Policy Coordination In An Ecology Of Water Management Games, Mark N. Lubell, Garry Robins, Peng Wang
Policy Coordination In An Ecology Of Water Management Games, Mark N. Lubell, Garry Robins, Peng Wang
2011
Policy outcomes in all but the simplest policy systems emerge from a complex of ecology of games featuring multiple actors, policy institutions, and issues, and not just single policies operating in isolation. This paper updates Long's (1958) ecology of games framework with Scharpf's (1997) actor-centered institutionalism to analyze the coordinating roles of actors and institutions on the context of the ecology of water management games in the San Francisco Bay. Actors participating in multiple institutions are analyzed using exponential random graph models for bipartite networks representing different assumptions about policy behavior, including geographic constraints. We find that policy coordination is …

The Potential And Possibilities For Utilizing Geographic Information Systems To Inform School Library As Place, Melissa P. Johnston, Bradley Wade Bishop
The Potential And Possibilities For Utilizing Geographic Information Systems To Inform School Library As Place, Melissa P. Johnston, Bradley Wade Bishop
Information Science Faculty Publications
Teacher librarians often consider their students and the internal school environment in planning programs and services but ignore the larger community from which learners originate. The purpose of this study was to provide a review of the ongoing discussions related to the school library in the community context and provide implications for utilizing geographic information systems (GIS) to inform the idea of the “school library as place.” This preliminary exploration, a thematic literature review, indicated multiple possibilities for implementing GIS in school libraries that may enable teacher librarians to better facilitate students’ development of a sense of place, support their …

Gideon'S Vuvuzela: Reconciling The Sixth Amendments Promises With The Doctrines Of Forfeiture And Implicit Waiver Of Counsel, Sarah Gerwig-Moore
Articles
Dating back to the early decades of the twentieth century, the United States Supreme Court has articulated clear, venerable standards for the waiver of constitutional rights--and in particular the right to counsel. This is a rich area for both litigation and teaching, if only to be able to repeat phrases such as "courts indulge every reasonable presumption against waiver" and "we do not presume acquiescence in the loss of fundamental rights." A defendant must proceed with "eyes open," and a waiver will not be presumed from a "silent record." Consistently affirmed and reaffirmed by the United States Supreme Court and …

Navigating the Mississippi River Campaign
A recent documentary on the Civil War noted that the first two years of the war were a virtual stalemate. That was true only in regard to events in the Eastern Theater. As Benton Rain Patterson makes clear in The Mississippi River Campaign,....

Executive Minority Employment And Compensation Gap In The S&P500: Is Compensation Disparity More Prevalent In Certain Industries?, Jason W. Toney
Executive Minority Employment And Compensation Gap In The S&P500: Is Compensation Disparity More Prevalent In Certain Industries?, Jason W. Toney
CMC Senior Theses
Minorities hold a significantly smaller percentage of executive positions in companies within the S&P500. However, whether these minorities are under compensated relative to their non-minority counterparts has not been previously investigated. Using Compustat data, this paper documents the differences in compensation between minorities and non-minorities as a whole, minority and non-minority CEOs, and the differences in compensation for minorities and non-minorities within industries. I show that there is no minority/white wage gap overall, and in some cases, minorities earn a premium compared to non-minorities.

How Incipient Colonies Create Territory: The Textual Surveys Of New Spain, 1520s–1620s, Andrew Sluyter, Richard Hunter
Faculty Publications
The study of colonial surveying and cartography has become key to understanding the history of European colonialism because of the recognition that land surveys and maps not only represent territory but form part of the process through which territory comes into being. While many studies have therefore focused on the history of instrumental surveying and cartography in New Spain, roughly equivalent to present-day Mexico, between the seventeenth and twentieth century, the textual surveys of the sixteenth century that helped to bring the initial colonial territory into being have gone largely unstudied. Content analysis of textual land surveys included in sixteenth-century …

Purpose Found: Conditions Of Meaningful Existence, Selfhood And The Role Of The Other In John Milton's Paradise Lost, Anna Sawch
Honors Theses
While Biblical interpretations of Genesis posit God as omnipotent creator and teacher, in John Milton's Paradise Lost it is Adam and Eve‟s relationship and interactions with one another that make them who they are and mold them into who they become. The Adam and Eve of Paradise Lost are true characters, and dynamic ones at that. Rather than serve an allegory or work to create a lofty moral lesson, Adam and Eve grow through speech, desire, and language, interfacing with one another in the spirit of true human curiosity and self-discovery. I first explored this observation that Milton's Adam and …

Examining Classroom Negotiation Strategies Of International Teaching Assistants, Gwendolyn M. Williams
Examining Classroom Negotiation Strategies Of International Teaching Assistants, Gwendolyn M. Williams
International Journal for the Scholarship of Teaching & Learning
From a constructivist point of view teacher identity evolves as the teacher interacts and negotiates with others. However, before negotiation can occur, instructors must establish their own teacher identity as a starting position. This narrative study analyzes how international teaching assistants negotiated with their American undergraduate students. Twenty participants engaged in two individual interviews and a videotaped classroom observation where the negotiation strategies were discussed and observed. Findings revealed that although experience improved their negotiation skills, many international teaching assistants struggled with negotiating with students because they did not understand the students’ background. Furthermore, cultural norms influenced how participants approached …

Reconceiving The Patent Rocket Docket: An Empirical Study Of Infringement Litigation 1985–2010, 11 J. Marshall Rev. Intell. Prop. L. 58 (2011), Saurabh Vishnubhakat
UIC Review of Intellectual Property Law
This Article presents the first survival model for systematically identifying and comparing United States district courts as patent rocket dockets, and for examining related trends in patent litigation. The conventional wisdom of rocket docket status in a judicial district tends to rely on average case disposition times and the availability of court rules for patent cases, as well as anecdotal information about well-known jurists with experience in patent adjudication. By comparison, this Article approaches rocket dockets through a quantitative investigation of recent historical trends in patent case filings as well as through market concentration analysis at the district court and …

Trademarks, Identity, And Justice, 11 J. Marshall Rev. Intell. Prop. L. 133 (2011), Rita Heimes
UIC Review of Intellectual Property Law
Intellectual property scholars have written extensively against expanding the scope of intellectual property laws, using social justice and distributive justice principles to support their arguments. A typical argument attacks broad adoption and enforcement of copyright laws that prevent access to information and therefore knowledge, or broad patent protection that reduces access to medicines and other important technologies. In recent years, a few scholars have begun to suggest that certain areas of intellectual property law—primarily copyright—may play a positive role in social justice. These arguments are founded on views of social and distributive justice that consider personal empowerment and freedom to …

University Initiation Of Patent Infringement Litigation, 10 J. Marshall Rev. Intell. Prop. L. 623 (2011), Jacob H. Rooksby
UIC Review of Intellectual Property Law
While the literature examining university engagement in patenting and technology transfer is quite developed, commentators largely have overlooked university involvement in patent litigation. This article focuses on one aspect of that involvement—initiation of patent infringement litigation—by providing a quantitative and textual analysis of patent infringement actions initiated by universities from 2009 through 2010. Suing for-profit actors for money may seem antithetical to the mission of not-for-profit universities, but in fact universities filed over fifty such cases in the studied time period. Examination of these cases reveals a remarkable similarity between the litigation behavior of universities and for-profit actors, as well …

Institute for Sustainable Solutions Publications and Presentations
As part of its approach to meeting Climate Action Plan goals, the City of Portland has joined with the Portland Sustainability Institute to create "EcoDistricts" in Portland neighborhoods to seek neighborhood engagement on behalf of city climate action goals. EcoDistricts, like neighborhoods, offer a scale at which individuals can be affective and empowered to make climate-positive choices, but in a manner that can scale up to make citywide climate action real.

Regional Variation in Hospitalization Rates: Causes and Implications
Sachin J. Shah, Harlan M. Krumholz. Section of Cardiology, Department of Internal Medicine, Yale University, School of Medicine, New Haven, CT.
Background: Admission rates vary by regions and states, but the extent by which variation in regional admission rates are related to variation in the medical need of populations and the association with hospital outcomes is unknown. To address these issues, we examine two cardiovascular conditions that differ in physician discretion to admit, acute myocardial infarction (AMI), less discretionary, and heart failure (HF), more discretionary. We first determined whether regional cardiovascular risk …
Geographical Indications: The International Debate Over Intellectual Property Rights For Local Producers, Emily Nation
Geographical Indications: The International Debate Over Intellectual Property Rights For Local Producers, Emily Nation
University of Colorado Law Review
Geographical indications are a type of intellectual property right. GIs exist where a product is named after its geographical origin and where the product has certain qualities attributable to its geography. Examples of GIs include Parmigiano- Reggiano cheese, Champagne, and Florida oranges. Governmental regulation of GIs protects producers' hardearned reputations from free-riding and reassures consumers that a product's origin is accurately represented. This Comment will explain how GIs are currently protected under international law as well as under domestic laws in the United States and the European Union. It will also discuss the international debate over the proper level of …

African Language Publishing For Children In South Africa: Challenges For Translators, Viv Edwards, Jacob Marriote Ngwaru
African Language Publishing For Children In South Africa: Challenges For Translators, Viv Edwards, Jacob Marriote Ngwaru
Institute for Educational Development, East Africa
The commitment to multilingualism embedded in the 1996 South African Constitution has wide ranging implications for many aspects of education. This paper focuses on the dearth of teaching and learning materials in African languages required to deliver effective bilingual education, and on the potential role of translation in offering solutions for this problem. Drawing on an analysis of currently available African language books for children and interviews with educators, writers, publishers, translators and organisations concerned with book promotion, it explores issues which have emerged as critical for both the quality and availability of translation. Attention is drawn to the ways …
