The Role Of The Caribbean Court Of Justice In Human Rights Adjudication: International Treaty Law Dimensions, Winston Anderson

"The Gaza military operations were, according to the Israeli Government, thoroughly and extensively planned. While the Israeli Government has sought to portray its operations as essentially a response to rocket attacks in the exercise of its right to self-defence, the Mission considers the plan to have been directed, at least in part, at a different target: the people of Gaza as a whole." "While the investigations published by the Israeli military and recognized in the U.N. committee's report have established the validity of some incidents that we investigated in cases involving individual soldiers, they also indicate that civilians were not …
Reducing Recidivism Through Entrepreneurship Programmes In Prisons, Thomas Cooney
Reducing Recidivism Through Entrepreneurship Programmes In Prisons, Thomas Cooney
Articles
Prison systems are facing significant challenges from overcrowding and a ‘revolving door’ routine. Reducing recidivism would help alleviate both these problems and would also assist in breaking the cycle of career criminality. However, one of the primary causes of recidivism is a lack of employment opportunities for people who have spent time in prison, thereby causing them to return to crime. Given the dearth of entrepreneurship research on ex-prisoners, this paper examines a ‘Start Your Own Business’ programme delivered inside a prison. Based on interviews with the participants, the author examines whether such programmes offer a realistic opportunity for reducing …

Police scandals during the 1980s and 90s exposed dramatic cases of drug-related corruption in a number of large American cities. The scandals in New York City culminated in the establishment of the Mollen Commission which focused on the investigation of corruption within the New York City Police Department (NYPD). The two year investigation identified a nexus between police misconduct and the operation of local drug markets, in particular cocaine and crack. A handful of scholarly studies from the same period provide the basis for most of our knowledge on the problem of drug-related police corruption. Data from these studies are …

Research Brief One-Sheet No.4: Officer-Involved Domestic Violence, Philip M. Stinson, John Liederbach
Criminal Justice Faculty Publications
Officer-Involved Domestic Violence (OIDV) refers to instances of domestic and/or family violence that occur within police families. OIDV has been recognized as an important issue for both police scholars and practitioners. The movement to recognize OIDV gained momentum through the last two decades, beginning with exploratory research that linked police stress and family violence (Johnson, 1991). The movement also involved enactment of the Violence Against Women Act (1994) and the Lautenberg Amendment to the federal Gun Control Act that prohibits individuals—including police officers—from owning or using a firearm if they are convicted of a misdemeanor crime of domestic violence. The …

The youth population is vulnerable to the constant changes that they are encountering. The stressors of school, their changing bodies, and coping with the stressors of home all play an important role in the way that they develop themselves as responsible citizens. The purpose of this study is to add new information to the field of social work and enhance the current practices that are implemented in the criminal justice system to help juvenile dilinquents. The study examines the caregiver's perspective on the effectiveness of a scared straight program known as Self-Discipline, Honor, Obedience, Character and Knowledge (S.H.O.C.K).

The Decline Of "The Record": A Comment On Posner, Frederick Schauer
The Decline Of "The Record": A Comment On Posner, Frederick Schauer
Duquesne Law Review
Judge Posner's views about appellate advocacy and judicial decision- making are rich and complex, addressing numerous topics of interest and importance to lawyers and other judges. His articulation of those views is candid and occasionally surprising, and I focus in this comment on one aspect of his views which may strike legal and judicial traditionalists as the most surprising of all-Judge Posner's assertion, without embarrassment or seeming reluctance, that he consults factual sources not to be found in the record from the trial court, nor discussed or argued below, nor referenced in the briefs of the parties, nor mentioned in …
Judicial Perspective And Mentorship At The Supreme Court: A Review Essay On In Chambers: Stories Of Supreme Court Law Clerks And Their Justices, Edited By Todd C. Peppers And Artemus Ward, Harvey Gee
Duquesne Law Review
In their recently released book, In Chambers: Stories of Supreme Court Law Clerks and Their Justices ("In Chambers"), editors Todd Peppers and Artemus Ward offer a collection of previously published articles and new unpublished essays on select justices and their clerks to illuminate how the personal relationships between justices and clerks impact the Court. Contributors include distinguished law professors, judges, academics, and legal correspondents. Peppers and Ward are certainly qualified to talk about the Supreme Court clerkship institution. Six years ago, Peppers released Courtiers of the Marble Palace: The Rise and Influence of the Supreme Court Law Clerk …
