcement, reducing litigation. Patent sales also move capital to innovators, which enhance incentives to innovate. But crucially, C corporations do not benefit from advantaged tax treatment. Efforts by other nations to encourage patent use and sales by providing “patent box” preferential tax regimes may provide some guidance for remedying this gap in the tax code.

Ecosystem health is a desired endpoint of environmental management and should be a primary design goal for ecological engineering. This paper describes ecosystem health as a comprehensive, multiscale, measure of system vigor, organization and resilience. Ecosystem health is thus closely linked to the idea of sustainability,whichimplies theabilityofthesystemtomaintainits structure(organization)andfunction (vigor) over time in the face of external stress (resilience). To be truly successful, ecological engineering should pursue the broader goal of designing healthy ecosystems, which may be novel assemblages of species that perform desired functions and produce a range of valuable ecosystem services. Sutherlandia frutescens (L.) R. Br (Fabaceae) is a multipurpose medicinal plant with diverse biological activities, and has been widely used for the treatment of cancer, AIDS, diabetes, and infectious diseases in southern Africa. The primary goal of this study was to investigate the chemical constituents of S. frutescens and develop an analytical method to analyze this plant and the dietary supplements derived from this plant. The dissertation is composed of six chapters. Chapter 1 introduces the general background of S. frutescens, including traditional uses and chemical and biological studies on the plant. There are countless occasions where marginalized groups bear witness to language-based discriminatory practices. Language, as defined here, is a species of symbolism. After reviewing the sociological literature, the term "microaggressions" appears to best describe the phenomena in its everyday occurrences. Microaggressions are "the brief and commonplace daily verbal, behavioral, and environmental indignities, whether intentional or unintentional, that communicate hostile, derogatory, or negative racial, gender, sexual-orientation, and religious slights and insults to the target person or group" (Sue, Capodilupo, et al., 2007; Sue, 2010). Sue classifies microaggressions into three forms: microassaults, microinsults, microinvalidations. The purpose of the project was tri-fold. By …

This Article analyzes how PPACA constitutes framework legislation that complies with global health law norms protecting a right to health in its approach to the reduction of health care disparities for racial and ethnic minorities in the United States. Part I identifies the global health laws that impose a duty on the United States to eliminate health disparities for people of color. Part II analyzes the legislative framework that PPACA creates to protect the right to health and eliminate health care disparities. Climate change is quickly transforming habitats. Species in affected regions are facing extinction as they are unable to migrate to suitable environments. This Note discusses assisted migration, the intentional human-assisted movement of imperiled species to suitable habitats outside of their historic range, as an important—though controversial—conservation tool. There are, however, no comprehensive assisted migration regulations in the United States. This Note argues that the U.S. Fish & Wildlife Service (FWS) should be the agency to issue regulations regarding assisted migration because FWS already has broad authority under the Endangered Species Act to conserve wildlife. Switchgrass (Panicum virgatum) is growing in recognition as a potential source for biomass. In order to use switchgrass optimally as a crop for biofuel production potential pests need to be detected and studied. Currently, one pest being studied is the stem-boring larva of the moth Blastobasis repartella. The objective of this experiment was to compare effects of larval feeding on rhizome buds for two cultivars of switchgrass, and to observe and document feeding behavior of the larva. The two cultivars of switchgrass used were Pathfinder (PTH), a lowland variety, and Sunburst (SBS), an upland variety. Six, 15-cm2 samples of rhizome …

Heterotaxy is a disease of abnormal left-right (LR) body patterning associated with congenital heart disease that has very poor outcomes. Despite advances in surgical management, the two most severe forms of heterotaxy, right and left atrial isomerism, have a 29% and 64% 5-year survival rate, respectively. Through copy number variant analysis of heterotaxy patients, GALNT11 was recently identified as a novel gene important in human LR development. The development of an autologous tissue engineered vascular graft (TEVG) holds great promise for improving outcomes in congenital heart surgery. The first clinical trial showed that this approach is safe and effective but that the primary mode of failure is stenosis. In a C57BL/6 mouse model of unseeded TEVGs implanted as inferior vena cava interposition grafts, neovessels form in 2 weeks and patent grafts show endothelial and smooth muscle cell (SMC) layers, but occluded grafts show accumulation of SMCs. This suggests stenosis results from abnormal SMC in-growth in the neointima. Studies on fibrosis have shown that resident endothelial cells (EC) …

This study tested the hypothesis that preterm infants who had a blood gas derangement on at least 2 of the first 3 postnatal days are at increased risk for more severe retinopathy of prematurity (ROP). 1,042 infants born before 28 weeks gestational age (GA) were included. Females continue to be significantly outnumbered by their male counterparts in the academic pipeline at the senior ranks. Confounding the problem is the inadequacy of tools used for measurement and analysis of it. A Relative Rate Index (RRI) is a better tool for measuring gender disparities of academic systems than calculating percentages of females in academia. An RRI determines the junctures and scales at which females fall out of the academic track. The RRIs for academic medicine departments at Yale were created using institutional records. Calculations indicate that the fallout for females in academia occurs from assistant to associate professor …
