Human Rights, Emergencies, And The Rule Of Law, Evan J. Criddle, Evan Fox-Decent Feb 2012

Human Rights, Emergencies, And The Rule Of Law, Evan J. Criddle, Evan Fox-Decent

Faculty Publications

This article illuminates the normative basis for international law’s regulation of public emergencies by arguing that human rights are best conceived as norms arising from a fiduciary relationship between states (or state-like actors) and persons subject to their power. States bear a fiduciary duty to guarantee subjects’ secure and equal freedom, a duty that flows from their institutional assumption of sovereign powers. The fiduciary theory disarms Carl Schmitt’s critique of constitutionalism by explaining how emergency powers can be reconciled with the rule of law.

Inside Agency Preemption, Catherine M. Sharkey Feb 2012

Inside Agency Preemption, Catherine M. Sharkey

Michigan Law Review

A subtle shift has taken place in the mechanics of preemption, the doctrine that determines when federal law displaces state law. In the past, Congress was the leading actor, and courts and commentators focused almost exclusively on the precise wording of its statutory directives as a clue to its intent to displace state law. Federal agencies were, if not ignored, certainly no more than supporting players. But the twenty-first century has witnessed a role reversal. Federal agencies now play the dominant role in statutory interpretation. The U.S. Supreme Court has recognized the ascendancy of federal agencies in preemption disputes-an ascendancy …

Age Of An Information Revolution: The Direct-To-Consumer Genetic Testing Industry And The Need For A Holistic Regulatory Approach, Michelle D. Irick

San Diego Law Review

In order to safeguard consumers and ensure the continued progress of a fledgling industry, determining how to interpret results and communicate them with consumers poses one of the most challenging and important tasks. In discussing the challenges the law faces in this area, this Comment will discuss: (1) consumer interfacing issues, such as in advertising and results analysis, faced by the genetic testing industry; (2) the methods DTC companies use in arriving at results and corresponding problems; (3) who may interpret and communicate results; (4) how the DTC genetic testing industry's activities relate to the claims made regarding test results; …

The Relationship Of School Uniforms To Student Attendance, Achievement, And Discipline, Russell Edward Sowell Feb 2012

The Relationship Of School Uniforms To Student Attendance, Achievement, And Discipline, Russell Edward Sowell

Doctoral Dissertations and Projects

This causal-comparative study examined the relationship of school uniforms to attendance, academic achievement, and discipline referral rates, using data collected from two high schools in rural southwest Georgia county school systems, one with a uniforms program and one without a uniforms program. After accounting for race and students with disabilities status, School A (with uniforms) had significantly better attendance and somewhat fewer minor behavior infractions, but trended lower in standardized math scores and more intermediate and major behavioral infractions than School B (without uniforms). These findings failed to demonstrate an unambiguous advantage of school uniforms, consistent with the mixed results …

Bicycle And Pedestrian Engineering Design Curriculum Expansion, Ashley Haire

TREC Final Reports

This project summary report describes the execution of OTREC Project #298 (Development, Deployment and Assessment of a New Educational Paradigm for Transportation Professionals and University Students). The project is one facet of a multiyear collaboration of the Region X Transportation Consortium that was sponsored by the Federal Highway Administration (FHWA). The regional collaboration aims to shift the traditional paradigm of engineering course delivery to foster a more hands-on approach. The University of Idaho, for example, has created activity-based modules for a traffic signals course, while the University of Washington developed similar modules for a freight systems course. The focus of …

Source Localization Via Time Difference Of Arrival, Ciprian Romeo Comsa Jan 2012

Source Localization Via Time Difference Of Arrival, Ciprian Romeo Comsa

Dissertations

Accurate localization of a signal source, based on the signals collected by a number of receiving sensors deployed in the source surrounding area is a problem of interest in various fields. This dissertation aims at exploring different techniques to improve the localization accuracy of non-cooperative sources, i.e., sources for which the specific transmitted symbols and the time of the transmitted signal are unknown to the receiving sensors. With the localization of non-cooperative sources, time difference of arrival (TDOA) of the signals received at pairs of sensors is typically employed.

A two-stage localization method in multipath environments is proposed. During the …
