The Constitutional Right Not To Participate In Abortions: Roe, Casey, And The Fourteenth Amendment Rights Of Healthcare Providers, Mark L. Rienzi Jan 2011

The Constitutional Right Not To Participate In Abortions: Roe, Casey, And The Fourteenth Amendment Rights Of Healthcare Providers, Mark L. Rienzi

Scholarly Articles

The Fourteenth Amendment rights of various parties in the abortion context – the pregnant woman, the fetus, the fetus’ father, the state – have been discussed at length by commentators and the courts. Surprisingly, the Fourteenth Amendment rights of the healthcare provider asked to provide the abortion have not. Roe and Casey establish a pregnant woman’s Fourteenth Amendment right to decide for herself whether to have an abortion. Do those same precedents also protect her doctor’s right to decide whether to participate in abortion procedures?

The Court’s substantive due process analysis typically looks for rights that are “deeply rooted” in …

Charity In The 21st Century: Trending Toward Decay, Roger Colinvaux Jan 2011

Charity In The 21st Century: Trending Toward Decay, Roger Colinvaux

Scholarly Articles

The Article argues that the federal tax law framework relating to charitable organizations is decaying. Through an overview of the historical development of the law relating to charity in the 20th century, the Article shows that the statutory law has passively accommodated significant growth of the charitable sector without demanding any rigor of the sector in the form of positive requirements or quantitative measures. This has led to growth without meaningful oversight – a recipe for problems. The Article then provides an overview of many of the scandals that engulfed the sector during the early 21st century and shows that …

Adopting The "Other": A Peculiar U.S. Orientalism In The Response To The Circassian War, 1838-1859, Christopher L. Miller Jan 2011

Adopting The "Other": A Peculiar U.S. Orientalism In The Response To The Circassian War, 1838-1859, Christopher L. Miller

History Faculty Publications

This study seeks to complicate the rather one-dimensional character of so-called "Orientalist" discourse as outlined by Edward Said by examining the way in which periodical literature in the United States during the early nineteenth century looked at a particular set of events in a particular region of the Greater Middle East: the so-called Circassian War in the Caucasus Mountains. There clearly was a variety of U.S. Orientalism that was partially a product of an imperialist project, though only partially. The attention paid to the Circassian War by nineteenth-century U.S. newspapers and magazines provides a unique window for understanding how and …

Resurrecting The Bogeyman: The Curious Forms Of The Substantial Burden Test In Rluipa, Adam J. Macleod Jan 2011

Resurrecting The Bogeyman: The Curious Forms Of The Substantial Burden Test In Rluipa, Adam J. Macleod

Scholarly Articles

In 2000 Congress revived strict scrutiny review of regulations that substantially burden religious land use when it enacted the Religious Land Use and Institutionalized Persons Act (RLUIPA). Many worry that RLUIPA creates a blanket exemption for religious institutions from neutral laws of general application, and that it threatens principles of federalism. A decade of experience with RLUIPA shows that these fears are unfounded. Indeed, the United States Courts of Appeals have gone out of their way to constrain the reach of RLUIPA's substantial burden provision. They have imposed upon the provision some creative interpretations, many of which are inconsistent with …

Courting The Iron Horse: How The United States Exacted Limited Controls Over The Railroads In The Second World War, Carl Nieman Jan 2011

Courting The Iron Horse: How The United States Exacted Limited Controls Over The Railroads In The Second World War, Carl Nieman

Honors Capstones

This thesis explores the extent of US Government control over the railroads during the Second World War. The purpose of this project is to discover how much government regulation there was regarding the railroads and how intrusive it was. This is achieved by looking over government documents between 1930 and 1950. These documents were reviewed and were assessed on how intrusive they were or were not and also the period in which they were wrote, during the war or before or after, was also taken into account. The findings of this thesis were that the US Government did increase its …

Making Wto Sps Dispute Settlement Work: Challenges And Practical Solutions, Eric Gillman Jan 2011

Making Wto Sps Dispute Settlement Work: Challenges And Practical Solutions, Eric Gillman

Northwestern Journal of International Law & Business

The Agreement on Sanitary and Phytosanitary Measures (SPS Agreement) represents an effort by the Members of the World Trade Organization (WTO) to balance competing interests in liberalizing trade, on one hand, and protecting human, animal, and plant life from risks posed by the free flow of goods on the other. SPS disputes center around a core question: Does the imported product at issue present a sufficiently serious threat to national health to warrant the imposition of trade-restrictive measures? Over twelve years and six disputes, panels and the Appellate Body (AB) have addressed this question by evaluating respondents' risk assessments. The …

China's Compliance With International Law: What Has Been Learned And The Gaps Remaining, Roda Mushkat Jan 2011

China's Compliance With International Law: What Has Been Learned And The Gaps Remaining, Roda Mushkat

Washington International Law Journal

Chinese willingness and ability to play by the rules in the global arena is a critical issue that has long loomed large on the academic and policy agendas. A substantial body of knowledge has been built in the past two decades, shedding considerable light on key dimensions of the question. However, there is an apparent need to fine-tune the approach pursued thus far by seeking greater methodological robustness and better theoretical elucidation. Data collection procedures must be anchored more firmly in principles of scientific inquiry, providing a solid empirical foundation for reliable and valid generalizations, and single-cause explanations need to …

The Church Abuse Scandal: Were Crimes Against Humanity Committed?, Dermot Groome Jan 2011

The Church Abuse Scandal: Were Crimes Against Humanity Committed?, Dermot Groome

Chicago Journal of International Law

Increasingly shocking revelations about sexual abuse by members of Catholic religious congregations and diocesan priests have recently raised the question of whether such widespread abuses constitute crimes against humanity. This paper considers that question in the context of a report issued by the Ryan Commission, an independent quasi-judicial commission that spent ten years conducting detailed investigations into childcare institutions operated by Catholic religious congregations in Ireland. The Ryan Commission's findings with respect to both widespread physical and sexual abuse provide a factual basis upon which to consider whether crimes against humanity were in fact committed. Contrasting the intentionality behind excessive …

Death By A Thousand Cuts: Incorporating Cumulative Effects In Australia's Environment Protection And Biodiversity Conservation Act, Jessica T. Dales Jan 2011

Death By A Thousand Cuts: Incorporating Cumulative Effects In Australia's Environment Protection And Biodiversity Conservation Act, Jessica T. Dales

Washington International Law Journal

The Environment Protection and Biodiversity Conservation Act 1999 (“EPBCA” or “the Act”) is the Australian government's keystone piece of environmental legislation. The EPBCA provides a legal framework to protect and manage nationally and internationally important flora, fauna, ecological communities, and heritage places—defined in the Act as matters of National Environmental Significance (“NES”). The Act comes into play when a proposed action has the potential to have a significant impact on a matter of national environmental significance. Although it has played a vital role in protecting Australia’s environment, the EPBCA does not explicitly address the cumulative impact of multiple actions on …

Cartels In The European Union: Procedural Fairness For Defendants And Claimants, David Anderson, Rachel Cuff Jan 2011

Cartels In The European Union: Procedural Fairness For Defendants And Claimants, David Anderson, Rachel Cuff

Fordham International Law Journal

This Essay will explore the issues and concerns from both the defendant and plaintiff angle, and from the micro to the macro level. Above all, it hopes to suggest ways in which the EU systems might be improved to increase fairness and access to justice for both sides. The first three Parts of this Essay consider the issues from the point of view of defendants in cartel investigations. Part I looks at concerns regarding the procedural detail of the investigative process, and in particular the increasing impact of human rights arguments. Part II steps back to focus on more over-arching …

Comparison Of Progression Of Diffuse Axonal Injury With Histology And Diffusion Tensor Imaging, Nisrine Zakaria Jan 2011

Comparison Of Progression Of Diffuse Axonal Injury With Histology And Diffusion Tensor Imaging, Nisrine Zakaria

Wayne State University Dissertations

Diffuse axonal injury, also known as traumatic axonal injury (TAI), is a major contributor to the pathology of traumatic brain injury. However, TAI is undetectable to conventional clinical magnetic resonance (MR) imaging techniques. Histologically, TAI is characterized by swollen axons that eventually disconnect and form axonal retraction balls (RB) in various white matter tracts. MR-diffusion tensor imaging (MR-DTI) has been reported to be sensitive to TAI in human TBI patients by measuring water molecular diffusion motion in white matter fiber tracts. To date, only one correlative animal study has been carried out to investigate the DTI relationship to TAI, and …

The Process Of Autophagy In An In Vitro Model Of Myocardial Ischemia-Reperfusion Injury, Kadija Abounit Jan 2011

The Process Of Autophagy In An In Vitro Model Of Myocardial Ischemia-Reperfusion Injury, Kadija Abounit

Wayne State University Dissertations

Autophagy has been implicated in the pathogenesis of myocardial ischemia-reperfusion (I/R) injury; however, it is not clear whether autophagy is beneficial or detrimental to cell survival. We hypothesized that autophagy is beneficial to cardiomyocytes during I/R and that the paucity of ATP may limit its occurrence. To test this hypothesis, we developed a model of ischemia (hypoxia) involving exposure of HL-1 murine atrial cardiomyocytes to two concentrations of oxygen (0.5% and 2.0%) and 2-deoxyglucose.

Hypoxia, irrespective of the oxygen concentration, caused a dramatic drop in cellular ATP and an increase in the phosphorylation of AMPK (an indication of energy starvation),. …

Boys' Masculinities In Three Adventure Physical Education Classes, Amy Tischler Jan 2011

Boys' Masculinities In Three Adventure Physical Education Classes, Amy Tischler

Wayne State University Dissertations

The diminished state of youth health in the United States has been a rising concern over the past few decades (Fahlman, Dake, McCaughtry, & Martin, 2008; Krebs, Baker, & Greer, 2003). Headlines across the nation declare that children in the United States are getting heavier and most point to a lack of physical activity as the cause (Wechsler et al., 2004). Understanding adventure physical education might help to create physical education programs that captivate students so much so that they look forward to participating rather than enacting task avoidance strategies. In fact, physical education might empower students to be physically …
