Reliability And Relevance As The Touchstones For Admissibility Of Evidence In Criminal Proceedings: Muhammad Bin Kadar V Pp [2011] 3 Slr 1205 [Case Note], Siyuan Chen
Research Collection Yong Pung How School Of Law
The Court of Appeal in Muhammad bin Kadar v PP [2011] 3 SLR 1205 (“Kadar”) formally recognised the judicial discretion to exclude evidence as an integral part of the law on criminal evidence in Singapore. This discretion, the court held, would help ensure that all evidence coming before the court would be as reliable as possible. While this commentary agrees that the foundational basis for the exclusionary discretion doctrine is desirable, it suggests that there are difficulties with the application of the doctrine. An alternative approach that works around the difficulties is canvassed for consideration.

Homeless Encampments On Public Right-Of-Way: A Planning And Best Practices Guide, Ellen M. Bassett, Andrée Tremoulet, Allison Moe
Urban Studies and Planning Faculty Publications and Presentations
Homelessness is a societal problem. Its causes are complex, and its effects have implications for many public agencies, including those not directly responsible for providing assistance to homeless individuals. Because homeless people constantly seek safe shelter and refuges, agencies that own public land and buildings sometimes find themselves in contact with this population. Nationally, the impact of homelessness appears to represent a substantial operational challenge for state transportation agencies and Departments of Transportation (DOTs). Two online surveys?one of state DOT managers and supervisors and the other of public sector managers of highway rest areas (DOT and other state agency staff)?conducted …

Journal of Rural Social Sciences
The development of an environmental identity is viewed by many as essential if we are to reorganize our societies toward ecological sustainability (Bell 2009; Clayton and Opotow 2003; Thomashow 2002). That, along with an eye toward environmental justice, was the major impetus for our graduate seminar in applied environmental sociology to partner with an elementary school in our small city of Hammond, LA, during the spring semester of 2010. After conducting focus groups with a group of fourth to sixth grade students and holding decision-making discussions with them for this community-based research (CBR) project, we went about two projects – …

Catalyst: A Social Justice Forum
Newly emerging, transitional societies –– that is, societies that traded dictatorial or authoritarian rule for some form of open or liberal polity –– face at least three interdependent problems of what is called in legal scholarship and social science “transitional justice”: the first is how (if at all) to hold the old regime’s autocratic, often violence-laden leadership responsible for its wrongdoings while in power; the second is what (if anything) to do with thousands upon thousands of ordinary folk whose participation in, or compliance with, the old regime helped legitimate and thus perpetuate the wrongdoing; and the third task how …

Navajo Peacemaking And Māori Restorative Justice: A Comparison Of Process And Procedure, Alethia Z. Fenney
Regis University Student Publications (comprehensive collection)
Due to the failure of some crime control approaches in law enforcement alternatives are being examined to determine their applicability in today's society. One of the approaches gaining criminological attention is "Navajo Peacemaking". another similar style of crime control is the Māori restorative justice process used in New Zealand. The purposed of this research study is to examine and compare these processes to determine their applicability as crime prevention tools in U.S. towns and cities. Walter Miller's Focal Concerns Theory was used to address the difference in motivation between mainstream culture and its subcultures. The results from this study demonstrated …

Using Student Response System (Srs) To Reduce Off-Task Behavior Of Students With Behavior Problems, Mary Johnson
Using Student Response System (Srs) To Reduce Off-Task Behavior Of Students With Behavior Problems, Mary Johnson
Theses and Dissertations
The purpose of the present study was to examine the effect of clickers on decreasing off-task behavior of students with behavior problems in Language and math classes. A total of five students and one special education teacher in a self-contained classroom participated in the study. A single-subject research design with ABAB phases was used. An online program called "Class Dojo" was used to record study behavior with a chart immediately to show their on-task and off-task behavior. During the baseline, student behavior was recorded in both Language and math classes for 5 days. During the intervention phase, each participating student …
