Ensuring Government Accountability During Public Health Emergencies, Fazal Khan Jul 2010

Ensuring Government Accountability During Public Health Emergencies, Fazal Khan

Scholarly Works

The main argument of this Article is that the gravest threat to civil liberties during a public health emergency (PHE) stems from federal powers premised on post-9/11 national security justifications, not putative state powers under the Model State Emergency Health Powers Act (MSEHPA). While I concur with earlier assessments that the MSEHPA is seriously flawed and that PHEs should be construed as primarily federal issues, going forward, more critical attention needs to be focused on the federal role during PHEs as the initially alarming MSEHPA appears to be more of a paper tiger. First, as the responses to Hurricane Katrina …

Student Perceptions Of Campus Safety Within The Virginia Community College System, Robert Chad Patton Jul 2010

Student Perceptions Of Campus Safety Within The Virginia Community College System, Robert Chad Patton

Educational Leadership & Workforce Development Theses & Dissertations

This research examined Virginia community college students' perceptions of campus safety. A survey of 11,161 students revealed the crimes students most feared being a victim of while on the community college campus and the areas in which they felt the most and least safe. The research also demonstrated the effect certain variables had on students' overall perception of campus safety. The variables studied included student demographics, the presence and type of security personnel, and the rurality of the campus setting. The campuses with the highest and lowest degrees of perceived safety were then further studied via case studies to gather …

Raising The Bar: Standards-Based Training, Supervision, And Evaluation, Adele Bernhard

Articles & Chapters

In this short Article, I sketch the methodology my colleagues and I at Pace Law School use to incorporate practice standards into our clinical teaching and reflect on how a standards-based teaching paradigm could be adapted to the training, supervision, and evaluation of public defenders. Then, I briefly consider how standards and standards-based teaching assist in the administration of assigned counsel plans and in the evaluation of the performance of public defender organizations. Although this Article does not cover any of these topics in depth, my goal is to introduce the reader to a standards-based approach to teaching and suggest …

Annual Report Of The University, 2009-2010, Volumes 1-4, University Of New Mexico

UNM Annual Reports

The enrollment management division outlined an ambitious set of goals for academic year 2009/2010. Many of the goals have been completed, some are in progress to be completed by the beginning of this fall, and some have been quite challenging to meet. Attached please find our detailed Work Plan that identifies each goal and below is a summary of some of our initiatives. The move to the SSSC building provided us a venue to harmonize our back office operations and it allowed enrollment management staff to move out of working in silos and instead commence with the process of cross-training …

Substantially Justified? The U.S. Government’S Use Of Name-Check Technologies In Naturalization Procedures, H. Jin Cho Jun 2010

Substantially Justified? The U.S. Government’S Use Of Name-Check Technologies In Naturalization Procedures, H. Jin Cho

Duke Law & Technology Review

The U.S. Citizenship and Immigration Services relies upon the Federal Bureau of Investigation to administer the National Name Check Program, which conducts background checks on applicants for naturalization. Backlogs have led to long delays for aspiring citizens and significant legal problems for the government.

This iBrief examines the First Circuit’s ruling in Aronov v. Napolitano that an eighteen-month delay in adjudicating a naturalization application was substantially justified. While the government’s inefficiency can be explained partly by an understaffed bureaucracy, overwhelming evidence suggests that these problems are exacerbated by a technological infrastructure that is ill-equipped to handle the scope of the …
