Spilling Secrets: Trade Secret Disclosure And Takings In Offshore Drilling Regulation, Michael A. Greene
Richmond Journal of Law & Technology
This Article will explore whether the law may require the disclosure of adequate proprietary information to enable effective regulation. Part II will discuss the settled law regarding the property status of trade secrets, the regulatory takings doctrine, the applicability of the Takings Clause of the United States Constitution to proprietary data, and the exactions doctrine. Part III will explore the validity of the mandatory submission of proprietary health, safety, and environmental data to government regulators, with the guarantee that such data will be kept secret from competitors and the public. Part IV will then explore the validity of regulation mandating …

Current And Emerging Transportation Technology: Final Nails In The Coffin Of The Dying Right Of Privacy?, James D. Phillips, Katharine E. Kohm
Richmond Journal of Law & Technology
Transportation networks constitute “the circulatory system of our economy.” The distinct modes that constitute the American transportation system—air, rail, transit, highways, and waterways—impact the entire range of our daily activities. Just as the human body depends on its circulatory system for life and well being, the United States’ vitality would grind to a halting stop without a vibrant transportation system.

Community Of Inquiry Framework And Learning Outcomes, Jennifer Ann Maddrell
Community Of Inquiry Framework And Learning Outcomes, Jennifer Ann Maddrell
STEMPS Theses & Dissertations
First described by Garrison, Anderson, and Archer (2000), the Community of Inquiry (CoI) framework suggests social presence, teaching presence, and cognitive presence are essential elements to foster successful educational experiences in computer-mediated higher education distance learning environments. While hundreds of CoI-based articles have been published since 2000, those critical of the framework and related research suggested a lack of empirical evidence to support the framework's central claim that a CoI leads to deep and meaningful learning outcomes (Rourke & Kanuka, 2009). The current study, conducted with 51 graduate students in five distance education courses at the same university, compared the …

Ogalala Sioux Tribal Profile, Karen Kimbro Chase
Ogalala Sioux Tribal Profile, Karen Kimbro Chase
Tribal Law Journal
This profile offers an excellent overview of Oglala Sioux law, both traditional and modern. Like many tribes, the Indian Reorganization Act had a major impact on the contemporary law of the Oglala Sioux. While the IRA resulted in tribal constitutions that reflected the values of the U.S. Constitution, this profile examines the traditional and customary law that was subsequently incorporated into the Oglala Sioux Constitution. This profile includes a brief history of the Oglala Sioux, overview of traditional law, governmental structure, summary of contemporary law, and history of political activism.

Sustainable Development In The Cultural Context: A Review Of Sources And Analysis Of Gaps, Joann Jacoby, Liz Cooper
University Libraries & Learning Sciences Faculty and Staff Publications
In order to be effective, sustainable development efforts must be grounded in a fundamental understanding of the local context. Two librarians with backgrounds in anthropology will address the issue of culturally-grounded sustainable development resources available online and in digital repositories. The presenters will review the literature on the importance of the cultural context in sustainable development, identify strengths of current culturally-grounded online collections, and review gaps in order to identify areas where libraries should focus further efforts to develop these types of collections.

New Adventures Of The Old Bureau: Modern-Day Reclamation Statutes And Congress Unfinished Environmental Business, Reed D. Benson
New Adventures Of The Old Bureau: Modern-Day Reclamation Statutes And Congress Unfinished Environmental Business, Reed D. Benson
Faculty Scholarship
Congress established the reclamation program in 1902, and the hundreds of federal water projects built in the 20th century helped shape the West. Today, the Bureau of Reclamation plays an enormously important role in managing these projects. But with no big new dams to build, the Bureau has been forced to revise its mission to address todays water management challenges, such as stretching finite water supplies and restoring aquatic ecosystems. Through both site-specific enactments and programmatic statutes, Congress in recent years has given the Bureau new authority and direction to address these modern challenges. But Congress has left a significant …
Too Hot To Handle: Climate Change And Agricultural Water Use, Denise D. Fort
Too Hot To Handle: Climate Change And Agricultural Water Use, Denise D. Fort
Faculty Scholarship
The world faces enormous challenges in responding to looming crises in food and water. Responding to this challenge will require flexibility; such flexibility may be impeded by legal institutions. This paper looks at the western United States and discusses the role of irrigated agriculture in that region. Because of climate change, a growing population, declining groundwater, the need to protect ecosystems and other conflicts, the author suggests that all water uses, including long-standing agricultural water rights, need to be examined in light of these changes. Legal systems have tended to serve the status quo, but perhaps the law can help …

They also summarize the citation reform steps taken in selected jurisdictions. Finally, John Cannan, …
How Law Schools Benefit When Librarians Publish, Teach And Hold Faculty Status, Carol A. Parker
How Law Schools Benefit When Librarians Publish, Teach And Hold Faculty Status, Carol A. Parker
Faculty Scholarship
Many non-director academic law librarians publish and teach legal research classes. Some hold faculty status as well. Law librarians have expertise in the development and delivery of legal research instruction methodologies and are developing a body of literature documenting their efforts to create and share a pedagogy of legal research instruction. Principles of shared faculty governance entitle library faculty to contribute to the development and delivery of a curriculum of legal research instruction. Encouraging law librarian participation in the shared governance of law schools should lead to increasing opportunities for the successful reform of legal education curricula with respect to …
Shadowing The Flag: Extending The Habeas Writ Beyond Guantanamo, Dawinder S. Sidhu
Shadowing The Flag: Extending The Habeas Writ Beyond Guantanamo, Dawinder S. Sidhu
Faculty Scholarship
The purpose of this Article is to explain why the D.C. Circuit got it wrong. Part I provides an overview of the facts and relevant law that formed the basis for the decision. Part II shows that the court misapplied the basic factors set forth initially by the Court in Eisentrager and later clarified in Boumediene. Part III contains a proposed framework that reorients and reframes these factors in order to make habeas jurisdiction analyses more workable and consistent with the historical justifications for the writ, separation of powers considerations, and governing case law. Part IV applies this framework to …

A Crisis Of Confidence And Legal Theory: Why The Economic Downturn Should Help Signal The End Of The Doctrine Of Efficient Breach, Dawinder S. Sidhu
Faculty Scholarship
To understand subprime behavior and efficient breaches, it is imperative to first examine the necessary social predicate for economic transactions. Accordingly, Part I will offer an overview of society and the market, highlighting the importance of reciprocity and trust to both. Part II will define the economic transactions implicated by this Article: basic contracting, efficient breach of contract, and the subprime behavior of the current economic crisis. Part III will make explicit the nexus between subprime behavior and efficient breaches by explaining that subprime behavior and efficient breaches are linked by shared elements; they are opportunistic in nature, are interested …
Public On Paper: The Failure Of Law To Protect Public Water Uses In The Western United States, Reed D. Benson
Public On Paper: The Failure Of Law To Protect Public Water Uses In The Western United States, Reed D. Benson
Faculty Scholarship
Water conflicts in the western United States increasingly arise from competition between traditional economic uses (especially irrigation, municipal supply and hydropower) and public uses (especially environmental protection and water-based recreation). Western United States water law, based on the prior appropriation doctrine, has always promoted maximizing ‘beneficial use’ of the resource and has effectively protected water allocations for traditional purposes. Public water uses also enjoy some legal protection, but it exists mostly on paper; in practice, neither statutory public interest provisions nor the non-statutory public trust doctrine has been widely effective. This paper identifies the relevant legal principles and briefly explains …
Can Havruta Style Learning Be A Best Practice In Law School?, Barbara P. Blumenfeld
Can Havruta Style Learning Be A Best Practice In Law School?, Barbara P. Blumenfeld
Faculty Scholarship
Havruta is a traditional Jewish method that seems compatible with legal education because of its focus on process, and so adaptable to law school training in legal reasoning, and because it is based upon dispute and resolution, another aspect that corresponds with the study of law. A unique form of collaborative student centered learning involving pairs of students, this article considers the application of Havruta to the law school setting and whether it should be incorporated into the law school curriculum.

Comprehensive Treatment Of Women With Postpartum Psychosis Across Health Care Systems From Swedish Psychiatrists' Perspectives, Inger Engqvist, Arne Åhlin, Ginette Ferszt, Kerstin Nilsson
Comprehensive Treatment Of Women With Postpartum Psychosis Across Health Care Systems From Swedish Psychiatrists' Perspectives, Inger Engqvist, Arne Åhlin, Ginette Ferszt, Kerstin Nilsson
The Qualitative Report
Studies concerning the psychiatrist's experiences of treating women with postpartum psychosis (PPP) or how they react to these women are limited in the literature. In this study a qualitative design is used. Data collection includes semi-structured interviews with nine Swedish psychiatrists working in psychiatric hospitals. The audio-taped interviews are transcribed verbatim and analyzed using content analysis. The findings consist of the categories: Protection, Treatment, Care, and Reactions. The psychiatrists describe emotions such as compassion, empathy and distress. A conclusion is that the psychiatrists focus on protecting the women from suicide and/or infanticide. Given the degree of stress the psychiatrists can …
Interviewing The Investigator: Strategies For Addressing Instrumentation And Researcher Bias Concerns In Qualitative Research, Ronald J. Chenail
Interviewing The Investigator: Strategies For Addressing Instrumentation And Researcher Bias Concerns In Qualitative Research, Ronald J. Chenail
The Qualitative Report
Instrumentation rigor and bias management are major challenges for qualitative researchers employing interviewing as a data generation method in their studies. A usual procedure for testing the quality of an interview protocol and for identifying potential researcher biases is the pilot study in which investigators try out their proposed methods to see if the planned procedures perform as envisioned by the researcher. Sometimes piloting is not practical or possible so an "interviewing the investigator" technique can serve as a useful first step to create interview protocols that help to generate the information proposed and to assess potential researcher biases especially …

Reports & Documents
Health Impact Assessment (HIA) is a set of procedures, methods and tools that estimate the effects of a policy, program or project on the health of a population. Ideally an HIA is conducted before the policy, program or project is implemented so that findings and recommendations can influence decision-making. An HIA can take a variety of different forms ranging from a “rapid” HIA that is written based on existing data and published literature to an HIA that could require months to complete and where local data is collected and analyzed to inform recommendations. The result of an HIA is evidence-based …

Aggressive Embryonal Rhabdomyosarcoma Presenting As Schwanoma : A Case Report, Mohammad Sohail Awan, Montasir Junaid, Zain A. Sobani
Department of Radiology
Rhabdomyosarcomas (RMS) are thought to arise from pluripotent muscle cell precursors intended to form the bodyís future striated muscle. Due to the wide distribution of striated muscle across the body these tumors may appear anywhere and cause symptoms accordingly. Presenting symptoms are highly variable and based on the tumor size and location making clinical diagnosis difficult. The diagnosis of RMS is based on histological examination; however they express varying cytologic pictures representing the different stages of rhabdomyoblasts and their development into skeletal muscle presenting pictures from highly to poorly differentiated neoplasms. Therefore their histological diagnosis also requires the use of …
