Networking The Parties: A Comparative Study Of Democratic And Republican Convention Delegates In 2008, Seth E. Masket, Michael T. Heaney, Joanne M. Miller, Dara Z. Strolovich Oct 2009

Networking The Parties: A Comparative Study Of Democratic And Republican Convention Delegates In 2008, Seth E. Masket, Michael T. Heaney, Joanne M. Miller, Dara Z. Strolovich

Working Papers

Parties‐as‐networks is an emerging approach to understanding American political parties as decentralized, nonhierarchical, fluid systems with porous boundaries of a wide array of actors. Parties‐asnetworks include interest groups, social movements, political consultants, and advocacy organizations, in additional to the usual suspects of elected officials, party officials, and citizen‐activists. This approach ameliorates several deficits of the traditional, tripartite view of parties in government, in elections, and as organizations. The authors apply the parties‐as‐networks approach using data from surveys of delegates at the 2008 Democratic and Republican national conventions. Analysis of delegates’ memberships in a wide variety of organizations demonstrates that Democrats …

The Response To Nuclear Proliferation, Annelies Z. Kamran Oct 2009

The Response To Nuclear Proliferation, Annelies Z. Kamran

Working Papers

This paper uses the methods of social network analysis to discover the structural patterns of cooperation that arose in response to a global traditional security problem. It does this by mapping compulsory and institutional power relations (Barnett and Duvall 2005) among actors responding to the proliferation of nuclear weapons since the end of the Cold War. For the institutional power measure, I use treaty and international agreement membership; and for the compulsory power measure, I use contractual obligations for nuclear expertise, materials, and technology. By mapping the relationships at the system level of world politics, including individual states as well …

A Case For Teaching Business Ethics In A Cost-Benefits Framework: Are Business Students More Discriminating In Their Decision Making?, Steven R. Cox, Kathy Parkison, Dianne M. Roden Oct 2009

A Case For Teaching Business Ethics In A Cost-Benefits Framework: Are Business Students More Discriminating In Their Decision Making?, Steven R. Cox, Kathy Parkison, Dianne M. Roden

Mountain Plains Journal of Business and Technology

"Based on a survey questionnaire of 299 university students, we find that business majors act more ethically than other majors in some cases and less ethically in others. Business students appear more likely to adopt the consequentialist framework to evaluate ethical dilemmas. Our results are consistent with business students being more discriminating based on the perceived costs and benefits of each case. We find differences in behavior based on active versus passive unethical behavior and based on the identity of the potentially harmed party. This evidence suggests that business school curricula that focus on acting ethically because it is the …

Must God Be Dead Or Irrelevant: Drawing A Circle That Lets Me In, Richard M. Esenberg Oct 2009

Must God Be Dead Or Irrelevant: Drawing A Circle That Lets Me In, Richard M. Esenberg

William & Mary Bill of Rights Journal

Some scholars claim that current Establishment Clause doctrine can increasingly be explained in terms of substantive neutrality-that is, the idea that government ought to treat religion and irreligion (or comparable secular activities) in the same way. Whether a product of the Court's commitment to the idea or an artifact of the positions of the "swing" Justices, this proposition has considerable explanatory power. The Supreme Court has, in recent years, permitted the government to make financial support equally available for religious uses, as long as it is done on a neutral basis and through the private choice of the recipients. It …

Roles And Capabilities Of The Retail Supply Chain Organization, C. Clifford Defee, Wesley S. Randall, Brian J. Gibson Oct 2009

Roles And Capabilities Of The Retail Supply Chain Organization, C. Clifford Defee, Wesley S. Randall, Brian J. Gibson

Journal of Transportation Management

Supply chain management (SCM) has become a critical strategic function in recent years. Research in the discipline has been focused toward the upstream side of the supply chain on functions such as warehousing, transportation, procurement and production. As power has shifted downstream toward retailers and their customers, SCM research has been slow to respond. This represents a significant gap, and a significant opportunity. Retailers face challenges that differ from those found in upstream suppliers and manufacturers. We present findings from a study of senior supply chain executives in the retail industry that focuses on the supply chain challenges of greatest …

Gendered Social Movements: A Critical Comparison Of The Suffrage And Gay Marriage Movements, Michelle L. Kelsey Oct 2009

Gendered Social Movements: A Critical Comparison Of The Suffrage And Gay Marriage Movements, Michelle L. Kelsey

Kaleidoscope: A Graduate Journal of Qualitative Communication Research

The elections of 2008 saw the passage of several overwhelming and explicit condemnations of gay rights across the nation. Most damaging to the gay marriage movement was the successful passage of proposition 8 in California, the first time that the right to gay marriage was repealed. I argue that the continued modeling of the civil rights framework defers an analysis of the argumentative strategies of historically gendered movements such as the suffrage movement and is a disservice to the strategic potential of the marriage equality movement. The critical comparison made here between suffrage and marriage equality opens the potential for …

Taking Empirical Research Seriously, Susan Saab Fortney Oct 2009

Taking Empirical Research Seriously, Susan Saab Fortney

Faculty Scholarship

This essay considers how empirical research on the legal profession can bridge the divide between theory, social science, and the ethical practice of law. After providing background information on the growing field of empirical legal research, Part I of this essay focuses on developments in empirical legal research on lawyering. Part II discusses how collaboration with practitioners and other stakeholders can help researchers address challenges related to accessing data. Once data are obtained, Part III suggests how dissemination and sharing of research can link the academy and practicing lawyers. The conclusion urges a collaborative course of action for legal ethics …

Awareness And The Perceived Effects Of The New Livestock And Meat Industries Act Of 2006: A Case Study Of Kgatleng And Kweneng Districts, Botswana, Patrick Malope, Elizabeth Ransom

Sociology and Anthropology Faculty Publications

The objective of this study was to determine whether butchery owners in rural Botswana are aware of the New Livestock and Meat Industries Act of 2006 and their perceptions as to how it will affect their businesses. The study further sought to determine whether the present slaughter facilities were compliant with the New Act. A structured questionnaire was administered to butcheries in selected villages of Kgatleng (n=9) and Kweneng (n=4) districts to get butchery owners’ views about the New Act and how it will affect their businesses. Data was analysed using frequencies.

The study found that the majority (77%) of …

Resisting Anti-Intellectualism And Promoting Legal Literacy, Leonard J. Long Oct 2009

Resisting Anti-Intellectualism And Promoting Legal Literacy, Leonard J. Long

Southern Illinois University Law Journal

Professor Long urges everyone involved in legal education, including professors, lawyers, students, and judges, to ask just one question: Of what use is a law school education? Those involved with law school educations should strive to be intellectually curious and well-rounded in education, and not to maintain the narrow view of simply “training lawyers.” For the benefit of society, consumers of legal services, lawyers, and law firms, we must encourage the pursuit of legal literacy. Law students should be encouraged to explore American literature and traditions of Anglo-American law to facilitate their legal literacy and to become cultural elitists. Students …

Strategery's Refuge, Christopher W. Seeds Oct 2009

Strategery's Refuge, Christopher W. Seeds

Cornell Law Faculty Publications

By popular account, the Supreme Court’s recent decisions on effective assistance of counsel in capital sentencing—aggressive critiques of counsel’s failure to investigate and present mitigating evidence—initiate an era of improved oversight of the quality of legal representation in death penalty cases. One would expect the new and improved jurisprudence to curb post hoc efforts by trial counsel to disguise incomplete trial preparation as a tactical decision, a practice that has long undercut the Strickland doctrine. But the shelters for post hoc rationalizations—the refuges for “strategery”—remain. Surveying decisions of the federal courts of appeals since the turn of the century, this …

Making Homework Count: Homework As A Collective Task For Language Minority Families, Kathy R. Fox Oct 2009

Making Homework Count: Homework As A Collective Task For Language Minority Families, Kathy R. Fox

Journal of Praxis in Multicultural Education

In response to a writing prompt asking, “What can parents do to ensure academic success for their child?” a mother with three children under the age of six wrote: “In my opinion he needs motivation from his parents and interest in his homework. [He needs] to read a lot so he will have good confidence with his friends and about everything, about his teacher.” This response was typical of those given by participants in a family literacy program (FLP) sponsored by a small urban school district. This program was originally designed to help minority language and culture parents learn functional …

Ministerial Misfeasance: R. V. Morris And A Unique Early Privacy Breach, Barry Cahill Oct 2009

Ministerial Misfeasance: R. V. Morris And A Unique Early Privacy Breach, Barry Cahill

Dalhousie Law Journal

According to Klein &Kratchanov (Government Information: The Right to Information and Protection of Privacy in Canada, 2nd ed., 2009), "there is one reported case of a successful private prosecution for violation of an access statute through the unauthorized release of personal information. The matter arose under a former Nova Scotia Act and resulted in a modest fine being imposed against a Minister of the Crown who had disclosed information about the complainant." What follows is a close, contextual study of a case unique in the short history of privacy law in Canada, from the perspective of the thirty-year development of …
