Keeping the nation resilient; that is a nation able to withstand any threat or catastrophe is a primary goal of the United States Government. United States V. Klein, Then And Now, Gordon G. Young Jan 2012

United States V. Klein, Then And Now, Gordon G. Young

Loyola University Chicago Law Journal

United States v. Klein, decided during Reconstruction, was the first U.S. Supreme Court case to invalidate a statutory restriction on federal courts’ jurisdiction. It is the only case to do so by finding a violation of Article III of the Constitution. Klein has been cited in thirty-three U.S. Supreme Court opinions and roughly five hundred times each by lower federal courts and law journal articles. Recent commentators have read Klein both too broadly and narrowly. Its central holding is that Congress may not grant federal courts jurisdiction to decide a set of cases on the merits while depriving them …

Reducing Courts’ Failure-To-Appear Rate By Written Reminders, Brian H. Bornstein, Alan J. Tomkins, Elizabeth M. Neeley, Mitchel N. Herian, Joseph A. Hamm

Alan Tomkins Publications

This article examines the effectiveness of using different kinds of written reminders to reduce misdemeanor defendants’ failure-to-appear (FTA) rates. A subset of defendants was surveyed after their scheduled court date to assess their perceptions of procedural justice and trust and confidence in the courts. Reminders reduced FTA overall, and more substantive reminders (e.g., with information on the negative consequences of FTA) were more effective than a simple reminder. FTA varied depending on several offense and offender characteristics, such as geographic location (urban vs. rural), type of offense, and number of offenses. The reminders were somewhat more effective for Whites and …

Administering Justice: Removing Statutory Barriers To Reentry, Joy Radice Jan 2012

Administering Justice: Removing Statutory Barriers To Reentry, Joy Radice

Scholarly Works

After years of swelling prison populations, the reentry into society of people with criminal convictions has become a central criminal justice issue. Scholars, advocates, judges, and lawmakers have repeatedly emphasized that, even after prison, punishment continues from severe civil penalties that are imposed by federal and state statutes on anyone with a conviction. To alleviate the impact of these punishments, they have increasingly endorsed state legislation that creates certificates of rehabilitation. Seven states offer these post- conviction certificates, and six others proposed such legislation in 2011. Many look to New York’s statute as the best model because it is the …

Acute Alcohol Ingestion And Sympathetic Neural Responses During Orthostatic Stress In Humans, Sarah F. Stream Jan 2012

Acute Alcohol Ingestion And Sympathetic Neural Responses During Orthostatic Stress In Humans, Sarah F. Stream

Dissertations, Master's Theses and Master's Reports - Open

Acute alcohol consumption has been reported to decrease mean arterial pressure (MAP) during orthostatic challenge, a response that may contribute to alcohol-mediated hypotension and eventually syncope. Muscle sympathetic nerve activity (MSNA) increases during orthostatic stress to help maintain MAP, yet the influence of alcohol on MSNA during orthostatic stress has not been determined. We hypothesized that alcohol ingestion would blunt arterial blood pressure and MSNA responses to progressive lower body negative pressure (LBNP). MAP, MSNA, and heart rate (HR) were recorded during progressive LBNP (-5, -10, -15, -20, -30, and -40 mmHg; 3 min/stage) in 30 subjects(age 24 ± 1 …

A Racial Impact Analysis Of Hb 1075/Sb 201, Grace E. Harris Leadership Institute, Virginia Commonwealth University, Patrice Banks, Cydny Neville, Sookyung Oh, Keith Rogers Jr.

L. Douglas Wilder School of Government and Public Affairs Publications

The economic and social consequences of untreated (or under-treated) substance abuse among minors are significant. This report provides a racial impact analysis of HB 1075/SB 201, legislation approved in the 2012 General Assembly session that seeks to improve access and use of substance and alcohol services by minors. In short, this policy could go a long way to ensure that families are properly educated about these life-changing (and life-saving) programs; however our analysis raises concerns related to cultural competency that may serve to undermine the legislation’s goal. Virginia is incredibly diverse and its communities vary widely with its assets and …
