Closing The Door On Misconduct: Rethinking The Ethical Standards That Govern Summations In Criminal Trials, Daniel S. Medwed Jan 2011

Closing The Door On Misconduct: Rethinking The Ethical Standards That Govern Summations In Criminal Trials, Daniel S. Medwed

UC Law Constitutional Quarterly

Closing argument is the most pivotal moment in a criminal trial. It represents the last opportunity for prosecutors to convince jurors of the defendant's guilt and for defense lawyers to show reasonable doubt. As a result, criminal lawyers may be tempted to conclude with sweeping arguments that pull at the heartstrings of their target audience, the jury. Scholars dating back to Aristotle have warned that the most persuasive arguments often contain an appeal to emotion-and that emotionally laden rhetoric can distract people from making rational choices.

Legal ethicists have struggled with the issues surrounding closing arguments, trying to reconcile the …

The Adam Walsh Act: Juveniles And Sex Offender Registration And Notification, Kallee Spooner Jan 2011

The Adam Walsh Act: Juveniles And Sex Offender Registration And Notification, Kallee Spooner

Undergraduate Review

Increased public concerns of juvenile sex offenders fueled the passage of the Adam Walsh Child Protection and Safety Act in 2006. The media coverage of these adolescents and public perception were influential in the enactment of this policy. Public fear is aroused by isolated incidents of deviance or crime. Media accounts highlight extreme cases, instead of more common incidents of sexual assaults (Harris & Lurigio, 2010). The fear culminates in the forming of groups of experts and concerned citizens that demand reform. Legislators cite media and views of their constituents as their primary sources of information about sex offenses and …

UIC John Marshall Journal of Information Technology & Privacy Law

In an unsuccessful attempt to heighten security, schools are implementing a technology that offers access to children’s personal information and minute-by-minute location. Although not entirely new, Radio Frequency Identification (RFID) technology use has recently been expanding within the school arena. Skeptics knowledgeable about the downfalls of the technology, however, have reason to be concerned. In order to understand the true urgency of this issue, this comment will explain the background of RFID technology, specifically what RFID tags are, how they are used, their purposes, and how they have become unsafe. Included will be an explanation of the reasons that schools …

2011 Maine Crime Victimization Survey Report: Informing Public Policy For Safer Communities, Mark Rubin, Jennifer Dodge, Eric Chiasson, Carmen Dorsey

Justice Policy

Executive Summary:

The purpose of the Maine Crime Victimization Survey (MCVS) is to better understand the nature and extent of crime in Maine. This report discusses findings of the 2011 survey and highlights areas of comparison with the original MCVS, which was conducted in 2006.

Many states, including Idaho, Utah, and Minnesota, have conducted state specific crime victimization surveys because the National Crime Victimization Survey (NCVS), a national data source on crime trends, cannot be parsed to the state level. Maine has been and is following this trend to better understand the frequency, characteristics, and consequences of criminal victimization.
