Bargained Justice: Plea-Bargaining’S Innocence Problem And The Brady Safety-Valve, Lucian E. Dervan
Bargained Justice: Plea-Bargaining’S Innocence Problem And The Brady Safety-Valve, Lucian E. Dervan
Utah Law Review
If any number of attorneys were asked in 2004 whether Lea Fastow’s plea bargain in the Enron case was constitutional, the majority would respond with a simple word—Brady. Yet while the 1970 Supreme Court decision Brady v. United States authorized plea-bargaining as a form of American justice, the case also contained a vital caveat that has been overlooked by scholars, practitioners, and courts for almost forty years. Brady contains a safety-valve that caps the amount of pressure that may be asserted against defendants by prohibiting prosecutors from offering incentives in return for guilty pleas that are so coercive as to …
Recantations Reconsidered: A New Framework For Righting Wrongful Convictions, Adam Heder, Michael Goldsmith
Recantations Reconsidered: A New Framework For Righting Wrongful Convictions, Adam Heder, Michael Goldsmith
Utah Law Review
Recanting witnesses face both judicial skepticism and complex procedural hurdles. This Article recognizes the validity of this skepticism. It also recognizes the valid judicial interest in preserving the finality of judgments. Nevertheless, just because most recantations lack credibility does not mean they all lack credibility. Thus courts, legislatures, and jurists alike have a common interest in ensuring that standards are in place that will precisely filter the reliable from the unreliable. This Article has identified a number of structural disadvantages facing recantations, though the larger problem remains in the dogmatic skepticism perpetuated by so many courts. Instead of relying on …
Juror Privacy In The Sixth Amendment Balance, Melanie D. Wilson
Juror Privacy In The Sixth Amendment Balance, Melanie D. Wilson
Utah Law Review
Jurors are a crucial, indeed constitutional, component in our criminal justice system. In modern times, despite their importance, jurors have been asked to reveal intensely private information during voir dire. Litigants and trial judges have allowed such probing questions under the guise of protecting the accused’s rights to a fair and public trial and to an impartial jury. This Article has demonstrated that giving prospective jurors greater privacy protection in the way of their own voir dire challenge better serves the accused’s rights without jeopardizing the interests of the media and public to observe these public proceedings. The added protection …
Performing Arts And Community Exchange (Pace) And The Fulfillment Of The Ignatian Educational Promise, Janna Goodwin, Amie Dowling
Performing Arts And Community Exchange (Pace) And The Fulfillment Of The Ignatian Educational Promise, Janna Goodwin, Amie Dowling
Jesuit Higher Education: A Journal
This article describes the development and evolution of a 2009 University of San Francisco (USF) course, Performing Arts and Community Exchange (PACE), and its most visible development: a devised, collaborative, dance theatre performance, Man.Alive. Stories from the edge of incarceration to the flight of imagination. PACE, which reflects and richly embodies Ignatian standards, can be used as a touchstone for appreciating and evaluating similar or resonant work across disciplines and at other institutions. Furthermore, contemplation of its pedagogy, methods, and outcomes may lead to a productive reconsideration of the kind of performing arts curriculum Jesuit universities should embrace.
A Study Of The Management Of Opioid Prescriptions Among Patients With A History Of Substance Abuse, Kara G. Veeder
A Study Of The Management Of Opioid Prescriptions Among Patients With A History Of Substance Abuse, Kara G. Veeder
MUSC Theses and Dissertations
Prescription opioid abuse is the fastest-growing drug problem in the United States and has been declared an epidemic by the U.S. White House Office of National Drug Control Policy. Immediate release (IR) opioids, especially hydrocodone and oxycodone, are abused or misused most commonly. Dentists are only second to family physicians in the number of IR opioid prescriptions written. Just under ten percent of the population in the United States in 2010 were classified with substance dependence or abuse in 2009. This study poses the following questions: 1. Do patients with a personal or family history of substance abuse manage prescription …

Five Devastating Collateral Consequences Of Juvenile Delinquency Adjudications You Should Know Before You Represent A Child, Julie Ellen Mcconnell
Five Devastating Collateral Consequences Of Juvenile Delinquency Adjudications You Should Know Before You Represent A Child, Julie Ellen Mcconnell

The original purpose of the juvenile court was to create a forum, separate from the adult courts, in which children could be given the opportunity for rehabilitation and treatment. Society placed an emphasis on correcting misbehavior and minimizing disruptions in the transition to adulthood for young people and wanted to spare them the stigma of being branded as “criminals.” In 1967, the Court established in In re Gault that juveniles, even though they were in a different system, were still entitled to the basic safeguards that an adult would be granted in the courtroom.
For most of the existence of …

Commissioning Innocence And Restoring Confidence: The North Carolina Innocence Inquiry Commission And The Missing Deliberative Citizen, Mary Kelly Tate

Since 1989, the United States has witnessed 289 DNA exonerations, with exonerees serving an average of thirteen years in prison. Although DNA and its unmatched power for conclusive results is what brought popular attention to wrongful convictions, the scope of the problem is vastly larger than the number of known DNA exonerations. The actual number of convicted individuals who are factually innocent is unknown. The state of North Carolina has recently responded to this national crisis via a newly created state agency. This essay applauds North Carolina's response, but urges that ordinary citizens, qua jurors, be active participants in its …

New forms of social media and virtual communication are changing the ways in which we meet new people and develop meaningful relationships. In today's world, you can skype a long-distance significant other or join an Internet chat room to find others who share a similar interest. While, in many ways, the Internet has facilitated our ability to interact with others unencumbered by geographical location or time zone, its unfettered reach has proved to be problematic for one relationship in particular-the marital unit. Studies show that more marriages are ending because of "virtual infidelity," the term used to describe nonphysical behavior …

Beyond The Excuses: The Effect Of Culturally Responsive Pedagogy On African American Male Students, Kelly Cousette
Beyond The Excuses: The Effect Of Culturally Responsive Pedagogy On African American Male Students, Kelly Cousette
All ETDs from UAB
ABSTRACT Nearly 30 years have elapsed since the National Assessment of Educational Progress reported that America's public education system is failing African American male students. These widely used statistics state that compared to their White and African American female counterparts, African American male students underperform in nearly all educational measures (i.e. GPA, standardized test scores, graduation and dropout rates, etc.). The majority of the research on this academic achievement gap has focused on deepening our understanding of the barriers to educating African American males. While understanding the problem is a logical first step to resolving any dilemma, research on this …
Are Mathematics, Economics, And Accounting Courses Important Determinants In Financial Management: A Rank Order Approach
Journal of Economics and Finance Education
Using an ordered probit model, we examine the determinants of student performance in an introductory, junior level financial management course at a rural state university in the eastern United States. It is discovered that the cumulative grade point average and academic major of a student are marginally significant predictors of that student’s final letter grade in the course. There is a much more significant positive relationship between grades received in two prerequisite mathematics courses and the grade in the introductory finance course. The letter grade received in the prerequisite microeconomics course reveals the phenomenon of persistence in that the probability …
