Background: The purpose of the present study was to examine the acute effects of a thermogenic nutritional supplement containing caffeine, capsaicin, bioperine, and niacin on muscular strength and endurance performance.
Methods: Twenty recreationally-active men (mean ± SD age = 21.5 ± 1.4 years; stature = 178.2 ± 6.3 cm; mass = 76.5 ± 9.9 kg; VO2 PEAK = 3.05 ± 0.59 L/min-1) volunteered to participate in this randomized, double-blinded, placebo-controlled, cross-over study. All testing took place over a three-week period, with each of the 3 laboratory visits separated by 7 days (± 2 hours). During the initial …

Morphological Deformities As Biomarkers In Fish From Contaminated Rivers In Taiwan, Peter Lin Sun, William E. Hawkins, Robin M. Overstreet, Nancy J. Brown-Peterson

Tilapia (Oreochromis spp.) were collected seasonally from four contaminated rivers in southwestern Taiwan for studies of morphological deformities that could be used as biomarkers of contamination. Morphological deformities found in tilapia were separated into 15 categories. Overall, the prevalence of deformities such as split fins, lower lip extension and gill deformities were significantly related to various water quality parameters, including low DO and high ammonium, lead and zinc concentrations. The persistence of tilapia in polluted waters and the development of a suite of morphological deformities suggest that tilapia can be used as sentinels of non-point source pollution in rivers.

Steps to facilitate inter-jurisdictional collaboration nationally and continentally have been critical for implementing and conducting coordinated wildlife rabies management programs that rely heavily on oral rabies vaccination (ORV). Formation of a national rabies management team has been pivotal for coordinated ORV programs in the United States of America. The signing of the North American Rabies Management Plan extended a collaborative framework for coordination of surveillance, control, and research in border areas among Canada, Mexico, and the US. Advances in enhanced surveillance have facilitated sampling of greater scope and intensity near ORV zones for improved rabies management decision-making in real time. …

The Prairie Pothole Region (PPR) is unique to North America. Its millions of wetlands and abundant ecosystem goods and services are highly sensitive to wide variations of temperature and precipitation in time and space characteristic of a strongly continental climate. Precipitation and temperature gradients across the PPR are orthogonal to each other. Precipitation nearly triples from west to east from approximately 300 mm/year to 900 mm/year, while mean annual temperature ranges from approximately 1°C in the north to nearly 10°C in the south. Twentieth-century weather records for 18 PPR weather stations representing 6 ecoregions revealed several trends. The climate generally …

Co-integration is an econometric property of time series variables. If two or more series are themselves non-stationary (unit root process), but a linear combination of them is stationary, then the series are said to be co-integrated. If there is a co-integration among some time series, we can say there is a long-run equilibrium. That is the non-stationary time series may diverge from each other in short-run, however they would arrive at equilibrium in long-run. Background: Artemether-lumefantrine (AL) is a major and highly effective artemisinin-based combination therapy that is becoming increasingly important as a new first-line therapy against Plasmodium falciparum malaria. However, recrudescences occurring after AL treatment have been reported. Identification of drug-specific parasite determinants that contribute to treatment failures will provide important tools for the detection and surveillance of AL resistance.
Methods: The findings from a 42-day follow-up efficacy trial in Tanzania that compared AL with sulfadoxinepyrimethamine (SP) were analyzed to identify candidate markers for lumefantrine tolerance/resistance in the chloroquine resistance transporter gene (pfcrt) and multidrug resistance gene 1 (pfmdr1). Data breach incidents are a growing concern in both the private and public sector. As an increasing amount of sensitive information is made available through information systems, the number of occurrences and the potential damage as a result of these breaches will continue to expand. There is a clear need for a framework to mitigate the dangers of leaking data while simultaneously allowing authorized individuals to gain access to necessary information. Do patents behave substantially like property rights in tangible assets, in that they encourage development and innovation? This article notes that historical evidence, cross-country evidence, economic experiments, and estimates of net benefits all indicate that general property rights institutions have a substantial direct effect on economic growth. Conversely, with a few important exceptions like chemicals and pharmaceuticals, empirical evidence indicates that intellectual property rights have at best only a weak and indirect effect on economic growth. Further, it appears that for public firms in most industries today, patents may actually discourage investment in innovation for fear of winding up on …

The Constitution places control of the federal government's funds in the hands of Congress. This article examines Congress' exercise of discretion in connection with expenditures, impoundments, debt and taxation. It concludes that its actual control over the government's funds has become limited over time and makes recommendations for more robust exercise of its traditional authority.

This article analyzes and applies to Labor Board decision making the Court’s oft-cited 1984 decision in Chevron U.S.A. v. Natural Resources Defense Council. The article argues that judicial review of Board decision making under Chevron, though limited, can still be sufficiently meaningful to control excessive shifts in Board lawmaking criticized by many commentators. The article explains why recent Supreme Court decisions reject any distinction between two theoretically distinct forms of agency discretionary lawmaking – (1) lawmaking through construction of the direct force of an ambiguous statute: and (2) lawmaking through the elaboration of law beyond that which is embodied in …

Justice Souter's imminent retirement from the U.S. Supreme Court provides President Obama with his first opportunity for a judicial nomination to the high court. President Obama's remarks about the relevance of life experience and of empathy are sparking discussion of relevant judicial qualifications. This Essay examines Professor Lani Guinier's recent argument that dissenting justices, particularly through the use of oral dissents, may spur ordinary people to action and that such dissents may expand the range of democratic action, as part of what she and Gerald Torres call "demosprudence." Because tort law generally and healthcare regulation specifically are traditional state functions and because medical, legal, and insurance practices are highly localized, legal scholars have long believed that medical malpractice falls within the states' exclusive jurisdiction and sovereignty. Indeed, this view is so widely held that modern legal scholarship takes it for granted. Articles on general federalism issues use medical malpractice as an easy example of a policy in which federal intervention lacks functional justification, and articles that focus on federalization of other tort reforms use medical malpractice as an easy foil, pointing out that the uniformity interest that justifies …

Disparities in Black health began in slavery, were reinforced in segregation and racism, and persist today despite significant remedial efforts. In the last decade, the statistics about Black health disparities show no improvement. The caustic history of slavery, racism and segregation hasn't been completely undone. Fundamental changes are still necessary to repair deficits in Black health.
But the election of Barack Obama has changed the relevance of reparations as a political tool for making these changes. We elected a Black man as President, and he refused to apply reparations talk to social programs of uplift for disadvantaged communities. Obama struck …

This article examines 3 questions: What is an academic field of law? Is health law such a field? If it is, how can or should it be described? The first question may have no answer; scholars and practicing lawyers have fashioned their owns spheres of expertise. Describing health law faces particular challenges, including the breadth of applicable doctrines and the decline of unique medically-oriented adaptations of general principles. The flurry of regulatory activity by the outgoing administration of President George W. Bush has raised, once again, the specter of midnight regulation. Whatever the reason for midnight regulation, there seems to be a general consensus that something has gone wrong when an outgoing administration takes important action while the incoming administration is essentially waiting to take over. BACKGROUND: There is no clear evidence that early decompression following spinal cord injury (SCI) improves neurologic outcome. Such information must be obtained from randomized controlled trials (RCTs). To date no large scale RCT has been performed evaluating the timing of surgical decompression in the setting of thoracolumbar spinal cord injury. A concern for many is the ethical dilemma that a delay in surgery may adversely effect neurologic recovery although this has never been conclusively proven. Many adolescents use the Internet, cell phones, television, and computer and video games on a daily basis. Therefore, an important question for educators is: how is technology affecting adolescents' quality and quantity of sleep, their attention difficulties, and their academic performance? The purpose of the current project was to examine the relationships between adolescent self-reports of technology usage, sleep patterns, attention difficulties and academic achievement. Results indicated that nocturnal technology use has a negative impact on adolescents' quality and quantity of sleep. In times of uncertainty and change where the job market is fluid and the U.S. economy is weak, students need to feel empowered to construct their lives and forge their career paths. Constructivism has been suggested as one way to empower people. The current study explored outcomes in constructivist career courses using a quasi-experimental pre/post-test design. The empowerment, indecision, and certainty of 115 culturally diverse college students were measured using the Career Decision Self-Efficacy Scale-Short Form (CDSE-SF) and the Career Decision Scale (CDS). Background: The chemopreventive effects of resveratrol (RSV) on prostate cancer have been well established; the androgen receptor (AR) plays pivotal roles in prostatic tumorigenesis. However, the exact underlying molecular mechanisms about the effects of RSV on AR have not been fully elucidated. A model system is needed to determine whether and how RSV represses AR transcriptional activity. Methodology: The AR cDNA was first cloned into the retroviral vector pOZ-N and then integrated into the genome of ARnegative HeLa cells to generate the AR(+) cells. Pulmonary arterial hypertension (PAH) is a devastating disease characterized by progressive elevation of pulmonary arterial pressure and vascular resistance due to pulmonary vasoconstriction and vessel remodeling as well as inflammation. Open marsh water management (OMWM) is a commonly used approach to manage salt marsh mosquitoes than can obviate the need for pesticide application and at the same time, partially restore natural functions of grid-ditched marshes. OMWM includes a variety of hydrologic manipulations, often tailored to the specific conditions on individual marshes, so the overall effectiveness of this approach is difficult to assess. Here, we report the results of controlled field trials to assess the effects of two approaches to OMWM on larval mosquito production at National Wildlife Refuges (NWR). It is important to view eutrophication as an increase in the supply of organic matter to an ecosystem rather than as a simple problem of nutrient pollution. This emphasizes that eutrophication is a fundamental change in the energetic base that may propagate through the system in various ways and produce a variety of changes. Some of these changes may be desirable (e.g., increased secondary production) and some may not (e.g., hypoxia). Defining eutrophication in terms of changing nutrient concentrations or chlorophyll levels or species composition confuses symptoms with the underlying phenomenon. The Readiness for Hospital Discharge Scale, Quality of Discharge Teaching Scale, and Post-Discharge Coping Difficulty Scale were developed by Dr. Marianne Weiss to measure nurse-sensitive discharge care processes and patient outcomes. Three versions of the scales were developed concurrently for different patient populations – Adult medical-surgical patients, Parents of hospitalized children, and Postpartum Patient mothers (see Weiss & Piacentine, 2006, Weiss et al., 2007, and Bobay et al., 2018 for description of the development and initial testing). Additional scales and information about translation rights are located at Marquette Nursing.
