The Duty To Warn/Protect Doctrine And Its Application In Pennsylvania, Clarence Watson
The Duty To Warn/Protect Doctrine And Its Application In Pennsylvania, Clarence Watson
Jefferson Journal of Psychiatry
Despite the almost universal familiarity of mental health professionals with the Tarasoff case, many questions regarding its associated legal requirements often arise when evaluating potentially dangerous patients. The principles of the duty to warn/protect, while appearing nebulous at times, contain key concepts that the clinician must consider in the face of potential danger to third parties. This article reviews the landmark decision of the Tarasoff case and outlines its key concepts. In addition, given that state jurisdictions vary in treatment of Tarasoff-like cases, this article explores the Pennsylvania Supreme Court decision, Emerich v. Philadelphia Center for Human Development, Inc.

The Nseers Effect: A Decade Of Racial Profiling, Fear, And Secrecy, Penn State Law Immigrants' Rights Clinic, Rights Working Group
Center for Immigrants' Rights Clinic Publications
n the wake of the tragic attacks of September 11, 2011, the landscape of immigration law and policy in the United States changed dramatically as the government scrambled to create counterterrorism programs to respond to potential national security threats. One program is the National Security Entry-Exit Registration System (NSEERS) or "special registration" that was initiated by the Department of Justice in 2002 and inherited by the Department of Homeland Security in 2003. NSEERS served as a tool that allowed the government to systematically target Arabs, Middle Easterners, Muslims, and South Asians from designated countries for advanced scrutiny. ...The purpose of …

Done With Distracted Driving: Implications Of Pennsylvania's Ban On Text-Based Communication While Driving Under The State Constitution, Tara M. Franklin
Done With Distracted Driving: Implications Of Pennsylvania's Ban On Text-Based Communication While Driving Under The State Constitution, Tara M. Franklin
Dickinson Law Review (1908-2003)
In an era characterized by prolific use of cellular phones with everexpanding capabilities, liberty and privacy ideals often compete with public safety interests. Rising levels of injuries and fatalities from collisions attributed to cell phone use while driving have motivated Pennsylvania lawmakers to ban text-based communication while an individual is operating a vehicle. Roadway safety is a legitimate and important governmental objective; however, the innumerable functions capable of being performed by a modem cell phone and the enormity of information able to be stored on such a device necessitates a policy consistent with Pennsylvania's historic dedication to the privacy rights …
Morality As A Legitimate Government Interest, Daniel F. Piar
Morality As A Legitimate Government Interest, Daniel F. Piar
Dickinson Law Review (1908-2003)
In recent years, the Supreme Court has taken inconsistent approaches to the question of whether morality can be a legitimate government interest sufficient to survive constitutional review. This article identifies three such approaches: (1) cases where morality is not considered as a legitimate government interest; (2) cases where morality is a legitimate government interest; and (3) cases where the Supreme Court has substituted its own moral judgment for those of the state actor under review. None of these approaches is wholly satisfactory. This article will argue that, in most cases, deferential review of morality-based state action fosters moral diversity, which …

Nonprofit Marketing Education In The United States: An Examination And Interpretation Of The Prevalance And Nature Of Curriculum, Theresa Meier Conley
Electronic Theses and Dissertations
The nonprofit sector is a large, growing, and essential part of the United States economy. There is a history of inspired ideas and complex change in the nonprofit sector that marketing educators and business school administrators must understand if they are to be leaders in the continuing evolution of nonprofit marketing education.
This manuscript includes a summarized historical perspective, a selective review of literature from existing nonprofit management and marketing education, a discussion of relevant contemporary issues for consideration, and mixed-method research results regarding the prevalence and nature of nonprofit marketing education. The mixed-method research strategy includes three phases; the …

Enforcement In Kind: Reexamining The Preemption Doctrine In Arizona V. United States, William Hochul Iii
Notre Dame Law Review
The article focuses on a legislation enacted by Arizona which offered powers to the state and local officers for enforcing immigration law and perform immigration checks in case of reasonable suspicion. A reexamination is conducted based on preemption in immigration law jurisprudence for analyzing federal and state conflicts with reference to the trial of Arizona v. United States. The affirmative duties of the officers and the enforcement mechanism of the U.S. Congress are also discussed.
Employee Surveillance And The Modern Workplace, Marko Pitesa
Employee Surveillance And The Modern Workplace, Marko Pitesa
Research Collection Lee Kong Chian School Of Business
Employee surveillance is rapidly becoming widespread in the modern workplace. The rise of information technologies is enabling the development of unprecedented methods of surveillance and employees as well as employers are now facing a need for a reassessment of the system of moral relations this phenomenon entails. This chapter provides an overview of the most widespread workplace surveillance methods and tries to identify the stakeholders and analyse the relations between them. Finally, the key findings of this ethical assessment are pointed out and guidelines for a morally responsible approach to workplace surveillance are proposed. The level of the analysis, in …
Bullying Victimization As A Disability In Public Elementary And Secondary Education, Douglas E. Abrams
Bullying Victimization As A Disability In Public Elementary And Secondary Education, Douglas E. Abrams
Missouri Law Review
As Jamey entered Williamsville North, his life was torn between outward signs of emotional strength and inner impulses toward personal despair. In May of 2011, he used his webcam to produce and post online his video for the "It Gets Better Project," which seeks to fortify students who are bullied because of perceptions about their sexual orientation. The project's perspective is that the sting of childhood and adolescent bullying fades with the passage of time. "All you have to do is hold your head up and you'll go far," Jamey spoke directly into the camera, "Just love yourself and you're …

Like Laws And Sausages: The Tale Of A Mere Portion Of The Process To Develop The South Broad Street Corridor Plan, Amy R. Lopez
Master's Theses
The processes to develop community plans share certain standard activities and stages while remaining distinctive and without pre-scripted procedures. This study documents the process that yielded the South Broad Street Corridor Plan June 2012 draft. The objective is to present the decision-making processes and their connections to the final plan document along with the plan document itself.
Independent Moisture-Sensitive Automatic Watering System, Jessica Sherbon
Independent Moisture-Sensitive Automatic Watering System, Jessica Sherbon
Electrical Engineering
With the availability of home improvement supplies, plant owners can quickly and easily set up an automatic system that waters their gardens based on a specified schedule. However, most of these systems require an electric outlet or water faucet making them unusable in locations where installed water and power lines do not exist, such as apartment balconies. This project defines a small-scale automated watering system that runs independently of installed water and power lines. The system takes water from a reservoir, such as a tank or bucket, and supplies that water to individual plants via a drip system. The design …

Historically-Informed Development In The Civic Center South Area Of Downtown Los Angeles, John Daniel Von Kerczek
Historically-Informed Development In The Civic Center South Area Of Downtown Los Angeles, John Daniel Von Kerczek
Master's Theses
The site of today’s Civic Center in Downtown Los Angeles evolved gradually over the course of over 150 years before being dramatically transformed in the early to mid 20th century. Understanding how this area evolved and was redeveloped can help guide efforts to restore physical and historical continuity throughout the area. Specifically, this historical understanding can assist in identifying key opportunity sites within the area, such as Civic Center South, and in setting urban design goals for new development. Research for this thesis included an analysis of the area’s historic development and a review of its current conditions. The historical …

Racism In The Criminal Justice System, Nichole Griffith
Racism In The Criminal Justice System, Nichole Griffith
Social Sciences
This paper examines racism in the criminal justice system. The criminal justice system creates and perpetuates racial hierarchy in the United States. African Americans are criminalized and targeted because of their skin color. I analyze the Reagan administration, the War on Drugs, corrupt police practices, media, inner city enforcement, police discretion, racial profiling, and sentencing to reveal this racism and unfair treatment of African Americans. These victims of racism face lifelong marginalization and exclusion because they were criminalized. I also draw a link between the criminal justice system and slavery and Jim Crow. This racism explains why there are so …

Justice Ginsburg And Religious Liberty, John D. Inazu
Justice Ginsburg And Religious Liberty, John D. Inazu
UC Law Journal
Justice Ginsburg has left an important mark on many areas of the Supreme Court’s jurisprudence, but she has written relatively little in the area of religion. This relatively small footprint increased significantly in the opinion that she wrote in the Court’s 2010 decision in Christian Legal Society v. Martinez. This Article examines three strands of Justice Ginsburg’s jurisprudence leading up to that opinion: religion, government funding of expression, and equality. It first traces Justice Ginsburg’s religious liberty views through four facets of her legal career: her role as an advocate, her opinions on the D.C. Circuit, her Supreme Court nomination …
