Relationship Between Membership In Deca, An Association Of Marketing Students, And Grade Point Average As An Indicator Of Academic Success, Michael Frederick Kosloski Jr. Jan 2010

Relationship Between Membership In Deca, An Association Of Marketing Students, And Grade Point Average As An Indicator Of Academic Success, Michael Frederick Kosloski Jr.

STEMPS Theses & Dissertations

Stakeholders in career and technical education, and more specifically marketing education, tout member benefits of applied learning through career and technical student organizations. However, there is little empirical evidence to support the notion that such student organizations help students to achieve academic gains. As a result, the purpose of this study was to collect and analyze empirical data to determine whether there is a relationship between DECA, An Association of Marketing Students, and academic gains as indicated by grade point average.

The study examined three relationships. The first was the relationship between DECA membership and grade point average movement, the …

An Examination Of The Reading First Program At A Southeastern Virginia Elementary School And The Impact On K–2 Student Reading Achievement, Leslie Ford Lippard

Teaching & Learning Theses & Dissertations

Reading First was a federal initiative aimed at improving reading instruction and implementing programs and strategies grounded in scientifically-based reading research. The legislation was predicated on research findings that high-quality reading instruction and intervention in the primary grades significantly reduces the numbers of students who experience difficulties in later grades. This study examined the Reading First program at an elementary school in southeastern Virginia from 2006-2008. Specifically, the researcher investigated the impact of the independent variable, the tier three model of intervention on K-2 student reading achievement. Quantitative data was garnered from 792 K-2 student participants attending the research site. …

Ordinary Administrative Law As Constitutional Common Law, Gillian E. Metzger Jan 2010

Ordinary Administrative Law As Constitutional Common Law, Gillian E. Metzger

Faculty Scholarship

Henry Monaghan famously argued that much of constitutional interpretation takes the form of what he termed constitutional common law, a body of doctrines and rules that are constitutionally inspired but not constitutionally required and that can be altered or reversed by Congress. This Essay argues that a fair amount of ordinary administrative law qualifies as constitutional common law: Constitutional concerns permeate core administrative law doctrines and requirements, yet Congress enjoys broad power to alter ordinary administrative law notwithstanding its constitutional aspect. Unfortunately, the constitutional common law character of much of ordinary administrative law is rarely acknowledged by courts. A striking …

Activating Systemic Change Toward Full Participation: The Pivotal Role Of Boundary Spanning Institutional Intermediaries, Susan Sturm Jan 2010

Activating Systemic Change Toward Full Participation: The Pivotal Role Of Boundary Spanning Institutional Intermediaries, Susan Sturm

Faculty Scholarship

Racial and social justice advocacy is in an era of transition. Race continues to permeate people's lives and to structure the social and economic hierarchy, but often in complicated ways that elude bright line categories. Disparities frequently result from cognitive bias, unequal access to opportunity networks, and other structural dynamics, rather than from intentional exclusion. For example, disparities in access to higher education persist as a result of differences in access, information, resources, networks, and evaluation, which give rise to achievement differentials at each critical turning point affecting successful advancement. These differences accumulate to produce substantial disparities in college participation …

Choice Of Law And Employee Restrictive Covenants: An American Perspective, Gillian Lester, Elizabeth Ryan Jan 2010

Choice Of Law And Employee Restrictive Covenants: An American Perspective, Gillian Lester, Elizabeth Ryan

Faculty Scholarship

Employees are increasingly mobile across state lines. This is partly the result of technological change facilitating individual movement and communication, but also a result of corresponding changes in corporate organization to establish offices and interests in multiple jurisdictions. With these developments, there has been a rise in litigation surrounding the enforcement of employee covenants not to compete when the parties or issues involved have connections to multiple jurisdictions. The emerging body of law intrigues and confounds lawyers and commentators because of its complexity and unpredictability. This essay is an effort to describe recent legal developments in the United States, situating …

Narrowing The Bankruptcy Safe Harbor For Derivatives To Combat Systemic Risk, Bryan G. Faubus Jan 2010

Narrowing The Bankruptcy Safe Harbor For Derivatives To Combat Systemic Risk, Bryan G. Faubus

Duke Law Journal

Bankruptcy law establishes proceedings designed to rehabilitate debtors while protecting creditors, but a series of safe harbors effectively exempts from bankruptcy proceedings certain financial contracts known as derivatives. Accordingly, when a party to a derivative contract goes bankrupt, the counterparty may terminate the contract and seize what it is owed from the debtor's assets. Congress enacted these safe harbors to combat the risk of systemic failure by maintaining liquidity in troubled markets; in doing so, however, they allowed counterparties to engage in opportunistic behavior and inefficiently consume a debtor's limited assets. Because these two consequences may harm the debtor and …

New Governance Anxieties: A Deweyan Response, William H. Simon Jan 2010

New Governance Anxieties: A Deweyan Response, William H. Simon

Faculty Scholarship

Most participants in the Symposium on New Governance and the Transformation of Law found the "new governance" phenomenon attractive and important, but as David and Louise Trubek note, they were not entirely comfortable with it.

One anxiety concerned the difficulty of defining the phenomenon and situating it in the universe of familiar political ideas and institutions. The term gets applied to a variety of institutions. To some people, these institutions do not fit snugly into any familiar political categories. To others, they bear a suspicious resemblance to categories that no longer inspire optimism – for example, Romantic communitarianism, corporatism, or …

The So-Called Right To Privacy, Jamal Greene Jan 2010

The So-Called Right To Privacy, Jamal Greene

Faculty Scholarship

The constitutional right to privacy has been a conservative bugaboo ever since Justice Douglas introduced it into the United States Reports in Griswold v. Connecticut. Reference to the "so-called" right to privacy has become code for the view that the right is doctrinally recognized but not in fact constitutionally enshrined. This Article argues that the constitutional right to privacy is no more. The two rights most associated historically with the right to privacy are abortion and intimate sexual conduct, yet Gonzales v. Carhart and Lawrence v. Texas made clear that neither of these rights is presently justified by its …

Implications Of The Internet For Quasi-Legislative Instruments Of Regulation, Peter L. Strauss Jan 2010

Implications Of The Internet For Quasi-Legislative Instruments Of Regulation, Peter L. Strauss

Faculty Scholarship

It is a quarter century since I began telling my Administrative Law students that they had better be watching the Internet and how agencies of interest to them were using it, as they entered an Information Age career. The changes since then have been remarkable. Rulemaking, where the pace has perhaps been slowest, is now accelerating into the Internet, driven by a President committed to openness and consultation. This paper seeks little more than to point the reader toward the places where she can find the changes and watch them for herself.

Mahalanobis Taguchi System (Mts) As A Prognostics Tool For Rolling Element Bearing Failures, Ahmet Soylemezoglu, Sarangapani Jagannathan, Can Saygin

Electrical and Computer Engineering Faculty Research & Creative Works

In this paper, a novel Mahalanobis-Taguchi system (MTS)-Based fault detection, isolation, and prognostics scheme is presented. the proposed data-driven scheme utilizes the Mahalanobis distance (MD)-Based fault clustering and the progression of MD values over time. MD thresholds derived from the clustering analysis are used for fault detection and isolation. When a fault is detected, the prognostics scheme, which monitors the progression of the MD values, is initiated. Then, using a linear approximation, time to failure is estimated. the performance of the scheme has been validated via experiments performed on rolling element bearings inside the spindle headstock of a microcomputer numerical …

Casing Pipe Damage Detection With Optical Fiber Sensors: A Case Study In Oil Well Constructions, Zhi Zhou, Jianping He, Minghua Huang, Jun He, Genda Chen

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

Casing pipes in oil well constructions may suddenly buckle inward as their inside and outside hydrostatic pressure difference increases. For the safety of construction workers and the steady development of oil industries, it is critically important to measure the stress state of a casing pipe. This study develops a rugged, real-time monitoring, and warning system that combines the distributed Brillouin Scattering Time Domain Reflectometry (BOTDR) and the discrete fiber Bragg grating (FBG) measurement. The BOTDR optical fiber sensors were embedded with no optical fiber splice joints in a fiber-reinforced polymer (FRP) rebar and the FBG sensors were wrapped in epoxy …

Teleophthalmology (TeleOph) is an electronic counterpart of today's face-to-face, patient-to-specialist ophthalmology system. It enables one or more ophthalmologists to remotely examine a patient's condition via a confidential and authentic communication channel. Specifically, TeleOph allows a trained nonspecialist in a primary clinic to screen the patients with digital instruments (e.g., camera, ophthalmoscope). The acquired medical data are delivered to the hospital where an ophthalmologist will review the data collected and, if required, provide further consultation for the patient through a real-time secure channel established over a public Internet network. If necessary, the ophthalmologist is able to further sample the images/video of …

Trust Differences Across National-Societal Cultures: Much To Do, Or Much Ado About Nothing?, Don Ferrin, Nicole Gillespie Jan 2010

Trust Differences Across National-Societal Cultures: Much To Do, Or Much Ado About Nothing?, Don Ferrin, Nicole Gillespie

Research Collection Lee Kong Chian School Of Business

Does trust and its development, functions and meaning, differ between people from different national–societal cultures? There is considerable anecdotal evidence and some theoretical argumentation to suggest it does, but are these supported by empirical research? This chapter reviews the available empirical evidence on the effects of national–societal culture on interpersonal trust. It focuses largely on quantitative empirical evidence to consider the extent to which, and the ways in which, interpersonal trust differs across national–societal cultures. In every category of our review we found evidence of cross-cultural differences, particularly on generalized trust, and also evidence of trust universals across cultures. In …

Sensor Data-Based Decision Making, Ahmet Soylemezoglu Jan 2010

Sensor Data-Based Decision Making, Ahmet Soylemezoglu

Doctoral Dissertations

"Increasing globalization and growing industrial system complexity has amplified the interest in the use of information provided by sensors as a means of improving overall manufacturing system performance and maintainability. However, utilization of sensors can only be effective if the real-time data can be integrated into the necessary business processes, such as production planning, scheduling and execution systems. This integration requires the development of intelligent decision making models that can effectively process the sensor data into information and suggest appropriate actions. To be able to improve the performance of a system, the health of the system also needs to be …

Characterization Of The Corrosion Protection Mechanism Of Cerium-Based Conversion Coatings On High Strength Aluminum Alloys, William R. Pinc Jan 2010

Characterization Of The Corrosion Protection Mechanism Of Cerium-Based Conversion Coatings On High Strength Aluminum Alloys, William R. Pinc

Doctoral Dissertations

"The aim of the work presented in this dissertation is to investigate the corrosion protection mechanism of cerium-based conversion coatings ( CeCCs) used in the corrosion protection of high strength aluminum alloys. The corrosion resistance of CeCCs involves two general mechanisms; barrier and active. The barrier protection mechanism was influenced by processing parameters, specifically surface preparation, post-treatment, and the use of gelatin. Post-treatment and the addition of gelatin to the coating solution resulted in fewer cracks and transformation of the coating to CeP0₄, which increased the corrosion resistance by improving the barrier aspect of CeCCs. CeCCs were found to best …

Solid Oxide Fuel Cell Electrode Characterization And Improvement For Fuel Flexibility And Supplemental Power Production, Isaiah D. Kellogg Jan 2010

Solid Oxide Fuel Cell Electrode Characterization And Improvement For Fuel Flexibility And Supplemental Power Production, Isaiah D. Kellogg

Doctoral Dissertations

"Solid oxide fuel cells (SOFC) were fabricated and the electrodes tested for their individual catalytic effectiveness in various fuels by exposing each electrode to mixed gas while the opposite electrode was exposed to its respective pure gas. Mixed hydrogen and oxygen gas was successfully utilized as fuel in a single chamber SOFC (SC-SOFC). The conditions at which the porous nickel-yttria-stabilized zirconia (Ni-YSZ) cermet anode performed well did not significantly overlap the conditions at which the La₀.₈Sr₀.₂Fe₀.₈Co₀.₂ oxide (LSCF) cathode performed well, but there was significant catalytic activity at both electrodes which increased the open circuit voltage (OCV) beyond that predicted …
