Constitutional Spaces, Allan Erbsen Jan 2011

Constitutional Spaces, Allan Erbsen

Articles

This Article is the first to systematically consider the Constitution’s identification, definition, and integration of the physical spaces in which it applies. Knowing how the Constitution addresses a particular problem often requires knowing where the problem arises. Yet despite the importance and pervasiveness of spatial references in the Constitution, commentators have not analyzed these references collectively. This Article fills that gap in the literature by examining each of the fourteen spaces that the Constitution identifies, as well as several that it overlooks, to reveal patterns in the text’s treatment of space and location. Among the spaces that the Article considers …

Diagonal Federalism And Climate Change: Implications For The Obama Administration, Hari M. Osofsky Jan 2011

Diagonal Federalism And Climate Change: Implications For The Obama Administration, Hari M. Osofsky

Articles

The Obama Administration’s efforts on climate change continue to face daunting challenges domestically and internationally. This Article makes a novel contribution by exploring how the Obama Administration can meet these challenges more effectively though systematically addressing the multiscalar character of climate change in the areas where it has greater regulatory control. Mitigating and adapting to climate change pose complex choices at individual, community, local, state, national, and international levels. The Article argues that these choices lead to many diagonal regulatory interactions: that is, dynamics among a wide range of public and private actors which simultaneously cut across levels of government …

Building A Global Community, Matthew Carlin Jan 2011

Building A Global Community, Matthew Carlin

Honors Capstones

The world is flatter now than ever before and this creates great opportunities but also great problems. One of the biggest problems to arise is a lack of understanding between cultures. This paper looks at one process of learning culture through study abroad and how to enhance that experience with volunteer work. Secondary research was used to learn the history, benefits, and drawbacks of both study abroad and volunteer work. Two surveys were designed to gather primary sources to confirm the secondary research. Through this research, I found that study abroad is trending towards a more meaningful cultural experience. There …

Harmony An Architecture For Network Centric Heterogeneous Terrain Database Re-Generation, Benito Graniela Jan 2011

Harmony An Architecture For Network Centric Heterogeneous Terrain Database Re-Generation, Benito Graniela

Electronic Theses and Dissertations

Homogeneous proprietary online terrain databases are prolific. So also is the one directional generation and update process for these terrain databases. The existence of architectures and common ontologies that enable consistent and harmonious outcomes between distributed, multi-directional, heterogeneous terrain databases are lacking. Further due to technological change that empowers end-users, the expectations for immediate terrain database update are constantly increasing. As an example, a variety of incompatible synthetic environmental representations are used for military Modeling and Simulation applications. Regeneration and near-real-time update of compiled synthetic environments in a distributed, heterogeneous run time environment is an issue that is relevant to …

A Sense Of Place Ethnographic Reflection On Two Palestinian Life Histories, Patrick H. Barrett Jan 2011

A Sense Of Place Ethnographic Reflection On Two Palestinian Life Histories, Patrick H. Barrett

Electronic Theses and Dissertations

There is a labyrinth of complex social connections between people and places that deserves careful anthropological reflection. People do not simply occupy places; they experience them, infusing them with life and social meaning. Basso (1996:53) argues that ethnography has reported little about the complex ways in which people are “alive to the world around them.” Anthropology is currently experiencing a resurging emphasis on place that seeks to account for its remarkably social features. Rather than primarily thinking about place when determining a location for fieldwork, emerging anthropological reflection shows the discipline is repositioning itself to explore the complex and often …

Employer Perceptions An Exploratory Study Of Employability Skills Expected Of New Graduates In The Hospitality Industry, Amy Parker Kleeman Jan 2011

Employer Perceptions An Exploratory Study Of Employability Skills Expected Of New Graduates In The Hospitality Industry, Amy Parker Kleeman

Electronic Theses and Dissertations

Graduate employability skills have become one of the most important topics on the higher education agenda in the first decade of the 21st century. In the United States, and throughout the world, global competition, growth of a knowledge-based economy, technological advances, and the multigenerational workforce have combined to substantially alter the contemporary workplace (Gedye & Chalkey, 2006). Whether by choice or circumstance, the expectation of a secure lifelong position with one employer and the opportunity for linear career progression are no longer typical nor practical in the contemporary workplace (Harvey, Locke, & Morey, 2002). Employability skills are those skills, attributes, …

Missiological Imagination As A Pedagogical Tool: African And Asian Christians In Conversion, Benjamin Hartley Jan 2011

Missiological Imagination As A Pedagogical Tool: African And Asian Christians In Conversion, Benjamin Hartley

Faculty Publications - George Fox School of Theology

This article provides an example of how mission history may be utilized in imaginative ways to promote student reflection about missiology. The article first presents biographical portraits of three Christian leaders from Africa and Asia in the late eighteenth century with respect to three missiological themes (migration, empire, and theology of evangelism). The second section of the essay is a fictitious and imaginative conversation among these three historical characters and me, the author, where questions are posed concerning these same themes. The article concludes with pedagogical reflections on the use of a similar exercise with students.

Gleaning Insight From Absence: Intelligence Tradecraft Lessons From Finding Bin Laden, John D. Deniston Jan 2011

Gleaning Insight From Absence: Intelligence Tradecraft Lessons From Finding Bin Laden, John D. Deniston

Australian Counter Terrorism Conference

Shortly after the May 2011 raid by American Special Forces that killed Osama Bin Laden, several of the fascinating clues that the Intelligence Community had used to unlock the puzzle of the Al Qaeda leader’s final whereabouts became public. While much analysis has focused on the centrality of surveillance of a trusted al Qaeda courier to narrow the bin Laden search, this paper offers attention to other compelling clues including the size and composition of bin Laden’s compound, its lack of internet or telephone service, and the peculiar behaviour of its occupants. On the basis of these leads, this paper …

"See You On Skype!": Relocation, Access, And Virtual Parenting In The Digital Age, Christine E. Doucet Jan 2011

"See You On Skype!": Relocation, Access, And Virtual Parenting In The Digital Age, Christine E. Doucet

Canadian Journal of Family Law

Since its emergence in the 1990s, the Internet has been celebrated as a tool for connecting people from all corners of the globe. Electronic communication tools, such as the Internet, now have a significant role in daily life, particularly with young people. While the legal field traditionally lags behind in integrating technological advancements into practice, these developments are increasingly, albeit somewhat slowly, being incorporated in family law disputes. Courts are now considering the use of virtual visitation to facilitate access between noncustodial parents and their children, particularly in contested relocation cases. This paper will examine the use of virtual visitation …

'A Blood-Stained Corpse In The Butler's Pantry’: The Queensland Bush Book Club, Robin Wagner Jan 2011

'A Blood-Stained Corpse In The Butler's Pantry’: The Queensland Bush Book Club, Robin Wagner

All Musselman Library Staff Works

Lending libraries were not the norm in 1934 when the Carnegie Corporation of New York sent American librarian, Ralph Munn, to conduct a study of the condition of Australian libraries. In his initial survey Munn learned of the Queensland Bush Book Club, an organization of well-to-do, philanthropic women from Brisbane who had established a book lending service for settlers in the Outback. They hoped to ease the drudgery and lighten the burden faced by isolated women and their families in the rural areas. The antidote was a regular parcel of “proper” reading matter which included books, newspapers and magazines. They …

Are International Judges Afraid Of Science?: A Comment On Mbengue, José E. Alvarez Jan 2011

Are International Judges Afraid Of Science?: A Comment On Mbengue, José E. Alvarez

Faculty Articles

This article considers and critiques the proposition that international adjudicators are afraid or avoid determinations of scientific fact because of their discomfort with the technical expertise involved or the probabilistic judgments required of such fact-finding. It argues that this contention ignores the endemic fact-finding challenges faced by international tribunals generally, that the uncertainties attributed to “scientific” evidence are actually prevalent throughout the judicial process, that adjudicators are actually quite familiar with probabilistic judgments, and that structural constraints on courts and arbitrators and adjudicators’ own backgrounds affect how well fact-finding occurs, irrespective of whether it involves science. Finally, it suggests that …

A/R/Tographic Collaboration As Radical Relatedness, Barbara Bickel, Stephanie Springgay, Ruth Beer, Rita L. Irwin, Kit Grauer, Gu Xiong

Publications

In this paper the authors examine a/r/tographical collaboration in a communityengaged research study investigating immigrant understandings of home and place. The study, The City of Richgate, involves a complex collaboration between community members, community organizations, educational institutions, and a research team comprising artist-educators. The study crosses border zones of cultural, ethnic, geographic, institutional, public, private, and disciplinary boundaries, reflecting the ever-changing character of postmodern reality. In this paper the authors reflect critically and theoretically on the lived experience of radical relatedness found within the complex collaboration, particularly within the a/r/tographic research team. This offers a qualitative methodology of radical …

Evaluating Repeat Photography In Documenting Natural And Cultural Landscape Changes: A Changing Crown Of The Continent Ecosystem Between 1899 And 2010, Dusty Leigh Waltner Jan 2011

Evaluating Repeat Photography In Documenting Natural And Cultural Landscape Changes: A Changing Crown Of The Continent Ecosystem Between 1899 And 2010, Dusty Leigh Waltner

Graduate Student Theses, Dissertations, & Professional Papers

Photography can be an invaluable tool in human geographical research, for example, to better understand the importance of place to people. Increasingly, geographers are looking at how photography can play an active role in the construction of geographical knowledge, that is, how photographs are seen rather than what they show. This study examines the use of repeat photography as a research method by conducting a case study on landscape change in the Crown of the Continent Ecosystem. Grounded in extensive archival research on the past, present, and future uses of photography as a research method, a repeat photography survey was …

A Case Study Of Problems And Possibilities In The Establishment Of A Guide Training Institute In Uttarakhand, India, Benjamin Schwartz

Graduate Student Theses, Dissertations, & Professional Papers

This project sought to explore the problems and possibilities experienced during the establishment of a guide training institute in Uttarakhand, India. As originally proposed by the Mountain Shepherds Initiative, a small tourism organization based in Uttarakhand, the aim of the guide training institute was to provide participants with the knowledge and skills needed to gain employment as guides within, and expand the extent of, high quality/low quantity birdwatching tourism within northern Uttarakhand. This project was undertaken in conjunction with the Mountain Shepherds Initiative and the problems and possibilities were identified during a six month stay in the region from May-November, …

Assessing Efficacy Of Restoration Treatments In Juniper Savannas Using Spatial Wavelets And Dot Grids On Aerial Photography, Erik James Apland Jan 2011

Assessing Efficacy Of Restoration Treatments In Juniper Savannas Using Spatial Wavelets And Dot Grids On Aerial Photography, Erik James Apland

Graduate Student Theses, Dissertations, & Professional Papers

Across much of their diverse natural range in the Western US, species of the genus juniperus are expanding onto open grass and shrublands and infilling open woodland areas. In Southern Arizona’s Clifton Ranger District, landscape-scale restoration treatments have been used to stall this expansion and reduce canopy-cover. This study utilizes and compares two techniques – dot- grid sampling and spatial wavelet analysis (SWA) – to estimate the efficacy of these treatments by measuring canopy-cover change pre-and post-treatment. Further, using the SWA dataset, the study explores the potential of SWA for landscape-scale ecological attribute estimation. This study found that restoration treatments …

Comparison Of Distance Education Leadership Styles And Future Investment In Two-Year Colleges, Ryan R. Schrenk

Graduate Student Theses, Dissertations, & Professional Papers

This foundational descriptive quantitative study examined leadership styles, traits of distance education leaders (e.g. VPs, Deans, Directors and Coordinators) and distance education program characteristics as well as funding priorities at the post-secondary level. Participants were subjected to Bass and Avolio's Multifactor Leadership Questionnaire (MLQ-5X), which identified leadership characteristics as transformational, transactional or passive-avoidant as manifest by nine scales as follows: Individualized Influence Attributes, Individualized Influence Behavior, Inspirational Motivation, Intellectual Stimulation, Individualized Consideration, Contingent Reward, Active Management-by-Exception, Passive Management-by-Exception and Laissez-Faire. In addition, the questionnaire further assessed leadership outcomes scaled as Extra Effort, Effectiveness and Satisfaction.

There were 55 respondents from …
