Changing Tactics: Rehabilitating Canadian Justice For Traumatized Veterans, J. Jason Samson Jan 2012

Changing Tactics: Rehabilitating Canadian Justice For Traumatized Veterans, J. Jason Samson

LLM Theses

This thesis examines how military members and veterans with Operational Stress Injuries are treated by Canadian justice systems. It suggests a correlation between mental injuries sustained on operations by military personnel and propensities for military and societal misconduct. By comparing civilian and military processes with American justice counterparts, a plan to improve the existing Canadian legal landscape is proposed. Using an analysis of the underlying philosophy and purpose of military justice, a problem solving diversionary court is recommended, along with legislative and policy amendments. The use of a consent-based "Treatment Standing Court Martial" would place military justice officials parallel to …

The First Father: Perspectives On The President's Fatherhood Initiative, Jessica Dixon Weaver Jan 2012

The First Father: Perspectives On The President's Fatherhood Initiative, Jessica Dixon Weaver

Faculty Journal Articles and Book Chapters

This short article presents an analysis of the thirteen-year-old President's Fatherhood Initiative utilized by the executive branch to tackle the problem of absent fathers in America. It argues that this social policy attempts to recapture the economic incentives central to the controversial Moynihan Report of 1965, emphasizing patriarchal and classist solutions to America's family crisis. The programs instituted by the Fatherhood Initiative stigmatize black and brown fathers and fail to address underlying government policy issues that impact their ability to be present and financially supportive in their children's lives. The programs still emphasize the marriage dyad as a cure-all rather …

The Missing Jury: The Neglected Role Of Juries In Eighth Amendment Punishments Clause Determinations, Meghan J. Ryan Jan 2012

The Missing Jury: The Neglected Role Of Juries In Eighth Amendment Punishments Clause Determinations, Meghan J. Ryan

Faculty Journal Articles and Book Chapters

A recent study of death penalty cases has revealed that judges, who are ordinarily thought of as the guardians of criminal defendants’ constitutional rights, are more likely to impose harsher punishments than jurors. This may be unsettling in its own right, but it is especially concerning because judges are the individuals charged with determining whether punishments are unconstitutionally cruel and unusual under the Eighth Amendment, and these determinations are supposed to be based on “the evolving standards of decency that mark the progress of a maturing society.” The study suggests that judges are out of step with society’s moral norms, …

Routine Screening For Intimate Partner Violence In Public Health Care Settings In Kenya: An Assessment Of Acceptability, Chi-Chi Undie, Catherine Maternowska, Margaret Mak'anyengo, Harriet Birungi, Jill Keesbury, Ian Askew Jan 2012

Routine Screening For Intimate Partner Violence In Public Health Care Settings In Kenya: An Assessment Of Acceptability, Chi-Chi Undie, Catherine Maternowska, Margaret Mak'anyengo, Harriet Birungi, Jill Keesbury, Ian Askew

Reproductive Health

Most research on intimate-partner violence (IPV) screening has been conducted in developed countries, so this study in Kenya serves as one of the first in a developing-country context to assess the acceptability of IPV screening from the perspective of providers and clients in public healthcare settings. The study conducted in Kenyatta National Hospital in Nairobi found that routine screening for IPV is acceptable to providers and clients at that location. However, to be effective as a routine service, the system needs to be reinforced in specific ways, including greater assurance of confidentiality, more positive provider attitudes, and higher respect for …

A Review And Evaluation Of Multi-Sectoral Response Services ('One-Stop Centers') For Gender-Based Violence In Kenya And Zambia, Jill Keesbury, Washington Onyango-Ouma, Chi-Chi Undie, Catherine Maternowska, Frederick Mugisha, Emmy Kageha, Ian Askew

Reproductive Health

An increasingly popular strategy for addressing sexual gender based violence (SGBV) is through the establishment of one-stop centers‘ (OSCs), which provide integrated, multi-disciplinary services in a single physical location. The goals of this assessment were two-fold: first, to assess the effectiveness of different OSC models in terms of health and legal outcomes for survivors, and the cost-effectiveness of these models; and second, to identify lessons learned in OSC implementation with recommendations for both start-up and scale-up. Findings from this study offer the first form of systematic evidence on the effectiveness of OSCs, which can guide national-level policymakers and program managers …

Rape Sentencing Study: A Review Of Statutory Sentencing Provisions For Rape, Defilement, And Sexual Assault In East, Central, And Southern Africa, Jill Thompson, Felly Nkweto Simmonds

Reproductive Health

Several countries in East, Central and Southern Africa have responded to the problem of violence against women and children by amending outdated criminal laws relating to rape and other forms of sexual and gender-based violence. This legislative review is Part I of a two-part desk review on sentencing of sexual offences and minimum sentences in the African and international context. It should be read in conjunction with Part II of the Rape Sentencing Study. The purpose of this review is to: 1) document the sentencing reforms made in selected countries in the East, Central and Southern African region since 1998; …

The Early Demise Of Early Release, Cecelia Klingele Jan 2012

The Early Demise Of Early Release, Cecelia Klingele

West Virginia Law Review

Reversing the tough-on-crime policies that have defined American criminal justice for the past two decades, cash-strapped states across the nation have begun reducing the number of people they confine in prisons and jails. In their efforts to reduce correctional populations, numerous states have passed laws that allow parole boards, prison officials, or judges to shorten the sentences of people already serving time in custody. These so-called "early release" laws have proven highly controversial and in at least three states have been repealed outright. In others, they remain on the books but have provided less savings than anticipated because of the …

The Symbiosis Between Criminal Codes And The Common Law, Stanley Yeo Jan 2012

The Symbiosis Between Criminal Codes And The Common Law, Stanley Yeo

National Law School of India Review

This article identifies the advantages which flow from judicial examination of the inter-relationship between criminal code provisions and common law pronouncements on criminal law. It outlines when judges interpreting and applying code provisions may be permitted to refer to common law pronouncements, and when common law judges might benefit from a study of code provisions. Australian, Canadian and Indian cases are used to illustrate the propositions that can be obtained from these courses.

Trans-Atlantic Circulation Of Black Tropes: Èsù And The West African Griot As Poetic References For Liberation In Cultures Of The African Diaspora, Jean-Baptiste Meunier Jan 2012

Trans-Atlantic Circulation Of Black Tropes: Èsù And The West African Griot As Poetic References For Liberation In Cultures Of The African Diaspora, Jean-Baptiste Meunier

LSU Doctoral Dissertations

My dissertation, under the direction of Dr Pius Ngandu Nkashama explores the spread of African rhetorical tropes in the Atlantic world. Building on Henry Louis Gates theory of Signifying, I use the West African God of fate Èsù and the West African cultural figure of the griot as cultural referents for the persistence of African tropes in the New World and their subsequent dissemination throughout the Atlantic world. Analyzing those two West African referents and their connections to New World cultures such as Afro-Brazilian capoeira angola, hip hop and African-American poetry, I attempt to demonstrate the centrality of the trope …

Does Need For Cognition Moderate The Relationship Between Eyewitness Age And Perceived Credibility?, Anna E. Pittman Jan 2012

Does Need For Cognition Moderate The Relationship Between Eyewitness Age And Perceived Credibility?, Anna E. Pittman

UNF Graduate Theses and Dissertations

The relationship between age and perceived credibility was examined, particularly whether or not middle-aged witnesses were perceived as more credible than older eyewitnesses. Additionally, I was interested in whether or not the relationship between age and credibility was moderated by need for cognition. Participants read a trial transcript about a child pedestrian-car accident wherein a defendant was charged with manslaughter. The sole eyewitness, either a 49 or 79 year-old male, testified that the child hit his head on a rock upon stepping off the curb before being struck by the defendant’s vehicle. Transcripts included direct and cross-examination with half accompanied …

Cultural Biases In The Weschler Memory Scale Iii (Wms-Iii), Adam David Less Jan 2012

Cultural Biases In The Weschler Memory Scale Iii (Wms-Iii), Adam David Less

UNF Graduate Theses and Dissertations

The Wechsler Memory Scale –iii is the newest version of a six-decade old neuropsychological inventory. Since its conception, the Wechsler Memory Scale has been highly utilized by practitioners to accurately assess various memory functions in adult subjects. Revisions made within this inventory include the Faces I subtest, a facial recognition scale, which was added in order to strengthen the instrument’s accuracy at measuring episodic memory. Facial recognition, both cross-race and within-race, has been researched extensively and consistent biases have been found between race of test taker and cross-racial identification. Theories of exposure/contextual interaction (environment) and biological foundations have been the …

Arizona, Immigration, And Latinos: The Epistemology Of Whiteness, The Geography Of Race, Interest Convergence, And The View From The Perspective Of Critical Theory, George A. Martinez

Faculty Journal Articles and Book Chapters

In this article, the author analyzes a scheme of laws in Arizona regarding immigration and Latinos by using the powerful tools of contemporary critical theory, which have been especially developed to analyze issues of race such as those presented in the laws at issue. As discussed below, critical theory, as applied to Arizona, reveals (1) that the newly enacted scheme of laws reflects an epistemology of whiteness and operates to transform Arizona into a white geographical landscape; (2) that the outlawing of ethnic studies in Arizona is a corollary to the establishment of a white geographical space in Arizona; (3) …
