Every Step You Take, They'll Be Watching You: The Legal And Practical Implications Of Lifetime Gps Monitoring Of Sex Offenders, Sarah Shekhter Jan 2011

Every Step You Take, They'll Be Watching You: The Legal And Practical Implications Of Lifetime Gps Monitoring Of Sex Offenders, Sarah Shekhter

UC Law Constitutional Quarterly

In 2006, California voters passed Proposition 63 ("Jessica's Law") which, among other provisions, required lifetime GPS monitoring of sex offenders. So far, California has only succeeded in fixing GPS devices to registered sex offenders on parole, yet this already constitutes the largest use of GPS monitoring anywhere in the world. A proper analysis of the constitutional issues surrounding electronic surveillance of parolees, probationers, and the released is warranted before further implementation.

This note explores past constitutional challenges to surveillance technology and sex offender legislation, applying their analyses to lifetime monitoring of sex offenders. It concludes that lifetime GPS monitoring threatens …

Shadowing The Flag: Extending The Habeas Writ Beyond Guantanamo, Dawinder S. Sidhu Jan 2011

Shadowing The Flag: Extending The Habeas Writ Beyond Guantanamo, Dawinder S. Sidhu

Faculty Scholarship

The purpose of this Article is to explain why the D.C. Circuit got it wrong. Part I provides an overview of the facts and relevant law that formed the basis for the decision. Part II shows that the court misapplied the basic factors set forth initially by the Court in Eisentrager and later clarified in Boumediene. Part III contains a proposed framework that reorients and reframes these factors in order to make habeas jurisdiction analyses more workable and consistent with the historical justifications for the writ, separation of powers considerations, and governing case law. Part IV applies this framework to …

Interoperability And Information Sharing, Sean P. Varano, Thomas J. Dover Jan 2011

Interoperability And Information Sharing, Sean P. Varano, Thomas J. Dover

Justice Studies Faculty Publications

Communication and information sharing are two of the most pressing issues facing the public safety community today. In previous chapters of this volume, authors have made note of the changing public safety landscape as it relates to the need for enhanced information and intelligence sharing among a broad cross-section of organizations. Public safety organizations, particularly law enforcement agencies, have been quick to adopt emerging technologies that have allowed for greater communication and information sharing capacities. While substantial improvements have been made over the decades that enhanced communication and information sharing, many challenges remain in the move to seamlessly integrated communication …

Communities As Allies, Joseph Schafer, Sean P. Varano, Nicholas Libby Jan 2011

Communities As Allies, Joseph Schafer, Sean P. Varano, Nicholas Libby

Justice Studies Faculty Publications

A popular axiom attributed to British policing is the police are the public and the public are the police. Inherent in this term is a blurring of the distinction between the police and the public they serve; the police are cast as being little different from the citizenry and citizens are cast into a role of responsibility for the safety and well-being of the community. In effect, communities are framed as allies in the fight to ensure safe and secure neighborhoods. Across space and time this idea has held uneven sway within American policing ideologies. This essay considers the relationship …

Randomization And The Fourth Amendment, Bernard E. Harcourt, Tracey L. Meares Jan 2011

Randomization And The Fourth Amendment, Bernard E. Harcourt, Tracey L. Meares

Articles

Randomized checkpoint searches are generally taken to be the exact antithesis of reasonableness under the Fourth Amendment. In the eyes of most jurists checkpoint searches violate the central requirement of valid Fourth Amendment searches-namely, individualized suspicion. We disagree. In this Article, we contend that randomized searches should serve as the very lodestar of a reasonable search. The notion of "individualized" suspicion is misleading; most suspicion in the modem policing context is group based and not individual specific. Randomized searches by definition are accompanied by a certain level of suspicion. The constitutional issue, we maintain, should not turn on the question …

What Leaders Should Know About Courage, Paul B. Lester, Cynthia Pury Jan 2011

What Leaders Should Know About Courage, Paul B. Lester, Cynthia Pury

United States Army: Publications

On the morning of March 16, 1968, Warrant Officer One Hugh Thompson JI. flew above the hamlet of Son My, near the village of My Lai in the Republic of Vietnam, in support of U.S. Army ground operations. His mission was dangerous but routine-provide reconnaissance for a battalion task force searching for enemy forces. What he saw and did that day, however, would irrevocably change his life.

The My Lai massacre is a well-documented stain on American military history: An infantry company led by Captain Ernest Medina, Lieutenant William Calley, and others entered Son My and systematically murdered hundreds of …

Trust The Key To Leading When Lives Are On The Line, Patrick J. Sweeney, Kurt T. Dirks, David C. Sundberg, Paul B. Lester

United States Army: Publications

The Hostage Rescue Team (HRT) of the Federal Bureau of Investigation was called in to assist the bureau's Special Weapons and Tactics (SWAT) team in Memphis to apprehend a married couple wanted on drug trafficking charges. The fugitive couple and an adult son, all with criminal records, were believed to be living in trailers in a mountain valley where outsiders would be easily noticed. The fugitives were known to stockpile weapons and had vowed never to be taken alive by law enforcement. Thus the FBI considered them to be armed and extremely dangerous.

Two HRT snipers along with two SWAT …

The U.S. Supreme Court Gets It Right In Arizona V. Gant: Justifications For Rules Protect Constitutional Rights, Shenequa L. Grey Jan 2011

The U.S. Supreme Court Gets It Right In Arizona V. Gant: Justifications For Rules Protect Constitutional Rights, Shenequa L. Grey

St. Thomas Law Review

The purpose of this article is to demonstrate how the justifications or rationales for legal principles form the basis for compliance with the Fourth Amendment of the United States Constitution; and that therefore, failure to comply with those justifications leads to unconstitutional searches and seizures. Strict compliance with the underlying justifications prevents the courts from circumventing the Constitution by establishing a rule, then expanding it beyond its intended purpose. This article demonstrates and reiterates that compliance with the underlying justifications for establishing rules is essential to protecting individual constitutional rights. In addressing these issues, Part I of this article gives …

A Pathway To Follow-On Biologics, Jeanne Yang Jan 2011

A Pathway To Follow-On Biologics, Jeanne Yang

UC Law Science and Technology Journal

Over the past several decades, advances in biotechnology and medicine have created an influx of biologics. Biologic products have shown great promise as effective treatments for cancer, autoimmune diseases, and other serious afflictions. Many drug manufacturers have been enticed by the promise of patent protection and strong market rates and have entered the field, developing innovative, therapeutic biologics. Consequently, there has also been a demand for generic follow-on biologics. There are two major factors limit the reach of biologic development: cost and safety. The need for an abbreviated approval system for follow-on biologics has been clearly demonstrated, and some options …

Video Surveillance Over Wireless Sensor And Actuator Networks Using Active Cameras, Dalei Wu, Song Ci, Haiyan Luo, Yun Ye, Haohong Wang Jan 2011

Video Surveillance Over Wireless Sensor And Actuator Networks Using Active Cameras, Dalei Wu, Song Ci, Haiyan Luo, Yun Ye, Haohong Wang

Department of Electrical and Computer Engineering: Faculty Publications (to 2015)

Although there has been much work focused on the camera control issue on keeping tracking a target of interest, few has been done on jointly considering the video coding, video transmission, and camera control for effective and efficient video surveillance over wireless sensor and actuator networks (WSAN). In this work, we propose a framework for real-time video surveillance with pan-tilt cameras where the video coding and transmission as well as the automated camera control are jointly optimized by taking into account the surveillance video quality requirement and the resource constraint of WSANs. The main contributions of this work are: i) …

Hats Off To Claire Flom: Education And The Importance Of Being Involved , Judith S. Kaye Jan 2011

Hats Off To Claire Flom: Education And The Importance Of Being Involved , Judith S. Kaye

Fordham Urban Law Journal

This transcript of the Claire Flom lecture covers primarily two themes—the importance of early intervention, and the importance of people getting involved with the public school system and in their children - and other children's education The lecture applies these concepts first to children with special education needs and then to adolescents, kids at the brink of adulthood. The article argues that early intervening early is key to both populations and that neglected learning difficulties only worsen with the passage of time.

From Sounds Bites To Sound Policy: Reclaiming The High Ground In Criminal Justice Policy-Making, Anthony C. Thompson Jan 2011

From Sounds Bites To Sound Policy: Reclaiming The High Ground In Criminal Justice Policy-Making, Anthony C. Thompson

Fordham Urban Law Journal

In this article, the author contemplates the way the criminal justice system is portrayed in the media and suggests how the media's emphasis on "sound bites" - which makes it difficult to separate fact from hype - has had significant policy ramifications. The author makes a point of exploring the many ways that conceptions of crime are formed and influenced, as well as how the media has shaped legislation. In the author's opinion, in order to curb the excessive influence of most mainstream representations of the criminal justice system, there must be some mechanism for oversight of both the media …

Complexity Theory And Local Government Application, Scott A. Brink Jan 2011

Complexity Theory And Local Government Application, Scott A. Brink

Theses and Graduate Projects

Local governnent agencies are experiencing changes that are making the delivery of essential services more challenging. These changes can largely be attributed to increasing demands for more services while budgets are reduced. That trend, combined with globalization, rapid advancements in technology, changing demographics, and other factors limit the ability of agencies to adapt and react to change fast enough. In more recent years, the rate of change has accelerated to the point that traditional methods of planning and adapting to change no longer work. Many organizations feel overwhelmed and helpless. The factors driving change influence each other in complex ways …

Effectiveness Of Public Private Partnership For Infrastructure Projects, Pius Francis Kwaku Agyemang Jan 2011

Effectiveness Of Public Private Partnership For Infrastructure Projects, Pius Francis Kwaku Agyemang

Civil Engineering Theses - Archive

Public Private Partnership (PPP) has over the years proven to be a good procurement method for Infrastructure projects. The partnership combines the efficiency, expertise, and innovation etc. of the private sector as well as appropriate risk allocation between both public and private sectors. The method also provides an alternate avenue for capital needed for engineering projects. The financing options provided through PPP makes the method increasingly popular due to the current global financial crisis. The method is employed in both developed and developing countries. The United States of America has been using the method since the 1980's. Most governments currently …
