This course introduces students to the historical development and emergence of the human rights movement, particularly following World War II and during the consolidating period of the 1970s. This period is often labeled the golden decade of human rights, as the movement that commenced at the end of World War II was consolidated through the adoption of two crucial international instruments. Furthermore, human rights advocacy, which works through victims’ testimony and evidence-based reporting on violations, began to take center stage, departing from the basic rules of humanitarian engagement that include impartiality, neutrality, and independence.

Even when a prisoner has overcome all of AEDPA’s requirements and the Supreme Court’s equitable bars to relief, the writ of habeas corpus may issue only as “law and justice” require. The Court has recognized in recent Terms that the habeas statute thus confers on courts discretion to deny relief notwithstanding the satisfactions of the statutory and equitable preconditions. This discretion, the Court has said, is not boundless. A judge may grant the writ only after considering the principles of finality and federalism. Whatever else that includes, the Supreme Court has made clear that a judge must apply Brecht’s …

Content Analysis Of K-12 Behavioral Threat Assessment And Management (Btam) Guides: Implementing Responses To Exogenous Shocks, Sarah Schappert
Criminology and Criminal Justice Theses and Dissertations
What information about teams, case management, reporting, information sharing, and training guidance are included in publicly available K-12 Behavioral Threat Assessment and Management (BTAM) guides? How does this information differ between K-12 BTAM guides created proactively versus those created reactively in response to an exogenous shock? In this thesis, I explore these questions by analyzing 30 publicly available K-12 BTAM guides. This study contributes to the sparse criminal justice literature on the use of BTAM guides, notably increasing the literature on BTAM responses to exogenous shocks. Findings indicate that although general information is usually included, specific details are often lacking. …

Latin American Countries (“LAMC”) maintain a distinct set of diplomatic practices that differ from those commonly observed around the world. One observable distinction is the doctrine of diplomatic asylum, which allows political refugees of other countries to seek asylum in foreign embassies. The concept of diplomatic asylum is seldom recognized outside of the Latin American region, leaving LAMC as one of the few that recognize and use this locally recognized right. Various cases have arisen over the years involving disputes between the countries receiving the refugee (receiving state) and the country that wants the refugee in their custody (territorial state). …

Compassionate Causation In The Domestic Violence Survivors Justice Act, Zoë Lewis Ewing

This Comment evaluates the implementation of the Domestic Violence Survivors Justice Act (DVSJA), a New York law passed in 2019 to provide shortened sentencing ranges for domestic violence survivors convicted of crimes. It identifies an inconsistency in sentencing courts’ application of the law’s causation standard, which requires that a petitioner’s experience of domestic violence be a “significant contributing factor” to their criminal conduct. Some courts interpret the prong narrowly, while others apply a broad causation standard. This Comment argues that courts should opt for the latter approach and consider causation in the DVSJA satisfied if domestic violence was “sufficiently significant …

Libraries And Human Trafficking: A Study Of New Jersey’S Public And Academic Library Engagement In Anti-Trafficking Efforts, Christabelle Robinson, Daniela Peterka-Benton

This study, conducted through the Global Center on Human Trafficking, explores the underexamined role of public and academic libraries in addressing human trafficking across the state of New Jersey. Despite limited formal guidance on their role in anti-trafficking efforts, libraries are increasingly acting as informal hubs for access to resources, education, and social service referrals. Through a statewide survey and qualitative responses from library professionals, this research examines how libraries are currently engaging in training, social work partnerships, programming, and public awareness initiatives. Findings reveal that while only a small percentage of libraries have received formal training, there is widespread …

Sexism and gender-stereotypes have long impacted societal and criminal justice system responses to victims of violent crime. Scholarly research has demonstrated that sexism is complex and takes varying forms (i.e., ambivalent, hostile, institutional, internalized and more). Of particular interest here is benevolent sexism, which is broadly defined as holding attitudes towards women that are seemingly positive, but which ultimately increase the patronization of women and reinforce their subordination. Such examples include the cultural customs of chivalry or the act of maintaining sexist attitudes with “good intentions.” Drawing on media case studies and scholarly literature, I examine the influence of benevolent …

Marijuana legalization has become prevalent in the United States, sparking discussion about the positive and negative effects of marijuana and marijuana legalization. Although the legality of marijuana has varied in the past, many states are passing legislation that attempts to address the negative and positive effects of legalization and form policies that keep communities safe. Current research clearly indicates harmful effects of marijuana use, including driving under the influence, undesirable later-life circumstances, cognitive deficits, mental health issues, and developmental issues resulting from marijuana use during pregnancy. Racial literacy is widespread in America, and as adult literacy educators our mission is to address illiteracy in all its manifestations. We teach literacies in reading and writing, numeracy, computer, speaking, listening, visual, health, and media, each vital to making sense of our world and functioning effectively in it. Racial literacy is just as vital and should be taught as well. I argue that racial literacy is critical to a meaningful civic and community life. Decolonizing re-entry programs require rethinking traditional approaches in supporting formerly incarcerated individuals and challenging colonial and deficit frameworks embedded in the criminal legal system, which often has an exclusive focus on punishment. This article names the risk factors and systemic barriers faced by equity-denied individuals during reintegration with a focus on the Canadian context. Two community-led programs in Ontario are highlighted as innovative case studies for effectively supporting reintegration of individuals exiting carceral institutions. Key characteristics of these programs which are offered by the Youth Association for Academics, Athletics, and Character Education (YAAACE) and Walls to Bridges (W2B) are outlined. …

Power, especially in the court system, is a potent determinant of intergroup relationships. Blind justice being only an ideal, public opinion can influence whether harm to low power groups is considered criminal and should be prosecuted. Our experiments investigated the impact of social dominance orientation (SDO) on the perceived appropriateness of punishment for harm to subordinate group members by dominant group members. Further, we examined the moderating role of a remorseful apology. We argue that perpetrators who do not show remorse towards their less powerful victim might be judged less harshly by those scoring high in SDO. Apologizing for the …

The federal courts are notoriously hesitant to modify their procedures and policies. Much of this “small c” conservatism is driven by a concern that their rules be “trans-substantive” and suited to a wide range of circumstances. For years, they stubbornly resisted allowing remote proceedings and similar uses of technology in the courtroom because of concerns that permitting them could affect the quality of lawyering and decision-making, compromise the safety of jurors and witnesses, and diminish the public’s perception of the courts. The COVID-19 pandemic abruptly changed this, forcing judges to alter radically the way they conducted proceedings.

Psychopathy has traditionally been studied using Hare's Psychopathy Checklist-Revised (PCL-R) but self-report measures like the Psychopathic Personality Inventory-Revised (PPI-R) have gained popularity due to comparative ease, speed of administration, and its broader applicability to the general population. However, the validity of the PPI-R across cultures has produced mixed results, particularly in non-Western and non-English speaking participants. This study examined racial/ethnic and gender differences in the PPI-R in a diverse sample of 536 college students. The internal and external validity of the PPI-R was good. The PPI-R correlated with the Triarchic Psychopathy Measure (TriPM), as well as trait anxiety, and empathy …
