Tax Liability For Wage Theft, Sachin S. Pandya
Tax Liability For Wage Theft, Sachin S. Pandya
Faculty Articles and Papers
This paper shows how, under existing tax law, illegal wage underpayment by an employer (sometimes called “wage theft”) may generate employer tax liability for unreported income or disallowed business expense deductions. Given that the tax authority needs information from the underpaid worker to prove such liability, the paper identifies two ways that a worker can transmit that information to a tax authority: becoming a tax informant, or bringing a qui tam action under a state false claims act. Finally, the paper discusses possible influences on the decision of the unpaid worker to inform on the employer to the tax authority, …

Health Mentally Incompetent Persons: Sterilization, Georgia State University Law Review
Health Mentally Incompetent Persons: Sterilization, Georgia State University Law Review
Georgia State University Law Review
The Act changes the standard of proof for order regarding sterilization of mentally incompetent persons from a preponderance of evidence to clear and convincing evidence. It provides for closed hearings and trials in connection with sterilization orders, the addition of a psychiatrist or psychologist on the examining team to determine whether a person is mentally incompetent, the requirement that the examining team consider the feasibility of alternate methods of birth control rather than sterilization and a deletion of governmental agencies from those authorized to file mental incompetency petitions.

Cityland – Vol. 9, No. 3, Center For New York City Law
CityLand - 2012
This issue of CityLand covers major land use and preservation developments in New York City as of May 2012. The City Council approved Rudin Management’s redevelopment of the former St. Vincent’s Hospital campus in Greenwich Village, including preservation of the Reiss Pavilion and creation of an AIDS memorial park. The City Planning Commission certified Jewish Home Lifecare’s proposal for a new nursing home on West 97th Street, despite community concerns about land scarcity. Landmarks resolved a long-standing conflict over an illegal addition on West 68th Street and approved revised additions to two buildings on Lispenard Street in Tribeca. The Park …

Nonprofit Continuum: Brazilian-Centered Organizations In The Bay Area Of San Francisco, Caroline Rehill
Nonprofit Continuum: Brazilian-Centered Organizations In The Bay Area Of San Francisco, Caroline Rehill
Master's Theses
Brazil has always been a country of immigration. Since the mid 1980s, Brazil has also become a country of emigration. Brazilians have migrated to the United States in large numbers throughout the past decades. In the host country, Brazilians experience the same issues inherent in any immigrant community, such as immigration status, education, health, and socio-economic issues. To address these issues and ease immigrants’ stay in the host country, nonprofit organizations and community groups are created. This thesis project examines, identifies, categorizes, and contextualizes the Brazilian-centered nonprofit organizations in the Bay Area of San Francisco. Contrary to existing research on …

The Relationship Between Student Ratings And Student Retention, Isis Artze-Vega
Open Access Dissertations
The relationship between students’ ratings of their instructors and student retention at the University of Miami was examined, extending a new thread of retention research which investigates the impact of students’ classroom experiences on their persistence. The predictive ability of other factors known to impact retention (including students’ race/ethnicity, SAT scores, family income, and grade-point averages) was also examined, and these were controlled for to discern the unique contribution of student ratings to retention. The sample consisted of students who enrolled in this institution in 2002, 2003, and 2004, and the independent variables of interest were their ratings of their …
