Two Concepts Of Community, Erica L. Neely
Two Concepts Of Community, Erica L. Neely
Philosophy and Religion Faculty Scholarship
Communities play an important role in many areas of philosophy, ranging from epistemology through social and political philosophy. However, two notions of community are often conflated. The descriptive concept of community takes a community to be a collection of individuals satisfying a particular description. The relational concept of community takes a community to consist of more than a set of members satisfying a particular trait; there must also be a relation of recognition among the members or between the members and the community as a whole. The descriptive concept is simpler, however, it does not provide a sufficiently robust concept …

Paratexts To Frida Kahlo's Oeuvre: The Relationship Between The Visual And The Textual, The Self And The Other, From The Self-Portraits To The Diary Entries, Levilson C. Reis
Modern Languages & Cultures Faculty Scholarship
This article examines the relationship between the visual and the textual in Frida Kahlo’s paintings and writings. It argues that an understanding of this relationship would offer a better picture of Kahlo’s oeuvre. The article begins with an examination of the dedicatory inscriptions in the self-portraits, engaging with Gérard Genette’s concept of paratext and Philippe Lejeune’s autobiographical pact, as a prelude to the study of the relationship between text and drawings in the diary. In a close reading of the diary, informed by Jacques Lacan’s theories of subject formation and object relations, the article goes on to show that the …

Why There Is No Duty To Die, Gary W. Levvis, Margaret M. Levvis
Why There Is No Duty To Die, Gary W. Levvis, Margaret M. Levvis
Torrington Articles
John Hardwig argues that patients have a duty to end their lives when their continued existence imposes serious hardship on their caregivers. Hardwig has deflected many critics’ objections concerning the practical implications of his position. Our goal is to demonstrate the self-contradictory nature of the duty-to-die thesis. Once we eliminate the vagueness (over the essential conditions subtending a presumed duty to die) and the ambiguity (implicit in Hardwig’s use of the term “duty”), we find that the essential conditions for such a duty cannot be simultaneously satisfied. The problem is that the very process by which the duty to die …
More Than Just Nonsense Verse?: The Language Of Dr. Seuss And Children's Literacy, Nicole Hewes
More Than Just Nonsense Verse?: The Language Of Dr. Seuss And Children's Literacy, Nicole Hewes
Senior Scholar Papers
In this Senior Scholars project I wanted to demonstrate that Dr. Seuss books are much more than just nonsense verse. For the first part of my project, I familiarized myself with all of his texts and scrutinized his use of language in a textual analysis. By scrutinizing Geisel’s use of language and wordplay, I hoped to isolate some characteristics that make a Seuss book different from other types of stories and texts. The second part of my project was an empirical study that tested what influence reading a real Seuss text versus a fake Seuss text has on students’ performance …
The Structural Constitutional Principle Of Republican Legitimacy, Mark D. Rosen
The Structural Constitutional Principle Of Republican Legitimacy, Mark D. Rosen
All Faculty Scholarship
Representative democracy does not spontaneously occur by citizens gathering to choose laws. Instead, republicanism takes place within an extensive legal framework that determines who gets to vote, how campaigns are conducted, what conditions must be met for representatives to make valid law, and many other things. Many of the “rules-of-the-road” that operationalize republicanism have been subject to constitutional challenges in recent decades. For example, lawsuits have been brought against “partisan gerrymandering” (which has led to most congressional districts not being party-competitive, but instead being safely Republican or Democratic) and against onerous voter identification requirements (which reduce the voting rates of …

Inclusion, Signing, Socialization, And Language Skills, Virginia Heslinga Ed. D., Erica Nevenglosky
Electronic Journal for Inclusive Education
21st-century education finds schools challenged to increase the inclusion of students with widely varying learning abilities, language backgrounds, social diversity, and skills. Educators and administrators acknowledge a need for interactive learning that engages visual, auditory, linear, spatial, tactile, and kinetic learning styles. Students’ styles for learning vary in combinations and intensity and teachers need to combine flexibility and creativity to present material and practices that will build enthusiasm for learning. Adding sign language to a classroom of heterogeneous learners that includes English language learners (ELL) will aid in generating a positive learning environment, inclusive and interactive for varied learning needs …
Self-Made Writer: A Grounded Theory Investigation Of Writing Development Without Writing Instruction In A Charlotte Mason Home School, Jennifer C. Spencer
Self-Made Writer: A Grounded Theory Investigation Of Writing Development Without Writing Instruction In A Charlotte Mason Home School, Jennifer C. Spencer
Education Dissertations and Projects
The aim of this study was to explore how one adult who learned at home under the holistic methods of Charlotte Mason developed as a writer when this model eschews direct instruction in composition. The participant in the study developed exemplary writing skills despite the fact that the teaching methods of the parent did not conform to state standards, nor even to techniques typically accepted as best practices by such organizations as the International Reading Association (IRA) and the National Association for the Education of Young Children (NAEYC). As states across the nation are adopting and implementing the Common Core, …

Chinese Guanxi And Anglo-American Networking: A Comparative Investigation Of Cross-Cultural Interpersonal Business Relationships, Kevin D. Lo
Organization, Leadership, and Communication
Both Chinese and Anglo-American cultures highlight the importance of interpersonal relationships for successful business. In Chinese and Anglo-American culture respectively, guanxi and networking are linguistic equivalents. However, cross-culturally there are emic differences, particularly of Chinese guanxi, which are not captured by these linguistic equivalencies. As such, Chinese guanxi remain somewhat mysterious to a non-Chinese audience. This study explores the differences between Chinese guanxi and Anglo-American networking through a process of semi-structured interviews with n=10 individuals familiar with both cultural contexts. The data indicate three major themes for Chinese guanxi: a heavy emphasis on reciprocity, a long-term orientation, and culture specific …
Visions Of Juliana: A Portuguese Woman At The Court Of The Mughals, Taymiya R. Zaman
Visions Of Juliana: A Portuguese Woman At The Court Of The Mughals, Taymiya R. Zaman
History
This article discusses Juliana Dias da Costa (d. 1734), an influential Portuguese woman at the court of the Mughal king Bahadur Shah I (d. 1712). Through an analysis of sources that traverse three centuries and several languages, this article demonstrates how visions of Juliana were shaped by the political aspirations of those writing about her. To Jesuits, Juliana was a proxy for their mission in India, and to the Portuguese, she was one of their own, strategically placed at court to serve their interests. And for her impoverished descendants in British India, she was emblematic of times when they held …
A Work System Front End For Object-Oriented Analysis And Des, Steven Alter
A Work System Front End For Object-Oriented Analysis And Des, Steven Alter
Business Analytics and Information Systems
This paper proposes that basic ideas from the work system theory (WST) and the work system method (WSM) might become a front end to object-oriented analysis and design (OOAD). After describing the background motivation and summarizing work system concepts, it uses a hiring system example to show how two tools from WSM can be used as a front end for OOAD, in effect, a step before creating use case diagrams. Potential benefits of this approach stem from a business-oriented question, "how can we improve this work system's performance," rather than an IT-oriented question, "how can we create an IT artifact …
The Influence Of Social Priming On Speech Perception, Sierra N. Broussard
The Influence Of Social Priming On Speech Perception, Sierra N. Broussard
Senior Theses
Speech perception relies on auditory, visual, and motor cues and has been historically difficult to model, partially due to this multimodality. One of the current models is the Fuzzy Logic Model of Perception (FLMP), which suggests that if one of these types of speech mode is altered, the perception of that speech signal should be altered in a quantifiable and predictable way. The current study uses social priming to activate the schema of blindness in order to reduce reliance of visual cues of syllables with a visually identical pair. According to the FLMP, by lowering reliance on visual cues, visual …
Rc-Maps: Bridging The Comprehension Gap In Eap Reading, Angela Meyer Sterzik, Carol Fraser
Rc-Maps: Bridging The Comprehension Gap In Eap Reading, Angela Meyer Sterzik, Carol Fraser
Faculty & Staff Publications - ELI
In academic environments, reading is assigned not simply to transmit information; students are required to take the information, and based on the task set by the instructor, assess, analyze, and critique it on the basis of personal experiences, prior knowledge, and other readings (Grabe, 2009). Thus text-based comprehension (Kintsch, 1998) alone is not sufficient for academic success. Top-down processing is also required; this involves applying prior knowledge to define purpose(s), to make and verify hypotheses, and to infer and question content (Macaro & Erler, 2008; Urquhart & Weir, 1991). Although research has given teachers direction regarding the approach to use …

The Name Four Factor Model For Engaging Students In Academic Support Services, Keith Mcnaught, Elizabeth Beal
Education Conference Papers
This paper describes the first student experience survey of a newly established academic and support service, delivered by an “Academic Enabling and Support Centre” (AESC) at The University of Notre Dame Australia, Fremantle campus. The purpose of the study was to identify the key factors that would be likely to increase student access and participation rates, and accordingly enhance student outcomes. There was an overt institutional focus on the needs of students from disadvantaged backgrounds, driven, in part, by the national agenda to increase student diversity and participation in the tertiary sector. The survey demonstrated that several operational aspects related …

Baby Steps: The Changing Relationship Between Michigan Obstetricians And Certified Professional Midwives, Deborah M. Fisch
Marquette Elder's Advisor
The possible enactment of licensure for Certified Professional Midwives (CPMs) by the state of Michigan provides an opportunity to reexamine the CPM-obstetrician (OB) relationship that has grown up under CPMs' unlicensed state of practice. This article examines the legal and institutional factors that shape the CPM-OB relationship in Michigan, with comparisons to two other neighboring states, Indiana and Wisconsin, as well as to a more distant example, the Netherlands. Four potential relationships are identified and explored: Exclusion, Coexistence, Subordination and Cooperation. Other factors that may shape the relationship are also studied, such as medical malpractice liability, liability …

Chapter 11, Songs In Intimacy And Community In A Changing World: Sikaiana Life 1980-1993, William Donner
Sikaiana Ethnography
A chapter on song composition and performance in the Sikaiana ethnography. Songs were an important part of Sikaiana life in 1980-1993. There were two major song types: songs composed in a traditional Polynesian style, and songs composed for the more recently introduced guitar.

Defining Lutheranism From The Margins: Paul Peter Waldenström On Being A ‘Good Lutheran’ In America, Mark Safstrom
Defining Lutheranism From The Margins: Paul Peter Waldenström On Being A ‘Good Lutheran’ In America, Mark Safstrom
Scandinavian Studies: Faculty Scholarship & Creative Works
The histories of church institutions may often be written by the orthodox “winners,” but dissenters, protesters, and even heretics undoubtedly play important roles in giving direction to the parent institution’s evolving identity. Such voices from the margins often set the agenda at crucial moments, prompting both the dissenters and establishment to engage in a debate to define proper theology and practice. Once a dissenting group has formally separated from a parent body, there is a risk that teleological hindsight will obscure the nature of these conversations, including the reasons for the ultimate separation and the intentions of both the dissenters …

His Name Is Not Tadzio, Or Death In Marseilles: Anna Seghers’S Transit, Eckhard Rolz
His Name Is Not Tadzio, Or Death In Marseilles: Anna Seghers’S Transit, Eckhard Rolz
School of American and Global Studies Faculty Publications with a Focus on Modern Languages and Global Studies
Anna Seghers’s novel Transit was widely praised by critics, especially in the former German Democratic Republic. Heinrich Böll even regards it as the most beautiful novel Anna Seghers ever wrote. A close analysis of the text, however, reveals many lose ends, one-dimensional characters, stereotypical descriptions of people, and subjects who act irrationally and strange. It is a platform for preaching her political views intermixed with Greek Mythology and Christian imagery. In addition, she borrows heavily from Thomas Mann’s Death in Venice, but fails to reach the sophistication Mann’s novel exhibits.

A Case Study In The Superiority Of The Purposive Approach To Statutory Interpretation: Bruesewitz V. Wyeth , Donald G. Gifford, William L. Reynolds, Andrew M. Murad
Faculty Scholarship
This Article uses the Supreme Court’s 2011 decision in Bruesewitz v. Wyeth to examine the textualist or “plain meaning” approach to statutory interpretation. For more than a quarter-century, Justice Scalia has successfully promoted textualism, usually associated with conservatism, among his colleagues. In Bruesewitz, Scalia, writing for the majority, and his liberal colleague Justice Sotomayer, in dissent, both employed textualism to determine if the plaintiffs, whose child was allegedly harmed by a vaccine, could pursue common-law tort claims or whether their remedies were limited to those available under the no-fault compensation system established by the National Childhood Vaccine Injury Act. Despite …

The Illegal Process: Basic Problems In The Making And Application Of Censorship, James Grimmelmann
Faculty Scholarship
This essay is a response to Derek Bambauer's article Orwell's Armchair, which proposes "[a] statute enabling censorship of Internet materia." Bambauer's theory is process-oriented: it focuses on the institutions that engage in censorship and the procedures that they follow. Accordingly, the essay examines his arguments through the lens of the canonical Legal Process text: Hart and Sacks' The Legal Process. A series of notes and queries inquire whether his proposed statute would limit censorship, regularize it, or legitimate it.
The Tangled Law And Politics Of Religious Freedom, Peter G. Danchin
The Tangled Law And Politics Of Religious Freedom, Peter G. Danchin

This symposium Essay comments on four interrelated themes regarding the right to religious liberty in international law that emerge from Seval Yildirim's article Global Tangles: Laws, Headcoverings and Religious Identity, 10 SANTA CLARA J. INT’L L. 52 (2012). The first is the paradoxical language of freedom in struggles over attempts to proscribe the wearing of the hijab, especially regarding the principles of gender equality and women’s rights. The second is the apparent comfort that governance feminism exhibits with the state imposition of new (presumably woman liberationist) norms and how institutions such as courts may act not only as …
