The 2010 Economic Impact Of The Nebraska Agricultural Production Complex, Eric Thompson, Bruce Johnson, Anil Giri Jun 2012

The 2010 Economic Impact Of The Nebraska Agricultural Production Complex, Eric Thompson, Bruce Johnson, Anil Giri

Department of Agricultural Economics: Faculty Publications

Nebraska’s agricultural production complex is remarkable in both its sheer volume of production and its diversity. The state is a national leader in the production of major crop and livestock commodities. It is also home to major input industries tied to agriculture as well as sectors processing agricultural production into value-added products, all of which contribute to its economic significance. Moreover, the growth of the state’s agriculture over the past decade has been phenomenal. In 2010, total farm cash receipts exceeded $20 billion for the first time, essentially double the 2000 level. And while the nation’s economy was hit by …

Gender-Specific Prison Reform: Addressing Human Rights Violations Against Women In Russia's Prisons, Courtney M. Skiles Jun 2012

Gender-Specific Prison Reform: Addressing Human Rights Violations Against Women In Russia's Prisons, Courtney M. Skiles

Washington International Law Journal

Russia currently incarcerates women in conditions that amount to human rights violations. Women incarcerated in Russia’s prisons experience not only oppression and abuse common to all those incarcerated in Russia, but also gender-specific harms. While Russia has signed on to many pivotal human rights treaties, it also has a long history of mass incarceration of its people. Today, the prison conditions for women in Russia reveal a need for reform. Reformers are challenged by a powerful State that has not prioritized the type of reform necessary to eliminate further harms done to incarcerated women. To ensure the rights of women …

Fiduciary Duties And Exculpatory Clauses: Clash Of The Titans Or Cozy Bedfellows, Louise Lark Hill Jun 2012

Fiduciary Duties And Exculpatory Clauses: Clash Of The Titans Or Cozy Bedfellows, Louise Lark Hill

University of Michigan Journal of Law Reform

Centuries ago, when land represented the majority of wealth, the trust was used primarily for holding and transferring real property. As the dominant form of wealth moved away from family land, the trust evolved into a device for managing financial assets. With this transformation came the use of exculpatory clauses by both amateur and professional trustees, providing an avenue for these fiduciaries to escape liability for designated acts. With the use of exculpatory provisions, discussion abounded about whether fiduciary duties were mandatory or subject to modification. The latter view eventually prevailed, with the majority of jurisdictions viewing fiduciary duties as …

Litigating The "Public Interest" In The Gilded Age: Common Law Business Regulation By Nineteenth-Century State Attorneys General, Paul Nolette Jun 2012

Litigating The "Public Interest" In The Gilded Age: Common Law Business Regulation By Nineteenth-Century State Attorneys General, Paul Nolette

Political Science Faculty Research and Publications

Heeding recent calls to explore the contributions of creative political actors other than federal judges to the process of American legal development, this article examines the role of state attorneys general (SAGs) during the period of rapid industrialization of the late nineteenth and early twentieth centuries. Consistent with recent revisionist accounts concerning the extent of government power during this era of supposed "laissez-faire," I find that SAGs during this period actively and creatively employed ancient common law legal theories in new ways to address the emerging corporate order during this time. Relying on a review of state court cases and …

Collateral Matters: Housing Code Compliance In The Mortgage Crisis, Kermit J. Lind Jun 2012

Collateral Matters: Housing Code Compliance In The Mortgage Crisis, Kermit J. Lind

Northern Illinois University Law Review

This article begins by describing the paradigm shift in mortgage loan servicing produced over the past two decades by securitization and exotic financing products using residential property for collateral. It shows how current mortgage servicing and debt collection practices ignore mortgage collateral and renders conventional housing code compliance procedures obsolete. It then suggests that new strategic thinking is needed to redesign and retool code compliance processes. Residential neighborhoods and communities need to protect themselves against the wanton lending and servicing practices produced in the wake of the mortgage disaster. There is still immanent disaster not only from the new financial …

Toward Economic Analysis Of The Uniform Probate Code, Daniel B. Kelly Jun 2012

Toward Economic Analysis Of The Uniform Probate Code, Daniel B. Kelly

University of Michigan Journal of Law Reform

Insights from economics and the economic analysis of law may be useful in analyzing succession law, including intestacy and wills as well as nonprobate transfers such as trusts. After surveying prior works that have examined succession from a functional perspective, I explore the possibility of utilizing tools like (i) transaction costs, (ii) the ex ante/ex post distinction, and (iii) rules versus standards, to illuminate the design of the Uniform Probate Code. Specifically, I investigate how these tools, which legal scholars have employed widely in other contexts, may be relevant in understanding events like the nonprobate revolution and issues like "dead …

Through The Eyes Of Higher Education Attorneys: How Department Chairs Are Navigating The Waters Of Legal Issues And Risk Management, Carol L.J. Hustoles Jun 2012

Through The Eyes Of Higher Education Attorneys: How Department Chairs Are Navigating The Waters Of Legal Issues And Risk Management, Carol L.J. Hustoles

Dissertations

Legal and risk management issues substantially impact the operations of colleges and universities, which face escalating compliance requirements in an increasingly litigious environment. Failing to assess legal liability issues and to constructively address them with risk management processes create vulnerability to claims and litigation, stretching limited institutional resources. Yet research studies are scarce on this topic.

This study used an online survey to obtain input from higher education attorneys across the U.S. regarding their perceptions of frequency and time spent on legal assistance for department chairpersons, chairs’ level of difficulty handling legal and risk management issues, matters having highest adverse …

Included in the study is a discussion of the reference works, research guides, and databases that make up these international legal collections. This is followed by a brief assessment of the trends and challenges that librarians face …

Environmental Justice On My Mind: Moving Georgia's Environmental Protection Division Toward The Consideration Of Enviornmental Justice In Permitting, David Deganian May 2012

Environmental Justice On My Mind: Moving Georgia's Environmental Protection Division Toward The Consideration Of Enviornmental Justice In Permitting, David Deganian

Environmental and Earth Law Journal (EELJ)

Under the Obama Administration, the Environmental Protection Agency (EPA) is leading efforts to incorporate environmental justice measures into its inner-workings. So, too, are numerous other federal agencies. These efforts, however, have little practical effect at the state level where sources of pollution, such as coal-fired power plants and other industrial facilities are granted permits to pollute. Under the cooperative federalism framework that exists today, the federal government cannot directly compel states to consider environmental justice unless such action is required by federal law. Thus, federal guidance pertaining to environmental justice will do little to prevent the pattern of siting pollution …
