Un-Convicting The Innocent: The Case For Shaken Baby Syndrome Review Panels, Rachel Burg Apr 2012

Un-Convicting The Innocent: The Case For Shaken Baby Syndrome Review Panels, Rachel Burg

University of Michigan Journal of Law Reform

This Note proposes that states should develop error-correction bodies to identify past errors that have resulted in wrongful convictions of people accused of shaking a child. These institutions, which I call SBS Review Panels, would be similar to the error-correction bodies and commissions that have recently been established throughout the world to deal with various sorts of wrongful convictions. An SBS-specific commission should be developed because of the high level of scientific expertise that is required to fully understand this diagnosis and the problems associated with using the triad of medical findings as evidence of the defendant's conduct. Part I …

Reform That Understands Our Seniors: How Interdisciplinary Services Can Help Solve The Capacity Riddle In Elder Law, Thomas Richard Stasi

University of Michigan Journal of Law Reform

This Note suggests an interdisciplinary approach to assist in determinations of legal capacity. It also urges an amendment to the Model Rules and current law firm business models, so attorneys can better approach capacity challenges. While this Note does not presume to resolve the problems faced by capacity determinations, the purpose is to offer functional alternatives to the current working models. Part I reviews the Model Rules' treatment of capacity issues, detailing attorneys' conflicting ethical duties and the ambiguous methodology for capacity evaluations. Part II examines the customary processes that attorneys presently follow for seeking diagnostic evaluations and highlights their …

OHSU-PSU School of Public Health Faculty Publications and Presentations

Background: Previous studies indicate multiple influences on the overall health of HIV-infected persons; however, few assess and rank longitudinal changes in social and structural barriers that are disproportionately found in impoverished populations. We empirically ranked factors that longitudinally impact the overall health status of HIV-infected homeless and unstably housed men.

Methods and Findings: Between 2002 and 2008, a cohort of 288 HIV+ homeless and unstably housed men was recruited and followed over time. The population was 60% non-Caucasian and the median age was 41 years; 67% of study participants reported recent drug use and 20% reported recent homelessness. At baseline, …

The Dilemma Of Guatemalan Adoptions: The Hague Convention, The Cna, And The Future Of Adoptions In Guatemala, Katherine E. Jennings

Senior Honors Theses

International adoptions between Guatemala and the United States were discontinued after the Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption (the Hague Convention) went into effect in the United States on April 1, 2008. The Guatemalan international adoption system had been considered faster and easier than that of many other countries due to the nature of its private system. As the system expanded, ethical concerns were raised regarding how the adoptions were managed including the manner in which the system was a lucrative business. To the public, it appeared that corruption was pervasive within the …

Mandatory Reporting: A Study On The Effect Of Universal Mandated Reporting, Amanda Regis Apr 2012

Mandatory Reporting: A Study On The Effect Of Universal Mandated Reporting, Amanda Regis

Honors Theses and Capstones

Scandals at Penn State and Syracuse University have the world talking about mandatory reporting. There no debate in the academic community concerning the detrimental effects of child maltreatment and neglect, but the debate concerning mandatory reporting is ongoing. This study looks at the effectiveness of universal mandatory reporting of child maltreatment versus the current statute of mandated reporting for only certain professions in the states of New York and Pennsylvania. When Pennsylvania changed its legislation to a universal mandatory reporting law, it experienced a great increase, of 500%, in the number of substantiated reports of child maltreatment. While this increase …

The King Library offers space for everybody’s use. This presentation provided information on the initial analysis for data collected in a study of the “library as place” and SJSU students' perceptions regarding their sense of belonging towards the King Library building. The study had three goals: 1) Learn about the …

Every Adolescent Deserves A Parent, Dale Margolin Cecka Apr 2012

Every Adolescent Deserves A Parent, Dale Margolin Cecka

Law Faculty Publications

This article argues that all adolescents, indeed all human beings, deserve at least one parent—one person who takes the good with the bad because that person’s life is intertwined with the child’s. The child matters to the parent in a way that a friend, nephew, or foster child may not. Child welfare professionals must never lose sight of this principle when they recruit, train, and maintain parents for adolescents. The parent can be someone who is already in the young person’s life or someone who has been unable to parent in the past, but is now ready to secure that …

The Development And Validation Of The Preference For Adherence To Theoretical Orientation Scale, Tiffinee S. Hamilton Apr 2012

The Development And Validation Of The Preference For Adherence To Theoretical Orientation Scale, Tiffinee S. Hamilton

Counseling & Human Services Theses & Dissertations

One of the most common criticisms of undergraduate and master's level graduate programs is that students lack the ability to define their view of human nature. One effective means of assisting students in their desire to identify their preference in orientation is the use of a validated psychometric instrument developed for mental health trainees. Thus, the purpose of this study is to develop and initially validate a new assessment tool, the Preference for Adherence to Theoretical Orientation Scale (PATOS). PATOS provides a theoretically grounded method for assessing a counselor's preference for a particular orientation(s) as well as adherence to a …

Effects Of Violence On Youths' Perceptions Of Peer And Sibling Aggression, Jessica Houston Apr 2012

Effects Of Violence On Youths' Perceptions Of Peer And Sibling Aggression, Jessica Houston

Master's Theses (2009 -)

The present study examined the relationship between youth exposure to violence in the home and community and their perceptions of the acceptability of aggression in interactions involving peers and siblings. The importance of the context in which the violence occurs was investigated, as well the ability of parent-child attachment to buffer the effects of violence on aggressive attitudes. A diverse sample of 148 children, ages 9 to 14, completed measures of interparental, parent-child, and community aggression, as well as a measure of mother-child attachment. Youths also rated the acceptability of aggressive interactions between two peers and two siblings in written …

Curative Care As The Access Point To Rural Social Transformation A Case Study Of The Comprehensive Rural Health Project, Nancy Liu Apr 2012

Curative Care As The Access Point To Rural Social Transformation A Case Study Of The Comprehensive Rural Health Project, Nancy Liu

Independent Study Project (ISP) Collection

Health inequities based on geographic differences and between rural and urban populations in modern India demonstrate the stark differences in health access and community development throughout the country. More than 70% of the Indian population lives in rural areas, and yet a greater proportion of health care spending is devoted to urban populations. In 2004-5, 29.2% of both central and state public expenditures were allocated to urban allopathic services while 11.8% went to rural allopathic services (Balarajan, Selvaraj, and Subramanian 2011, 508). There are more than twice as many government beds in urban than in rural areas and geographic distribution …

Independent Study Project (ISP) Collection

The Instituto Povo do Mar (or IPOM) seeks to improve the lives of children in the favela of Serviluz through experiential education, providing classes in music, art, yoga, surfing, and other subjects. Previous studies have shown how surfing programs can provide immense psychological benefits for children who are at risk for trauma because of their impoverished environments, and the other classes that IPOM offers also give structural support to community children in various ways. In addition to the direct benefits that Serviluz children receive from these programs, IPOM also has a broader social justice goal in mind. The organization sees …

Criss Library Faculty Proceedings & Presentations

This article offers a theoretical model of online, graduate student information seeking behavior. The qualitative methodology used to gather data for the development of the model included an electronic survey and semi-structured interviews conducted online using Adobe Connect Pro™. Participating in the study were 238 graduate students enrolled in at least one online course at a mid-western university. Data analysis included use of Zoomerang™ reports to interpret survey data, and content analysis of interview transcriptions. The resulting evolution of the Bates’ (2002) theoretical model includes new two modes of information seeking: scrutinizing (directed, dynamic), and being alert (undirected, dynamic). The …
