[Review Of] Mark Rifkin. When Did Indians Become Straight? Kinship, The History Of Sexuality, And Native Sovereignty, Lindsey Schneider Jan 2012

[Review Of] Mark Rifkin. When Did Indians Become Straight? Kinship, The History Of Sexuality, And Native Sovereignty, Lindsey Schneider

Ethnic Studies Review

Mark Rifkin's second monograph. When Did Indians Become Straight, is an intellectually rigorous and theoretically dense work that explores the relationship between Indigenous political formations and heteronormativity by presenting a literary history of sexuality that spans the last two centuries. Rifkin argues that the settler state's investment in, and enforcement of, heterosexuality as the basic organizing structure of society is a response to the fact that "Indigeneity puts the state in crisis by raising fundamental questions about the legitimacy of its (continued) existence" (37). As a result, Indigenous geopolitical alliances that exceed liberal state logics of what counts as "proper …

Effects Of Simultaneous Speech And Sign On Infants’ Attention To Spoken Language, Jonathan Y. Ting, Tonya R. Bergeson, Richard T. Miyamoto Jan 2012

Effects Of Simultaneous Speech And Sign On Infants’ Attention To Spoken Language, Jonathan Y. Ting, Tonya R. Bergeson, Richard T. Miyamoto

Scholarship and Professional Work - Communication

Objectives: To examine the hypothesis that infants receiving a degraded auditory signal have more difficulty segmenting words from fluent speech if familiarized with the words presented in both speech and sign compared to familiarization with the words presented in speech only. Study Design: Experiment utilizing an infant-controlled visual preference procedure. Methods: Twenty 8.5-month-old normal-hearing infants completed testing. Infants were familiarized with repetitions of words in either the speech + sign (n = 10) or the speech only (n = 10) condition. Results: Infants were then presented with four six-sentence passages using an infant-controlled visual preference procedure. Every sentence in two …

Toward Understanding The Nature Of Leadership In Alleviating State Fragility, Ajay Tejasvi Narasimhan Jan 2012

Toward Understanding The Nature Of Leadership In Alleviating State Fragility, Ajay Tejasvi Narasimhan

CGU Theses & Dissertations

Approximately sixty countries have been designated `Fragile States' by international development agencies. Home to two billion of the world's poorest people, these fragile states are characterized by violence, weak institutions and shattered economies. Not only do they pose a challenge to regional security, they often become the breeding grounds for terrorism.

Donor agencies pour billions of dollars annually into these countries - through policy advice and conditional loans - to alleviate fragility and promote development. Development, however it is defined, involves economic, social and political transformation. Such a transformation is shaped by ideas, engages multiple interests, and proceeds within rules …

Say It Loud: An Action Research Project Examining The Afrivisual And Africology, Looking For Alternative African American Community College Teaching Strategies, Daniel E. Mitchell

CGU Theses & Dissertations

For this study, the researcher sought to implement a visual arts-based Afrivisual to help inspire, motivate and empower African American students in gaining a culturally relevant education in Euro-American-centered schools. Using the Afrivisual in this work as an action-oriented tool the researcher sought to expose African American students to an African historical context.

This research project utilized three African-centered theoretical frameworks: (1) Afrocentricity, (2) Africana Philosophy, and (3) Africana Critical Theory. The problem this work addresses is found in four areas, (1) American history is Eurocentric, (2) African history has been distorted, (3) Africa’s contribution to world civilization has been …

Developing Teachers' Capacities To Create Caring Relationships With Students: A Case Study Of A Gandhi-Inspired Private School In India, Victoria S. Zakrzewski Jan 2012

Developing Teachers' Capacities To Create Caring Relationships With Students: A Case Study Of A Gandhi-Inspired Private School In India, Victoria S. Zakrzewski

CGU Theses & Dissertations

Research indicates that many factors may impede teachers' ability to develop caring relationships with students such as the school environment (Schaps, 2009), lack of cultural understanding (Thompson, 1998), the teacher's beliefs and attitudes about care (Goldstein, 2002), and personal experience of being cared for (Noddings, 1984). Yet, little research exists on how schools can address these and other potential limiting factors in order to help teachers cultivate caring relationships with students. The purpose of this study was to examine how one school in India, which claims to emphasize the importance of the teacher-student relationship, develops and supports teachers' capacities to …

Another World Entire: The Posthumanism Of Cormac Mccarthy, Margaret Henson Pless Jan 2012

Another World Entire: The Posthumanism Of Cormac Mccarthy, Margaret Henson Pless

Electronic Theses and Dissertations

Cormac McCarthy's novels are thought experiments in what it might mean to write posthuman works of fiction. In a close reading of three of his novels, Child of God, The Crossing, and The Road , this project reveals how McCarthy's stories paradoxically unravel the dangerous human desire to make of our world a story. His characters, Lester Ballard, Billy Parham, and the boy, become posthuman as they live increasingly outside of narrative. Their existences extend beyond the page, in a radical intimacy with the world, evident in the haunting and elusive presences, and absences, of wolves, hawks, trout, and even …

Why Corporate Social Responsibility Will Emerge As A Driver Of Effective And Compelling Differentiation For Chinese Brands, Joseph Baladi Jan 2012

Why Corporate Social Responsibility Will Emerge As A Driver Of Effective And Compelling Differentiation For Chinese Brands, Joseph Baladi

Research Collection Lee Kong Chian School Of Business

Although the responsibility and role of business within society have evolved over the past two decades, they remain issues that retain conceptual dimensions. This means that instead of consensus over form and function, both are surrounded by a persistent cloud of disagreement and confusion. Too many people remain unsure about what they represent, the importance they play and the impact they have (or should have) on business as well as society. For one thing, different interpretations of what defines business responsibility to society exist. These range from concern over business’ environmental impact and contribution to climate change, to sustainability practices, …

The Dialectics Of Teacher Change Wtihin A Community Of Practice, Armand R. Pires Jan 2012

The Dialectics Of Teacher Change Wtihin A Community Of Practice, Armand R. Pires

Open Access Dissertations

Teacher change is at the heart of school reform. The research on teacher change has been primarily focused on teacher change from an individualistic perspective and has identified three possible paths of teacher change: beliefs precede change, change precedes beliefs, or change is nonlinear and recursive. This study looked at teacher change within a middle school during a time the school was undergoing a district-driven change in student grouping practices.

The study was conducted during the 2009-2010 school year and included ten teachers of science, social studies, and English in a grade 6-8 middle school. A qualitative study approach was …

Voices Silenced, Voices Heard: Exploring Status, Discourse, And Learning In Middle School Discussion Groups, Laura A. Chiaravalloti

Open Access Dissertations

Purpose: Cooperative learning structures allow diverse groups of students to learn together while developing higher-order thinking skills, yet there are concerns that not all students’ voices are being heard. The intent of this study was to discover the relationship between the instructional methodologies one teacher used to foster the development of group skills in students and the ways small discussion groups actually functioned. This study explored issues of power and status on students’ learning opportunities in middle school discussion groups. Method: This qualitative study was conducted under an ethnographic lens using a teacher-as-researcher approach. Data were collected over one school …

Nebraska Anthropologist

The following article is the author's treatise on the imperative for explicit theoretical use in North American archaeological approaches and research by critically assessing the views of Michelle Hegmon 's (2003:213-243) "Setting Theoretical Egos Aside: Issues and Theory in North American Archaeology" and Matthew Johnson's (2010:216-235) conclusions on the future of theory seen in Archaeological Theory: An Introduction, 2nd ed. This commentary discusses theory development in North American Archaeology as a discipline and advocates for the explicit use of theory in North American Archaeological research. A critical analysis of American archaeology is discussed through an assessment of common themes, …

Conscientious Objection To Creating Same-Sex Unions: An International Analysis, Bruce Macdougall, Elsje Bonthuys, Kenneth Mck. Norrie, Marjolein Van Den Brink Jan 2012

Conscientious Objection To Creating Same-Sex Unions: An International Analysis, Bruce Macdougall, Elsje Bonthuys, Kenneth Mck. Norrie, Marjolein Van Den Brink

All Faculty Publications

In jurisdictions that recognize same-sex marriages and unions, the question arises as to the extent to which civic officials who normally preside at such unions can refuse such participation for religious reasons. This paper examines this issue in the context of four jurisdictions: Scotland, Canada, the Netherlands and South Africa. What is striking is how different is the process of reaching a resolution in each jurisdiction, though the actual result might be the same. This difference arises because of the jurisdiction-specific reasons why same-sex marriages and unions are recognized, how they are recognized, the status of the officers who preside …

Patent Law's Audience, Mark D. Janis, Timothy R. Holbrook Jan 2012

Patent Law's Audience, Mark D. Janis, Timothy R. Holbrook

Articles by Maurer Faculty

Many rules of patent law rest on a false premise about their target audience. Rules of patentability purport to provide subtle incentives to innovators. However, innovators typically encounter these rules only indirectly, through intermediaries such as lawyers, venture capitalists, managers, and others. Rules of patent scope strive to provide notice of the boundaries of the patent right to anyone whose activities might approach those boundaries, including, in theory, any member of the general public. But the rules of patent scope are practically incomprehensible to the general public. In this Article, we argue that rules of patent law should be designed …

Perceptions And Needs Of Agricultural Teachers On Classroom Diversity And Inclusion., Hari K. Vommi

Graduate Theses, Dissertations, and Problem Reports (ETD)

Classrooms in the United States are more diverse than ever. It is predicted that nearly half of the public education students in the United States will be other than White by 2019. Teachers should have positive attitudes towards classroom diversity and inclusion. They should be well prepared to teach effectively in a diverse classroom. The purpose of the study was to examine the perceptions, the perceived confidence levels, and the perceived needs of agricultural teachers on classroom diversity, inclusion and multicultural education. The study also assessed the willingness of the teachers to participate in college courses and/or professional trainings on …

Silence And Self-Making: Black Lung Rhetoric And The Ken Hechler Letters, Jennifer De Pompei Jan 2012

Silence And Self-Making: Black Lung Rhetoric And The Ken Hechler Letters, Jennifer De Pompei

Theses, Dissertations and Capstones

This thesis combines history, rhetoric, and feminist identity studies to discuss the subject of black lung disease and the Appalachian coal miner. The first chapter examines the "evolution of mentalities" in historical and popular discourse surrounding the miner, which reflects James V. Catano's subversive form of the self-making identity in Ragged Dicks. The second chapter uses the feminist theory of silence as a form of control and power to understand the absence of black lung disease from the literature of coal. The final chapter is a case study of the correspondence between Congressional Representative Ken Hechler of West Virginia and …

The Future Of Gun Control Laws Post-Mcdonald And Heller And The Death Of One-Gun-Per-Month Legislation Note, Michael J. Habib

Connecticut Law Review

In McDonald v. Chicago, the Supreme Court incorporated the Second Amendment individual right to bear arms elucidated in District of Columbia v. Heller, and made the right applicable to state action. While Heller defined the right, McDonald clarified some of the justifications for limiting that right through appropriate government regulation. However, because Second Amendment jurisprudence is still in its infancy, the Court conspicuously left many questions unanswered Included amongst those questions is: What is the exact breadth and depth of the right to bear arms?; To what extent may the government permissibly restrict the right to bear arms?; and, What …

Constructing The Threat And The Role Of The Expert Witness: A Response To Aziz Rana's Who Decides On Security Commentary: National Security: Response, Wadie E. Said Jan 2012

Constructing The Threat And The Role Of The Expert Witness: A Response To Aziz Rana's Who Decides On Security Commentary: National Security: Response, Wadie E. Said

Connecticut Law Review

Aziz Rana's article presents clearly the overlooked but crucial question of "Who Decides on Security?" Namely, is determining who or what groups constitute a threat something that we are capable of making ourselves, or must we necessarily cede that authority to those in power-who supposedly have both the access to knowledge and the ability to understand it-to protect us from threats we cannot perceive? Using Rana's historical analysis as a framework, this Article builds on his thesis to show how the wide latitude granted to the conclusions of the Executive Branch's national security specialists in political matters has migrated into …

Limiting Principles And Empowering Practices In American Indian Religious Freedoms, Kristen A. Carpenter Jan 2012

Limiting Principles And Empowering Practices In American Indian Religious Freedoms, Kristen A. Carpenter

Connecticut Law Review

Employment Division v. Smith was a watershed moment in First Amendment law, with the Supreme Court holding that neutral statutes of general applicability could not burden the free exercise of religion. Congress’s subsequent attempts, including the passage of Religious Freedom Restoration Act and Religious Land Use and Institutionalized Persons Act, to revive legal protections for religious practice through the legislative and administrative process have received tremendous attention from legal scholars. Lost in this conversation, however, have been the American Indians at the center of the Smith case. Indeed, for them, the decision criminalizing the possession of their peyote sacrament was …

The Devil Comes To Kansas: A Story Of Free Love, Sexual Privacy, And The Law, Charles J. Reid Jr. Jan 2012

The Devil Comes To Kansas: A Story Of Free Love, Sexual Privacy, And The Law, Charles J. Reid Jr.

Michigan Journal of Gender & Law

On Sunday, September 19, 1886, Moses Harman, the editor of the radical newspaper Lucifer the Light-Bearer, presided over an inherently contradictory event-a free-love marriage ceremony between his associate editor, the thirty-seven-year-old Edwin Walker, and Moses' own daughter, the sixteen-year-old Lillian. The case that the two Harmans and Walker wished to present aimed to transform marriage from a public to a private relationship and from a permanent and exclusive one to a temporary one that permitted potentially many partners. State v. Walker and its parties have received some scholarly notice, but the truly radical quality of the arguments Moses, Edwin, and …

King Alfonso Xi In Lope’S Amor, Pleito Y Desafío: A Practical And Just Model Of Kingship In A Time Of Moral Ambiguity, Terri Carney Jan 2012

King Alfonso Xi In Lope’S Amor, Pleito Y Desafío: A Practical And Just Model Of Kingship In A Time Of Moral Ambiguity, Terri Carney

Scholarship and Professional Work - LAS

It is an axiom that the king is a pillar of Spanish Golden Age drama. Indeed, whether fictional or historic, on the stage or in the audience, the figure of the king is prevalent in the world of the comedia as a site of cultural anxiety surrounding the role of the monarchy in the newly urbanized and litigious seventeenth-century Spanish society. Scholars such as Melveena McKendrick (Playing the King) and Frank Casa (“The Duality of the King in Golden Age Drama”) have explored the personage of the king in a variety of these plays. Neither of these studies …

Luis Goytisolo's Teoría Del Conocimiento As Postmodern Autobiography, Terri Carney Jan 2012

Luis Goytisolo's Teoría Del Conocimiento As Postmodern Autobiography, Terri Carney

Scholarship and Professional Work - LAS
