Constitutionalizing Immigration Law: The Vital Role Of Judicial Discretion In The Removal Of Lawful Permanent Residents, Maritza I. Reyes
Constitutionalizing Immigration Law: The Vital Role Of Judicial Discretion In The Removal Of Lawful Permanent Residents, Maritza I. Reyes
Journal Publications
For decades, scholars and advocates criticized the harsh, mandatory nature of the Federal Sentencing Guidelines. They argued that federal district court judges should have discretion to authorize a punishment that fits the facts and circumstances of the crime and the defendant. Similarly, immigration scholars and advocates criticize the harsh laws that categorically remove lawful permanent residents, even after minor crimes, from the United States. In 2005, in United States v. Booker, the Supreme Court "constitutionalized" the Sentencing Guidelines by rendering them advisory, and returning judicial discretion to federal judges. This Article argues that the similar constitutional, historical, theoretical, societal, and …

Electronic Discovery And The Constitution: Inaccessible Justice, Jennifer M. Smith

Computers are the cynosure of American society. As a result, most information is stored electronically and only a small amount of information ever becomes a paper document. This explosion of electronically stored information has affected every aspect of society, including the court system. Litigation is drastically different than a few years ago due to this onset of electronically stored information. The discovery of electronically stored information in litigation has become known as electronic discovery. For many, electronic discovery is expensive and complicated, and thus, litigants are settling frivolous cases to avoid the costs and complexities of engaging in discovery to …

The Strong Arm Of The Law Is Weak: How The Tvpa Fails To Effectively Assist Victims Of The Sex Trade, Cheryl Page

Acts that occur in the underbelly of our global community can be shocking to many, but they occur every night and day right in our own neighborhoods. Sex trafficking, a derivative of human trafficking, is occurring in epidemic proportions on a global scale while the victims are suffering in silence. Sexual exploitation has taken the media forefront in recent years.' Much legislation has been passed to try to curb this illegal marketing of innocent women and children. Laws in various countries have been evaluated, studied, and researched and lead to the sad conclusion that these laws alone are insufficient in …

The Gendered Aspects Of Social Justice Work And Occupational Segregation In The Legal Academy: A Review Of 2003, Barbara Cox
The Gendered Aspects Of Social Justice Work And Occupational Segregation In The Legal Academy: A Review Of 2003, Barbara Cox
Faculty Scholarship
My service as chair of the Section on Women in Legal Education ("Section") was rather unusual. I started serving on the Executive Committee in 1999 and became Chair-Elect in 2001. Veryl Miles (Catholic) was Chair for 2001 but became Deputy Director of the Association of American Law Schools (AALS) in August that year, so I served out her term as Interim Chair from August 1 to December 31, 2001. Then I became Chair-Elect again in 2002 (because I was on sabbatical that year and could not serve as Chair) and Vernellia Randall agreed to step in as Chair. I served …
A Prospective Examination Of Posttraumatic Stress And Alcohol Use Disorders Among Returning Veterans, Matthew D. Pierce
A Prospective Examination Of Posttraumatic Stress And Alcohol Use Disorders Among Returning Veterans, Matthew D. Pierce
Open Access Master's Theses
The traumatic effects of combat on psychological functioning have long been recognized. Operation Iraqi Freedom and Operation Enduring Freedom have amplified the need for a better understanding of the association between posttraumatic stress disorder (PTSD) and alcohol use disorders (AUD). We prospectively examined PTSD and AUD symptoms and investigated relations between combat exposure (CE) and relationship status (RS) on these outcomes. We hypothesized that CE would have a main effect on both PTSD and AUD symptoms while RS would have a main effect on AUD symptoms but not PTSD. We also examined CE X RS interactions as well as hypothesized …

Teenager Students' Perception Of Safety In Relation To Non-Political Graffiti Vandalism, Outdoor Lighting And Situational Crime Prevention Variables In Tehran / Saeedeh Rezaee, Saeedeh Rezaee
Student Works (2010-2019)
There are several challenges to the implementation of crime prevention policies for effective and efficient crime prevention programs for a long term sustainable solution to the threats posed by crime. Situational crime prevention (SCP) strategy is an innovative method of preventing crime and has received a stronger empirical support than any other strategy in recent years. It has been recognised as a sustainable response to crime issues, but has not been adapted in Iran until now. Rapid and uncontrolled urbanisation in many developing countries, including Iran, is having a fundamental social and environmental consequence in development of the cities. Tehran …

Studies On Forensically Important Entomological Specimens Recovered From Monkey Carrion Exposed To Different Ecological Habitats / Chen Chee Dhang, Chee Dhang Chen
Student Works (2010-2019)
Little information was available on the forensically important specimens collected from carcasses in indoor and different ecological habitats in Malaysia. This study was attempted to determine the arthropod succession on carcasses (1) placed in different ecological habitats, such as lowland forested area, coastal area and montane forested area; (2) placed in indoor and outdoor conditions; and (3) carcasses being incinerated, submerged in freshwater river, and treated with insecticide and its effect on post mortem interval (PMI) estimation. Carcasses placed outdoor and indoor underwent 5 decomposition stages namely, fresh, bloating, decay, advanced decay and remains/dry. Decomposition duration on carcasses placed in …

Constructing The Threat And The Role Of The Expert Witness: A Response To Aziz Rana's Who Decides On Security?, Wadie E. Said
Publications
Aziz Rana's article presents clearly the overlooked but crucial question of "Who Decides on Security?" Namely, is determining who or what groups constitute a threat something that we are capable of making ourselves, or must we necessarily cede that authority to those in power-who supposedly have both the access to knowledge and the ability to understand it-to protect us from threats we cannot perceive? Using Rana's historical analysis as a framework, this Article builds on his thesis to show how the wide latitude granted to the conclusions of the Executive Branch's national security specialists in political matters has migrated into …

Internal Whistle-Blowing Intentions: A Study Of Demographic And Individual Factors, Syahrul Ahmad, George Smith, Zubaidah Ismail
Research outputs 2012
Internal auditors hold a unique position in their organizations to prevent, deter, and detect corporate wrongdoings. However, the role of this profession in investigating their ethical decision-making behaviors towards internal whistle-blowing intentions has been very often neglected. Furthermore, although extensive researches have been undertaken on the issue of whistle blowing globally, empirical studies on this area are still scarce in Malaysia. This paper examines internal whistle-blowing intentions among internal auditors in Malaysia by utilizing three independent vignettes. A mail survey was conducted to investigate demographic and individual factors that could influence internal auditors’ ethical decision-making processes. The likelihood for internal …
Caseload Allocation And Special Judicial Skills: Finding The 'Right Judge', Kathy Mack, Sharyn Roach Anleu, Anne Wallace
Caseload Allocation And Special Judicial Skills: Finding The 'Right Judge', Kathy Mack, Sharyn Roach Anleu, Anne Wallace
Research outputs 2012
Australian courts, as with those in most common law systems, value judicial officers who are generalists. Appointment to a court indicates that the appointee is capable of dealing impartially with all types of cases that come before it. However, caseload allocation processes within courts also recognize and value different skills or expertise that may be applied to particular types of cases or to particular judicial tasks. Our research investigates ways magistrates courts in Australia (first instance courts of general criminal and civil jurisdiction) manage caseload allocation processes to match magistrates’ skills and abilities to specific work demands within their general …

Graffiti Offenders' Patterns Of Desistance From, And Persistence In, Crime: New Insights Into Reducing Recidivist Offending, Myra Taylor, Umneea Khan
Research outputs 2012
While graffiti is a gateway crime towards more serious criminal offending, little is known about graffitists' patterns of desistance from, and persistence in, crime. This paper addresses this knowledge shortfall through an examination of the Western Australian Police Information Management System (IMS) database for three age-groups (i.e. preteens, adolescents, adults) and three categories of graffiti offenders (Early Desisters, Limited Persisters, Chronic Persisters). Descriptive and chi-squared statistics reveal that: i) nearly three-quarters of all of the 667 preteen, adolescent and adult graffiti offenders desisted from further offending after their first or second contact with police; ii) the mainly adolescent cohort of …

Challenging The Habeas Process Rather Than The Result, Justin F. Marceau
Challenging The Habeas Process Rather Than The Result, Justin F. Marceau
Washington and Lee Law Review
Habeas scholarship has repeatedly assessed whether the Antiterrorism and Effective Death Penalty Act’s (AEDPA’s) limitations on federal habeas relief were as severe in practice as they appeared to be on paper. By analyzing recent doctrinal shifts—particularly focusing on two Supreme Court decisions from this Term—and substantial new empirical data, this Article acknowledges that AEDPA’s bite has reached substantial proportions, in many ways exceeding the initial concerns and hype surrounding the legislation. More importantly, after acknowledging that federal habeas relief from state court convictions has become “microscopically” rare, this Article considers what the rarity of relief ought to mean as a …

Is Color Blind Justice Also Culturally Blind? The Cultural Blindness In Justice, Shiv Narayan Persaud
Is Color Blind Justice Also Culturally Blind? The Cultural Blindness In Justice, Shiv Narayan Persaud
Journal Publications
As diverse ethnic groups continue to experience numeric growth and societal grounding in America, their advocacies for culturally competent representation within the legal system cannot be ignored or underplayed. Undoubtedly, some professions such as mental and physical health, and their related sectors, have developed and continue to integrate cultural competencies into their respective practices. Others such as the legal profession seem to lag in their advocacies and promotion of culturally competent practices.
In the criminal justice system, where discretionary legal decision-making authority is commonplace and may grossly affect the civil liberties of the citizenry, a paucity of standards requiring cultural …

Congressional Inquiry And The Federal Criminal Law, J. Richard Broughton
Congressional Inquiry And The Federal Criminal Law, J. Richard Broughton
University of Richmond Law Review
This article supports constraint of the modern federal criminal law regime through greater attention to, and use of, congressional investigation and over =sight powers. Through an analysis of the 2009 and 2010 United States House of Representatives hearings on over-criminalization, this article asserts that Congress has political and constitutional incentives to use its investigation and oversight powers to address these problems. Conventional wisdom asserts that political disincentives to reduce the federal criminal law regime and weaknesses in investigative and oversight powers limit congressional effectiveness.

Jailing The Johns: The Issue Of Demand In Sex Trafficking, Cheryl Page

Slavery is an institution that many people believe no longer exists. Slavery has not ended and there are millions of innocent victims caught in this system. This is not the slavery that was fought over in the U.S. Civil War. This form of slavery is not very different from colonial slavery-innocent people caught and trapped in this web of sex for service. Today, this form of slavery is better known as human trafficking. This is a brutal, heinous, and damaging situation that many women and children find themselves in as unwilling participants.' Most victims have little to no hope of …
