"You Crossed The Fog Line!" - Kansas, Pretext, And The Fourth Amendment, Melanie Wilson
"You Crossed The Fog Line!" - Kansas, Pretext, And The Fourth Amendment, Melanie Wilson
Scholarly Works
This article examines orders recently decided in the District of Kansas to show, circumstantially, that Kansas police are using "fog-line" traffic infractions as an excuse to stop out-of-state cars driven by people of Hispanic ethnicity and to investigate for drug trafficking. If a stop uncovers contraband, the defendant is charged with a crime, sometimes in federal court. At a subsequent hearing to evaluate a defendant’s motion to suppress the contraband, the officer testifies to his reason for the stop – “You crossed the fog line,” “drifted from your lane of travel,” or “failed to maintain a single lane.” The officer …
Mapping The Medical Device Development Process, Scott T. Ham
Mapping The Medical Device Development Process, Scott T. Ham
Industrial Technology and Packaging
This project examined the use of process mapping as a tool to show the process of developing medical devices from a broad perspective that includes research, innovation, development, regulation, and marketing. The medical device development cycle, on a broad scope, is not well defined. The lack of a universal language with which to describe this process has made it difficult to understand and communicate. In this project, data was collected from peer-reviewed sources, summarized in a literature review, drawn out by hand into a series of lower-level process maps and finally assembled into a single process map. This project is …

Rethinking The Presumption Of Constitutionality, F. Andrew Hessick
Rethinking The Presumption Of Constitutionality, F. Andrew Hessick
Notre Dame Law Review
One of the judiciary's self-imposed limits on the power of judicial review is the presumption of constitutionality. Under that presumption, courts supply any conceivable facts necessary to satisfy judicially created constitutional tests. The Supreme Court has given three reasons for the presumption: to show due respect to legislative conclusions that their enactments are constitutional, to promote republican principles by preventing courts from interfering with legislative decisions, and to recognize the legislature's institutional superiority over the courts at making factual determinations. This Article argues that the presumption does not sensibly implement these reasons. It further argues that these reasons equally, if …
Raising The Bar: Standards-Based Training, Supervision, And Evaluation, Adele Bernhard
Raising The Bar: Standards-Based Training, Supervision, And Evaluation, Adele Bernhard
Missouri Law Review
In this short Article, I sketch the methodology my colleagues and I at Pace Law School use to incorporate practice standards into our clinical teaching and reflect on how a standards-based teaching paradigm could be adapted to the training, supervision, and evaluation of public defenders. Then, I briefly consider how standards and standards-based teaching assist in the administration of assigned counsel plans and in the evaluation of the performance of public defender organizations. Although this Article does not cover any of these topics in depth, my goal is to introduce the reader to a standards-based approach to teaching and suggest …

Racial Disparities In Sentencing: Implications For The Criminal Justice System And The African American Community, Ngozi Caleb Kamalu, Margery Coulson-Clark, Nkechi Margaret Kamalu
African Journal of Criminology and Justice Studies
This paper analyzes the consequences of discriminatory sentencing on the African American community. The intent is to review factors that contribute to the over-representation of African Americans in the prison system and to analyze the way that the judicial system maintains these disparate numbers through practices and procedures, racial profiling, historical biases and quasi legal procedures sanctioned by the mainstream process under the guise of law and order. Review of the literature, extensive meta- analysis and statistics confirms and support the statistics presented and the finding provided. The results of these harsh and disparate sentencing are resulting in the weakening and …

Achieving Successful Long-Term Recovery And Safety From A Catastrophe: The Federal Role, Shirley Laska, Pamela Jenkins, Robert Montjoy, Monica Farris, Michelle Gremillion, Joel Devalcourt, K. C. King, Branda Nowell, Thomas Birkland
CHART Publications
Our task, reflected in this report, was to assess the government’s role in achieving long-term, safe recovery of the Gulf coast communities from the catastrophic disaster of Hurricanes Katrina and Rita in the early fall of 2005. The focus is on its catastrophic nature and the ability of our society to deal with such. This report offers our analysis with a focus on the federal government, per the national policy interests of the Ford Foundation. A companion book from the research is under preparation; it will consider the same question with the state and local government focus added to the …
State Constitutional Challenges To Indigent Defense Systems, Stephen F. Hanlon
State Constitutional Challenges To Indigent Defense Systems, Stephen F. Hanlon
Missouri Law Review
For many years, the primary vehicle that advocates used to protect the fundamental right of the accused to the effective assistance of counsel was the Sixth Amendment to the United States Constitution, as incorporated to the states by the Fourteenth Amendment. For some time, most obviously during the Warren Court years, this federal strategy proved fruitful; indeed, it resulted in a series of landmark decisions by the United States Supreme Court that impact indigent defense systems to this day. A subsequent sea change in the Court's jurisprudence, however, which placed great emphasis on federalism, particularly the doctrines of justiciability and …

Energy Harvesting From Exercise Machines Cal Poly Recreation Center Implementation, Justin Arakaki, Praveen Lawrence, Audrey Nakamura
Electrical Engineering
As Cal Poly moves towards an environmentally friendly campus, the Energy Harvesting from Exercise Machines (EHFEM) project looks to generate a new source of renewable energy to help power the Cal Poly Recreation Center. The project focuses on retrofitting exercise machines to generate electricity. As of December 2009, Audrey Nakamura, Justin Arakaki, and Praveen Lawrence developed a design which allows the contribution of electricity generated from multiple exercise machines into the power grid.
The project will require an investigation of retrofitted machine designs by Cal Poly students and commercially available products and systems. The information obtained from the product research …
Epiphenomenal Indigent Defense, Darryl K. Brown
Epiphenomenal Indigent Defense, Darryl K. Brown
Missouri Law Review
There are some much-studied, recurring social events and behaviors that, although centrally important to public policy and social life, have proven intractable to explanation and prediction. As currently salient examples, consider stock market crashes and recessions. Economists cannot consistently see them coming nor explain them after the fact in consistent detail. Another example is crime rates, which rise, and in recent decades fall, without any discernable strong causal link to familiar variables such as employment or imprisonment rates. This Article describes why we can add state funding for indigent defense counsel to that list and what this conclusion means for …
