No Direction Home: Constitutional Limitations On Washington's Homeless Encampment Ordinances, Jordan Talge

The Washington State Constitution protects the free exercise of religion. It also vests strong police power in local governments. When these two constitutional provisions conflict, the Washington State Supreme Court must draw the line between valid police power action and impermissible burden on free exercise. In City of Woodinville v. Northshore United Church of Christ, a municipal government crossed that line. The City of Woodinville, Washington refused to consider a church’s application to host a homeless encampment. The Court held this outright refusal to be an unjustified infringement on the church’s free exercise of religion. The Court did not, …

The Ecology Action Center provides environmental education, information and outreach for McLean County, Illinois. In an effort to make services accessible to the entire county, the Ecology Action Center realizes the need to better reach the minority community in Bloomington-Normal. This study examines the environmental justice concerns in relation to minority involvement in environmental work; environmental concerns among minorities; and environmental outreach to minorities and low-income people. This project reveals that regardless of race, all people share environmental concerns; however, the kinds of concerns may differ. The culmination of this project provides suggestions for how the Ecology Action Center can …

Subglottic Secretion Aspiration In The Prevention Of Ventilator-Associated Pneumonia: A Review Of The Literature., Rachel Scherzer

Ventilator-associated pneumonia is a common nosocomial infection that results in both negative patient outcomes and increased health care costs. Recently, many efforts have been targeted at ventilator-associated pneumonia prevention, including the practice of subglottic secretion aspiration. Six randomized control studies examining the effectiveness of subglottic secretion aspiration in the prevention of ventilator-associated pneumonia were reviewed for this article. Results consistently show that subglottic secretion aspiration significantly reduces the incidence of ventilator-associated pneumonia in a variety of patient populations. Despite these findings, this practice is limited in clinical settings. This clinical practice should be implemented in individuals requiring mechanical ventilation to …

Many diseases commonly associated with aging are now thought to have social and physiologic antecedents in early life. Understanding how the timing of exposure to early life risk factors influences later-life health may illuminate mechanisms driving adult health inequalities and identify possible points for effective interventions. Recognizing chronic diseases as developing across the lifecourse also has implications for the conduct of research on adult risk factors for disease. We review alternative conceptual models that describe how the timing of risk factor exposure relates to the development of disease. This thesis predicts how United States Supreme Court Associate Justice John Paul Stevens would have ruled on the constitutionality of same-sex marriage if the issue were to have come before him while he was on the Court. The hypothesis is that he would have found a constitutional right to same-sex marriage. The hypothesis is substantiated based on an analysis of Stevens‟ record in ten specific cases. The thesis puts forth the argument that these ten cases most accurately predict how Stevens would have voted on the constitutional issue. Stevens‟ opinions and dissents in these cases are examined. With the loss and degradation of wetlands in some areas of the Prairie Pothole Region (PPR) reaching 80-90%, it is critical that resource managers ensure that the habitat that is put back on the landscape is as high quality as possible. Resource managers have been excavating sediment and topsoil, to promote the “hemi-marsh” condition, during the wetland restoration process in the PPR for over 20 years. I refer to the commonly held perception that the hemi-marsh condition supports the most diverse avian communities in small prairie pothole wetlands as the hemi-marsh condition hypothesis. This study is designed to look at the relationship between test anxiety and mindfulness. This study consists of three surveys designed to look at different aspects of mindfulness and test anxiety. The Test Anxiety Inventory (TAI) is designed to determine to what degree a student has test anxiety. The Five Facet Mindfulness Questionnaire (FFMQ) is designed to measure an individual’s level of mindfulness in five different facets. The White Bear Suppression Inventory (WBSI) is designed to measure how much individuals suppress their thoughts. The present study examined the relation between sensation seeking and life satisfaction. Participants completed four online surveys. One survey included a number of questions designed to measure personal sensation seeking level (Sensation Seeking Scale Form V). Another asked questions regarding life satisfaction (Satisfaction With Life Scale). A third survey included questions regarding one’s feelings about one’s self (Rosenberg Self-Esteem Scale). The final survey asked questions regarding perceived stress level (Perceived Stress Scale). Results indicated that higher levels of Disinhibition and Boredom Susceptibility were associated with lower levels of life satisfaction. The purpose of this Article is two-fold. First, the Article argues that the parent’s right to educate his or her children is strictly circumscribed by the parent’s duty to ensure that children learn habits of critical reasoning and reflection. The law has long recognized that the state’s duty to educate children is superior to any parental right. Indeed, the “parentalist” position to the contrary rests on an inflation of rights that is, in fact, a radical departure from longstanding legal norms. This article will investigate current state laws regarding the change of a husband’s name to his wife’s upon marriage. Given that tradition, and often law itself, discourage that practice, the lingering gendered norms that perpetuate the historical tradition will be explored. Components of this article will include a brief historical analysis of the origin of surnames and the law as it has developed on that issue, including an examination of the place of tradition in the law both empirically and normatively. Octomom And Multi-Fetal Pregnancies: Why Federal Legislation Should Require Insurers To Cover In Vitro Fertilization, Camille M. Davidson

This article examines the public health, legal, and policy implications of multi-fetal pregnancies resulting from in vitro fertilization (IVF), using the 2009 “Octomom” case as a catalyst for discussion. Camille M. Davidson argues that the high rate of multi-fetal pregnancies in the United States is a direct consequence of the unregulated fertility industry, the financial burden of IVF on patients, and the incentive structures created by the Fertility Clinic Success Rate and Certification Act. She contends that lack of mandated insurance coverage compels patients and physicians to transfer multiple embryos per cycle to maximize pregnancy chances, increasing the risks of …

In June 2010, the Association of American Medical Colleges issued the third and final portion of its conflict-of-interest policy initiatives. The task force on “Conflicts of Interest in Clinical Care” did not mince words when it described the impetus for these initiatives: “It is imperative that the possibility or perception of [financial conflict of interest] be advertently examined and appropriately evaluated to ensure that academic medicine in all of its missions is fundamentally dedicated to the welfare of patients and the improvement of public health.”

Clinicians practicing today need to be aware of the ways in which the current industry-dominated climate may undermine the integrity of the scientific process and, thus, may compromise patient care. In the mental health field, corporate sponsorship bias can affect psychiatric taxonomy and clinical Practice Guidelines (CPG). Financial conflicts of interest (FCOI) can occur when there are financial associations between researchers, authors, or panel members developing psychiatric diagnostic and treatment guidelines, and the pharmaceutical industry, or when randomized clinical trials (RCTs) are industry funded. Therefore, clinicians need to be especially vigilant about the informed consent process when patients are prescribed …

Since its launch in 2008, Commonwealth Compact has grown steadily, employing several strategies to promote diversity statewide. The Benchmarks initiative has collected data, analyzed in this report, on a significant portion of the state workforce. Guided by Stephen Crosby, dean of the McCormack Graduate School of Policy and Global Studies at UMass Boston, Commonwealth Compact has conducted newsmaking surveys of public opinion and of boards of directors statewide. In addition, it has convened ongoing coalitions with its higher education partners, and established a collaborative of local business schools aimed specifically at increasing faculty diversity. This Article undertakes the first ever analysis of the consequences of the justice and legal system's extensive use of lethality assessment tools for women subjected to abuse. An increasing number of states are now requiring their police, prosecutors, civil attorneys, advocates, service providers, and court personnel to assess women in order to obtain a score that indicates the woman's lethality risk because of domestic violence. The mandated danger assessment screen of all women subjected to violence focuses only on the risk of homicide and thereby limits the definition of what is domestic violence. The Limits Of Constitutional Convergence, Eric A. Posner, Rosalind Dixon

Globalization, some legal scholars suggest, is a force that makes increasing convergence among different countries' constitutions more or less inevitable. This Essay explores this hypothesis by analyzing both the logic – and potential limits – to four different mechanisms of constitutional convergence: first, changes in global “superstructure”; second, comparative learning; third, international coercion; and fourth, global competition. For each mechanism, it shows, quite special conditions will in fact be required before global convergence is likely even at the level of legal policy. At a constitutional level, it further suggests, it will be even rarer for these mechanisms to create wholesale …
