Historical Biogeography Of Nebraska Pronghorns (Antilocapra Americana), Justin D. Hoffman, Hugh H. Genoways, Rachel R. Jones
Historical Biogeography Of Nebraska Pronghorns (Antilocapra Americana), Justin D. Hoffman, Hugh H. Genoways, Rachel R. Jones
University of Nebraska State Museum: Mammalogy Papers
Archeological and paleontological records indicate that the pronghorn (Antilocapra americana) have a history of at least 20,000 years of occurrence within the current boundaries of Nebraska. Pronghorns occurred throughout the state for much of its history. With the evidence at hand we concluded that the eastern boundary of the geographic distribution of the pronghorn south of the Niobrara River in Nebraska at the beginning of the 19th century was along the western perimeter of the eastern deciduous forest and tallgrass prairie. This excluded most of the easternmost tier of counties in the state. This geographic arrangement persisted throughout …

Rationalizing Religious Exemptions: A Legislative Process Theory Of Statutory Exemptions For Religion, Zoe Robinson
Rationalizing Religious Exemptions: A Legislative Process Theory Of Statutory Exemptions For Religion, Zoe Robinson
William & Mary Bill of Rights Journal
This Article proposes a new theory of religious liberty in the United States: it hypothesizes that a person’s religious freedom is dependent on their political power. Following the Supreme Court’s 1990 decision of Employment Division v. Smith, the legislature has sole control over the enactment of accommodations and exemptions from laws of general application for religious adherents. This Article argues that post-Smith accounts of religious liberty and pluralism fail to systematically analyze the relationship between religious liberty and legislative exemptions. To this end, the Article proposes a unique public choice model that hypothesizes that legislative accommodations and exemptions may result …

Capture And Analysis Of Cells Using Magnetic Beads, Alexandro Dominguez
All Capstone Projects
Magnetic separation of cells and bacterium is a fascinating field of study. There are tremendous capabilities in separation, selectivity, and sensitivity. Magnetic separation reduces complex techniques, time consuming preparation, and complicated multistep methods of separation. The separation of cells, bacterium, and macromolecules can be extremely challenging. Fortunately, magnetically tagged cells, bacterium and macromolecules can be easily separated without great expertise. Antibody magnetic micro beads are specific to a cell, bacterium, or macromolecules. Separating a mixture can lead to a better, more accurate analysis of samples that can be crucial in the medical field, therapeutic drug delivery systems, and in some circumstances …

Alcoholic Cardiomyopathy: A Review., Anil George, Vincent M Figueredo
Alcoholic Cardiomyopathy: A Review., Anil George, Vincent M Figueredo
Division of Cardiology Faculty Papers
Alcohol abuse can cause cardiomyopathy indistinguishable from other types of dilated nonischemic cardiomyopathy. Most heavy drinkers remain asymptomatic in the earlier stages of disease progression, and many never develop the familiar clinical manifestations that typify heart failure. We review the current thinking on the pathophysiology, clinical characteristics, and treatments available for alcoholic cardiomyopathy. The relationship of alcohol to heart disease is complicated by the fact that in moderation, alcohol has been shown to afford a certain degree of protection against cardiovascular disease.

Secondary Students, Laptops And Game Design: Examining The Potential Of Homemade Powerpoint Games In A Blended Learning Environment, Michael Barbour, Jim Kinsella, Lloyd P. Rieber
Education Faculty Publications
The integration of technology into K-12 classrooms has long been hampered by the problem of scalability. Familiar software programs, such as MS PowerPoint, can be used as a tool for students to create educational games to deepen their understanding of content. In this article, the authors examine students in two secondary social studies classes that created homemade PowerPoint games as a way to review for their mid-term and final examinations. The authors compared student performance on these exams based upon the topics covered by their game design. While no significant differences in student outcomes were found, qualitative analyses indicate that …

After Evil: A Politics Of Human Rights - Robert Meister, Debra L. Delaet
After Evil: A Politics Of Human Rights - Robert Meister, Debra L. Delaet
International Dialogue
In After Evil: A Politics of Human Rights, Robert Meister puts forth an original, subtle, and provocative critique of mainstream human rights discourse in contemporary global politics. He describes this discourse, which he capitalizes as Human Rights Discourse throughout the text, as “… a new discourse of global power that claims to supersede the cruelties perpetrated by both revolutionaries and counterrevolutionaries during the previous two centuries” (3). Meister argues that this discourse creates a false temporal divide between historical periods of “evil” in which gross violations of human rights are committed and post-conflict periods of justice during which parties are …

Eco-Tourism Resorts: A Case Study Of Best Practices At The Hamanasi Resort In Belize, Kathryn Early
Honors Theses and Capstones
The objective of this research is to investigate best practice initiatives of sustainability involved in the successful development and management of Hamanasi Resort, an award winning eco-tourism resort located in Belize. The four phases of research at Hamanasi as originally proposed, found in Part I of the thesis, are outlined as follows: Phase one includes hands-on research through shadowing in different hotel departments, observation of management practices in Hamanasi, interviews conducted with employees, and questionnaires administered to guests; Phase two begins a study of the business and organizational model of Hamanasi along with an examination of the critical issues encountered …
Fighting A War You've Already Lost: Zombies And Zombis In Firefly/Serenity And Dollhouse, Gerry Canavan
Fighting A War You've Already Lost: Zombies And Zombis In Firefly/Serenity And Dollhouse, Gerry Canavan
English Faculty Research and Publications
This article explores the use of zombie imagery in two sf narratives created by Joss Whedon: Firefly (US 2002–3), Serenity (US 2005) and Dollhouse (US 2009–10). The translation of the zombie from its traditional horror-movie context to the far-future space opera of Firefly/Serenity and the near-future cyberpunk of Dollhouse reveals the zombie's allegorisation of the consequences of biopolitical governmentality and neoliberal capitalism. In both series zombies function as a figure for both the dehumanisation caused by state and market forces and the possibility of Utopian resistance to these forces.
Mouse Versus Rat: Profound Differences In Meiotic Regulation At The Level Of The Isolated Oocyte, Stephen M. Downs
Mouse Versus Rat: Profound Differences In Meiotic Regulation At The Level Of The Isolated Oocyte, Stephen M. Downs
Biological Sciences Faculty Research and Publications
Cumulus cell-enclosed oocytes (CEO), denuded oocytes (DO), or dissected follicles were obtained 44–48 hr after priming immature mice (20–23 days old) with 5 IU or immature rats (25–27 days old) with 12.5 IU of equine chorionic gonadotropin, and exposed to a variety of culture conditions. Mouse oocytes were more effectively maintained in meiotic arrest by hypoxanthine, dbcAMP, IBMX, milrinone, and 8-Br-cGMP. Atrial natriuretic peptide, a guanylate cyclase activator, suppressed maturation in CEO from both species, but mycophenolic acid reversed IBMX-maintained meiotic arrest in mouse CEO with little activity in rat CEO. IBMX-arrested mouse, but not rat, CEO were induced to …
The Adversarial Myth: Appellate Court Extra-Record Factfinding, Brianne J. Gorod
The Adversarial Myth: Appellate Court Extra-Record Factfinding, Brianne J. Gorod
Duke Law Journal
The United States' commitment to adversarial justice is a defining feature of its legal system. Standing doctrine, for example, is supposed to ensure that courts can rely on adverse parties to present the facts courts need to resolve disputes. Although the U.S. legal system generally lives up to this adversarial ideal, it sometimes does not. Appellate courts often look outside the record the parties developed before the trial court, turning instead to their own independent research and to factual claims in amicus briefs. This deviation from the adversarial process is an important respect in which the nation's adversarial commitment is …
Incentives For Conservation Easements: The Charitable Deduction Or A Better Way , Daniel Halperin
Incentives For Conservation Easements: The Charitable Deduction Or A Better Way , Daniel Halperin
Law and Contemporary Problems
Halperin talks about tax-policy concerns relating to the charitable deduction for conservation easement donations. The conflict of interest between charity and other owners raises a concern that the charitable deduction would not reflect the ultimate charitable benefit. The deduction for conservation easements is the principal exception to this rule despite the significant potential for abuse and the distinct possibility that the public benefit may be less than anticipated.
A Tradable Conservation Easement For Vulnerable Conservation Objectives, W. William Weeks
A Tradable Conservation Easement For Vulnerable Conservation Objectives, W. William Weeks
Law and Contemporary Problems
Weeks talks about tradable conservation easement for vulnerable conservation objectives. The critical conservation objectives in some conservation easements will probably be compromised by the effects of climate change in the relatively near future. Conservation easements broadly intended and drafted to serve those kinds of general purposes are, as a group, unlikely to be so acutely affected by changing ecological conditions that their broad purposes will cease, over time, to be served.

Improving Cardiovascular Stent Design Using Patient-Specific Models And Shape Optimization, Timothy J. Gundert
Improving Cardiovascular Stent Design Using Patient-Specific Models And Shape Optimization, Timothy J. Gundert
Master's Theses (2009 -)
Stent geometry influences local hemodynamic alterations (i.e. the forces moving blood through the cardiovascular system) associated with adverse clinical outcomes. Computational fluid dynamics (CFD) is frequently used to quantify stent-induced hemodynamic disturbances, but previous CFD studies have relied on simplified device or vascular representations. Additionally, efforts to minimize stent-induced hemodynamic disturbances using CFD models often only compare a small number of possible stent geometries. This thesis describes methods for modeling commercial stents in patient-specific vessels along with computational techniques for determining optimal stent geometries that address the limitations of previous studies.
An efficient and robust method was developed for virtually …
Same-Sex Marriage, Second-Class Citizenship, And Law's Social Meanings, Michael C. Dorf
Same-Sex Marriage, Second-Class Citizenship, And Law's Social Meanings, Michael C. Dorf
Cornell Law Faculty Publications
Government acts, statements, and symbols that carry the social meaning of second-class citizenship may, as a consequence of that fact, violate the Establishment Clause or the constitutional requirement of equal protection. Yet social meaning is often contested. Do laws permitting same-sex couples to form civil unions but not to enter into marriage convey the social meaning that gays and lesbians are second-class citizens? Do official displays of the Confederate battle flag unconstitutionally convey support for slavery and white supremacy? When public schools teach evolution but not creationism, do they show disrespect for creationists? Different audiences reach different conclusions about the …

Extensive Clonal Spread And Extreme Longevity In Saw Palmetto, A Foundation Clonal Plant, Mizuki K. Takahashi, Liana M. Horner, Toshiro Kubota, Nathan A. Keller, Warren G. Abrahamson Ii
Faculty Journal Articles
The lack of effective tools have hampered our ability to assess the size, growth and ages of clonal plants. With Serenoa repens (saw palmetto) as a model, we introduce a novel analytical framework that integrates DNA fingerprinting and mathematical modelling to simulate growth and estimate ages of clonal plants. We also demonstrate the application of such life-history information of clonal plants to provide insight into management plans. Serenoa is an ecologically important foundation species in many Southeastern United States ecosystems; yet, many land managers consider Serenoa a troublesome invasive plant. Accordingly, management plans have been developed to reduce or eliminate …

Breeding Biology Of Oryzomys Palustris, The Marsh Rice Rat, In Eastern Virginia, Robert K. Rose, Erin A. Dreelin
Virginia Journal of Science
The objectives of our study were to determine the age of maturity, litter size, and the timing of the breeding season of marsh rice rats (Oryzomys palustris) of coastal Virginia. From May 1995 to May 1996, monthly samples of rice rats were live-trapped in two coastal tidal marshes of eastern Virginia, and then necropsied. Sexual maturity was attained at 30-40 g for both sexes. Mean litter size of 4.63 (N= 16) did not differ among months or in mass or parity classes. Data from two other studies conducted in the same county, one of them contemporaneous, also were …

Reconciling Chevron, Mead, And The Review Of Agency Discretion: Source Of Law And The Standards Of Judicial Review, Michael P. Healy
Law Faculty Scholarly Articles
Although the Supreme Court's watershed decision in Chevron U.S.A. Inc. v. Natural Resources Defense Council, Inc. has been understood by many as defining the framework for judicial review of agency legal determinations, there have been longstanding questions about the application of the standards for reviewing administrative action. These questions have become more troublesome following the Supreme Court's 2001 decision in United States v. Mead Corp. Mead established that Chevron review only applies when defined requirements are met and held that so-called Skidmore deference applies when Chevron deference does not apply. Surveying the aftermath of Mead and its effect on the …

Engaging The Legal Academy In Disaster Response, Susan Kuo, Davida Finger, Laila Hlass, Anne Hornsby, Rachel Van Cleave
Faculty Publications
This article discusses three models of law school engagement that have been used to respond to natural disasters. The three models discussed are a disaster law clinic, a course on disaster law, and a student-led initiative featuring non-credit, pro bono placements. Each model offers a conceptual approach for integrating community-based, justice-oriented initiatives into academic and clinical teaching. Taken as templates for a more permanent model of engagement in the area of post-disaster law and social justice, these models demonstrate that the legal academy can meet its service obligation to the community while training lawyers to better appreciate the central tenets …

Nikita Mikhalkov’S Cinematic Verdict On Contemporary Russia, Yuliya Ladygina
Reconstruction: Studies in Contemporary Culture
After the bombing of the World Trade Center and the Pentagon on 11 September 2001, Putin’s administration reacted promptly to the new rhetoric in Washington and, in turn, re-branded Russia’s campaign in Chechnya as a clear-cut conflict of backward Islamic terrorists assaulting civilized Russia. As a result, the entire Chechen nation and its struggle for political independence has been systematically misrepresented and maligned in the Russian mass media, particularly in film and television. While an abundance of scholarship has examined what sorts of stories Western film and TV drama have been telling about war and terror, and what kinds of …

[First paragraph]
In the fifth season of the television series Supernatural, demon-hunting brothers Sam and Dean Winchester (Jared Padalecki and Jensen Ackles) investigate a haunted hotel. The episode, "The Real Ghostbusters," "features a dour legend, a graveyard, a hidden map, and an unfortunate tourist who is scalped by the ghosts of murdered children. Standard fare for this cult series, except that the hotel Sam and Dean are investigating is also hosting a Supernatural fan convention, complete with discussion panels (including The Homoerotic Subtext of Supernatural), live-action role-playing (LARPing, Supernatural merchandise, and elaborate character costumes. The episode demonstrates the …
