Smart City As Urban Innovation: Focusing On Management, Policy, And Context, Taewoo Nam, Theresa A. Pardo Jan 2011

Smart City As Urban Innovation: Focusing On Management, Policy, And Context, Taewoo Nam, Theresa A. Pardo

Center for Technology in Government

5th International Conference on Theory and Practice of Electronic Governance (ICEGOV2011), Mon, 26 Sep 2011.This paper sees a smart city not as a status of how smart a city is but as a city’s effort to make itself smart. The connotation of a smart city represents city innovation in management and policy as well as technology. Since the unique context of each city shapes the technological, organizational and policy aspects of that city, a smart city can be considered a contextualized interplay among technological innovation, managerial and organizational innovation, and policy innovation. However, only little research discusses innovation in management …

Police Mistakes Of Law, Wayne A. Logan Jan 2011

Police Mistakes Of Law, Wayne A. Logan

Scholarly Publications

This Article addresses something that most Americans would consider a constitutional impossibility: police officers stopping or arresting individuals for lawful behavior and courts deeming such seizures reasonable for Fourth Amendment purposes, thereby precluding application of the exclusionary rule. Today, however, an increasing number of courts condone seizures based on what they consider “reasonable” police mistakes of law, typically concerning petty offenses, and permit evidence secured as a result to support prosecutions for unrelated, more serious offenses (usually relating to guns or drugs). The Article surveys the important rule-of-law, separation-of-powers, and legislative-accountability reasons supporting continued judicial adherence to the historic no-excuse …

Misuse And Abuse Of Legal Argument By Analogy In Transjudicial Communication: The Case Of Zaheeruddin V. State, Amjad Mahmood Khan Jan 2011

Misuse And Abuse Of Legal Argument By Analogy In Transjudicial Communication: The Case Of Zaheeruddin V. State, Amjad Mahmood Khan

Richmond Journal of Global Law & Business

This article explores the risks and limits of transjudicial communication. In particular, I critique the scholarly contention that transjudicial communication can be built upon commonly accepted methods of legal reasoning. I argue that transnational courts do not uniformly understand or apply commonly accepted methods of legal reasoning, especially legal argument by analogy. As a result, transnational courts that utilize transjudicial communication can and do render specious, even destructive, judicial opinions. I analyze the case of Zaheeruddin v. State—a controversial decision by the Supreme Court of Pakistan that upheld the constitutionality of Pakistan’s antiblasphemy ordinances. The Supreme Court of Pakistan poorly …

Prosecuting Terrorism: The Material Support Statute And Muslim Charities, Michael G. Freedman

UC Law Constitutional Quarterly

The federal law prohibiting the provision of material support to terrorist organizations has been no stranger to controversy. From its politically charged origins through its repeated amendment after September 11, 2001, it has remained an important, but often critiqued, weapon in the government's legal response to terrorism. The most prominent legal challenge to the law lasted over a decade. It culminated in June 2010, when the United States Supreme Court upheld the constitutionality of the law in Holder v. Humanitarian Law Project. The Court's opinion, however, correctly recognized that important questions remain unresolved.

One such question, which this Note addresses, …

Implementing Evidence-Based Principles In Community Corrections (2011), Mark Rubin, William Ethridge Mppm, Michael Rocque

Maine Statistical Analysis Center

In 2003, the National Institute of Corrections (NIC) selected Maine as one of two pilot states1 to demonstrate and test an integrated approach to the implementation of evidence-based principles in community corrections. The project model and conceptual framework developed by NIC emphasized the maintenance of an equal and integrated focus on three domains during implementation:

1. Evidence-based principles (EBP);

2. Organizational development; and

3. Collaboration.

The stated project goal was to build learning organizations that reduce recidivism through the systemic integration of evidence-based principles in collaboration with community and justice partners. NIC provided technical assistance to Maine during the course …

Community Life In Nonmetropolitan Nebraska: Current Perceptions And Future Strategies: 2011 Nebraska Rural Poll Results, Rebecca J. Vogt, Randolph L. Cantrell, Bradley D. Lubben, Connie Reimers-Hild

Nebraska Rural Poll

By many different measures, rural Nebraskans are positive about their community. Many rural Nebraskans rate their community as friendly, trusting and supportive. Most rural Nebraskans also say it would be difficult to leave their community. In addition, most rural Nebraskans disagree that their community is powerless to control its future.

Differences of opinion exist by the size of their community. Residents of smaller communities are more likely than residents of larger communities to rate their community favorably on its social dimensions and to have positive sentiments about their community. However, residents of larger communities are more likely than residents of …

An Examination Of The Organizational Factors That Contribute To Police Officer Perceived Organizational Support, Dustin Cody Gaines

Theses Digitization Project

The purpose of this research was to examine the effect of various organizational arrangements on police officers' belief that they and their work are valued by the department. This study examines four management domains and their impact on officers' feelings of being valued. These four management domains are: inclusiveness in decision-making, supervisor relationships, professionalism. and communicated direction. The data came from a sample of 176 survey respondents who are patrol officers in a Southern Californian municipal police department.
