The United States economy is struggling to recover from its worst economic downturn since the Great Depression. After several huge doses of conventional macroeconomic stimulus - deficit-spending and monetary stimulus - policymakers are understandably eager to find innovative no-cost ways of sustaining growth both in the short and long runs. In response to this challenge, the Kauffman Foundation convened a number of America’s leading legal scholars and social scientists during the summer of 2010 to present and discuss their ideas for changing legal rules and policies to promote innovation and accelerate U.S. economic growth. This meeting led to the publication …

Between "Voluntary Migrants" And War Refugees: The Health Of The Shan Burmese Migrant Workers In Northern Thailand, Nishant Verma, Celina Su, Coralie Chan, Peter Muennig

Publications and Research

The Shan are a large migrant group from Burma (Myanmar) found within Thailand. While some Shan migrate to escape the civil war within Burma, others migrate for economic opportunity. Despite the size of this population, little is known about their health. Our study highlights the need for expanded access to primary care among this Shan population. Despite the arduous and trying journeys of these Shan migrants, they do not display the level of health sometimes attributed to health selection among immigrant groups.

Securitizing Gender: Identity, Biometrics, And Transgender Bodies At The Airport, Paisley Currah, Tara Mulqueen Jan 2011

Securitizing Gender: Identity, Biometrics, And Transgender Bodies At The Airport, Paisley Currah, Tara Mulqueen

Publications and Research

It is widely assumed that the more information surveillance apparatuses can collect about an individual, the less risk she poses. In this article, we examine how gender figures into and potentially disrupts the link between identity and security. Our analysis centers on one very particular event: the confusion that erupts at the airport when US Transportation Security Administration agents perceive a conflict between the gender marked on one's papers, the image of one's body produced by a machine, and/or an individual's perceived gender presentation. Gender has been so deeply naturalized—as immutable, as easily apprehended, and as existing before and outside …

The C.R.E.A.T.E. Approach To Primary Literature Shifts Undergraduates’ Self-Assessed Ability To Read And Analyze Journal Articles, Attitudes About Science, And Epistemological Beliefs, Sally G. Hoskins, David Lopatto, Leslie M. Stevens Jan 2011

The C.R.E.A.T.E. Approach To Primary Literature Shifts Undergraduates’ Self-Assessed Ability To Read And Analyze Journal Articles, Attitudes About Science, And Epistemological Beliefs, Sally G. Hoskins, David Lopatto, Leslie M. Stevens

Publications and Research

The C.R.E.A.T.E. (Consider,Read, Elucidate hypotheses, Analyze and interpret data, Think of the next Experiment)method uses intensive analysis of primary literature in the undergraduate classroom to demystify and humanize science. We have reported previously that the method improves students’ critical thinking and content integration abilities, while at the same time enhancing their self-reported understanding of “who does science, and why.” We report here the results of an assessment that addressed C.R.E.A.T.E. students’ attitudes about the nature of science, beliefs about learning, and confidence in their ability to read, analyze, and explain research articles. Using a Likert-style survey administered pre- and postcourse, …

Designing Surveillance Law, Patricia L. Bellia Jan 2011

Designing Surveillance Law, Patricia L. Bellia

Journal Articles

As communications surveillance techniques become increasingly important in government efforts to detect and thwart criminal and terrorist activities, questions of how to reconcile privacy and law enforcement interests take on paramount importance. These questions have institutional as well as substantive dimensions. That is, the issue is not simply what the limits on communications surveillance should be, but who should set them — courts through application of the Fourth Amendment or legislatures through statutes and the oversight process? The scholarly literature offers divergent positive and normative perspectives on these questions.

Restoring Lost Connections: Land Use, Policing, And Urban Vitality, Nicole Stelle Garnett Jan 2011

Restoring Lost Connections: Land Use, Policing, And Urban Vitality, Nicole Stelle Garnett

Journal Articles

Justice William Brennan rightfully reminded all of us that state constitutional law is too often neglected in our courtrooms and our classrooms. State constitutions, to borrow from the late Chief Justice William Rehnquist, ought not to be "relegated to the status of a poor relation" in our constitutional legal structure. They differ in important ways from the federal law Constitution-and those differences provide the space within which our democratic experiment flourishes. And I am sure if Justice Brennan were here with us today, he would agree that we also should not neglect the study of the state and local policies …

The Contribution Of Set Switching And Working Memory To Sentence Processing In Older Adults, Mira Goral, Manuella Clark-Cotton, Avron Spiro Iii, Loraine Obler, Jay Verkuilen, Martin Albert

Publications and Research

This study evaluates the involvement of switching skills and working memory capacity in auditory sentence processing in older adults. The authors examined 241 healthy participants, aged 55 to 88 years, who completed four neuropsychological tasks and two sentence-processing tasks. In addition to age and the expected contribution of working memory, switching ability, as measured by the number of perseverative errors on the Wisconsin Card Sorting Test, emerged as a strong predictor of performance on both sentence-processing tasks. Individuals with both low working-memory spans and more perseverative errors achieved the lowest accuracy scores. These findings are consistent with compensatory accounts of …

Equality And Differences, John M. Finnis Jan 2011

Equality And Differences, John M. Finnis

Journal Articles

This revised and annotated version of the H.L.A. Hart Memorial lecture in the University of Oxford in June 2011 has some significant differences in coverage from the essay of the same title published in the American Journal of Jurisprudence 56 (2011) 17-44, including a brief discussion of Waldron’s treatment of basic equality and Cohen’s “luck-egalitarianism”. The object of the lecture is to establish the grounds of basic human equality, and to indicate how neglect of non-basic inequalities and of preconditions for sustainable common good tends to ensure that legal measures promoting equality rights and condemning ‘discrimination’ yield serious injustices (violations …

Do Joint Parenting Laws Make Any Difference?, Margaret F. Brinig, Douglas W. Allen Jan 2011

Do Joint Parenting Laws Make Any Difference?, Margaret F. Brinig, Douglas W. Allen

Journal Articles

Using a unique data set on divorcing couples, we analyze the effects of a change in legal entitlement on the outcomes for divorcing couples. In particular, we analyze the 1997 change to custody provisions in the State of Oregon. Prior to 1997, Oregon assigned custody, based on the discretion of the court, in the best interests of the child. This was changed to a presumption- of joint parenting, which manifests in the courts encouraging and imposing joint (or shared) custody in cases that otherwise would have had sole custody arrangements. We find that the law had several implications for divorce …

Characteristics Of Road-Kill Locations Of San Clemente Island Foxes, Nathan P. Snow, William F. Andelt, Nicholas P. Gould Jan 2011

Characteristics Of Road-Kill Locations Of San Clemente Island Foxes, Nathan P. Snow, William F. Andelt, Nicholas P. Gould

United States Department of Agriculture Wildlife Services: Staff Publications

Mortalities from collisions with vehicles have created concern for the welfare of the San Clemente Island fox (Urocyon littoralis clementae); 1 of only 6 genetically distinct subspecies of island fox. To find possible solutions for minimizing these mortalities, we compared 9 characteristics of roads and roadsides at kill-sites and control-sites to ascertain whether certain features were associated with risk of collisions. We found that kill-sites were positively associated with the volume of traffic, and negatively associated with the distance of motorists’ visibility, which had not been previously identified for island foxes. Additionally, visual obstructions along roadsides (i.e., steep …

Finding Her Voice: A Conversation With Allison Whittenberg, Kaavonia Hinton

Teaching & Learning Faculty Publications

Sweet Thang. Life Is Fine. Hollywood & Maine. These are all books by poet and dramatist Allison Whittenberg. These novels are about young black women coming to terms with who they are intellectually, emotionally, and culturally. Critics say Whittenberg’s young adult fiction is well written, and they praise the way she crafts convincing dialogue and moving narration ( Jones, 2009 ; Rochman, 2008 ; Brautigam, 2006 ; Hutley, 2006 ). They also commend her for offering readers an opportunity to see characters grapple with issues they are concerned about. For example, Martin (2006) points out that in Sweet Thang , …

The Impact Of Conformity Salience On Technical Questionnaire Completion In Male And Female College Students, Jessica R. Flansburg, Terry F. Pettijohn Ii Jan 2011

The Impact Of Conformity Salience On Technical Questionnaire Completion In Male And Female College Students, Jessica R. Flansburg, Terry F. Pettijohn Ii

Journal of Social, Behavioral, and Health Sciences

This study explored the effect of conformity salience on the technical completion of a questionnaire. Previous research has documented the motivational effects of priming on behavior, but not specifically conformity salience and questionnaire completion. Participants (

N

= 71) were randomly assigned to read a statement to prime conformity or to not prime conformity before completing a questionnaire with specific instructions of how to complete responses by filling in circles with a pencil. Participants in the conformity salient condition were hypothesized to be more likely to follow the directions of the questionnaire than participants in the conformity nonsalient condition, and …

Predictors Of Snack Food Consumption Among Upper Elementary Children Using Social Cognitive Theory, Paul Branscum, Manoj Sharma Jan 2011

Predictors Of Snack Food Consumption Among Upper Elementary Children Using Social Cognitive Theory, Paul Branscum, Manoj Sharma

Journal of Social, Behavioral, and Health Sciences

This study examined the extent to which the constructs of social cognitive theory (SCT) can predict snack food consumption among elementary school-age children. A valid and reliable 22-item instrument was administered to 212 children. Snack food consumption was evaluated by asking children to recall and report all foods consumed outside of meals in the previous 24 hours. On average, the children consumed 513 calories from snack foods per day. Most came from sugar-sweetened beverages and calorically dense snacks. Fruit and vegetable snacks were positively predicted by self-control ( R2

= 0.017), and sugar-sweetened beverage snacks were negatively predicted by …

The Impact Of Infectious Disease On Chronic Disease: A Review Of Contemporary Findings, Wendy Berke Jan 2011

The Impact Of Infectious Disease On Chronic Disease: A Review Of Contemporary Findings, Wendy Berke

Journal of Social, Behavioral, and Health Sciences

Infectious diseases are among the top causes of death in adults and children. Chronic diseases such as cardiovascular disease and cancer are among the top causes of death in adults. Associations between bacterial and viral infectious agents and subsequent development of chronic disease have been made in the past but are currently being reexamined with more rigor and specificity. This review examines infectious disease agent causes and associations with cancer, cardiovascular disease, metabolic disease, and neurodegenerative disease. These associations will impact future research, surveillance, treatment, and prevention of both infectious and chronic diseases.

Generational Shift And Drug Abuse In Older Americans, John B. White, David F. Duncan, Thomas Nicholson, Dana Bradley, John Bonaguro Jan 2011

Generational Shift And Drug Abuse In Older Americans, John B. White, David F. Duncan, Thomas Nicholson, Dana Bradley, John Bonaguro

Journal of Social, Behavioral, and Health Sciences

Since the problem of substance abuse by older adults began to receive serious professional attention, the focus has been almost exclusively on alcohol abuse. This reality is changing as the “baby boomers” age. We examined data from the National Household Survey on Drug Abuse (1985) and the National Survey on Drug Use and Health (2006) comparing nationwide prevalence of both legal and illicit drugs. Use of drugs by category varied over the study period; some showed little change (e.g., alcohol) while others showed marked increase (e.g., marijuana, cocaine). We found that the population of older Americans in 2006 contained greater …

In A Class Of Their Own: The Eighth Circuit Upholds A Credit Card Agreement's Class Action Waiver And Mandatory Arbitration Clause, Lucinda Housley Luetkemeyer

Missouri Law Review

The United States Court of Appeals for the Eighth Circuit recently joined the cadre of courts to uphold class action waivers in arbitration agreements. In Cicle v. Chase Bank USA, the court held that a Missouri woman's putative class action suit against a credit card company was barred due to theclass action waiver in her card agreement's arbitration clause. The Eighth Circuit reversed a sharply worded federal district court order and rejected the plaintiff s contention that the class action waiver was a "de facto immunity provision[]" for the credit card company which would leave her and other similarly situation …

"Consider With Whom You Are Working": Discourse Models Of School Librarianship In Collaboration, Sue C. Kimmel Jan 2011

"Consider With Whom You Are Working": Discourse Models Of School Librarianship In Collaboration, Sue C. Kimmel

Teaching & Learning Faculty Publications

The question of why school librarians still struggle to fully enact the roles defined in "Information Power" and "Empowering Learners" may be viewed as a struggle to gain recognition from others that this is what a "real school librarian" does. Discourse Analysis offers school library research a new theoretical and analytical tool to explore how these roles or identities are created or contested in interactions with others by examining the moment-to-moment talk for the presence of larger meanings, or "discourses." Applying a discourse analysis to an exchange that occurred near the end of an ethnographic study of collaborative discourse between …

Choosing My Best Thing: Black Motherhood And Academia, Kaavonia Hinton-Johnson Jan 2011

Choosing My Best Thing: Black Motherhood And Academia, Kaavonia Hinton-Johnson

Teaching & Learning Faculty Publications

(First paragraph) Scholars argue that White feminist theoretical undertakings concerning mothering are not appropriate for studying Black mothers because they rarely take race and culture into consideration (Collins, 1991; Joseph, 1991). Collins (1994) argues that the experiences of Black mothers are paramount to any inclusive discussion about mother/child relationships. Scholars who have turned their attention to the Black mother often do so via literary works and/or criticism (see, for example, Crews, 1996; Morrison, 1987; Wade-Gayles, 1984; Washington, 1990; Williams, 1986) or in reality (Collins, 1991, 1994; Roberts, 1997a). However, a computerized search for studies on the Black mother produces literature …
