High Expectations And Some Wounded Hopes: The Policy And Politics Of A Uniform Statute On Videotaping Custodial Interrogations, Andrew E. Taslitz
High Expectations And Some Wounded Hopes: The Policy And Politics Of A Uniform Statute On Videotaping Custodial Interrogations, Andrew E. Taslitz
Northwestern Journal of Law & Social Policy
Much has been written about the need to videotape the entire process of police interrogation of suspects. Videotaping discourages abusive interrogation techniques, improves police training in proper techniques, reduces frivolous suppression motions, and improves jury decision making about the voluntariness and accuracy of a confession. Despite these benefits, only a small number of states have adopted legislation mandating electronic recording of the entire interrogation process. In the hope of accelerating legislative adoption of this procedure and of improving the quality of such legislation, the Uniform Law Commission (ULC) ratified a uniform recording statute for consideration by the states. I was …

White Collar Crime And The United States' Economy, Megan Graham
Honors Theses and Capstones
This paper attempts to study white collar crime and the cost it has on the United States' economy. White collar crime has many ripple effects including job loss, stock price changes, consumer price increases, jail costs, and court costs, and each of these comes at an enormous cost to society. Overall, this paper argues that more resources are needed for white collar crime prevention in order to save a large sum of money each year.

Striking A Balance: Managing Blogs In Loosely Coupled Systems, Troy A. Swanson, Dennis E. Gregory, Edward E. Raspiller
Educational Leadership & Workforce Development Faculty Publications
As the oldest implementation of Web 2.0 technologies, blogs present an opportunity to understand how community college administrators are addressing two conundrums: conundrum of control and the conundrum of adaptability. These problems arise from the need of leaders to put organizational controls in place even as these controls limit the tool's usefulness and the adaptability of the technology. The purpose of this study using a multiple case study method is (1) to further the understanding of how community college administrators and blog authors strike a balance between organizational control and adaptability when implementing and using blog technologies and (2) to …

Reconstruction: Studies in Contemporary Culture
In recent years, street harassment has garnered a significant amount of public and scholarly attention. Activist campaigns to spread awareness on this issue and promote women’s public safety have shaped laws along with cultural understandings of gender and power. In 2010, integrated media artist Suyin Looui offered her contribution to this discourse through a game titled Hey Baby. Designed as a first person shooter, Hey Baby allows the player to experience street harassment.
This roundtable places Hey Baby in conversation with two activist-scholars concerned with street harassment. Holly Kearl is the founder of StopStreetHarassment.org and author of Stop Street …

Searching And Seizing After 9/11: Developing And Applying Empirical Methodology To Measure Judicial Output Inthe Supreme Court's Section 8 Jurisprudence, Richard Jochelson, Michael Weinrath, Melaine Janelle Murchison
Dalhousie Law Journal
In 2005, Margit Cohn and Mordechai Kremnitzer created a multidimensional model to measure judicial discourse inherent in the decision making of constitutional courts. Their model set out multiple indicia bywhich to measure whether the court acted within proper constitutional constraints in order to determine the extent to which a court rendered a decision that was activist or restrained. This study attempts to operationalize that model. We use this model to analyze changes in interpretation of search and seizure law under section 8 after the enactment of the Canadian Charter of Rights and Freedoms at the Supreme Court of Canada. The …
Assessing Exclusion Clauses: The Supreme Court Of Canada's Three Issue Framework In Tercon Contractors Ltd V British Columbia (Transportation And Highways), Shannon O'Byrne
Dalhousie Law Journal
The Supreme Court of Canada's 2010 decision in Tercon Contractors Ltd v British Columbia (Transportation and Highways) concerned the enforceability of a broadly drafted exclusion clause in the context of public procurement tendering. It is noteworthy for several reasons. First, the decision unanimously articulated a three-issue framework for determining the enforceability of exclusion clauses. Second, and on a more theoretical front, Tercon offered competing visions as to how contracts are to be interpreted. Though the Supreme Court was unanimous that parties to a contract should-of course-generally be bound by its terms, the majority and dissent followed significantly different paths for …

Missouri Educator Perceptions On The Use Of Smartphones/Cell Phones In A Secondary School Setting: Their Relationship To Instruction, Christopher Birch
Dissertations
This mixed methods study evaluated the differences in the perceptions of educators in the state of Missouri on cell phone use in the classroom setting and its relationship to instruction. Specifically, this study analyzed the difference in perceptions and relationships that exist among educators (teachers and counselors) and administrators in Missouri public schools. Furthermore, this study also examined relationships between region (rural versus suburban), school setting (middle school versus high school), and education level (bachelors and masters/specialist/doctorate) and interest level in using cell phones as an instructional tool. In addition, this research investigated current instructional practices involving mobile technology. Through …
How The Movies Became Speech, Samantha Barbas
How The Movies Became Speech, Samantha Barbas
Journal Articles
In its 1915 decision in Mutual Film v. Industrial Commission of Ohio, the Supreme Court held that motion pictures were, as a medium, unprotected by freedom of speech and press because they were mere “entertainment” and “spectacles” with a “capacity for evil.” Mutual legitimated an extensive regime of film censorship that existed until the 1950s. It was not until 1952, in Burstyn v. Wilson, that the Court declared motion pictures to be, like the traditional press, an important medium for the communication of ideas protected by the First Amendment. By the middle of the next decade, film censorship in the …
The Search For America's Most Eligible Patent: The Impact Of The Bilski Decision On Obtaining Patents For Processes And Business Methods, Mark Connolly
William & Mary Business Law Review
For one year, the business community, patent lawyers, and the media in the United States speculated as to how the Supreme Court would rule in Bilski v. Kappos. Some forecasted the end of all business method patents, while others advanced the idea that after the case, practically any business method could be patented. When the dust settled, the Court’s holding did neither: it determined that the machine-or-transformation test is not the exclusive test for patent eligibility under Section 101, and left open the possibility for business method patents to withstand future challenges.
While this result frustrated many that advocated for …
America's Energy Dependency: Will Government Regulation Of Caffeine Bring The Caffeine Companies To A Crash?, Rakesh J. Parikh
America's Energy Dependency: Will Government Regulation Of Caffeine Bring The Caffeine Companies To A Crash?, Rakesh J. Parikh
William & Mary Business Law Review
In light of Americans’ growing love affair with caffeinated products, this Note considers not only the possibility of future regulation of those products, but also the effect that regulation would have on caffeinated product-producing companies. While there is no certainty that such regulation is in our future, the regulation of market-similar products like tobacco and alcohol, and regulations abroad on heavily caffeinated drinks, suggest American regulation of caffeinated products to be a distinct possibility. This would be a serious concern for caffeine companies, who could face reduced access to target markets as a result of FDA-imposed limitations, whether by age …

A Behavioral Approach To Modus Operandi: Incident Form Completion And Its Effect On Predictive Analysis, Sarah Elizabeth Casella
Dissertations
This study examined the effects of task clarification, group feedback, and policy change on incident form completion by police officers. Participants included all sworn officers employed in the Operations Division by the Kalamazoo Department of Public Safety. The task consisted of completing the modus operandi (MO) section of the incident reports for burglary, robbery and aggravated assault. The main dependent variable was the percentage of incident reports with MO form completion. The secondary dependent variable was quality of the MOs completed in the reports; more specifically the completeness of the MO section compared to the narrative and discrepancies between the …
Drivers License Suspension For Offenses Not Involving A Motor Vehicle In Illinois: An Irrational Application Of The Rational Basis Test, Colby Hathaway
Drivers License Suspension For Offenses Not Involving A Motor Vehicle In Illinois: An Irrational Application Of The Rational Basis Test, Colby Hathaway
Northern Illinois University Law Review
The focus of this Comment is to look at how the court system in Illinois has treated substantive due process challenges to state statutes that require revocation or suspension of a driver's license when no motor vehicle was involved in the offense. The Supreme Court of Illinois has heard several cases on this issue, and the results have been inconsistent. The Court first held that license revocation for those charged with delivery of a controlled substance was unconstitutional, and then later held that license suspension for consumption of alcohol by a minor was constitutional. This inconsistency has also given rise …

Learnlocal| Place - Based Education Community Planning Meets Classroom Education, Holli Andrews
Muskie School Capstones and Dissertations
Partnerships between planners and high school teachers add a dynamic element to local planning. Youth who are engaged in community-driven efforts provide a fresh perspective for long-term objectives. They are not inhibited by the old ways of doing things. They exhibit ownership in the conditions of their community, and they show enthusiasm for becoming involved. Young people bring modern ideas to the planning table. Planner-teacher partnerships enhance opportunities for broad community development as well. By bringing local planning into classroom education, there is an opportunity to increase the level of participation through parents, family members, caregivers and youth groups. With …
When Coercion Lacks Care: Competency To Make Medical Treatment Decisions And Parens Patriae Civil Commitments, Dora W. Klein
When Coercion Lacks Care: Competency To Make Medical Treatment Decisions And Parens Patriae Civil Commitments, Dora W. Klein
University of Michigan Journal of Law Reform
The subject of this Article is people who have been civilly committed under a state's parens patriae authority to care for those who are unable to care for themselves. These are people who, because of a mental illness, are a danger to themselves. Even after they have been determined to be so disabled by their mental illness that they cannot care for themselves, many are nonetheless found to be competent to refuse medical treatment. Competency to make medical treatment decisions generally requires only a capacity to understand a proposed treatment, not an actual or rational understanding of that treatment. This …
