Beyond terms and conditions of employment, topics such as salaries and fringe benefits, issues that, again, were central in Wisconsin and Ohio, courts agree that an array of topics are subject to mandatory negotiations. ...

Put another way, Wisconsin led the way as the first state to mandate negotiations for public sector employees, including teachers, while also being the initial jurisdiction to enact reforms aimed at limiting the scope of unions and collective bargaining. ...

The fact that the attempted recall of Walker failed aside, such a strategy raises a question about the power of unions who represent a minority …

Mathematical Modeling Of Pipeline Features For Robotic Inspection, Yang Gao Apr 2012

Mathematical Modeling Of Pipeline Features For Robotic Inspection, Yang Gao

Doctoral Dissertations

Underground pipeline systems play an indispensable role in transporting liquids in both developed and developing countries. The associated social and economic cost to repair a pipe upon abrupt failure is often unacceptable. Regular inspection is a preventative action that aims to monitor pipe conditions, catch abnormalities and reduce the chance of undesirable surprises. Robots with CCTV video cameras have been used for decades to inspect pipelines, yielding only qualitative information. It is becoming necessary and preferable for municipalities, project managers and engineers to also quantify the 3-D geometry of underground pipe networks. Existing robots equipped specialized hardware and software algorithms …

A Maine Guide For Developing Community Wind Projects, Rick Harbison Apr 2012

A Maine Guide For Developing Community Wind Projects, Rick Harbison

Muskie School Capstones and Dissertations

In recent decades, wind power has emerged as one of the fastest-growing sources of energy in the United States. By the end of 2011, 46,919 megawatts (MW) of wind power had been installed across the country.1 A number of factors have driven this growth, chief among them are: technological innovation, increasing public support for renewable energy, and state and federal policies that encourage wind development.

While the predominant model for wind development in the United States—and Maine—has been large-scale commercial wind farms, a small but growing sector of wind development, known as “community wind,” is beginning to gain a foothold. …

Cost As A Sentencing Factor: A Response, Jeff Milyo Apr 2012

Cost As A Sentencing Factor: A Response, Jeff Milyo

Missouri Law Review

Professor Chad Flanders offers a normative theoretical critique of including costs of punishment in Sentence Advisory Reports (SARs) that the Missouri Sentencing Advisory Commission (MOSAC) produces. This approach provides a useful lens for understanding divergent opinions on the practice of including cost information in SARs and provides a consistent logical framework for understanding whether this practice squares with more fundamental principles of criminal punishment. In this Response, I complement the normative analysis in the main Article with several observations from a different analytical perspective. As an empirical social scientist, my analytical approach is based on positive analysis. I am less …

State Drug Testing Requirements For Welfare Recipients: Are Missouri And Florida's New Laws Constitutional, Abby E. Schaberg Apr 2012

State Drug Testing Requirements For Welfare Recipients: Are Missouri And Florida's New Laws Constitutional, Abby E. Schaberg

Missouri Law Review

This Summary examines the framework set up by the Supreme Court for analyzing the constitutionality of drug testing on welfare recipients. It discusses the states' implementation of such programs, and specifically analyzes laws recently passed by Florida and Missouri that authorize drug-testing requirements on welfare recipients. The likely outcome of challenges to these laws appears to be dependent, at least in part, on whether the law provides for suspicionless drug testing or calls for drug testing based on some reasonable suspicion of drug use.

The Long And Winding Road: State Sovereign Immunity's Effect On Gaming License Revocation For The Casino Debtor, Christopher M. Humes Apr 2012

The Long And Winding Road: State Sovereign Immunity's Effect On Gaming License Revocation For The Casino Debtor, Christopher M. Humes

UNLV Gaming Law Journal

One of the most vital and contentious proceedings between a casino debtor and a regulatory agency is a post-petition license revocation hearing. Much debate exists about whether the license qualifies as property of the estate and whether the regulatory agency can be exempted from the protections inherent in the Bankruptcy Code due to the use of police and regulatory power. However, maybe the most contentious and impactful debate is whether the regulatory agency is free from the bankruptcy court’s jurisdiction due to the Eleventh Amendment’s guarantee of sovereign immunity.

At the center of the tension concerning sovereign immunity lies 11 …

Beating Down The Lowly: The Criminalization Of The Homeless And Alternative Solutions, Amber Will Apr 2012

Beating Down The Lowly: The Criminalization Of The Homeless And Alternative Solutions, Amber Will

Symposium on Research and Creative Expression (SORCE)

In the current economy, the issue of homelessness is increasingly pervading the normal constructs of society. Thousands of men, women, and children struggle to find a place to sleep and enough food to satisfy their hungry stomachs. While many people suffer under these conditions, local governments continue to create new anti-homeless legislation to further eject them out of society. Bans prevent the homeless from urinating, sleeping, camping, and panhandling in public through fines and prison sentences. The laws specifically target the homeless, discriminating against them for actions which are necessary for daily survival. The legal system only further hurts this …

Human-Canine Relationships: Dog Behavior And Owner Perceptions, Briannan K. Byrd Apr 2012

Human-Canine Relationships: Dog Behavior And Owner Perceptions, Briannan K. Byrd

Senior Honors Theses

Abstract

Owning a dog has many physiological and psychological advantages; however, dog behavior can manifest itself in a variety of negative ways, including aggression. Research suggested that genetics and environment might play a role in aggression. It was demonstrated that owners can affect their dogs’ behaviors. Owners can unwittingly condition or encourage their dogs to misbehave, whether through their inaccurate perceptions or misguided actions towards the dogs. Dog behavior specialists view owner education as the key to solving the communication barrier between human and canine. The present study’s purpose was to assess if this view was possible. The research question …

Implications Of Eu Enlargement For India-Eu Labour Mobility Competition, Challenges And Opportunities, Puja Guha Apr 2012

Implications Of Eu Enlargement For India-Eu Labour Mobility Competition, Challenges And Opportunities, Puja Guha

Working Papers

1st May, 2004 marked the fifth and the largest European Union enlargement, with accessions given to 10 countries, out of which eight were Eastern European. Following this, another round of enlargement took place in 2007, which provided Bulgaria and Romania the EU member status. Introduction of these new States to the EU opened up a whole new debate about labour migration and policies. While the older EU countries (EU-15) consider these New Member States (NMS) as a pool of cheap resources, with the advantage of proximity, it has created skepticism among the Indian migrants, one of the largest migrant groups …

Is False Imputation Of Being Gay, Lesbian, Or Bisexual Still Defamatory? The Arkansas Case, Jay Barth Apr 2012

Is False Imputation Of Being Gay, Lesbian, Or Bisexual Still Defamatory? The Arkansas Case, Jay Barth

University of Arkansas at Little Rock Law Review

Falsely identifying someone as lesbian, gay, or bisexual (LGB) has historically been defamation per se in American courts. In modern times, however, courts have become conflicted as to whether a false imputation of a person as LGB is defamatory. Accordingly, this article examines the roots of defamation law as it relates to sexual minorities, and then examines questions regarding the defamatory status of false identification of another as LGB, whether community or national standards should drive such a determination, and finally, to what degree is any legal recognition of harm to reputation for being LBG a perpetuation of the status …

Canines On Campus: Companion Animals At Postsecondary Educational Institutions, Rebecca J. Huss

Missouri Law Review

This Article focuses on the issues that arise when students wish to attend a postsecondary institution accompanied by an animal. Part II begins by analyzing federal law applicable to students bringing service and assistance animals to campus. Part III explores the use of animal-assisted activities on campus. Part IV continues with an examination of policies allowing students to have companion animals in campus housing. Part V considers concerns administrators raise about allowing animals on campus. Finally, Part VI sets forth the steps an educational institution should implement to ensure compliance with the law and proposes actions that can be taken …
