Aliens In A Foreign Field: Examining Whether States Have The Authority To Pass Legislation In The Field Of Immigration Law, Jonathan Futrell
Aliens In A Foreign Field: Examining Whether States Have The Authority To Pass Legislation In The Field Of Immigration Law, Jonathan Futrell
Mercer Law Review
There is no question that immigration regulation is primarily a national issue. The federal government regulates when people can come into the country, how long they can stay, and what they can do while they are here. The United States Supreme Court has continually reaffirmed Congress's plenary power to create and regulate immigration laws. Any comprehensive immigration reform law must come from Congress. The recent laws passed by Arizona, Georgia, and Alabama cannot be classified as immigration reform laws. Instead, these are immigration "related" laws. The question then becomes just how far can the states go in passing laws that …
Propaganda Exposed A Glimpse Into The Truth Of Hidden Agendas, Carolyn Park
Propaganda Exposed A Glimpse Into The Truth Of Hidden Agendas, Carolyn Park
HIM 1990-2015
Government propaganda has been a topic of interest since America was founded, and today is no exception. Every recent Presidential Administration has been accused of using taxpayer dollars to fund propaganda. Although the funding of propaganda has been prohibited by the Consolidated Appropriations Act since 1951, it still occurs frequently. There is no entity that reviews government correspondence before it is released to the public, so government agencies are free to produce what they feel is appropriate even if it is prohibited by the Act. Furthermore, there is no law that specifically forbids government propaganda, and the current punishments amount …
Fort Drive: Reestablishing Its Significance Within Washington, D.C.'S Park System, Kathryn Kelly Finnigan
Fort Drive: Reestablishing Its Significance Within Washington, D.C.'S Park System, Kathryn Kelly Finnigan
All Theses
This thesis is an in-depth examination of Fort Drive, a 20th century proposed parkway connecting the principal Union Army fortifications which encircled Washington, D.C. The goal of the work is to determine if the landscapes acquired for Fort Drive are eligible for the National Register of Historic Places. This paper answers two questions: what role did Fort Drive play in establishing the Nation's Capital's park system; and are the remnants of the Fort Drive endeavor significant? These questions were answered through analysis of the National Capital Planning Commission's records, a comparison of the standards set by current National Register designations, …

Bart Cell Phone Service Shutdown: Time For A Virtual Forum?, Rachel Lackert
Bart Cell Phone Service Shutdown: Time For A Virtual Forum?, Rachel Lackert
Federal Communications Law Journal
The balancing act between protecting First Amendment rights and the necessity of law enforcement to maintain the public order is not simple under normal circumstances. On August 11, 2011, San Francisco's Bay Area Rapid Transit ("BART") created a paradigm embodying the very essence of this problem by shutting down cell phone and Internet service to prevent citizens from organizing and planning a protest. Both the constitutional and telecommunications law implications of BART's cell phone and Internet shutdown beg for analysis and reform, especially in an age of rapidly advancing technology. This Note analyzes the legal implications of BART's shutdown, and …

California's 2011 Realignment Legislation Addressing Public Safety And How It Will Impact Local Governments, John Mineau
California's 2011 Realignment Legislation Addressing Public Safety And How It Will Impact Local Governments, John Mineau
Master's Theses or Doctor of Nursing Practice
California’s 2011 Realignment Legislation Addressing Public Safety is the most sweeping public safety reform package since shortly after California’s statehood in 1850. Traditionally, any person convicted and confined for a felony has been incarcerated and supervised by the state. Moving forward, realignment will put many convicted felons in local jails instead of state prisons. It will also place paroling offenders under local probation supervision rather than state parole. The change in parole supervision represents a monumental shift of responsibility from the state to local governments. Realignment will have major effects on local government operations and budgets. Realignment has been conceptualized …
The Evolution Of Unconstitutionality In Sex Offender Registration Laws, Catherine L. Carpenter, Amy E. Beverlin
The Evolution Of Unconstitutionality In Sex Offender Registration Laws, Catherine L. Carpenter, Amy E. Beverlin
UC Law Journal
More is not always better. Consider sex offender registration laws. Initially anchored by rational basis, registration schemes have spiraled out of control because legislators, eager to please a fearful public, have been given unfettered freedom by a deferential judiciary. This Article does not challenge the state’s legislative power to enact sex offender registration laws. Instead, this Article posits that, even if sex offender registration schemes initially were constitutional, serially amended sex offender registration schemes—what this Article dubs super-registration schemes—are not. Their emergence demands reexamination of the traditionally held assumptions that defined original registration laws as civil regulations. Two intertwined causes …

Brazil is soccer. The game is so deeply ingrained in daily life - in Brazilian identity and self-esteem- that they define each other. Soccer is so profoundly intertwined with Brazilian culture that familiarity with the sport begins early, producing a bottomless pool of talent. Year after year, soccer stars seem to roll out of Brazil like cars off a factory assembly line; it’s a natural talent that grows in almost every Brazilian child. Soccer means passion to Brazilians; it is the symbol of their nationality, as they have proven to be very the best at it.
Now, Brazil finally has …

Ties That Bind: The Emergence Of Iron Tie Rod Reinforcement In Load Bearing Masonry Buildings Of Charleston, S.C., Jamie Lynn Wiedman
Ties That Bind: The Emergence Of Iron Tie Rod Reinforcement In Load Bearing Masonry Buildings Of Charleston, S.C., Jamie Lynn Wiedman
All Theses
Comprehensive studies of structural tie rods in Charleston's load bearing masonry buildings are scarce. While the presence of these anchors on building facades fascinates passersby and is appreciated throughout the city, a general knowledge of their history and emergence as a technology is lacking. Often associated with the earthquake of 1886, iron tie rods were in fact present in Charleston buildings as early as the 18th century. And while the effect of the 1886 earthquake on Charleston's built environment is typically looked at from a sociological or political perspective, and the physical effect has been studied extensively, rarely has the …

Legitimizing The "Republican Monarch" A Reexamination Of French Foreign Policy In The Atlantic Alliance, 1958-1960, Drew Fedorka
Legitimizing The "Republican Monarch" A Reexamination Of French Foreign Policy In The Atlantic Alliance, 1958-1960, Drew Fedorka
HIM 1990-2015
This thesis focuses on the role foreign policy played in legitimizing the early French Fifth Republic from 1958 to 1960. I argue that President Charles de Gaulle employed foreign policy in the service of gaining public support for his new government and the new republic. Many historians have argued previously that his foreign policy of grandeur, as it came to be called, was used to recast international politics and France's role in them. My work diverges from these previous interpretations by arguing that Gaullist foreign policy served, in many instances, overarching domestic goals, not French international interests. I see foreign …
Florida's Medical Malpractice Tort Reform A Cognitive Analysis Of Litigious, Legislative Promulgation And Jurisprudence, Joseph Formoso
Florida's Medical Malpractice Tort Reform A Cognitive Analysis Of Litigious, Legislative Promulgation And Jurisprudence, Joseph Formoso
HIM 1990-2015
Public opinion in recent years has been seemingly manipulated by superfluous stories, bad press, and negative commentaries regarding the perceived "Medical Malpractice Crisis." It has initiated a political attack on Florida's tort system which has resulted in making valid medical malpractice claims even more so difficult for victimized plaintiffs to pursue. After months of diligent research, and with the loyal aid of my university advisors and the dedicated law librarians I've had the honor to work with, I have thoroughly analyzed Florida's past and present medical malpractice tort reforms and governing procedural laws; in addition to arguing, by virtue of …
Evaluating The Psychometric Properties Of The Aggressive Driving Behavior Questionnaire (Adbq), Ajla Gurda
Evaluating The Psychometric Properties Of The Aggressive Driving Behavior Questionnaire (Adbq), Ajla Gurda
HIM 1990-2015
A principal axis factor analysis with promax rotation yielded four factors, or joint variations between the 20 items, that were inter-correlated with eigenvalues greater than 1. The ADBQ was also found to have high internal consistency (Cronbach's alpha = .86). The four factors were used to form four subscales of aggressive driving behavior that included anger/aggression, speeding/minor infractions, overt expression, and judgment of other drivers. The four subscales were found to correlate with self-reported biographical and driver history data, as well as, gender differences across scales. Additional analyses were conducted using data from the present sample from the University of …
Immigration Law And Enforcement The Role Of States And Local Authorities, Yisell Rodriguez
Immigration Law And Enforcement The Role Of States And Local Authorities, Yisell Rodriguez
HIM 1990-2015
Immigration law and its enforcement are controversial and highly debated topics. States are increasing their role in the enforcement of immigration law by enacting laws that allow local law enforcement to function as immigration officers with the intent of decreasing the illegal alien population within their jurisdiction. The primary focus of this thesis is to determine whether state and local police have the legal power to enforce immigration laws that have been the jurisdiction of the Federal Government for decades. There are two sides that are discussed in this thesis, the proponents who are in favor of increased participation and …
An Examination Of The History And Effect Of American Sex Offense Laws And Offender Registration, David Shabat-Love
An Examination Of The History And Effect Of American Sex Offense Laws And Offender Registration, David Shabat-Love
HIM 1990-2015
America's Sex Offense statutes and cases are some of the most controversial sections of modern law, both for the extreme sensitivity of their subject matter as well as the scope and application of those laws. This thesis is an analysis and overview of both the objective and subjective issues posed by the current state of those very laws: the subjective portion explored the development of current laws and the diverse attendant legal issues such as over-broadness and excessive or misdirected effect as compared to the Legislative and public intent which directly led to the development of these laws. Additionally a …

The Duality Of Florida's Criminal Pretrial Diversion Programs A Separate Treatment Court For Veterans, David Vanzandt
HIM 1990-2015
This thesis examines two issues facing Florida's young and fledgling Veteran Treatment Courts. First is whether or not a separate hybrid court of already existing mental health and drug courts is needed exclusively for veterans; and second, funding and efficiency of such courts as compared to traditional criminal institutions.
The Weak Registry The Constitutionality And Effectiveness Of Legal Restrictions On Convicted Sex Offenders, Andrea-Li Medina
The Weak Registry The Constitutionality And Effectiveness Of Legal Restrictions On Convicted Sex Offenders, Andrea-Li Medina
HIM 1990-2015
Over the last few decades our society has moved towards restricting where sexual offenders can live, work, and overall congregate. This issue has been the focus of great public attention due to the media's role in bringing these offenders to the light. Whether it is through the news, movies, TV series, books, talk shows, newspapers articles, etc., these offenders are constantly being talked about. Every body of government in the United States has moved towards implementing restrictions that are aimed at keeping sex offenders away from places where they are considered a potential danger. However, what it is not talked …

Existential Psychotherapy With Adults In Assisted Living, Christine A. Burbidge
Expressive Therapies Dissertations
This study explored aging individuals’ perceptions of existential poetry therapy. Six existential themes served as guides. They were: hope, gratitude, mindfulness, loss of mobility, forgiveness, and meaning in life. The data were analyzed via three sub-inquiries: (a) What thoughts and feelings do these six themes elicit; (b) What additional themes (existential or non) would the participants like to explore; and (c) What roadblocks hinder this population for accessing poetry therapy to its optimal extent. The research method involved two focus groups with a total of five participants, and data were analyzed using qualitative content analysis. The three most common themes …

Hidden Violence Is Silent Rape: Sexual And Gender-Based Violence In Refugees, Asylum Seekers And Undocumented Migrants In Belgium And The Netherlands, Ines Keygnaert, Nicole Vettenbu, Marleen Temmerman
Obstetrics and Gynaecology, East Africa
Although women, young people and refugees are vulnerable to sexual and gender-based violence (SGBV) worldwide, little evidence exists concerning SGBV against refugees in Europe. Using community-based participatory research, 223 in-depth interviews were conducted with refugees, asylum seekers and undocumented migrants in Belgium and the Netherlands. Responses were analysed using framework analysis. The majority of the respondents were either personally victimised or knew of a close peer being victimised since their arrival in the European Union. A total of 332 experiences of SGBV were reported, mostly afflicted on them by (ex-)partners or asylum professionals. More than half of the reported violent …

State Juvenile Justice Spending Decisions: The Effects Of Federal Aid, Race, Politics, And Other Socioeconomic Factors, Willie B. Coleman Smith
State Juvenile Justice Spending Decisions: The Effects Of Federal Aid, Race, Politics, And Other Socioeconomic Factors, Willie B. Coleman Smith
UNLV Theses, Dissertations, Professional Papers, and Capstones
Historically, juvenile justice in the United States has been the responsibility of state governments with limited federal support. There is a notable gap in the empirical literature on factors that affect funding policies for state juvenile justice programs. In this dissertation research, I used two theoretical perspectives to examine determinants of juvenile justice spending: economic theory on intergovernmental aid and tenets of the Politics of Social Order Framework, developed by Stucky, Heimer, and Lang (2007) to investigate corrections spending. Two research questions were considered: 1) What impact does federal aid have on state spending on juvenile justice programs? and 2) …

August 28, 1963: Building Community Through Collective Discourse, Jennifer Nestelberger
UNLV Theses, Dissertations, Professional Papers, and Capstones
The August 28, 1963 March on Washington is often remembered primarily for Martin Luther King, Jr.'s "I Have a Dream" speech, which serves as the pinnacle of civil rights movement oratory. This thesis, in contrast, examines speeches of the leaders of the "Big Six" organizations that preceded King's well-known words in order to shed light on the complexities of the movement and the outcomes that can result from meaningful dissent. Occurring at a time of division, the March emerged as a symbol of hope for change in the nation. The addresses of the day reflected this hope and helped build …
Monitoring And Modeling Of The Hydraulic And Sediment Processes At In-Stream Restoration Structures In The Vicinity Of A Bridge Crossing, Brian P. Schultz
Monitoring And Modeling Of The Hydraulic And Sediment Processes At In-Stream Restoration Structures In The Vicinity Of A Bridge Crossing, Brian P. Schultz
Master’s Theses
The long-term performance of infrastructure depends on reliable and sustainable designs. Many of Pennsylvania’s streams experience sediment transport problems that increase maintenance costs and lower structural integrity of bridge crossings. A stream restoration project is one common mitigation measure used to correct such problems at bridge crossings. Specifically, in an attempt to alleviate aggradation problems with the Old Route 15 Bridge crossing on White Deer Creek, in White Deer, PA, two in-stream structures (rock cross vanes) and several bank stabilization features were installed along with a complete channel redevelopment. The objectives of this research were to characterize the hydraulic and …

Public Safety Application For Approaching Emergency Vehicle Alert And Accident Reporting In Vanets Using Wave, Harshad Phule
Theses
Today's transport system has evolved from horse driven carriages and paved roads to a more complex road transport system made up of a variety of vehicles and other infrastructure, all put in place in order to support safe and efficient mobility of vehicles. The next step to further improve the transportation system of today is to make the vehicles and roadside infrastructure more intelligent by making them communicate with each other. This new ability will help find new solutions to current problems like traffic congestion, vehicular collisions, monitoring of adherence to traffic rules and alerting the drivers of hazardous conditions. …

A High Stakes Gamble In North Las Vegas, Robert E. Lang
Lincy Institute Reports and Briefs
The City of North Las Vegas, operating in the shadow of the Las Vegas Strip, one of the world’s most iconic urban settings, faces a series of financial and political challenges that threaten its ability to perform basic municipal services. This paper explores how North Las Vegas reached the edge of insolvency, the implications for North Las Vegas and the surrounding municipalities of Las Vegas, Henderson, and unincorporated Clark County, and the path forward in the face of unprecedented economic and political turmoil.
