Veterans Court: Towards The Implementation Of A Collaborative Justice Model In San Luis Obispo County, Daniel Smee Jan 2012

Veterans Court: Towards The Implementation Of A Collaborative Justice Model In San Luis Obispo County, Daniel Smee

Continuing Education (CAPSTONE)

Veterans’ treatment courts represent an emerging trend across the country of collaborative justice designed to deal with criminal justice issues stemming from problems linked to military service. This approach places the veteran in VA (Veterans Affairs) treatment programs as a diversion from incarceration. There are few such courts in California (nine) largely in non-rural counties. This study investigated two rural counties, Tulare and Santa Barbara with Veterans courts to develop a model for such a court in San Luis Obispo County. Early recidivism data at the one-year point for Tulare County showed a zero percent rate of criminal behavior (12 …

Capital Punishment And Race: Racial Culture Of The South, Jerry Joubert

Undergraduate Review

There are currently 34 states with the death penalty and 16 states without the death penalty in the United States. According to the most recent report from the Death Penalty Information Center, there have been 1276 executions in the United States since 1976. In the year 2011 alone, there were 42 executions. This was 4 executions less than the previous year. Among the 1276 total executions in the United States since 1976, 1048 have taken place in the South. There are approximately 3,251 inmates on death row. African-Americans represent 42% of these inmates (Death Penalty Information Center, 2011). This statistic …

One More Good Reason For In-Car Videotaping Of Traffic Stops: An Accurate Assessment Of "Consent", Robert L. White Jan 2012

One More Good Reason For In-Car Videotaping Of Traffic Stops: An Accurate Assessment Of "Consent", Robert L. White

University of Michigan Journal of Law Reform Caveat

There are a number of reasons why legislative reform mandating the use of in-car cameras in police cruisers would benefit the criminal justice system in Illinois. In-car cameras provide evidence for cases involving traffic violations or intoxicated motorists. They produce instantly available training materials. They also assist victims of police misconduct, as well as officers defending themselves against misconduct claims. This Comment looks to add to this list of benefits the role in-car cameras can play in assessing the validity of consents to search that officers obtain during traffic stops.

Recognizing The Right To Petition For Victims Of Domestic Violence, Tamara L. Kuennen Jan 2012

Recognizing The Right To Petition For Victims Of Domestic Violence, Tamara L. Kuennen

Sturm College of Law: Faculty Scholarship

Like any citizen, a victim of domestic violence (DV) may call the police for help when she needs it. And yet, when a victim calls the police, she not only seeks law enforcement assistance but also invokes her constitutional right to seek one of the most fundamental services the government can provide—protection from harm. That right, recently described by the Supreme Court as “essential to freedom,” is the right “to petition the Government for a redress of grievances” guaranteed by the First Amendment. This Article argues that a combination of law and policy initiatives produces negative collateral consequences for DV …

A Liberal Communitarian Conception Of Privacy, 29 J. Marshall J. Computer & Info. L. 419 (2012), Amitai Etzioni

UIC John Marshall Journal of Information Technology & Privacy Law

In a large and complex society, anti-social behavior cannot be restrained by government intervention alone—without it becoming a police state. Informal social controls are necessary to keep deviance from societal norms and values at a socially acceptable level, and one of the levers of this social pressure is the observation of and reaction to the personal conduct of members of one’s community.

This article argues that in several areas of contemporary American life decreasing privacy by strengthening informal social controls will lessen the need for state surveillance and regulation, which tends to be act with a heavier hand and is …

Research Brief One-Sheet No.2: Off-Duty Crime By Police Officers, Philip M. Stinson, John Liederbach, Tina L. Freiburger Jan 2012

Research Brief One-Sheet No.2: Off-Duty Crime By Police Officers, Philip M. Stinson, John Liederbach, Tina L. Freiburger

Criminal Justice Faculty Publications

Virtually all of the existing data on the off-duty misconduct of police officers describes the misbehavior of New York Police Department (NYPD) officers (see e.g. Fyfe and Kane, 2006; Kane and White, 2009). These data indicate that a significant portion of police misconduct emanates from behavior that occurs off-duty, including domestic violence, bar fights, drunk driving, burglary, and sex offenses. The NYPD data are agency-specific however; so very little is known about the nature and character of off-duty misconduct perpetrated by police employed by other police agencies. The purpose of this study is to explore off-duty police crime in the …

A Better Balancing: Reconsidering Pre-Conviction Dna Extraction From Federal Arrestees, Joy Radice Jan 2012

A Better Balancing: Reconsidering Pre-Conviction Dna Extraction From Federal Arrestees, Joy Radice

Scholarly Works

Federal law mandates the collection of a biological sample from anyone arrested by federal authorities or facing federal charges, regardless of the charge. The FBI then creates a DNA profile from the sample and enters that profile into the Combined DNA Index System (“CODIS”), a national database through which law enforcement matches individuals and crime scene DNA evidence.

Part I of the essay briefly reviews the federal statute that authorizes pre-conviction DNA extraction and the Fourth Amendment principles that underlie the current constitutional challenges to it. Part II identifies the various, and sometimes competing, rationales offered to justify the constitutionality …

Significant Race Differences In Factors Related To The Detention Recidivism Of Youthful Offenders, Christopher A. Mallett, Miyuki Fukushima, Patricia A. Stoddard Dare, Linda M. Quinn Jan 2012

Significant Race Differences In Factors Related To The Detention Recidivism Of Youthful Offenders, Christopher A. Mallett, Miyuki Fukushima, Patricia A. Stoddard Dare, Linda M. Quinn

Social Work Faculty Publications

A significant number of youthful offenders in the United States are held in juvenile court detention centers. Of broad concern is the disproportionate impact these placements have on minority youth, with African American and Hispanic youth much more frequently detained in these facilities compared to Caucasian youth. This U.S. study of a 2-county youthful offender population in the Midwest (1 urban, 1 rural) investigated racial differences in both extralegal (demographic, educational, mental health, and history of abuse or neglect) and court-related legal variables that predict detention placement upon recidivism—in other words, a second detention placement. Findings from logistic regression analysis …

The School Success Program: Improving Maltreated Children's Academic And School-Related Outcomes, Christopher A. Mallett

Social Work Faculty Publications

Many victims of childhood maltreatment experience difficulties in school and with academic performance. This article reviews the evidence on the connection between child- hood maltreatment and school performance and presents an evaluation of a unique program established by Children's Services in Lorain County, Ohio. Since 2001, the School Success Program, in collaboration with 18 Ohio public school districts, has provided individual tutoring and mentoring by certified teachers to 615 maltreated children and youths, working closely with the whole family in an in-home setting. Most children and youths in the program have progressed to their appropriate grade level while improving overall …

Gender And Securities Law In The Supreme Court, Lyman P.Q. Johnson, Michelle Harner, Jason A. Cantone Jan 2012

Gender And Securities Law In The Supreme Court, Lyman P.Q. Johnson, Michelle Harner, Jason A. Cantone

Scholarly Articles

The 2010 appointment of Elena Kagan to the United States Supreme Court meant that, for the first time, three female justices would serve together on that court. Less clear is whether Justice Kagan’s gender will really matter in how she votes as a justice. This question is an especially visible aspect of a larger issue: do female judges display gendered voting patterns in the cases that come before them?

This article makes a novel contribution to the growing literature on female voting patterns. We investigated whether female justices on the United States Supreme Court voted differently than, or otherwise influenced, …

Juvenile Life Without Parole, Kallee Spooner Jan 2012

Juvenile Life Without Parole, Kallee Spooner

Undergraduate Review

The purpose of this paper is to analyze data, policy trends, and legal concerns on the issue of sentencing juvenile offenders to life without the possibility of parole (LWOP). Policy changes in the 1980s and 90s dramatically changed the sentencing outcomes for juvenile offenders. Significantly departing from the rehabilitative goals established by the juvenile court, states adopted harsher punishments, including LWOP. During this shift, the diminished culpability of youth became insignificant when compared to the nature of their crimes. The recent cases of Roper v. Simmons (2005) and Graham v. Florida (2010) reinstated the importance of recognizing that juveniles are …

Indigenous Family Violence: An Attempt To Understand The Problems And Inform Appropriate And Effective Responses To Criminal Justice System Intervention, Andrew Day, Robin Jones, Martin Nakata, Dennis Mcdermott Jan 2012

Indigenous Family Violence: An Attempt To Understand The Problems And Inform Appropriate And Effective Responses To Criminal Justice System Intervention, Andrew Day, Robin Jones, Martin Nakata, Dennis Mcdermott

Aboriginal Policy Research Consortium International (APRCi)

Whilst high levels of concern about the prevalence of family violence within Indigenous communities have long been expressed, progress in the development of evidence-based intervention programs for known perpetrators has been slow. This review of the literature aims to provide a resource for practitioners who work in this area, and a framework from within which culturally specific violence prevention programs can be developed and delivered. It is suggested that effective responses to Indigenous family violence need to be informed by culturally informed models of violence, and that significant work is needed to develop interventions that successfully manage the risk of …

Improving Criminal Justice Data And Policy, Mary Rogan Jan 2012

Improving Criminal Justice Data And Policy, Mary Rogan

Articles

Criminal justice policy in Ireland is often criticised for lacking a robust evidence base.

Increased knowledge about crime and criminal justice may act to enrich all types of criminological enquiry and policy formation. This paper explores the potential of large population registries, similar to those created in the health sector, to inform criminal justice policymaking. The paper looks at the importance of such data collection for criminal justice research and policy and the potential hurdles to its development.
