Justice In The Shadowlands: Pretrial Detention, Punishment, & The Sixth Amendment, Laura I. Appleman Jun 2012

Justice In The Shadowlands: Pretrial Detention, Punishment, & The Sixth Amendment, Laura I. Appleman

Washington and Lee Law Review

In a criminal system that tips heavily to the side of wealth and power, we routinely detain the accused in often horrifying conditions, confined in jails while still maintaining the presumption of innocence. Here, in the rotting jail cells of impoverished defendants, lies the Shadowlands of Justice, where the lack of criminal procedure has produced a darkness unrelieved by much scrutiny or concern on the part of the law. This Article contends that our current system of pretrial detention lies in shambles, routinely incarcerating the accused in horrifying conditions often far worse than those of convicted offenders in prisons. Due …

Embracing Tribal Sovereignty To Eliminate Criminal Jurisdiction Chaos, Lindsey Trainor Golden Jun 2012

Embracing Tribal Sovereignty To Eliminate Criminal Jurisdiction Chaos, Lindsey Trainor Golden

University of Michigan Journal of Law Reform

This Note argues that the current federal laws regarding tribal criminal jurisdiction are contrary to existing policies that recognize inherent tribal sovereignty, and that to fully restore tribal sovereignty and reduce reservation crime rates, Congress should revise the MCA and the TLOA to comprehensively address the legal barriers that adversely affect tribes' ability to prosecute crimes committed within their geographic borders. Part I outlines the historical progression of laws addressing criminal jurisdiction in Indian Country and identifies the problems with the law's disregard and displacement of tribal sovereignty. Part II examines the current state of criminal jurisdiction on reservations-focusing on …

Setting Us Up For Disaster: The Supreme Court's Decision In Terry V. Ohio, Thomas B. Mcaffee Jun 2012

Setting Us Up For Disaster: The Supreme Court's Decision In Terry V. Ohio, Thomas B. Mcaffee

Nevada Law Journal

The controversies spawned by the Supreme Court’s decision in Terry v. Ohio are just about as expansive as the decision’s implications for the development of Fourth Amendment doctrine. And it was recently observed that it is perhaps the most criticized Fourth Amendment decision since the modern Supreme Court belatedly incorporated the amendment, and eventually the exclusionary rule.3 Fortunately, there is neither time nor space to address and fully resolve all of these controversies, or even to determine whether the case was just wrongly decided; the somewhat narrower thesis of this Article is that the long-term impact of Terry on the …

Making The Most Of United States V. Jones In A Surveillance Society: A Statutory Implementation Of Mosaic Theory, Christopher Slobogin Jun 2012

Making The Most Of United States V. Jones In A Surveillance Society: A Statutory Implementation Of Mosaic Theory, Christopher Slobogin

Vanderbilt Law School Faculty Publications

In the Supreme Court's recent decision in United States v. Jones, a majority of the Justices appeared to recognize that under some circumstances aggregation of information about an individual through governmental surveillance can amount to a Fourth Amendment search. If adopted by the Court, this notion sometimes called "mosaic theory"-could bring about a radical change to Fourth Amendment jurisprudence, not just in connection with surveillance of public movements-the issue raised in Jonesbut also with respect to the government's increasingly pervasive record-mining efforts. One reason the Court might avoid the mosaic theory is the perceived difficulty of implementing it. This article …

Clean Needles And Bad Blood: Needle Exchange As Morality Policy, Elizabeth A. Bowen Jun 2012

Clean Needles And Bad Blood: Needle Exchange As Morality Policy, Elizabeth A. Bowen

The Journal of Sociology & Social Welfare

The morality policy framework is a lens for understanding the unique characteristics of policies that attempt to regulate personal morals and behaviors. Needle exchange, a controversial intervention for reducing the transmission of HIV in injection drug users, shares many of the hallmark characteristics of morality policies. Analyzing needle exchange from a morality policy perspective, focusing on the 21-year ban on federal funding for needle exchange, reveals how value-based arguments have been used in the needle exchange debate and explains why the issue is likely to remain controversial in the United States. This analysis adds to the understanding of moral and …

Political Feasibility Of Implementing Smart Growth Development Strategies In The Monterey Bay Area, Kristin Mckee Jun 2012

Political Feasibility Of Implementing Smart Growth Development Strategies In The Monterey Bay Area, Kristin Mckee

Master's Theses

Development over the past sixty years has created patterned growth and expansion outward from city centers, separating residences from commercial areas and employment centers. This separation of land uses has increased automobile dependency, which increases vehicle miles traveled and associated greenhouse gas emissions. California Senate Bill 375 mandates the development and implementation of a “Sustainable Communities Strategy” in order to plan regional land use and transportation in a coordinated fashion. In coordination with this effort, the Association of Monterey Bay Area Governments (AMBAG) is developing the Regional Implementation Plan for Smart Growth Development Strategies, which entails the identification of smart …

Batterers' Perception Of Treatment Non-Completion, Zoila Gordon

Loma Linda University Electronic Theses, Dissertations & Projects

The purpose of this study was to examine reasons why batterers drop out of batterers’ intervention programs. A qualitative design was utilized within the framework of Gove’s Prime Physical Theory, Bandura’s Self-Efficacy Theory and Braithwaite’s Reintegrative Shaming Theory. Data collection included interviewing a sample of 22 court mandated male batterers, who had initially dropped out of treatment and had been reinstated. Participants were from a diverse background. Results indicated five key themes that emerged from the batterers’ responses: (1) An overall lack of trust toward the legal system which greatly contributed to anger upon entering group; (2) a lack of …

Using Human Rights To Hold The Us Accountable For Its Anti-Sex Trafficking Agenda: The Universal Periodic Review And New Directions For Us Policy, Kari Lerum, Kiesha Mccurtis, Penelope Saunders, Stéphanie Wahab

School of Social Work Faculty Publications and Presentations

Since the passing of the Trafficking Victims Protection Act of 2000, anti-trafficking efforts have grown in funding, political strength, and popular-culture appeal in the United States and globally. Particularly influential in shaping anti-trafficking policy in the United States are anti-prostitution advocates who are primarily concerned with rehabilitating sex workers and eradicating sexual commerce. Simultaneous to the development of prohibitionist anti-trafficking and anti-prostitution efforts in the US, movements for sex worker rights have also grown in strength and visibility, influencing a variety of cultural, academic, and public health arenas. While sex worker activists have widened the dialogue around sex workers’ rights, …

Bradenton, Fl: A Patchwork City, Rebekah G. Brightbill May 2012

Bradenton, Fl: A Patchwork City, Rebekah G. Brightbill

USF Tampa Graduate Theses and Dissertations

The City of Bradenton is a patchwork city, whose neighborhoods vary greatly in quality. While its neighborhoods differ in type based on consumer preference, they vary in quality because of federal, state, and local planning and urban policy. These policies have resulted in inequality of place and race, clustering racial minorities in center city neighborhoods with deteriorated infrastructure and income inequality. This impacts the ability of the City to be competitive with other cities as a metropolitan whole. The City's economically and racially segregated neighborhoods are not the inevitable outcome of market forces, but rather reflect decades of federal, state, …

Behind Bars: Prison Abolition And Collective Work Toward Social Justice, Emily M. Pulsfus May 2012

Behind Bars: Prison Abolition And Collective Work Toward Social Justice, Emily M. Pulsfus

Capstone Collection

Work toward the collective movements for liberation has proven to be a difficult task for those who have chosen to dedicate their lives and work to make social change. A close examination of the non-profit industrial complex and the connections with the prison-industrial complex will enable social change agents to better articulate the ways in which we can move forward toward a more just world. The question central to my research asks: Is prison abolition necessary for social justice? To answer this question I will use an analysis of the non-profit industrial complex to explore how a social justice institution, …
